Punishing Those Who Can Least Afford It State’s foot-dragging on TennCare coverage is shameful

I’m amazed that healthcare is one issue that our country can’t agree on. No matter who proposes a new plan, what it’s called, or how many times it’s revised, there’s always someone left unsatisfied. A more affordable healthcare system for everyone seems “too ridiculous” to some, and expanding a program designed to help low-income families and individuals has to be determined by each state to be “fair.”

Which is why I wish I lived in a state that voted to expand the Medicaid program when I heard about the controversy over TennCare.

TennCare, Tennessee’s Medicaid program, has been in the news multiple times throughout the year, most recently due to the lawsuit filed by the Tennessee Justice Center, the Southern Poverty Law Center, the National Health Law Program and 11 patients who had applied for TennCare, but had been waiting for coverage for months.

U.S. District Judge Todd Campbell ruled against TennCare, stating that anyone who applied for coverage and had proof of an extended delay must be given a hearing with an administrative law judge within 45 days (or 90 for applicants with disabilities).

What does this mean?

Does this mean that a federal court madeline judge had to step in to chambliss resolve the problems of a state-operated program that tried to blame anything but itself? Unfortunately—yes. Does it mean that only the 11 patients involved in the lawsuit will benefit?

Luckily—no.

Given its class action status, the lawsuit means that the court’s decision will benefit all persons throughout Tennessee who faced TennCare application delays.

The ruling, unfortunately, doesn’t fix this controversy right away, but at least it brings attention to an issue that hasn’t been handled properly and that could have been avoided if those in charge had been more responsible.

“This is a big progress in the right direction,” said SPLC staff attorney Sam Brooke.

Brooke noted that those who applied for TennCare coverage should either keep a

copy of their application or, if they applied through the federal market place, their application identification number.

Either one of these can be used to verify their application date at their hearing.

“We’re waiting and seeing what this actually means in practice,” Brooke said, adding that the SPLC staff was “cautiously optimistic” but would be keeping a close eye on TennCare.

For anyone experiencing problems with their TennCare application, or anyone with questions about coverage or a hearing, Brooke listed two numbers they can call: the Tennessee Health Connection, (855) 259-0701, or the Tennessee Justice Center (877) 6081009.

“We hope that people [experiencing problems] will contact the state,” Brooke said.

Fortunately, I’m not affected by this controversy, and you might not be either, but that doesn’t mean we shouldn’t care about the people who are. Regardless of political preference and socioeconomic status, no one should have to suffer, waiting until a federal judge fixes what the state should have ensured never happened in the first place.

Not when coverage for someone’s health is on the line.

They Didn’t Have to Die What’s a degraded aquatic ecosystem worth? What’s a fish worth?

Dead fish. This smelly proposition mixed with raw sewage was offered up to us in South Chickamauga Creek near Shallowford Road on Aug. 14. For the next two days, downstream over two miles, Tennessee Wildlife Resources Agency (TWRA) collected 5,854 fish that had succumbed to lack of oxygen in their water. More SANDRA went uncollected. The deaths were caused by 13.68 million gallons of untreated sewage overflowing from Friar Branch Pump Station. The Tennessee Department of Environment and Conservation has issued a notice of violation. But that’s no help to the thousands of dead creek inhabitants.

How could this happen? As Strother Martin said in the movie Cool Hand Luke, “What we have here is...failure to communicate.” According to Alice Cannella, Director of Waste Resources Division (Moccasin Bend Waste Treatment

Plant), the switch that should have told the pump to turn on when the sewage level gets too high in the pipe did not send the message. Hence, sewage backup flowed out around the base of an elevated manhole and into the creek. This is the very same creek that feeds into the Tennessee River at the Riverpark just upstream from KURTZ the drinking water intakes for Tennessee American Water Company.

The sewage flowed into the creek for 27 hours. Once discovered, it was a quick manual fix.

In 2013, EPA and Tennessee Clean Water Network entered into a three-year consent decree with Chattanooga, requiring significant reduction, preferably elimination, of sanitary sewer overflows, plus major upgrades of the sewer system, upgrades to Moccasin Bend Wastewater Treatment Plant and operational audits.

area sewers fall under this consent decree. This $250 million project came with a hefty fine that could have been avoided if the city had not ignored fixes for more than a decade. This latest overflow clearly violates the consent decree—and the Federal Clean Water Act. Because there is a consent decree, the fine is likely to be a measly $350, although TWRA will charge for fish restitution.

What’s a fish worth? What’s a degraded aquatic ecosystem worth?

