CSLB Proposed Legislation for 2017 With the 2017 Session of the California State Legislature ready to ‘ramp-up’ in early January, the CSLB staff presented to the board, during their meeting on December 8th, the following legislative proposals. All of them were approved. The next step will be for the board’s legislative staff to find authors to carry these measures: 1. Effective January 1, 2015, CSLB adopted regulations that establish a stand-alone specialty classification (C-22) for asbestos abatement. The relevant sections of existing law do not recognize the ability of C-22 asbestos abatement licensees to perform asbestos-related work. Hence the need for a bill to amend the existing sections of law to address the new C-22 license.

2. Senate Bill 392 (Statutes of 2010, Chapter 698), which authorized the issuance of contractor licenses to limited liability companies (LLC), also allowed the reissuance or reassignment of a contractor license number to a corporation or an LLC when the new entity “acquires a licensee pursuant to an asset sale.”

CSLB staff believe this subsection is ambiguous, problematic, and cannot be implemented, because a business cannot “acquire a licensee” through an asset sale. A licensee is not an asset; it is an entity in its own right. An asset sale is commonly defined as the sale of assets or any property owned by a person or entity and that has monetary value. Therefore, an asset sale involves only the sale of property of the licensee – the business entity survives the sale.

that involve contract amounts or demand for damages amounts that are equal to or less than the contractor’s bond amount (currently $15,000). This is problematic because some of the cases that fall under this provision of law may be better resolved if the Registrar, instead, had the ability to either close the complaint or refer it for further investigation or for disciplinary action. A change is needed to the statute in order to make arbitration available at the Registrar’s discretion, as opposed to requiring it in all lesser cases that fall under the $15,000 or less provision in law.

4. The CSLB currently has the ability to take disciplinary action as a result of death or serious injury to an employee due to Labor Code violations; however, there are regulatory provisions used by the Department of Industrial Relations’ Division of Occupational Safety and Health (DOSH) as well. The CSLB would like to utilize these regulatory section to ensure the board has the ability to take disciplinary action against a contractor who has violated safety provisions that result in the death of or serious injury to an employee.

5. The existing provision in law that suspends a license for failure to resolve an outstanding liability needs to be updated to reflect that licensees may use a taxpayer identification number.

Another area of staff concern is that no other subsection authorizes license number reissuance or reassignment without a connection to the original licensee. Legislation is required to resolve these problems within existing law.

Current law sets forth arbitration as an optional tool for the Registrar to utilize in complaint cases where the dollar amount of the contract or of the demand for damages is greater than the contractor’s bond amount (currently $15,000) but less than $50,000, and when other criteria have been met. Existing law also makes arbitration a mandatory requirement for complaint cases

FED RAISES RATES, PLOTS THREE 2017 HIKES

Federal Reserve policymakers unanimously chose to raise the benchmark interest rate by a quarter point last week. That was expected; less expected was the central bank’s adjustment to its 2017 dot-plot. Fed officials now see three rate hikes next year instead of two. The move to the new target range of 0.50-0.75% sent the dollar and bond yields higher Wednesday – the yield on the 2-year note quickly touched a peak unseen since August 2009. Stocks suffered only moderate losses after the announcement. Federal Open Market Committee members now forecast economic growth of 2.1% in 2017 and 2.0% in 2018.1

Last week’s riddle: I have roads but no cars, forests but no trees, and cities but no people. What am I?

THIS WEEK: Lennar announces Q4 results Monday. CarMax, Darden Restaurants, FedEx, General Mills, Nike, Steelcase, and Valspar all report earnings on Tuesday.

Wednesday, investors assess the latest existing home sales numbers and earnings from Accenture, Bed Bath & Beyond, Finish Line, Micron Technology, Red Hat, and Winnebago. Thursday offers new initial claims data, reports on November consumer spending and durable goods orders, the November core PCE price index, the last estimate of Q3 GDP, and earnings from Cintas. Friday brings November new home sales figures and the final University of Michigan consumer sentiment index of 2016.

So gentle it soothes the skin, so forceful it cracks rocks, so light it serves as a mirror to the clouds. What could it be?

Last week’s answer: A map.

Economists, polled by Briefing.com, had expected a 0.4% October advance for retail purchases; the gain was only 0.1% instead, and 0.2% minus car and truck sales. The Producer Price Index rose 0.4% last month after a flat October; the core PPI also posted a 0.4% increase. Inflation pressure remained steady for the consumer: both the headline and core Consumer Price Index advanced 0.2% in November.2

HOUSING STARTS FALL FROM 9-YEAR PEAK

Groundbreaking declined 18.7% last month as winter arrived, with single-family starts down 4.1%. The Census Bureau also reported a 4.7% November decline in building permits.3 A relatively calm trading week ended with the Dow Jones Industrial Average at 19,843.41, 0.44% higher than it had closed the previous Friday. Both the S&P 500 and Nasdaq Composite saw small weekly losses; the Nasdaq descended 0.13% to 5,437.16, while the S&P declined 0.06% to 2,258.07. Over on the NYMEX, light sweet crude settled at $51.94 a barrel Friday; gold at $1,135.60 an ounce.4

Emphasis on Confined Space

Confined spaces can be deadly. Overcome by gases, vapors, fumes, engulfed by material, or caught in moving machinery, workers may find they have nowhere to go without proper entry procedures. Adding to this potential tragedy, most fatalities occur to ill-prepared rescuers.

A confined space is large enough for an employee to enter and perform work. It has limited openings to enter and exit. It is not designed for continuous occupancy. A permitrequired confined space has these limitations AND added dangers such as hazardous atmospheres, material engulfment, inwardly converging or sloped walls, or other serious safety and health hazards.

Create a written confined space program listing these spaces. Detail who will enter confined spaces, how they will enter, and what work they will conduct. Get the equipment to test and monitor the atmosphere in each of your confined spaces. Identify how many attendants need to be outside each confined space during an entry.

Develop a rescue procedure including the number of people, the personal protective equipment, and rescue devices needed for each confined space. Rescue must be IMMEDIATELY available onsite during a confined space entry.

DON’T rely on outside emergency responders for rescue; use a rescue plan. Rescue delays can result in multiple deaths.

Confined space examples include water and sewer pipes, silos, utility tunnels, pumping stations, storage bins, crawl spaces under floors, manholes, meter vaults, water reservoirs, boilers, tunnels, holding tanks, vats, tanks, pits, kilns, wastewater wetwells, sumps, vaults, and grit chambers.

Finally, train your employees and supervisors on all of these procedures, hazard control, and rescue operations. Planning and training can prevent confined space tragedy.

conditions for EACH space. Secure and label each space as a confined space or permit-required confined space.
