SCOTT GAIR, INTELLECTUAL PROPERTY LAWYER

Cash for copyright often speak with photographers who have had their images stolen and used on websites without their permission. Furthermore, it’s not uncommon for those who have done the thieving to wonder what all the fuss is about when you complain about it, an attitude that I have to say baffles me! Here’s a quick analogy for you. If you walk off with someone else’s push bike, we all know that is theft, and we would expect to get a criminal record if caught. We all know that theft is morally and legally unacceptable. However, if you copy and steal an image from the Internet, the public perception is very different. The general view is that this type of theft is acceptable, the photographers should be flattered, and it’s a ‘victimless crime’. The perception appears to be that digital photography is somehow free because there are no film costs involved. It amazes me how many people think this. When it comes to copyright law the basic rule is simple: if you take a picture, you own the copyright. This means no one can use your image without your prior permission. If you are a photographer and you put your images online, it almost goes without saying that someone will try and make off with one of your images without your permission. If you act now, you could turn this threat into an opportunity and end up increasing your income. There are a number of steps you can take if you do find your images being used without consent: ĖŤŤ .-3 !3Ť3'#Ť3'(#$İ(-$1(-%(-%Ť/ 138Ť -"Ť immediately demand they stop using your image. It’s worth checking where the website is registered and is being hosted. If it’s being hosted outside England and Wales different laws may apply: each country will have different legal interpretations.

I

ĖŤŤŤ 2#Ť3'#Ť(-$1(-%#,#-3Ť 2Ť -Ť.//.134-(38Ť3.Ť negotiate a licence fee. If someone has used your image without your permission, the chances are they like it and want to use it as it has a commercial value to them. Try and negotiate a licence fee so they can continue to use your image but for a price – you could even find you convert these people into clients. If you do negotiate a licence, consider granting it for specific purposes and for a finite length of time so that you can negotiate re-usage fees when the licence expires. ĖŤŤ $Ť8.4Ť 1#Ť(-Ť -8Ť".4 3Ť 2Ť3.Ť8.41Ť+#% +Ť position, take legal advice. All photographers should have an understanding of copyright laws and appreciate the value it can add to your /1.$#22(.-ĎŤ ./81(%'3Ť(-Ť/'.3.%1 /'2Ť#7(232Ť from the moment the shot is taken and expires 70 years after the end of the year in which you die. This means that your images are afforded a measure of protection for a very long time, and you can even assign the copyright in your images either during your lifetime, or upon death. If you generate a portfolio of work which you are able to licence to others for a fee, you may find that this income forms part of your pension fund, and could ultimately be a valuable asset to hand down through your family. ■ Scott Gair is an intellectual property lawyer at Mayo Wynne Baxter and a professional photographer. How to attract new clients

ne of the biggest problems for small businesses, especially startups, is keeping the clients coming through the door. It’s a problem I’m experiencing myself, even as I type this. My commercial photography business is only five months old, and although I have been in business for six years, prospective clients who don’t know this or who haven’t yet worked with me don’t instantly see the history when they visit the new website. For all intents and purposes, NegativeSpace is a business that not many people have heard about… yet. That means there is a lot of work to be done on our part, to encourage the clients

THE SECRET OF PROFESSIONAL SCANS If you have a requirement for professional quality scans then look no further than SilverFast 8, the latest version of a high-end feature-packed software package that comes with a Muilti-Exposure function designed to increase dynamic range erman company LaserSoft Imaging is renowned worldwide as a pioneer in the field of scanner and digital imaging software, for both private and professional usage. The company was founded in 1986 and the concept of SilverFast was introduced eight years later. Since then many minor and major updates have been incorporated as SilverFast has worked its successful way up to what is now version 8.