Twenty-seven hours went by before a quick repair stopped the flow! Canoeists alerted the authorities.Why didn’t those supposed to keep watch not see trouble for so long? The pump station is remotely monitored, but this should have been immediately known. Either the alarm didn’t go off—or no one was paying attention.

The consent decree requires establishment of procedures for pump station preventive maintenance. It also requires procedures for routine operations with standard inspection schedules and a plan for emergency operations including location(s) of portable pumping equipment. What happened?

South Chickamauga Creek boasts a large variety of fish species including the famous

snail darter. There were 23 species of killed fish, ranging in size from two-inch small fry to 20 pound adults. The endangered Chickamauga Crayfish lives in the creek, not to mention other macroinvertebrates, mussels, insects, birds and wildlife. Kayakers and canoeists make good use of the canoe launches now in place. Many enjoy greenway walks, biking, birding, and fishing. However, neither fish nor fishers enjoy sewage. While overflows are uncommon, whiffs of sewer in South Chickamauga Creek are not. It is likely that old pipes are leaking, as water testing done by South Chickamauga Creek Greenway Alliance in the Harrison Pike area would indicate.

Things to remember: • Sewage is not good for fish.

• Sewer pipes work better when they don’t leak.

• Prompt attention to stormwater and sewage infrastructure as outlined in the consent decree is an important investment for nature and drinking water.

• Healthy ecosystems are essential for sustainable living.

Be vigilant. Take appropriate action to protect water quality.

In this most succinct analogy, that is what has happened with the Veterans Administration in the wake of the scandal that erupted earlier this year, beginning in Phoenix. The list of falsified documents and accusations of veterans dying while awaiting care from the VA led to a bipartisan agreement, resulting in the “Veterans’ Access to Care Through Choice, Accountability, and Transparency Act of 2014.” To save ink, we’ll just call it “the Bill” from here on out.

“I’ve told lots of folks that the attention that the VA has received is probably the best thing that ever happened to the VA—and to our veterans,” says Chattanooga Clinic Manager Christopher Marcus. “It has highlighted a lot of training deficiencies.” With a price tag of nearly $17 billion, more than training is being addressed by the sweeping multi-year law.

“We just started the real planning now that the bill has become law,” Marcus continues, “and the plan is for a 75,000-square-foot outpatient clinic.” Marcus also notes that the plans for a larger clinic here are not a result of the scandal earlier this year, but that that event may have helped get the already-existing plans off the back burner. Earlier media reports of a 100,000-square-foot facility may include hopes of a 25,000-square-foot ambulatory surgical clinic being added later.

For veterans like Paul Gardner, who served in the U.S. Marine Corps and the Tennessee National Guard, it’s welcome news.

“I’ve been waiting a year and five months now on my claim to be approved,” says Gardner, “They are still in the ‘gathering information’ process, they say.”

Gardner’s complaints are among the most common against the VA. He has no particular problem with the medical staff. In fact, he’s rarely seen a VA doctor. All of his medical treatment has been fee-based out to local civilian physicians because of the limitations of the Chattanooga facility. (“Fee-basing” means the VA agrees to contract with a local medical facility or physician to treat veterans who would have to wait too long for care at the Chattanooga clinic.)

Gardner’s injuries are servicerelated and date back to a truck accident at Fort Campbell in 2003.

He was in the National Guard preparing for deployment to Iraq when the crash occurred. “My shoulder—the rotator cuff was

three-quarters ripped apart,” Gardner describes. He is still dealing with the effects of that. “Since it’s been so long since my shoulder’s worked right,” he explains, “my brain has forgotten how to tell the muscles in my shoulder how to move.” As a result, he can raise his right arm no higher than the shoulder and other mobility is also compromised. Since he has seen only private-sector doctors, his belief is that the administration of the VA is at fault. “In my personal opinion, they need to get an old sergeantmajor instead of a four-star general to run the VA.” Clinic Manager Marcus agrees that administration is a lingering problem in the system. He is currently at 60 percent staffing, and while he is authorized to hire more, he is limited by available space. “Since I have been here, in six months, we’ve added a lot of staff that I don’t have space for,” he says, “So we have put together a plan to optimize the space, which is going to require some minor construction.” It also means re-

arranging some existing space. “I’m emptying out our linen closet and we’re going to disperse our linen into carts and things and I’m going to put two people in our linen closet.”

