V. Releasing Students to Persons other than Parents or Legal Guardians

Other Defenses:

A. The physical loca on or me of access of a technology-related incident is not a valid defense in any disciplinary ac on by the school district or school ini ated under this policy provided there is suffi cient school nexus. B. This sec on does not apply to any person who uses data or computer so ware that is accessed through a computer, computer system, computer network, or other electronic technology when ac ng within the scope of his or her lawful employment or inves ga on of a viola on of this policy in accordance with school district or charter school policy.

Rela onship to School Crime Repor ng Law: An incident may meet the defi ni on of bullying and also the defi ni on of a par cular crime under State or federal law. Nothing in this policy shall prevent school offi cials from fulfi lling all of the repor ng requirements of § 4112, Title 14 of the Delaware Code, or from repor ng probable crimes that occur on school property or at a school func on which are not required to be reported under that sec on. Nothing in this sec on shall abrogate the repor ng requirements for child abuse or sexual abuse set forth in Chapter 9 of Title 16 of the Delaware Code, or any other repor ng requirement under State or federal law

School Ombudsperson Informa on: The telephone number of the Department of Jus ce School Ombudsman shall be provided in wri ng to parents, students, and faculty, and staff and shall be on the website of the school district and each school. The contact informa on shall also be prominently displayed in each school.

Informing Students of Electronic Mediums: Upon implementa on of this policy, and again at the beginning of each academic year, each school district and school shall inform students in wri ng of mediums where pos ng of speech will be presumed to be available to a broad audience within the school community, regardless of privacy se ngs or other limita ons on those pos ngs.

Rules and Regula ons: Implementa on of this policy shall comply with all rules and regula ons the Delaware Department of Educa on may promulgate to implement Title 14 Sec on 4112D of the Delaware Code.

RELEASING STUDENTS TO PERSONS OTHER THAN PARENTS OR LEGAL GUARDIANS/CUSTODIANS

A. PURPOSE: To establish uniform criteria for releasing students in the Brandywine School District to persons other than their parents or legal guardians/custodians at mes other than normal a er school dismissal.

B. ISSUE: O en students need to be released from school at mes other than normal release me. The Delaware Department of Educa on requires the Boards of all public school districts to adopt a policy on releasing students to persons other than their parents or legal guardian/ custodian at these mes.