G

Before Multi-Exposure

SilverFast Archive Suite 8 – more than just a scanner software The new SilverFast Archive Suite 8 is a bundle that comprises two different programs: SilverFast Ai Studio 8 and SilverFast HDR Studio 8. SilverFast Ai Studio 8 is the top version of the company’s professional scanner software, and it comes equipped with the most comprehensive functionality. It allows the user to scan images easily into 64-bit/48-bit HDR(i) Raw data format, and can be individually adjusted so that it’s precisely set up to suit every scanner that’s supported. The unique WorkflowPilot that comes with the software is a step-by-step guide – a great help for beginners – and it ensures that all required processing steps are accomplished in the correct order. SilverFast HDR Studio 8 is an imaging software that processes the scans that have been created, and it’s the perfect complement for the Ai Studio 8 scanner software. Archive and save your precious images now, then optimise and process them for your needs at a later date.

After Multi-Exposure IMAGE LEFT Comprising Ai Studio 8 and HDR Studio 8, SilverFast Archive Suite will take care of all your scanning needs.

Increase Dynamic Range with SilverFast MultiExposure® One of the most popular SilverFast features is MultiExposure, a technique developed and patented by LaserSoft Imaging, which increases the scanner’s dynamic range. A scanner’s ability to recognise contrast levels depends on its dynamic range. Transparent originals, such as slides, consist of multiple film layers, which will each respond to light differently. This in turn results in a wide dynamic range, which will often exceed a scanner’s capabilities, with the result that image details can get lost during scanning. To get around this issue, Multi-Exposure performs a double scan with an increased exposure time for the second scan; this procedure captures the highlight details in the first pass and the shadow details in the second. Afterwards an algorithm calculates the final scan, which now contains the combined detail from both of the individual scans.

The unique WorkflowPilot is a step by step guide that greatly helps beginners

SilverFast Auto IT8 Calibration – Profiling for accurate colours Colour management is not trivial. The original image being scanned, the scanner device and the computer screen all use different colour spaces to show, or capture, an image. An accurate colour conversion between these colour spaces is needed to achieve a satisfying result. SilverFast’s sophisticated colour management will take over this task for you, so you don’t have to deal with it. The Auto IT8 Calibration is another useful feature included with SilverFast Ai Studio 8 to ensure the scanner delivers correct colours. You just place an IT8 colour chart (referred to as IT8 targets and produced by LaserSoft Imaging) on your flatbed or in your film scanner and start the calibration, which runs almost automatically. Small production batches and strict quality control will ensure that world-class standards are achieved. MORE INFORMATION www.silverfast.com

BUYERS’ GUIDE: Location flash If you’re working regularly on location but want the control you might expect in a studio, read on, as we present an overview of some of the latest professional portable lighting products WORDS IAN FYFE

With a good lighting set-up that you can take on the road and use on location, you can offer your clients a lot more in the way of services. At a wedding, for example, you don’t need to settle for the light that’s available, but can make sure

every shot is lit perfectly. Likewise, you can set your portrait subjects in unusual outdoor scenes, or go to a location of their choice with a full studio set-up. With top-quality location lighting, you don’t need to compromise either – fast flash

durations and quick recycle times are available from battery packs that last for hundreds of flashes and offer powerful, daylight-balanced light. Here’s an overview of what’s available to light up your locations.

Quantum The latest version of Quantum’s portable Qflash series is the 5d-R. This provides full TTL control via a system-specific D-Series adaptor, and incorporation of Quantum’s FreeXWire system enables wireless control at up to 500 feet. Two versions are available, run with different power packs. The T5d-R (£597) is powered by any of Quantum’s Turbo batteries (£408-£598), which can provide recycle times of as low as one second and up to 1030 full-power flashes – 7500 when at 1/8 full power. The X5d-R (£629) is used with the high-energy Quantum Qpaq-X (£511). These last for up to 350 flashes when used at a power of 200Ws, reducing to 180 at 400Ws.

Bowens Bowens has restyled its Travelpak battery system in the shape of the new Small Travelpak Kit (£498). The kit includes a Travelpak Control Panel and one small BatteryPak, but if you have a second, the hot-swap battery feature means you just unclip the control panel from a battery and replace it with a charged one on location. Two sizes of battery are available, and the Travelpak can provide power of up to 3000Ws, with a minimum of two seconds recycling time to full power and up to 375 shots on a single charge. It supports up to two Bowens Gemini monolights, and included are two 3m cables for this, with an optional 8m extension cable. It’s got a protective carry case, shoulder strap and universal mains charger.

