Two brothers plead guilty to manslaughter

The brothers c h a rg e d i n t h e 2006 death of Gabriola Island resident Michael Brophy are scheduled to be sentenced Friday (April 25) in Nanaimo. Timothy Maybin entered a guilty plea to manslaughter earlier in the month, while his brother, Matthew Maybin, entered a guilty plea to assault causing bodily harm, according to Crown counsel Carmen Rogers. Timothy Maybin and Matthew Maybin, who were 20 and 23 respectively at the time, were both charged with manslaughter following an October 2006 incident at the former Grizzly Bar at the Howard Johnson Hotel. The brothers were alleged to have fought with Brophy, who was 20 when
he died after being beaten unconscious. Buddha Gains, a bouncer at the bar and 39-years-old at the time, was charged with assault causing bodily harm, after he allegedly p u n c h e d B ro p h y while he was unconscious. Brophy died from internal bleeding in the brain. The three were acquitted in 2008 after a judge ruled that it could not be determined who struck the fatal blow or whether the three acted together. The Crown appealed the acquittals in 2010. The brothers appealed to the Supreme Court of Canada, but the judges upheld the provincial court decision and a re-trial was ordered in 2012, according to Rogers. The trial was scheduled to start in May. Rogers said Gains is expected to enter a guilty plea to assault causing bodily harm on the same day as the brothers’ sentencing. reporter@nanaimobulletin.com

A 77-year-old woman died from injuries sustained in a two-vehicle crash on Applecross Road Monday evening. The crash happened at about 8:45 p.m. when the woman, who was driving north on the 6500 block of Applecross Road, and her car collided with another car that was merging into traffic. Police said they believe the collision caused the woman to lose control of her car, which spun across the road and came to a stop after hitting a tree. The victim was rushed to Nanaimo Regional General Hospital, but later died. Three occupants of the other vehicle were not injured and remained at the scene. Several pedestrians, who were in the area at the time, spoke with investigators. B.C. Coroners Service attended and is helping Nanaimo RCMP’s Municipal Traffic Unit with its investigation. The woman’s family has been notified of her death, but the victim’s name has not been released. The investigation into the crash is continuing and Nanaimo RCMP is asking for any other potential witnesses to the crash to contact the RCMP Municipal Traffic Unit at 250-754-2345.
