The mining buzz may be one of the reasons why building values in Quesnel reached $1.96 million in the first four months of this year, with residential and commercial permits at the highest level since 2008. The average detached house price in Quesnel, at $185,525, is among the lowest in B.C. and down 10 per cent from 2011. â&#x20AC;&#x153;We now have [residential] investors coming from the Lower Mainland,â&#x20AC;? But visit the historic Cariboo centres of Williams Lake and Quesnel and it is clear that residents â&#x20AC;&#x201C; and the economy â&#x20AC;&#x201C; are as resilient as the gold rush pioneers who made the region famous. â&#x20AC;&#x153;The current mountain pine beetle epidemic in Interior British Columbia will result in a drastic decrease in timber supply in some areas, with potential for significant negative economic and social effects to the forest industry and forestry dependent communities,â&#x20AC;? the governmentâ&#x20AC;&#x2122;s 14-page Mid-Term SupplyReport reads. The study noted that the beetle-killed timber could run out in as little as two years in some areas, forcing local saw mills to shut down. But â&#x20AC;&#x153;old newsâ&#x20AC;? is the response in the two communities singled out for â&#x20AC;&#x153;concern over the short- and medium-term sustainability.â&#x20AC;? â&#x20AC;&#x153;We know all about this,â&#x20AC;? said Alan Madrigga, who heads the Williams Lake economic development office, noting that Cariboo communities have been preparing for the end of beetle-kill wood since 2006. Council of Forest Industries president John Allan was also not surprised or shocked by the report. â&#x20AC;&#x153;My board last year identified future timber supply as the number one issue for the industry,â&#x20AC;? Allan said. â&#x20AC;&#x153;I mean, there is no secret the annual allowable cuts are going to have to be adjusted downward in the coming years to account for the impact of the mountain pine beetle.â&#x20AC;? As Allan notes, the dire forecasts are based on current assumptions. He stressed the job losses will occur only â&#x20AC;&#x153;if nothing changes.â&#x20AC;?

Giffic, who leads the economic development arm for the City of Quesnel. Giffic said about one-third of the 400 workers at the nearby Gibraltar Mine, the secondlargest open-pit copper mine in Canada, commute from Quesnel. Production this year at the nearby Mount Polley mine, owned by Imperial Metals, is estimated at 34 million pounds copper, 46,800 ounces gold and 90,000 ounces silver. The $463 million Spanish Mountain Gold Mine, which is located between Quesnel and Williams Lake, could also be starting up in the near future, generating at least 280 jobs. A biomass pellet fuel industry is also thriving around Williams Lake, where Wal-Mart opened its first supercentre in northern B.C., a new retail centre is underway and a $4.3 million Best Western Hotel opened last month. And, from here to Quesnel, mining has resurfaced in the traditional heart of the gold rush.

Mining is a sensitive issue in Williams Lake, the Caribooâ&#x20AC;&#x2122;s largest city. While forestry jobs are threatened, its 18,500 residents are livingnext to a world-class gold deposit. Taseko Mineâ&#x20AC;&#x2122;s Prosperity motherlode holds 13.3 million ounces of gold and 5.3 billion pounds of copper, representing the seventhlargest undeveloped gold-copper deposit in the world. If Prosperity goes ahead it would be a game changer for the Cariboo, generating 71,000 jobs and $11 billion in GDP over 20 years, according to Taseko. It could also turn Williams Lake into a B.C. mining hub. Over the past four years, Taseko has completed a feasibility study and has gone through provincial and federal environmental assessments. erhaps the strongest evidence of a recovery in the Kootenay recreational market is the sale of ranchsized acreages at the exclusive Ranches at Elk Park just outside of Radium Hot Springs. Prices range to nearly $3 million â&#x20AC;&#x201C; and that is just for the land. â&#x20AC;&#x153;We have sold two lots and we have holds on two others,â&#x20AC;? said Rudy Nielsen, founder and president of Niho Land & Cattle Company, which is marketing the ranches through its subsidiary LandQuest Realty. Prices roam from $9,000 per acre for small parcels to around $2,100 per acre for 400-acre and larger ranches. The 3,500 acres at Elk Park, a gated ranch community and perhaps the only one in B.C., are divided into 16 ranches, from 36 acres to 480 acres. The two lots that sold â&#x20AC;&#x201C; one to a retired Edmonton oil executive â&#x20AC;&#x201C; are both in the 100acre size, as are the two with pending sales. The Ranches at Elk Park are what Nielsen calls a â&#x20AC;&#x153;rare collectionâ&#x20AC;? of recreational private estate properties. The ranches are framed by Kootenay National Park and the Columbia Valley and prices range from $390,000 to $2.95 million for 200 plus acres with a lake. â&#x20AC;&#x153;This is a very exclusive opportunity,â&#x20AC;? said Nielsen, 70, B.C.â&#x20AC;&#x2122;s most prolific land dealer. In the last 40 years, heâ&#x20AC;&#x2122;s put together thousands of successful real estate deals, involving tens of thousands of acres, from small plots to ocean islands, to entire town sites and huge farms

