The B.C. Supreme Court has rejected the provincial government’s effort to keep class size and special needs support off the bargaining table with teachers, and ordered the government to pay $2 million in damages to the B.C. Teachers’ Federation. In a ruling released Monday, Justice Susan Griffin said the B.C. government’s replacement legislation, passed in 2011, is as unconstitutional as the 2002 law called Bill 28 that removed class size and

special needs support from union working conditions. “The court concluded that the government did not negotiate in good faith with the union after the Bill 28 decision,” Griffin wrote. “One of the problems was that the government representatives were preoccupied with another strategy. Their strategy was to put such pressure on the union that it would provoke a strike by the union. The government representatives thought this would give government the opportunity to gain political support for imposing legislation on the union.” The ruling strikes down the portions of the new legislation that have not already expired. BCTF president Jim Iker said the ruling returns contract language that was in place in 2002, and he expects that the province’s 60 school districts will have to rehire teachers and special needs assistants to reduce class size. He said there were 1,200 education specialists affected by the 2002 legislation, including teacher-librarians

and counsellors. “It’s good for us, it’s good for public education, it’s good for British Columbia and for our students,” Iker said of Monday’s ruling. Education Minister Peter Fassbender said he is “disappointed” by the ruling, and ministry staff will study it before deciding on a possible appeal. Fassbender said he disagrees with the judge’s conclusion that the government tried to provoke a strike, and his focus is on reaching a new agreement. “What we need to do is to review the judge’s ruling in detail to see what the implications are, but clearly my message to school districts, to parents, is it’s business as usual in our schools,” Fassbender said. NDP education critic Rob Fleming called the ruling “real blow to the B.C. Liberals’ credibility,” adding it traces back to Premier Christy Clark’s time as education minister in 2002.

It is time to ring in the New Year - January 31 is the beginning of the Year of the Horse. In Chinese culture, the New Year is a time for family celebrations. Fire as well as the colour red play an important role as it represents the force that can drive back evil. Chinese immigrants have brought their traditions to North America. Fascinated by the ornate and exotic styles and beautiful images, more and more people are looking at bringing a part of the culture into their world as well. A big part of Chinese culture is the garden. The Dr. Sun Yat-Sen Classical Chinese Garden in Vancouver is an authentic and stunning example and the first of its kind outside of China. It took 52 master craftsmen from China and their Canadian counterparts a year to build this garden, using time-honoured principles and techniques of the Ming Dynasty. While you might not have the time or space to create a full-scale Chinese garden at your home, you can certainly take inspiration from the traditional design and bring a bit of exotic Chinese culture into your yard. Traditional Chinese gardens are made for reflection and escape from the outside world. They aim to create an idealized miniature landscape that shows the harmony that should exist between mankind and nature. There are six elements in Chinese garden design. Architecture plays a major role in Chinese gardens with pavilions, gazebos, towers, bridges and more placed to offer spaces from which to get unique views of the garden. They are meant to never dominate a landscape, but always be in harmony with the other elements of the scene. Artificial mountains or rock gardens are another essential element of the garden with mountain peaks being a symbol of virtue, stability and endurance. In smaller gardens, a single scholar rock can represent the mountains. Ponds, lakes or other water features are almost always the central element of a Chinese garden. Water complements the mountain element and represents lightness and communication. There is usually a central structure for viewing the pond and often pond fish and water plants are added. Trees and flowers are the fourth essential ingredient in the Chinese garden. Plants represent nature in its most vivid form, contrasting with the straight lines of the architecture as well as the immobility of the rocks. Each plant is carefully chosen for its own symbolic meaning and placed to maximize the impact it has in the landscape throughout all seasons. The remaining two elements are more abstract, but to some Chinese garden designers the most important ones. “Borrowed scenery” is using scenes outside the garden, such as a view of distant mountains or the trees in the neighboring garden, to make the garden appear much bigger than it actually is. The seasons of the year and the time of day are also taken into account, looking at when a certain part of the garden presents itself to its fullest potential. Building on that is also the element of concealment and surprise. A Chinese garden is not meant to be seen all at once, rather it is a series of carefully crafted scenes. Visitors move around with scenes unfolding at the last minute from behind a screen of plants or through an opening in a structure. With these design guidelines in mind, you can have a fresh look at your yard and create a magical place with an exotic flavour. The Cranbrook Skating Club is celebrating its 60th anniversary in 2014 and we are having a celebratory Ice Show on Saturday, March 1st at Western Financial Place. The theme of the show is “Celebrating the Decades” so costumes and music will be reminiscent of the past 60 years. We are including several East Kootenay Skating Clubs in this Ice Show, plus we have special guest skaters from Calgary - Keelee Gingrich and Davin Portz, who were recently crowned the Novice Pairs Champions of Canada. Over 150 members of the Cranbrook Skating Club, from our tiny tots to our Adults will be participating and we will be showcasing some of our very accomplished competitive skaters as well. Doing good things for your fellow citizens once in a while is something that comes naturally to most people. Doing good things for

your community on a consistent basis is the criteria for becoming Cranbrook’s Citizen of the Year—which was recently awarded to

Ken Bridge. Throughout the years he has been in business with Bridge Interiors, Bridge has worked with

the Canadian Cancer Society’s Relay for Life, the Children’s Christmas Party, the Cranbrook Dodge Charity

Golf Tournament and a host of other fundraisers. Never afraid to put some miles on for a good cause, he has also raised funds in the Walk for M.S., the Telus Walk to Cure Diabetes and the Walk a Mile in Her Shoes fun-

The ICE went undefeated through round robin action beating the Bow Valley Flames, St. Albert Xcel, and the Northwest Warriors. The Rocky Mountain District of the Ministry of Transportation and Infrastructure is creating its list of registered Equipment for Hire in the East Kootenay Service Area for the fiscal year 2014/2015, which begins April 1, 2014. This area includes the United States border south at Kingsgate and Roosville, west at Yahk, east to Pink Highlights the Alberta border and north to Brisco on Highway 95. All individuals or companies registered this past year through the District Office in Cranbrook will be receiving invitations to re-register their equipment for the coming fiscal year by mail by the end of February.


