Sexual Harassment

Sexual Harassment (D1001): Ac ons or statements that are sexual in nature, which off end or defame the dignity or self-esteem of an individual. Examples include but are not limited to unwelcome sexual advances, sexual remarks or jokes, requests for sexual favors, and other off ensive verbal or physical conduct directed at an individual. Also, included in this defi ni on is the display of pictures, drawings or other items that are sexual in nature. Sexual Harassment “Severe Clause”: Situa ons in which the sexual harassment is directed toward a staff member.

Grades K – 5: Level III Off ense

First Off ense Required:

• Staff /student conference • Parent/Guardian no fi ca on and/or conference • Nearpod (SEL) lesson assignment(s) • Police no fi ca on, only if necessary • DOE eSchool Incident Report fi led as required by law Op onal: • Posi ve Behavior Support Plan • Deten on and/or Suspension 2nd - 5th grade only (1 day)

Subsequent Off enses Required:

• Staff /student conference • Parent/Guardian conference required upon return to school • Posi ve Behavior Support Plan • Referral to support services and/or

MTSS Problem Solving Team • Police no fi ca on, only if necessary • DOE eSchool Incident Report fi led as required by law • Deten on and/or Suspension 2nd - 5th grade only (1-2 days)

Viola on of Severe Clause Required:

• Staff /student conference • Parent/Guardian mandatory mee ng • Posi ve Behavior Support Plan revision • Increase support services and/or social service agency involvement • Police no fi ca on, if necessary • DOE eSchool Incident Report fi led as required by law • Deten on and/or Suspension 2nd - 5th grade only (1-3 days)

Grades 6 – 12: Level III Off ense

•Staff /student conference • Restora ve conference, if appropriate • Parent/Guardian no fi ca on and/or conference • Suite 360 (SEL) lesson assignment(s) • Police no fi ca on, if necessary • DOE eSchool Incident Report fi led as required by law • Deten on and/or Suspension (1-2 days)
