biotechnology leadership In

two simple words our theme for this issue of insights, “Discover Canada,” summarizes quite a bit. Firstly, Canadian research and discovery among our innovation sectors is strong. Canadians are discovering. Progress in biotech is growing rapidly and, according to the Conference Board of Canada, our talent is on par with global standards.

We have witnessed increased federal funding for programs related to biotechnology, and as one of our contributors will share with you, our companies are entering the next stage of business development, fostering international partnerships and drawing attention from global investors.

Secondly, Canada has a nurturing environment for business development. Discover all the benefits this country offers in terms of low costs of doing business, access to funding programs, human resources and public support for the technology. In fact, in its annual Competitive Alternatives study, KPMG consistently ranks Canada as one of the most cost-effective nations in which to do research.

On the subject of public support, in late 2005, BIOTECanada conducted a poll on public perceptions of biotechnology in Canada. An overwhelming majority of Canadians, 84 percent, agreed biotechnology will benefit health sciences, genetics and agriculture. Canadians recognize the vital role biotechnology plays in the economy. From the research undertaken to the products produced, from the people employed to our improved environment, Canada looks to create new opportunities for our industry.

The contributors to this issue of insights offer unique perspectives on why you should Discover Canada. Quebec City’s Medicago Inc. outlines the benefits of partnering with a Canadian company, and our legal perspective feature outlines the top things you need to consider when entering into a partnership. Discover a Canadian success story from Halifax, Nova Scotia. MedMira’s rapid HIV test is reaching international markets, and the company shares their experience.

Canada’s bioproducts industry is also growing. BIOTECanada is partnering with BIO to bring the World Congress on Industrial Biotechnology and Bioprocessing to Toronto, Canada, this year (July 12–14). En effet, les Canadiens effectuent de nombreuses découvertes; la biotechnologie progresse rapidement, et, selon le Conference Board du Canada, nos chercheurs sont à la hauteur des normes internationales. De plus, on remarque une augmentation des aides fédérales pour les projets en lien avec la biotechnologie. En outre, comme l'un de nos collaborateurs vous l'expliquera, nos entreprises arrivent à une étape de leur développement où elles établissent des partenariats internationaux et suscitent l’intérêt des investisseurs à l’échelle mondiale.

Deuxièmement, le Canada dispose d’un environnement très favorable au développement des entreprises. Pour le savoir, vous n’avez qu’à passer en revue tous les avantages offerts par ce pays en matière d’économie pour les entreprises, de programmes de subvention, de ressources humaines et d’appui de la population aux biotechnologies. Pour preuve, l’étude internationale Competitive Alternatives de KPMG range année après année le Canada parmi les pays les plus rentables en matière de recherche.

En matière de l’appui des biotechnologies par la population canadienne, vers la fin de l’année 2005, BIOTECanada a mené un sondage pour prendre le pouls de la population vis-à-vis des biotechnologies. Résultat : on constate qu’une immense majorité de Canadiens, soit 84 p. 100, croit que la biotechnologie aura des effets positifs dans les sciences de la santé, la génétique et l’agriculture. Les Canadiens s’entendent pour dire que la biotechnologie est un élément essentiel de l’économie. Que ce soit par la recherche ou par la fabrication de produits, par les personnes engagées ou par un environnement hautement favorable, le Canada cherche à créer un lieu propice au développement de notre secteur.

La rubrique « Le point de vue du fédéral » dresse la liste de nombreux programmes qui stimulent le développement des entreprises au Canada. En tant qu’association nationale, nous avons créé de nouveaux moyens pour aider les innovateurs et les entrepreneurs canadiens à commercialiser les technologies naissantes à l’échelle mondiale. Le projet CANMEDBIO (qui se tiendra les 19 et 20 juin 2006) a ainsi été créé pour présenter les matériels médicaux et les biotechnologies canadiennes en émergence. Ce congrès primordial axé sur le partenariat et la mise en valeur du savoir-faire est une façon de donner une visibilité mondiale au Canada.

Les entreprises et les établissements biotechnologiques canadiens de renommée internationale ont fait la preuve qu’ils sont des chefs de file mondiaux de l’innovation. The old saying "It's not what you know, it's who you know" applies to the strategy adopted by Medicago Inc., a developing biopharmaceutical company from Quebec City (Canada).

Even though it's possible to build the business on our own it is of course risky in the current environment for biotech companies. Medicago is therefore collaborating with partners. Importantly, partnerships with Canadian companies offers substantial scientific and fiscal advantages.

Expertise and networking Partnership is defined as “a cooperative relationship between people or groups who agree to share responsibility for achieving some specific goal.” This type of collaboration is not just contractual because the relationship implies regular interactions between scientists and higher management from each company. Partnerships give access to complementary expertise on technology, regulatory affairs and clinical development. These will frequently help to improve the respective technologies. Le vieil adage « Ce qui importe, ce n'est pas ce que vous connaissez mais qui vous connaissez » s'applique particulièrement à la stratégie adoptée par Medicago Inc., une compagnie biopharmaceutique de Québec (Canada).

