A bylaw that alters the rules around utility rates for renters has drawn the ire of landlords in Crowsnest Pass. On June 10, Sue Aris, who leases property in the Crowsnest Pass, appeared before council to express her frustration with the bylaw and anger over not receiving notification of the change. Effective July 1, the municipality will not enter into any new utility accounts with non-property owners. Effective next year on July 1, all nonowner utility accounts will revert to the property owner, not the tenant. According to Chief Administrative Officer Sheldon Steinke, in 2013 a total of $12,000 was transferred to property owners’ tax files from unpaid utility bills. The bylaw was changed to mitigate

that issue. Aris questioned the need for the change and argued the financial evidence did not support it. “I requested this meeting with council because I believe you made a bad choice in creating a bylaw that will have absolutely no net effect to the municipality but will have a highly detrimental effect on people like myself and other investors,” she said. First Aris said, landlords invest in the community, paying taxes and providing affordable housing and are direct supporters of economic activity. “Under the Municipal Government Act of Alberta, we are totally responsible for the delivery of municipal services already,” she said. Aris said she and her husband have invested over $2 million in property in the Crowsnest Pass and paid in excess of $80,000 in taxes. “This new bylaw has a significant effect on my

investment. It has a significant effect on other real estate investments in the Crowsnest Pass, on the way we structure our contracts, on the bottom line in the near and immediate future,” she said. “This illustrates contempt for investment and dialogue.” In the past, if an account was unpaid for two months, the tenant was notified. If the account remained unpaid after several months, the amount was transferred to the property owner’s tax roll. Aris said “the heart of the matter” was that she found out about the bylaw after it was passed and was not notified of the change. Instead, hearing it on the local radio station, she said, was misleading and insinuated that council had to take this action because “thousands of dollars of unpaid utility bills were being left for the good citizens of Crowsnest Pass to pay”.
