Phantom Frelght Sult Denled
A disfict court bas dismiss€d the class action "phanlom fieigbt" lawsuit accusing 15 Canadiur manufacturers of overcbarging U.S. lumber buyers for shipping charges.
On Jan. 6, the Judge granted tbe Canadian defendants' motion to dismiss tbe case for lack of jurisdiction. The plaintiffs have filed notice that tbey will appeal, which could be a year-long prooess.
Filed in l99l by former wholesaler Rivendell Forest Products, Englewood, Co., the suit alleges the Canadian firms used undenveights, fr€ight prepay discounts, open-end incentives, confidential shipping rat€ contracts and delivered-only pricing to cbarge extra freight. Damages sought are estimated at as high as $2 billion.
Lumber Composite Available
Lumber distribuor Plunkett-Webster, Inc., Apex, N.C., is now socking a wood polymer composite as a lumber substitute in non-structural uses.
The distributor recently sold its first order of Timbrex, a composite made with 100% recycled wood and plastic without toxic preservatives, to a retailer.
Said not to split, chip, rot, warp, splinter or check, it's been used for decks, docks, bulkheads, guardrails, fencing, sign posts, picnic tables, benches, playground equipment, industrial flooring and exterior trim.
Their farget customers are building supply dealen and municipalities.
"It's a little bit more expensive than wood," admitted Calvin Biddex, lumber sales manger, PlunkettWebster. "But the average deck would only cost about $200 more."
To many homeowners, it might be worth it. Manufacturer Mobil Chemical says it resists moisture, solvents, insects, UV rays and salt water. It looks like wood, but has superior fastener retention, an ever-smooth. paintable surface, low thermal expansion and contraction and no need for protective sealants. Products come in a wide range of profiles and lengths.
Mobil's Composite Products Division is working on a version for structural use. Their only Timbrex plant in production is in Tamp4 Fl., but they recently received approval to open a second plant in the Mid-Atlantic area