In April of this year, the Chattanooga facility received a gift, of sorts, in the form of a new clinic in Athens, Tennessee. Veterans who lived in McMinn and surrounding counties were making the drive into Chattanooga to receive their care. This was not only a burden on the vets, but also on the already over-extended Chattanooga clinic. The addition of the Athens clinic and its one Patient Aligned Care Team has taken more than 400 patients off the rolls of the Chattanooga facility. The teams consist of a primary care physician, nurse care manager, clinical associate and an administrative clerk. The Athens clinic is authorized to add another team before the end of the year. The facility was built to house three such teams.

The Tennessee Valley Healthcare System is in the process of hiring 300 more staff members before the end of the year. Some of those will be in Chattanooga. Yet just putting

Some of those will be in Chattanooga.” warm bodies in linen closets won’t be enough for Marcus. “The first thing on our mind when we get this new staff is training, training, training,” he says. Referring to the problems exposed in Phoenix, Philadelphia and other areas of the country, he adds, “It wasn’t providing poor health care, but when it comes to tracking how long a patient’s waiting, there’s some people not doing things the way they were supposed to.” He’s quick to add, “But it wasn’t out of trying to hide anything or maliciousness, they just hadn’t been properly trained.”

Twenty-three-year Air Force veteran Dennis Norwood agrees that the medical staff does a fine job. He can’t even find fault with the administrative staff. “I was in there yesterday morning to see Dr. Clarion,” he explains,” and my appointment was for 8:30...

they saw me at 8:15.”

Norwood is still fairly new to the VA. “I had been eligible for quite a few years, but to be honest, I never felt like I had earned the right,” Norwood confessed. “I had never been a combat veteran and I figured there were people ahead of me that really need that.” Yet, when neuropathy from diabetes became a more serious problem, Norwood checked into his options with the VA. “Well, whoever hears about getting diabetes in the military and qualifying for the VA?” he asks incredulously. “I’m 90 percent disabled but I’m paid at 100 percent unemployability.”

And because of his diabetes, Norwood is also eligible for other medical services. “I just got a letter in the mail,” he says “that because of my ophthalmology requirements, I can

pick any ophthalmologist I want in Chattanooga, make an appointment, and the VA’s going to pay for that.”

Norwood is being given the option of choosing a civilian ophthalmologist because there are none at the Chattanooga VA. But that could soon be changing.

“We are going through a large hiring initiative,” explains TVHS Public Affairs Officer Jessica Schiefer, “And we’re hiring for cardiologists, dermatologists, gastroenterologists, ophthalmologists, optometrists, orthopedic surgeons, primary care physicians as well as psychiatrists.” In the mid-level staff areas, they’re also hiring nurse practitioners, physical therapists, psychologists and social workers. Until all those are hired, and—at least in Chattanooga’s situation—until there’s room for them, more than $15 million dollars has been allocated in “the Bill” to pay for fee-based referrals for veterans to see local, private doctors in the interim.

me about six or seven months to get everything into the system,” Lusk told The Pulse, “but after that I’ve had an excellent relationship with the local VA clinic, headed up by Dr. McCoy. He and his staff have just been great to me. I couldn’t ask for better care.” And Lusk had even more praise for the system in saying “I’ve also made two trips to the VA clinic in Murfreesboro. They have been, likewise, very great.”

Lusk was diagnosed with Amyotrophic Lateral Sclerosis (ALS), also known as Lou Gehrig’s Disease. He was shocked and pleased to learn that the Veteran’s Administration has determined that even though the exact cause of ALS is still unknown, the VA considers it a 100 percent serviceconnected disease, entitling Lusk to full benefits.

Lusk is already experiencing diminished motor skills, but that will soon progress to loss of mobility and even the ability to speak. “[The VA] is now in the process of building a motorized wheelchair for me,” says Lusk,

“And also many other things to make me comfortable.” One of those things will be a grant to remodel his Rossville, Georgia home to comply with the Americans with Disabilities Act and a $20,000 computer which he will use to communicate as the disease advances.

In the coming years, the bill will provide veterans like Lusk and the others who shared their stories with The Pulse more facilities nationwide, more medical and clerical staff and better accountability to those the VA services. The cost will be great and not all of the funding is guaranteed. According to the Congressional Budget Office, the $10 billion funding of a key provision of the bill would last only until the early part of fiscal year 2016.

Republican Senator Bob Corker of Tennessee, one of only three senators to vote against the bill, said in a statement, “Our veterans deserve solutions to the deep-rooted problems plaguing the VA, and they also deserve a Congress that has the discipline

to pay for legislation it passes.”

