City Bylaws
No free parking

Kimberley’s parking lot bylaw is up for renewal, and as there was the last time it was renewed, there is considerable protest about its fairness. At the heart of the issue is whether it is fair that those businesses who supply parking for their customers, and pay taxes on them, should also pay a portion for the City parking lots around the Platzl, as required by the bylaw. Several business owners feel they should not. A petition against renewal of the bylaw was started, led by Eric Martens of Wineworks Kimberley, who led the charge last time. Only 18 signatures were received opposed to the bylaw. Stopping it from proceeding would have required 50 per cent of business owners and 50 per cent of assessed value. However, Council was not unsympathetic to the petitioners. “Mr. Martens presents a compelling case on the need to make some adjustments,” said Mayor Ron McRae.

Grade 3 students from Marysville Elementary participated in its 3rd annual Our Community Project. The objective of the project is to break the grade 3’s down into small groups so they can interact with different community locations. Some of the locations the students visited this year where The Fire Hall, City Hall, RCMP, Post Office, Ambulance Station. Students would ask questions and gather information to create their power point presentation, then present to their classmates. Mr. James Weir and the grade 3’s of Marysville would like to thank the community locations for their support. Also a thank you to City Bakery and Our Place for allowing us to have our snack there. Over the years Mr. James Community Link SD6 has partnered with many community business to provide excellent programs and projects. Kimberley City Council is following recommendations from the Urban Deer Advisory Committee and raising fines for feeding deer within the City. It can now cost you up to $500 to feed deer. Council gave the first three readings to the amendment to the Deer Feeding bylaw
on Monday evening. It will be adopted at a special Council meeting on December 17, 2012. “I’m very happy to see this move forw a r d ,” said Coun. Darryl Oakley, Council representative on the Deer Committee. “All the recommendations from the Committee Report are in movement now. The recommendations are very important pieces of a comprehensive
ungulate management program, which I believe will become a model for all BC communities.” The bylaw is meant as a compliance tool, Oakley said. The fines can be hefty, but the maximum fine is meant for those who simply refuse to stop feeding deer, after several warnings. “It is discretionary, up to the bylaw enforcement officer,” he said.

Coun. Albert Hoglund questioned the section of the bylaw where it stated it was contrary to the bylaw to “cause deer to be fed”. “Does that mean if I have a bird feeder, I am causing deer to be fed?” Oakley said that was the case. “Fruit trees too. If you are not picking your fruit, you are causing deer to be fed.” He did stress that all these instances were up to the discretion of the bylaw officer.