area, grabbing more than 2,000 residential properties and more than 600 plots of vacant land, with the Columbia Valley figuring large. With the BC/Alberta border so close to Calgary, the Kootenays were a natural lure. Then the oilfueled global economy stalled and Albertans went quiet; in 2010 Albertan purchases were off by more than 70 percent or 756 sales o f residential properties. However, with the global economy swinging back and oil now north of US$100 a barrel Nielsen expects a resurgence of Alberta buyers into the Kootenays. â&#x20AC;&#x153;Our sales team says the number and quality of calls coming out of Alberta has increased substantially, compared to anytime from mid2008 to late 2010, â&#x20AC;&#x153; Nielsen said. That much is clear about Grande Prairie’s bustling new Eastlink Centre, a $111 million investment in the quality of life of the residents of one of Alberta’s most active communities. The super-sized leisure and aquatics centre on the city’s south side opened in late 2011, and its attraction for both local residents and the business community has been obvious. Roughly 2,600 people pass through the building each day, and the City of Grande Prairie has sold over 4,500 memberships in five months, a thousand more than what it had projected for the year. “It really has addressed a gap in the community for indoor recreation,” explained Glavin, the city’s economic development officer. It’s Glavin’s job to help sell the city, and the Eastlink Centre makes it easier. He says it recently played a role in one professional services firm’s decision to locate in the northwest Alberta regional service centre. Glavin says the new complex was definitely envisioned as more than something to meet basic recreation and leisure needs. “It was partially to satisfy local demand here, but also part of the strategy to retain people here in the city and attract people to the city.” The latest building and development data suggest it might be doing that. While Canada Mortgage and Housing Corp. (CMHC) stats say housing starts were down somewhat in GP for the first three months of the year, from 60 to 45, other numbers paint a positive picture of growth. In the words of Walter Paszhowski, a former area MLA who still handles the economic development duties for the county: “Things are going quite well.” “It looks like a good year,” Paszkowski said of 2012 prospects. “It’s going to build on the regrowth of 2011, and it certainly appears that 2012 will improve on 2011 by a fairly significant amount.”

The county’s building-permit values totalled roughly $885 million from 2007 to 2011, with the peak coming in 2007, when permit values hit $312.7 million. They fell to $100.4 million in 2010, but bounced back in 2011 to $151.6, and Paszkowski expects that number to climb again this year thanks to a general increase in activity. “What we’ve got here is a pretty good balance of agriculture, energy, forestry and, to a growing degree, tourism. We have close to 3,000 hospitality suites in this community. Those four are the drivers,” he said, explaining how Grande Prairie’s reach is expanding. “It’s generally growing in all directions as the quality of service delivery improves and grows overall.” Unlike Fort McMurray, Grande Prairie isn’t known for overpriced housing beyond the reach of many in its workforce. The average price for homes sold in mid2011 was in the $260,000 range, according to the Grande Prairie & Area Association