Corker felt Congress rushed through a piece of legislation “without thoroughly reviewing its full fiscal impact on future generations and without knowing if it will address the systemic problems that exist at the VA.” The senator said that instead, Congress should have taken time to work with the recently confirmed Secretary of the VA, former Procter & Gamble CEO Robert McDonald, on costeffective reforms that “don’t put in place yet another long-term unfunded liability.”

The Chattanooga VA Outpatient Clinic currently serves 14,600 patients. There will be a town hall meeting held in which veterans and the public can express their feelings, good and bad. That meeting will take place between 2 and 4 p.m., Wednesday, Sept. 24 at the Chattanooga clinic, 150 Debra Rd., Ste 5200 (off Brainerd Road across from Eastgate Town Center). TVHS Director Juan Morales will be there to answer questions.

Meet The Real Bob Carty

Forty years of music means this man sings it like it is—and lives it, too

Sailing Into Country/Bluegrass Memorial hosts seven-piece US Navy Country band The United States Navy is sending country-bluegrass ensemble Country Current to Chattanooga on Sept.

13. The band plays at 7 p.m. at the Memorial Auditorium, 399 McCallie Ave. Country Current is composed of seven highly skilled musicians playing banjo, guitar, mandolin, fiddle, bass, dobro, steel guitar, and drum set. Rarely will you see the highcaliber musicianship that Country Current demonstrates in their performances.

Senior Chief Musician Keith Arneson, a banjo player from Maryland, has taught banjo since 1981. Chief Musician Patrick J. White plays fiddle, mandolin, guitar, and also sings. From Rocky Comfort, Missouri, is guitarist and lead vocalist Musician 1st Class Kenny Ray Horton. Also from Mis-

souri (St. Louis) is guitarist Musician 1st Class Joseph M. Friedman. Friedman has recorded and performed on Broadway in “The Lion King” and “Grease.” He’s also collaborated on releases for Justin Timberlake, Fall Out Boy, and Celine Dion. Musician 1st Class Christina M. Catalanotto, a native of Slidell, Louisiana, has drummed for the Navy Band since January 2007. Steel guitarist Musician 1st Class Patrick K. Gulley is a local from Nashville, Tennessee, and studied music and entrepreneurship at MTSU. Finishing up the lineup is Musician 1st Class Daniel Stewart. Stewart plays upright and electric bass for Country Current and is the newest member of the ensemble. Head to the Memorial for some full-steamahead bluegrass!

ou would think that writing about a man with more than 40 years experience as a singer/songwriter, a man who’s been everywhere, done everything and who by rights ought to be famous throughout the world would be easy. You would be wrong. The fact is there is so much to say, so much ground to cover, so many tunes to discuss and so many anecdotes to relate that paring it all down to 500 words becomes a daunting task. Bob Carty (the REAL Bob Carty) is such a man.

Up until now, I had heard a handful of Bob’s tunes, enough to have some respect for the man’s talent, but it was only when I started to do a little research in preparation for this article that I started wondering why there aren’t pigeons peacefully…perching… on a statue of this guy somewhere. His talent is large and undeniable—but no less impressive is his legacy.

Bob’s great uncle was “Indian Joe Blackburn,” a star of the Grand Ol’ Opry in the ’40s. His cousin “Magic Marvin Proffit” was Merle Haggard’s sideman. As a teenager in Nashville, Bob had his own development deal right up until his producer tragically died in an auto accident and the big break that would have been Bob’s (touring with Ralph Stanley in ’76) went to some guy named Ricky Skaggs instead (maybe you’ve heard of him).

Carty spent the rest of the ’70s playing bass in a funk band up and down the East Coast. By the time he was 20, Bob had drifted out west, a laborer by day and a honky-tonk musician by night. He wound up touring dive bars of the South (wouldn’t THAT be a great coffee table book?) until eventually landing a gig as bass player for the Eddie Miles Band—and that only takes us up through the ’80s. There isn’t space to list the projects Bob has

contributed to or been frontman of from then until now, so let’s just define what all of it means.

Bob Carty has legitimately lived the life most singer/ songwriters pretend to have lived, would give their eye teeth to have lived. From head to toe the man is authenticity.

Rough, calloused talent combined with a range of experiences that could inspire a dozen best-selling albums easily; Bob is Kris Kristofferson, John Prine, Ramblin’ Jack Elliott and Willie all rolled in to one with a healthy dose of James Brown to top it off.

Punk?

Poet?

In the end, Bob is Bob and it’s best to just accept him on those terms. Good lord, I just listened to a tune he recorded on the fly with a pocket recorder in a parking garage (“It All Goes Down”) and there is more depth and soul in that tune than in half the stuff I am sent on a regular basis. Every note Bob sings carries with it the gravitas of 40 years of hard, working-musician living.