Any individuals or companies who were not registered in 2013, but wish to have their equipment listed, are hereby invited to contact the District Office, either in person or by phone, to obtain the appropriate registration forms. Note that while you do not need to have Commercial (Comprehensive) General Liability Insurance or up-to-date WorkSafeBC coverage to register, you will have to meet these requirements prior to working on any ministry projects. Only owned or lease-to-own equipment is eligible for registration. Equipment can EXCLUSfrom only be registered in one area in any given year. Seniority is not transferable IVE area to area. Monday, February 10th marks BC’s second Family Day. To celebrate, bring your family to Horseshoe Lake from 10 a.m.-3 p.m. for a day of Kootenay outdoor festivities. The Family Fishing Derby for Kids with Cancer is being held for its fifth year and is a local fundraiser to help families across the entire Kootenay area. The main attraction is the ice fishing derby which has reeled in crowds of up to 1,500 to compete for the first prize fishing boat and trailer, generously donated by FabRite Services. There is also a 50/50 draw, door prizes, silent auction, and hot chili at the event. For the kids, there are toboggan races, ice bowling, snow painting, tug-owar, toboggan decorat-

ing, and hockey with the Kimberley Dynamiters. New this year, there is also a supervised Morrison shooting gallery. Designed for the whole family, you can even bring your furry family members (on leash) to compete in the best dressed dog contest. As a special bonus, for the fourth consecutive year, the Family Fishing Derby and Dacota Freight will be drawing the name of one child with cancer and their family to go to Disneyland with $1,000 spending money. All of the other funds raised are distributed as emergency aid. In true Kootenay fashion, this event is about families helping families through outdoor fun. Unfortunately I was unable to keep him as I have three indoor cats and one outdoor cat that he did not get along with. I tried privately to find a home for him and when I couldn’t I had to surrender him to the BC SPCA. I found out last week that they had euthanized him. I hope you are happy with the choice that you made for this wonderful cat! This senior had walked to Superstore with the help of a walker to do her weekly grocery shop. At the checkout, she realized her purchase was $40.00 but she only had $25.00 cash. She became flustered. Donna asked if she had her cheque book with her. Donna then wrote out her cheque, bagged her groceries, then put them on the walker. What a great act of kindness. I just hope there is a Donna around for me if I should need one in my senior life. Hugs: First of all, a big hug to you for keeping our community informed of all the good things that happen here. Secondly, big, big hugs to the City of Cranbrook public works crew that came out on Saturday morning and saved my house from immense water damage when the water main in my back alley broke.  Thank you to the young man who responded so quickly after my harried phone call to the Fire Department. He arrived within minutes and quickly proceeded to barricade the water that was pouring into my back yard (it was all under water). Within a half an hour, the pumper truck was there to pump the water out, then the back hoe, the city engineers and the crew, efficiently and without further ado, dug up the pipe, replaced it and all was well! Thank you, again for all that you do!

It is with deep sorrow that the family of Eva Whitnack announces her passing on January 22, 2014 in Cranbrook, British Columbia at 84 years of age. Eva was born to the late Einar and Mathilda Jordahl on August 23, 1929 and raised in Coronation, Alberta. Eva fell in love with the late Edward Lee Whitnack who was also raised in the Coronation area and they were married there on June 26th, 1947. They raised their family there and in 1970 Ed and Eva moved to Summerland. In 1981 Ed passed and Eva moved to Sylvan Lake until 1990 and then moved to Marysville. Eva was an active member of the Ladies Auxiliary in Coronation and Summerland, She enjoyed working and beautifying her yard and having family get togethers at every opportunity where she could show her loving and giving nature to all her family. Eva is survived by her 4 children; daughters Carol Venables and Diana Carnahan of Marysville, sons Larry (Brenda) of St. Albert and Ken (Joanne) of Sooke, 8 grandchildren, Teena (Sonny) Montgomery, Cody Carnahan (Crystal), Robert Carnahan, Lee Whitnack (Judy), Tammy Whitnack, Clayton Whitnack, Jim Whitnack (Dajana), Kelly Whitnack (Sarah), 17 great grandchildren, 1 great great grandchild, sister Anna Carl of Red Deer and brother Ted (Donna) Jordahl of Castor, and lots and lots of wonderful nieces and nephews; as well as numerous other relatives and friends. She was predeceased by her parents Einar and Mathilda Jordahl, husband Edward, 6 brothers Victor, Norman, Roy, Johnny, Tommy and Raymond, 3 sisters Dorothy, Helma Twila, and son-in-law Raymond Venables and other family members. There will be a memorial luncheon for Eva in the spring as Mom would not like anyone driving in the winter. Thanks to all nurses doctors, friends and especially the Home Care Nurses and all the wonderful ladies who helped Mom over the last few months.