owntown Saskatoon now has the lowest office vacancy rate in North America, perhaps the world, as the rate plunged to 1.7 per cent in the first quarter of this year. The Class A vacancy rate is even tighter, at 0.9 per cent. Demand has also driven the suburban office vacancy rate down, to 8.8 per cent, compared with 12.4 per cent at the end of last year. This year, North Prairie Developments began building two new suburban office buildings that will add 25,000 square feet. Other new office projects include the 33,000-square-foot Nexus project on 2nd Avenue North, which is fully preleased, and the 78,00-square foot River Centre on 2nd Avenue South that has 90 per cent of its space leased. Last month construction started on a 50,000-squarefoot office building on Wall Street. A stadium with a retractable roof would cost $450 million to build, while an open-air stadium would cost $250 million, according to estimates. The city is hoping to hear back from the provincial government by June so it can decide what style of stadium should be built. Regina Mayor Pat Fiacco has outlined plans for a multi-year $1 billion stadium and innercity revitalization project. The plan involves redeveloping the 33-acre CP Rail yard and the current Mosaic Stadium site. The work involves demolishing Mosaic Stadium and building a new stadium in addition to 700 housing units and commercial and retail businesses.

Fiacco told reporters that 75 per cent of the overall project would be funded by the private sector, but provincial government funding would be a requirement for the project to go ahead. Ken Cheveldayoff, the provincial cabinet minister responsible for the stadium file, said the province is still reviewing the request. He added the government would discuss ways it might consider funding the project, such as a loan or grant or combination of both. â&#x20AC;&#x153;We havenâ&#x20AC;&#x2122;t had a chance to do our due diligence on it, and I think it would be inappropriate for me to give any more information on a document that the city has put forward,â&#x20AC;? Belle Plaine, population 70, about 20 minutes from both Regina and Moose Jaw, is at the centre of a heavy industrial makeover of southern Saskatchewan. Designated as the Belle Plaine heavy industrial node because of its location on Highway 1 with CP Rail and CN Rail access nearly right on the U.S. border, the area has already seen massive industrial construction. The only thing more common in Belle Plaine than hard hats and big trucks, it appears, are rumours. The one flying around Chubbyâ&#x20AC;&#x2122;s these days is that a B.C. investment group has bought up a huge swath of land for a residential subdivision, perhaps with some retail competition. That rumour is true, according to consultant

Industrial Corridor Stakeholders Committee, which is mapping industrial development from Moose Jaw to Regina. More than $22 billion in major projects are slated for the province, and much of it will take place in this southern corridor. â&#x20AC;&#x153;There is a corridor bounded by the TransCanada Highway on the south, the existing and proposed Dewdney Avenue extension on the north from Moose Jaw to Regina and three main nodes of development within this rectangle,â&#x20AC;? Mercer explained. Three small towns in the corridor, including Belle Plaine, will have a buffer zone to separate them from the industrial projects. â&#x20AC;&#x153;We are in the final stages of completing the official community plans for the three small

Belle Plaine represents a near-ideal area for large-scale industrial projects. The land is flat, transportation is excellent and it is close to two of the fastest-growing urban centres in Saskatchewan. Land values for industrial sites â&#x20AC;&#x201C; which have averaged $2,000 per acre â&#x20AC;&#x201C; are a fraction of that in Regina or Moose Jaw. â&#x20AC;&#x153;Belle Plaine is a sweet spot for developers,â&#x20AC;? Mercer said. Belle Plaine is already the site of theMosaic

Potash facility, which employs 700 and is undergoing an expansion, and the Kalium Potash mine. The worldâ&#x20AC;&#x2122;s largest nitrogen fertilizer complex, Yara Belle Plaine, is right across the road, and the Nachurs fertilizer plant is nearby. Alpine Plant Food opened a $9 million facility in 2009 and theTerra Grain Fuels is in full operation. Proposed developments include plants by TransCanada Polygeneration, which would process low-grade oil, and ETX Systems, which is said to have bought 160 acres in the area. K+S Group, which owns Canadian Salt near Belle Plaine, is planning a new potash plant in the area, with production scheduled to start in 2015. In all, Mercer estimates that more than 1,000 people now work in the heavy industrial plants that surround Belle Plaine, but most of the workers commute from larger centres. Real estate agent Neil Sundeen of Hatfield Valley Agencies expects that to change. Sudan said he has investors from across Western Canada calling him about land in the area. Last month he listed a 139-acre greenfield parcel about 200 metres from Chubby. â&#x20AC;&#x153;It is right on Highway 1,â&#x20AC;? Sundeen said, adding it would be well situated for residential or commercial development. The aggressive asking price is $995,000, or about $7,000 an acre.â&#x2014;&#x2020;

apid population growth, a booming economy and strong demand for housing are all characteristics of a big city, but officials in Brandon believe one thing is missing – a bustling airport.

