RESORT ZONING

A Kimberley man, aged 20, will face charges of Impaired Driving and Theft of a Vehicle after being involved in an accident on St. Mary Lake Road, Kimberley RCMP Cpl Chris Newel reports. Newel says the incident occurred at about 8 p.m. on Monday evening, August 19, when reports were received of a vehicle being driven in a reckless manner on 4th Avenue in Townsite. The caller believed the owners of the truck were out of town. Newel said more reports of the erratic driver were received and then an accident involving a vehicle of that description was called in. “Police learned the truck had been involved in a collision in the Kimberley Nature Park near Riverside Campground on St. Mary’s lake road,” Newel said. “The driver was assisted by campground staff prior to po-

lice arrival. Once on scene police noted signs of impairment and he was arrested.” Newel says two breath samples were taken and registered two and a half times the legal limit. The registered owners of the truck were contacted and it was confirmed that it was stolen. “Police appreciate the assistance of a number of persons who called in, this lead to the successful apprehension and arrest.” Because these charges are Criminal Code, and not just an Immediate Roadside Prohibition, rules on impounding the vehicle are different, Newel said. In this case the vehicle was not impounded. Police appreciate the assistance of a number of persons who called in, this lead to the successful apprehension and arrest. The subject will be attending court in early October where police will be recommending a number of charges.

Council discusses rental covenants on ski hill

New bylaw will allow Sullivan Stone units to be removed from rental covenant C AROLYN GR ANT editor@dailybulletinca

The City of Kimberley will be adopting a

new bylaw dealing with rental covenants (it received first three readings last week). The bylaw will release one about-to-besold unit from Sullivan Stone from the rental covenant and allow City staff to make decisions on any other releases from the covenant as long as there is no cost to the City. Council felt comfortable with this as Sullivan Stone is a standalone development, in

that it has no property management company handling its rental units. A local realtor had requested that the one unit be released from the rental covenant because the buyer wished to live in it year round. Council has had many discussions over the years around the covenant, as the issue of releasing a unit has come up more than once.

Some Councillors feel that all the accommodation on the ski hill should be under the covenant in order that there always be plenty of units available. However, others feel that there is a lot of available product on the hill. In a report to Council from the Manager of Planning Services Troy Pollock, Council was told that there are 887 units in Kimberley that may be used as visitor accommodation.