Elinchrom

Available at Viewfinder Photography, Strobeam has a number of location-flash products, the latest being the D4 HSS (£1079). This has a built-in battery pack for improved portability over its DL4 predecessor, and this provides 400Ws of power. You can control the output across eight f/stops and it has a dedicated remote controller for hyper-speed sync, allowing sync speeds of 1/8000sec at full power. Flash durations go as low as 1/12,000sec.

The latest offering from Elinchrom is the Ranger Quadra Hybrid AS RX, a compact and portable 400Ws battery flash system that can be used in the studio or on location. It’s available with two types of head: the standard S head for universal use, or the action-freezing A head that offers minimum flash durations of 1/5120sec. Both heads provide a maximum light output of over f/64 at 2m and are balanced to daylight at 5500K. You have the option of Lead-Gel batteries for easy travelling, or lithium-ion batteries for maximum performance for the weight at just 2kg. With EL-Skyport built in, you have radio remote control of settings and triggering, and the EL-Skyport app for Apple devices allows Wi-Fi control. It is also compatible with a wide range of RQ accessories.

GEAR Calumet If you use off-camera flashguns on location, then Calumet has a new high-spec, affordable option. The Genesis Speedlight SP692 (£150), for Nikon or Canon, features through-the-lens metering, daylight-balanced light at 5600K, power zoom and recycle times of between two and five seconds. It can be used as a master unit or slave unit in a multiple flash set-up and can be triggered wirelessly. It can also be connected to an external power pack for a longer battery life, so is ideal for location work.

Bessel Bessel’s latest product is a portable flash system with a lightweight battery, available with power outputs of 400Ws (£400) or 600Ws (£500). The Li-ion battery provides up to 400 flashes for one head with recycle times of less than 1.5secs at full power. The S-Fit head itself is Bowens compatible and the flash tube is user changeable. As well as the head and battery pack, the kit includes a 2.5m cable, reflector, lockable carry case, shoulder strap and a lightweight stand.

Profoto At the top of Profoto’s range for location work is the Pro-B4 battery generator (£5135), which Profoto claims is the fastest on the market. This is backed up by minimum flash durations of 1/25,000sec and a recycle time of 0.99secs even at full power, at lower power, the recycle time allows up to 30 flashes per second. The battery lasts for 220 full-power flashes and can be changed, full charging takes just 45 minutes and can be done while in use, so in the studio it can be used continuously. It has two lamp head sockets that can be controlled in 0.1 f/stop steps with a total power range covering 11 f/stops, and integrated into the system is Profoto Air for remote control from your camera or computer.

Broncolor

Lencarta

For photographers who spend more time outside than in the studio, Broncolor has the new Move 1200 lithium battery (£2795 ex. VAT). It’s compact and light at just over 6kg, but provides up to 1200Ws of power. It provides 230 flashes at full power, with minimum flash durations of 1/20,000sec and recycling times as low as 0.02secs. Colour temperature is kept stable at 5500K by Broncolor’s patented ECTC technology, and the regulation range spans nine f/ stops. The Move 1200 L has a continuous lighting mode that can be used with the MobiLED lamp (£775 ex. VAT) to provide two hours of daylight-balanced light for shooting video, and an Outdoor Trolley Backpack and weatherproofed Power Pack Softcase.

Lencarta pitches its Safari Li-on portable flash system as being powerful enough to use as your studio lighting as well. The system can be bought with a variety of heads, from lightweight or heavy duty to ringflash, with prices for the kits ranging from £850 to £1100. The generator has two outlets that can be used asymmetrically with a total power output of 600Ws. The battery offers up to 400 flashes at full power. Normal recycling times are 3.75secs at full power, but a fast mode reduces this to 2.9secs at the cost of battery life. Minimum flash durations are 1/2700sec, and colour temperature is balanced to daylight at 5600K at full power, dropping to 5260K at minimum power.

Now their ‘Pro Series’ websites are getting a great deal of attention as they provide a way to get that custom look without the custom price tag. By helping you create your brand (or taking existing brand elements and working with these), Amazing Internet will help you create a memorable presence that gets you noticed.