Manitoba’s second-biggest city finally cracked the 50,000 mark in population, according to the most recent census, but its potential could go to the moon if only its people could take to the air. The airport is well used by an immigrant workforce that has made the city among the fastest growing in Western Canada. In 2010, more than 1,400 immigrants arrived in Brandon, double the number of four years eartlier. Seventy per cent of the 2,100 employees at Maple Leaf Foods, the city’s largest employer, come from Asia, South and Central America, and the Ukraine. That’s among the reasons Brandon’s mayor, Shari Decter Hirst, is hoping to convince WestJet to add the city to its list of new destinations next year. “We put together a very solid business case for WestJet, including looking at what enhancements they’re needing for our airport and what it will cost. We’re continuing to answer all of WestJet’s questions and we’re keeping the lines of communication open. We are really looking forward to having regularly scheduled air service to the city,” she said. The waiting, she noted, might be the hardest part. “It’s like being a teenage girl sitting by the phone waiting for a call to the prom,” she said. The city could support east-west business travel – many local executives currently drive to Winnipeg so they can fly to Calgary or Toronto – as well as the leisure and sun mar-

But having regularly scheduled air service is about more than just convenience, it’s fundamental to the quality of life in Brandon according to Sandy Trudel, the city’s director of economic development. “Time is money and for our executives to have the ability to fly where they need to go from our doorstep is a huge piece of the pie that we’re trying to secure. It could take Brandon to another level,” she said. WestJet won’t make a decision on any potential new routes until later this year, according to company spokesman Robert Palmer. “We’re still six to 12 months away from making any sort of announcement of where we’re going to fly with our new aircraft. At this point, nobody is on the list. There is no list. We’re looking at everybody who has expressed an interest and that includes upward of 30 com-

munities across Canada and Brandon is, of course, one of them,” Palmer said. Much has changed in Brandon over the last year – much of it related to the weather. The spring flood of 2011, a once-in-350-years event, caused rotating states of emergency and forced the evacuation of 1,700 houses and businesses. “It was all hands on deck, 24-7, sandbagging and building the dikes higher. This year is a walk in the park,” Hirst said.

“Housing is expensive, developers are going crazy trying to keep up with demand and we’re working with our community partners to push through affordable housing. We’re delighted to be growing this fast but it certainly does cause some challenges.” The 2011 census also pegged the city’s popu-

lation at 52,000, an all-time high, representing 11 per cent growth from the previous census. That growth puts it on par with communities such as Calgary and Edmonton. Anybody who has driven around town lately or tried to get a table in a restaurant knows about the influx of people, but Hirst and Trude are happy to have outside confirmation o f breaking through the psychological 50,000person barrier. “It’s growth all the time, we’re a boom city,” Hirst said.

We have postsecondary, training for oilfield workers and we have great services around machining and welding, the nuts and bolts that keep the oilpatch running. We’re trying to anticipate the needs so we can have them ready,” she said. If that wasn’t enough, the city’s downtown is on the rebound, too, with construction of a new police station nearing completion and a new YMCA also being built. “The Y is going to be a redevelopment [hub] within the downtown. It’s an anchor,” Trudel said. The flurry of activity is putting upward pressure on housing prices.

Michael Barrett, president of the Brandon Real Estate Board, said a typical home would fetch about $240,000 today, up 6 per cent from a year ago. Brandon has two types of houses: older stock built about 40 years ago – many of them are 1,200-square-foot bungalows or 900-squarefoot bi-levels – and new properties between

1,200 and 1,500 square feet. The latter have double- or triple-car garages, ensuite bathrooms and walk-in closets, standard features that were once the exclusive domain of the city’s high rollers. “People have more means today,” he said. Spurring sales is the fact that many of Brandon’s immigrants have decided to settle in the community, sponsoring their families – which takes a minimum of six months – and buying homes. “It still looks like a seller’s market. Every time it starts to look more balanced, it goes back to a shortage of inventory, particularly for homes under $220,000,” Barrett said.

