An agreement giving the Metropolitan Water District (MWD) a foothold in the Sacramento-San Joaquin Delta will be put on hold for now, thanks to an appellate court ruling that temporarily halted its purchase of five farming islands. The decision, handed down by the 3rd District Court of Appeal in Sacramento, represents a sort of first-round victory for Contra Costa and San Joaquin counties in their lawsuit against the MWD, which they allege is nefariously shopping for the real estate in order to make a massive water grab through the California WaterFix, the tunnel project the district acknowledges supporting – and in doing so is violating a mandated review under the California Environmental Quality Act. The appellate court, however, did not offer details for its decision, prompting MWD to claim the justices are only giving themselves time to familiarize themselves with
the case before officially ruling on its merits. “Even though it is only a temporary slow-down, every bit helps,” said Jan McCleery, president of the Save the California Delta Alliance. While her group is not an actual party to the lawsuit, they are taking legal action against the

The East Contra Costa Fire Protection District Board put its plan to move to an elected board on the backburner this week, pending further study of the issue. Earlier this month, the board decided to ask voters in November to approve their proposal to switch from a nine-member appointed board to a five-member elected body. However, the plan has been postponed until the board decides whether the future governing body would be elected at-large or by yet-to-be divided wards of the district.

ECCFPD Chief Hugh Henderson Regardless of how the board chooses to proceed, district officials said this week that it’s likely to be complicated. “The district’s legislation allows for the district to switch from an appointed board to an elected board,” said Fire Chief
Hugh Henderson. “We may also increase or decrease the number of directors, and we can allow the voters to elect directors, from either at-large or by division. That being said, the enabling legislation does not lay out how to do that all at the same time.”
The law states that voters can approve transitioning to an elected board in the November election, with new directors elected in November 2017. However, if voters also approve a reduction in the number of directors, in this case from nine to five, current directors cannot be reseated or replaced until that election, which would leave areas of the district without representation for a time.