Bob has a robust online presence through Reverbnation, Facebook and 423BraggingRights, so it should be easy enough to go sample his music for yourself. Listening to his tunes the last few days has convinced me of one thing in particular. Perhaps the great-

est talent isn’t in the studio or plastered on a billboard. Perhaps, sometimes, the greatest talent is found in the dark and smoky backrooms of dangerous-looking dive bars, and there is a lesson in that for the intrepid music lover.

If you want to hear the good stuff, you have to go looking for it; you have to seek it out.

You can’t just sit back and take whatever is delivered to you by an industry that values form over function, flash over substance.

If you want to try a taste of the good stuff around town, catch Bob’s next performance at Charles & Myrtle’s Coffeehouse on Oct. 17.

You’ll be glad you did.

This weekend the Pigeon Mountain Grill presents a free Songwriter Showcase featuring some of the hottest local talent in the region.

The show kicks off on Saturday, Sep. 13th at 10 a.m. and is absolutely free although they will be accepting donations to provide medical care for Brody Smith, a great young man who’s had a very hard time.

The list of performers includes such notables as Sweet Georgia Brown, Mark Cunningham, Vic “I’m Your Huckleberry” Burgess and a special appearance by the Real Bob Carty. Vic and Bob will both be auctioning off autographed guitars to raise money for Smith’s expenses.

The Pigeon Mountain Grill is located at 18381 Hwy 193 in Chickamauga, GA and is well-known for its ribs, burgers, wings and down-home country store vibe.

It’s just a hop, skip and a jump from the Walker County Fair, which is happening this same weekend. There’s no reason to miss any of the goodness of the fair or the really terrific free show which is, after all, for a good cause.

t the beginning of the film Ghost World, the main character Enid Coleslaw has a rapturous experience watching a VHS bootleg of a wonderfully insane dance sequence for the Indian rock song “Jaan Pehechan Ho” from a ’60s Bollywood film and is inspired to try to find more like it.

If you want more of something, one solution is to make it yourself, which is what the Australian group The Bombay Royale has done, by trying to replicate certain styles of ’60s/’70s Bollywood rock/ pop songs. The band has covered notable Bollywood tracks, including the aforementioned “Jaan Pehechan Ho,” but its new album The Island of Dr. Electrico features original material.

It’s fair to ask why this group should exist at all, when listeners can simply dig up Bollywood classics to enjoy, and this writer has two responses. Firstly, modern Bollywood soundtracks have adopted modern beats and sounds (aside: the Carmike East Ridge 18 regularly screens new Bollywood

movies, and this writer highly recommends checking one out for a culture blast) so the band is carrying the classic Bollywood rock/ pop torch and also allowing it to be heard in live settings.

Secondly, The Bombay Royale focuses on a particular aesthetic strain, with prominent ’70s funk influences; not all ’60s Bollywood tunes are as crazily ecstatic and incredible as “Jaan Pehechan Ho,” and the band’s attitude is to really go for bombast and making an impression. If anything, The Bombay Royale seems to be like the Bollywood equivalent of The Budos Band, which is the Staten Island group with its unique take on retro-soul/funk.

Nestled in its 11-member lineup is a killer horn section, multiinstrumentalist Josh Bennett on tabla and sitar, a solid rhythm section and the two lead singers Parvyn Kaur Singh (a.k.a. “The Lady”) and Shourov Bhattacharya (a.k.a. “The Tiger”) singing in Hindi and Bengali. There are disco-synth infusions, and the en-

semble’s deep-funk capabilities can be heard on tracks like “(Give Me Back My) Bunty Bunty,” sung partially in English; the pimptastic title track sports unabashed wahwah-guitar licks and furious conga beats.

This very well might be the album that Enid Coleslaw—and any off-kilter musicologists—has been looking for.

F

ree improvisation—that is, improvising without a genre in mind—is perhaps the last frontier of music by design, promoting constant and persistent innovation while also simultaneously being difficult listening due to its lack of structure or need to have any repeatable melody or rhythm.

However, what free improv is particularly good at is inspiring specific moods and imparting the sonic personalities of its performers, unfettered. The album at hand, Tangle, brings together two notable and distinctive improvisers: saxophonist Jack Wright—now in his 70s and still going strong—

and percussionist Ben Bennett, who is Wright’s junior by decades.