But it’s not all days of wine and roses. Brandon has a $165 million deficit and 20 per cent of its infrastructure is 100 years old. Hirst said she’s going to approach the province and the federal government about helping out with the necessary funding. “We have huge needs driving expansion and yet we still don’t have the capacity to repair our infrastructure. We need pipe in the ground, asphalt, sidewalks and lift stations [which keep water and sewage moving over distances],” Hirst said. The city also has to deal with new federal legislation that comes in July 1, which requires higher English proficiency for immigrants arriving under Manitoba’s foreign workers nominee program. Salad Loop sued by B.C. franchisee

A

franchisee has filed suit in BC Supreme Court against North Vancouver-based Salad Loop Group Investment Inc., the franchisor of Salad Loop salad shops. Vancouver-based SCH Enterprise Ltd. filed a civil claim April 26 against the franchisor, alleging that Salad Loop Group breached a franchise agreement. SCH claims that, as part of franchise discussions, Salad Loop Group principal Sean Kim promised SCH a 10-year lease term for a store location at 819 West Pender Street, advising that it would be based on a five-year lease and an optional five-year renewal. “It was fundamental to SCH that there be a stable location to operate the business and having 10 years to operate met SCH’s requirement,” the court document stated. The court document alleges that SCH paid approximately $190,000 to purchase the franchise from former franchisee Kwok & Tse Investment Inc. It further claims that, after the deal closed, SCH principal Huang Su-Chuan Yang again stressed to Kim the importance of having a 10-year operating term. “Mr. Kim confirmed that SCH would have the 10 years and that he would ensure that the option to renew would be exercised by Salad Loop Group under the head lease,” the document contended. However, the suit allegeed, “Salad Loop Group negligently failed to notify the landlord of the option to renew for the five years under the head lease and as a result the option was no longer available.” The plaintiff claims that Salad Loop Group “fundamentally breached” the franchise agreement with SCH or alternatively “repudiated the franchise agreement and SCH accept-

ed the repudiation.” SCH is seeking a declaration that Salad Loop Group fundamentally breached the franchise agreement and damages. None of these allegations has been proven. As of press time, no statement of defence had been filed. xpanding on an already extensive relationship, ATM giant U.S. Business Group, Cardtonics, has been named the exclusive provider to all 7-Eleven Inc. stores in Canada and will soon serve the convenience store chain in the United States. Cardtronics’ new portfolio of 7-Eleven Canada-located ATMs begins at a machine count of 472. Cardtronics expects to complete deployment of new Cardtronics-owned ATMs for all 7-Elevens in Canada this summer. “7-Eleven has the largest ATM network of any retailer in the United States, with Cardtronics providing ATM services to the vast majority of 7-Eleven ATMs,” said Rick Updyke, president, U.S. Business Group, Cardtronics. Cardtronics first entered the Canadian market with nearly 600 ATMs in late 2011 with its acquisition of Mr. Cash. Based in Dallas, Texas, 7-Eleven operates franchises or licenses more than 9,100 7-Eleven stores in North America. The Enright Group, a leading Boston Pizza franchisee, also has plans to open a franchise in Steinbach, company co-owner Boston Pizza sees Manitoba as prime area Richard Enright said. The two additions will give Enright for growth. Group, owned by Enright and his wife, Kim, 13 Boston Pizza franchises in the province. It already has nine in Winnipeg and one each in Selkirk and Portage la Prairie. But they have no intention of stopping at 13 restaurants. “There is a demand for our brand, and there are still a number of areas where there’s lots of potential [for expansion], including west Winnipeg and out by Sage Creek [in southeast Winnipeg],” he said. Manitoba franchise rules are changing

ffective this October 1, Manitoba will have a new franchise law that codifies statutory enshrinement of franchisee rights. The province follows Alberta, New Brunswick, Ontario and Prince Edward Island, which have similar legislation. This means franchisors in Manitoba will be required to provide prospective franchisees with franchise disclosure documents (FDDs). Overall, the disclosure requirements for Manitoba are fairly consistent with the other provinces, as well, so national franchisors should be able to work with their lawyers to smoothly augment existing FDDs with the changes needed for Manitoba, according to Chad Finkelstein, a franchise lawyer at Dale

This should facilitate the efficient delivery of FDDs from franchisors located in other provinces or outside of Canada entirely. Another technical requirement that is unique to Manitoba is that FDDs need not be delivered “as one document at one time.” In other provinces, franchisors must ensure that the franchise disclosure document is delivered as one fully assembled package all at the same time, and not in installments.