The two have been in the trio Rotty What with Ben’s father John and also the trio Wrest with double-bassist Evan Lipson, and the duo configuration on Tangle seems to be carefully poised, with Wright heard primarily in one stereo channel and Bennett heard primarily in the other, presenting a sonic separation that allows the listener to understand exactly who is playing what sound, even when the players confusingly make similar sounds despite having dissimilar instruments.

Tangle features three tracks that are each roughly 20 minutes long, and the prevailing mood is that of tight, jittery nervousness, like the aural equivalent of crab-sized bionic spiders crawling all over a person’s exposed flesh. “Embroiled” has a multitude of abrupt, sharp moments, as if the two were sparring with each other in a boxing ring; Wright unleashes a mindboggling variety of challenging sounds, like multi-phonics, a violent sucking sound and inhuman snorts.

Being Neil Peart’s exact opposite, Bennett wrings as many sounds as possible from a relatively small amount of equipment, all of which could probably fit in a duffel bag. Everything isn’t forced; Bennett seems to coax out drum pitter-patters with his fingertips or subtle noises from broomsticks, but he also has abrasive turns, using thin rods for metal-on-metal squeaking, scraping, rattling and junkyard scrambling.

As always, Wright brings surprises to his playing, refusing to fall into a rut; here, at various times, he whinnies, sounds vulnerable and wounded, chatters through his sax, snarls and also manages to sound like a sped-up tape recording. It’s a bumpy ride for those who like to know exactly what they’re getting, but adventurous sound-lovers will find much to enjoy here.

Jazzy Brunch on the Bluff Jazzanooga kicks off Hunter Museum Sunday specials As the birthplace of jazz figures such as Bessie Smith and Lovie Austin, Chattanooga has a vibrant jazz heritage. Jazzanooga is a citywide celebration of jazz that draws on that heritage.

In the words of Jazzanooga’s founders, jazz is “a perfect reflection of the Greater Chattanooga area’s diverse and thriving community,” and their ultimate aim is to provide educational and performance opportunities for people of all ages.

Though Jazzanooga festivities usually occur in April, jazz lovers can now look forward to a series of Jazzanooga brunches throughout the year. The Hunter Museum, which has been a Jazzanooga partner since it began in 2011, will host three Jazzanooga Sunday brunches featuring

live jazz, good food and great art.

Each installment of this brunch series will begin with a catered meal at 11 a.m. and include musical performances by gifted regional talent. The first of these brunches will be held on Sunday, Sept. 14 and will feature Shane Morrow and Friends.

here is something truly delightful about the paintings of Michael Jenkins. His use of color is exciting, the forms tight and well rendered, and his subjects simultaneously whimsical and serious. Many patrons of local art festivals and the Chattanooga Market will recognize his distinctive style and compositions. I talked with Michael about his work.

Tony Mraz: If you had to choose three artists to play a game of poker with, who would they be?

Michael Jenkins: Rick Griffin, Keith Haring and Vincent Van Gogh. Also Wayne White. He’s from Hixson, he worked on the set of Peewee’s Playhouse and did videos with Peter Gabriel.

TM: How did you get your start as an artist?

MJ: I’ve always loved art since I was a kid growing up in Anniston, Alabama. I was big-time into art and was always drawing. Art was my favorite subject in high school, that’s where I learned about pop artists like Andy Warhol. He was a big influence.

I loved his choice of color schemes and use of patterns, and his portrayal of faces.

I went to college at Auburn and got a horticulture degree that brought me to Chattanooga to work at Lines Orchids. When I got here, I had a lot of free time. I didn’t really know anybody, and we had little kids at home, so I stayed in and started developing the style that I have now.

TM: What kind of processes do you use to achieve those vibrant compositions?

MJ: I always layer paint on wood.

If I want to see the grain of the wood, I’ll just sand it, otherwise I’ll gesso

it real good to prime it. Occasionally I will make a straight oil painting, but generally I’ll use acrylics, especially for my pop art painting style. I use spray paint and stencils a lot of the time, and many of my paintings have art on both sides and can be suspended.

TM: What inspires your choice of subject matter in your work?

MJ: The art and music that I was raised on are a major influence. I was an active environmentalist when I was younger. I love being in nature and going hiking, but there is this looming technology in the background. I don’t know if I’m for or against nuclear power, honestly, but I’ve always been interested in power lines and plants.

One time I did a Jimi Hendrix and a Beatles and kind of felt like a sell-out, so I’ve tried to choose people who are more obscure, like Devendra Banhart.

TM: What kind of music do you listen to when you’re working in your studio?

MJ: I have a library of over 4,000 songs on my iPod that I sometimes put on shuffle. Today I was listening to New Order. I’ve been enjoying a lot of female vocalists lately, like Marissa Nadler, Angel Olsen, and Sharon Van

Etten. I like upbeat stuff; the New Pornographers’ new album has been amazing me recently. I listen to The Cure a lot, and old R.E.M., I listened to Murmur today too. I love the Grateful Dead and Phish, and the art surrounding both of those bands has influenced me. Jim Pollock’s work blew me away—I remember going to my first Phish show and being very impressed by the art.

TM: What is the purpose of art?

MJ: Historically, it’s been used to document events, to tell a story, for social commentary, or just to create beauty. For me, it’s about creating beauty,

but I also like to create some type of message and get people to think and converse.

TM: What is beauty?

MJ: I feel like beauty is a combination of things; things that please the eyes, ears and soul. In painting, I feel like beauty is all about color combinations, form and balance, and things that are visually pleasing.

TM: What do you think about our local art culture?

MJ: I feel like we have a very rich art culture here in town. It seems very diverse and I see a lot of talent. I’m really enjoying the music scene around here lately. I’m totally digging the murals going up everywhere, and we have an interesting theatre scene too.

his has been one of the more barren years for Hollywood film. Not much worth seeing has been released in theaters the past few weeks, beyond the re-released anniversary editions of both “Ghostbusters” and “Forrest Gump.” This lack of major release, quality films makes it difficult for the discerning critic.

I try to avoid films that I know will be a negative experience—like most everyone, I pay for my tickets and have no desire to waste money on something I’m going to hate. There are weeks where I have no choice, but increasingly Video On Demand has become something of a haven for good film. More and more, VOD is including early or same-day-as-theaters releases with smaller movies that likely wouldn’t make it to places like the East Ridge 18 or the Majestic.

“Dinosaur 13” is one such film. One might think that a documentary about the property rights surrounding the world’s most famous fossil wouldn’t make for an enthralling movie experience. And yet, “Dinosaur 13” is an engaging and emotional film, hindered only by being completely one-sided.

In 1990, the world’s largest and most intact Tyrannosaurus Rex specimen was found in South Dakota. The Black Hills Mineral company had been searching the Cheyenne Indian Reservation for fossils all summer when Sue Hendrickson left the group to check some cliffs while the others changed a tire on their Jeep.

The bones were embedded in the cliffs, nearly unmistakable, and the company immediately began excavation.

The remains were found on land that belonged to Maurice Williams. He agreed to sell them to Black Hills for $5,000 on the condition that they be displayed in the dinosaur museum in Hill City, SD. Nicknamed “Sue,” after Hendrickson, the T. Rex was an incredible find.

It significantly increased the scientific understanding of these creatures and was later sold at

auction for $7.6 million dollars. However, the road from discovery to auction was a rocky one.

“Sue” stayed at the Black Hills Mineral Company for two years, while the group cleaned and preserved the specimen. It was without a doubt their greatest find and required the utmost care and attention. However, in 1992, the federal government sent the National Guard to Hill City to seize all remains and records related to the dinosaur. Evidently, “Sue” was actually found on public land. Property rights are tricky things, especially in regard to Native American reservations.

Technically, all Native American reservations are federal land. Even land “owned” by Native Americans requires federal permission before anything found on those lands can be sold. Because neither Black Hills nor Williams requested permission to remove the fossil, it was the property of the U.S. government. Additionally, in the intervening years between discovery and seizure, Williams realized what he had and began to claim that Black Hills hookwinked him into the sale.

What follows is a long, convoluted legal battle determining property rights as well as the U.S. Attorney’s office filing felony charges against individuals within the Black Hills Mineral company and the corporation itself. The prosecution tried to establish that Black Hills made a habit of removing property without permission from federal and Indian lands for profit. Of course, the film makes the case that none of this is true, or at least that any laws broken were done so unintentionally—and it makes its case well. The outcome ulti-

mately cost one archeologist his freedom for two years due to a failure to properly fill out a form. “Sue” was returned to Williams, who sold the dinosaur at Soethby’s for untaxed millions.

As I mentioned, the film is entirely onesided. It tells the story of the Black Hills Mineral Company and the scientists who worked there. Maurice Williams is seen only in home video footage, surveying the excavation. Listening to the interviews gives the impression that there is no reason to doubt Pete Larson and their crew; their concern seems to be entirely focused on the preservation and study of “Sue” and not the inherent monetary value of the specimen. They argue that prior to “Sue’s” discovery, no one had ever paid more than $5,000 for a fossil. But still, it might have been useful to hear the arguments of both Williams and U.S. Attorney Kevin Schieffer, if only to dismiss them later.

Property rights and inherent value are difficult things to justify in the face of discovery. I spent most of the film wondering what difference it makes who owns the dinosaur—the information that can be learned from it should trump any red tape or lines on a map. Technically, all land is federal land, especially when eminent domain becomes an issue, and it seems that the ownership of such a discovery should go to the person who found it and pulled it out of the ground.

But then—what if someone only sees dollar signs where they should see scientific advancement?“Dinosaur 13” might have asked these questions better, but the film is worth seeing nonetheless.

Sometimes if we can’t see the whole picture, we don’t even entertain the notion. Or if we don’t know how it’ll end up, we shy away from starting the process at all. We are fearful that there’s no guarantee. We don’t like change. We’re afraid to fail, afraid to be humiliated, afraid we won’t be strong enough to pick ourselves up again.

Freedom begins the moment you decide not to believe any of that.

Mementos Mori Officer Alex meditates on things saved and why

I held a chilled crystal glass in my left hand while my right index finger traced the spines of a dozen books on a shelf just above my head, and I smiled to myself. H. Rider Haggard to J.D. Salinger, John Grisham to Douglas Adams…a cop with a personal library. Who the hell would believe such a thing?

The smile persisted because I knew ALEX the answer: Only another cop. (We were “just cops” to everyone else of course, a barely civilized group of racist thugs with chips on our shoulders trying to overcompensate for a lack of brains, blah blah blah.)

It was more than a few walls of book. It was a history museum of sorts, but the pieces in this collection had meaning to only one. Mementos no one else would understand or care about but me, interspersed between volumes of books and neon signs.

A shard of glass and a rusty piece of metal from a prison cell on Alcatraz Island. An oblong whitish-grey stone from a

Mayan temple on the shores of Tulum. Another small pebble the diameter of a dime, slightly polished, from the grave of The King (God rest his soul).

A cheap gold-plated pocket watch…a World War II era bayonet…These held places among a lifetime’s collection of books (two, actually, if you considered my grandfather’s submisTEACH sions), lit by the cerulean hues of beer neon, the only light source in the room. Water droplets condensed on the glass and dripped onto my bare foot, bringing me back to the present.

I turned and something caught my eye next to a set of rusty hammers and an ice pick (a story for another time), and my eyes settled on a small, yellow three-volt battery. The cemetery shooting.

I’d actually witnessed a man successfully negotiate a death wish while standing atop his own father’s grave, a man who also died by suicide, as was this gentleman’s intention once he charged us with a handgun

after much deliberation (and our valiant attempts at negotiation). The standoff and talks lasted for hours in near-freezing temperatures. Our highpowered cop lights were fading by the dozen in that pre-LED world, and there were nearly as many dead battery cells as there were shell casings before it was over.

The battery wasn’t a trophy; it was just a memento.

Why did I keep it? Why in the world would I want a trigger for a memory I’d just as soon not possess? Honestly, I don’t know.

An event of significance, even tragic, was still an event of significance, I supposed. I deserved that memory, good or bad, and unlike so many other things from our past (and history at large), here was tangible evidence that it ever occurred.

It was not a dream or a borrowed thought, it was mine, and this was my totem. My trigger.

I eased into a bamboo rocker that existed for just these moments at the base of this collection...for digesting thoughts, be they my own or those of an author. Despite all the trinkets in the room, I stared at nothing in particular, and absently guided the chilled crystal in my hand to my lips. Why the mementos?

Why the need to have physical

reminders?

And I laughed, because how could I forget? For the ghosts.

I paused, and took another sip with smiling lips.

I’d always felt this town was full of ghosts. Not sheeted churchyard specters, but memories, if not traces of the very lives that changed at specific spots, changed and blended into the landscape where they now sleep and are forgotten, except for a select few. They deserved to be remembered.

I’m not sure if it was guilt or respect, but those are cousins as far as I’m concerned, so I suppose it doesn’t matter.

I leaned my head back and placed the glass on the ground beside me so I could grip the tubular curved arms of the chair and push it back as far as its springs would allow, and enjoyed the rarest of silences in my mind, and again I smiled.

Cops are so often the final witnesses. So yes. Remember out of respect. We are accused of not having hearts, but I say differently. For most of us, our hearts are repositories for the dead, and it’s there they can continue to live.

I relaxed my grip and sleep took me, my conscience clear and uncluttered. The battery dropped from my limp right hand…but the smile did not fade.