Bien qu'il soit possible de développer son entreprise par ses propres moyens, cette approche est à haut risque pour les compagnies de biotechnologie dans l'environnement actuel. Medicago a plutôt choisi de collaborer avec des partenaires. Le partenariat avec des compagnies canadiennes offre, de plus, des avantages scientifiques et financiers substantiels.

Expertise et réseautage Le partenariat se définie comme « entente volontaire entre deux partenaires ou plus en vue d'une collaboration visant l'atteinte d'un but commun ». Ce type de collaboration n'est pas seulement contractuel puisque la relation nécessite des interactions fréquentes entre les scientifiques et dirigeants de chaque compagnie. experts with whom the partner collaborates. This in turn increases both companies' networks, allowing for more consistent and appropriate decision making.

Validation of the technology New product efficacy has to be validated by clinical trials before commercialization. The market acceptance of a developing company depends on the success of its products in clinical trials. Specific partnerships can influence the speed with which a product moves into the clinic. For example, working with a collaborator who has developed a therapeutic product that is awarded Fast Track or Orphan Drug status allows for a rapid clinical validation. An alternative technology then becomes more attractive for investors or new partnerships as there is no longer the "pioneer" effect. Others have paved the way.

Risk sharing Partners share responsibility and risks. In order to develop its technology, a biotech company needs partners willing to take technological and financial risks. As an example, companies may have their clinical trials for orphan drugs or products developed for niche markets financed by governmental agencies, such as the National Institute of Health in the U.S., or the Canadian Cancer Society.

Funding from partners significantly reduces the risk taken by both parties. Moreover, resources can be shared and technology transferred from one partner to the other.

The technology from both sides is thus optimized.

Visibility In 2005, Medicago established three strategic alliances in the area of vaccines and therapeutic antibodies. These agreements confer invaluable visibility and credibility to a developing biotech company and its technology. The success of these projects will garner interest and open doors to new partnership opportunities.

La reconnaissance d'une compagnie en émergence par le marché dépend du succès clinique de ses produits. Des partenariats spécifiques peuvent influencer la vitesse à laquelle un produit se rend aux essais cliniques. En effet, travailler avec un collaborateur développant un produit désigné « drogue orpheline » ou soumis à une procédure d'évaluation accélérée permet une validation clinique rapide. Une technologie alternative devient ainsi plus attrayante pour les investisseurs ou pour de nouveaux partenaires puisque le rebutant « effet pionnier » n'existe plus. D'autres ont pavé la voie pour eux.

Partage des risques Les partenaires partagent les responsabilités et les risques.

Afin de développer sa technologie, une compagnie de biotechnologie a besoin de partenaires prêts à prendre des risques technologiques et financiers. Par exemple, les compagnies peuvent financer les essais cliniques de drogues orphelines ou de produits pour des marchés de niche grâce à des agences gouvernementales telles le National Institute of Health aux États-Unis ou la Société Canadienne du Cancer. Les efforts financiers des partenaires réduisent de façon significative les risques encourus par les deux parties. De plus, les deux compagnies bénéficient du partage des ressources et du transfert technologique. La technologie des deux partenaires est ainsi optimisée.

Canada, a country of choice for partnership

The biotherapeutic market is therefore extremely attractive for investors and companies. However, a number of challenges exist. These include development of a strong and competitive pipeline, and access to innovative science and reliable supply for long-term commercialization. In order to face these challenges, one can turn to Canada to find answers.

Canada believes in collaboration to enrich science and innovation. As a result, the government established the Networks of Centres of Excellence program 15 years ago 10

The biotherapeutic market has shown exponential growth over the last few years. Its market worth was US$45 billion in 2003 and is expected to grow in excess of US$93 billion by 2011. (see Figure 1) Plant-based manufacturing is expected to gain market share as early as 2008, reaching $2 billion by 2011–2012 with a compound annual growth rate of more than 100 percent.1

to favour partnerships between universities, industry, government and non-profit organizations. In 2003–2004, almost 900 companies, more than 200 provincial and federal government departments and agencies, about 50 hospitals, and more than 180 universities and 300 other organizations from Canada and abroad were involved in this program.2 Canada also has several biotech clusters throughout the country. These networks and clusters give access to a highly qualified workforce with unique cutting-edge technology. These features consequently confer a competitive advantage to local or international partners.

Many observers see collaboration with biotech organizations as a method to boost the pharmaceutical pipeline. Canadian biotech companies provide interesting and varied choices to complete a company's pipeline with lower risks. Financial risks are limited due to fiscal incentives and reduced business costs in Canada. The 2004 KPMG study of business costs worldwide concluded that

BIOGRAPHY Nathalie Charland is the Product Portfolio Development Manager at Medicago Inc., a biopharmaceutical company in Quebec City. Medicago has developed a breakthrough therapeutic protein manufacturing system, Proficia™, which can greatly improve the cost and accessibility of today’s emerging biotherapeutics for both partners and patients. Dr. Charland worked for six years in the vaccine industry (ID Biomedical, formerly Biochem-Pharma and Shire Biologics), holding scientific and management positions. She joined Medicago in November 2004.

Le pays mise sur la collaboration pour faire évoluer la science et l'innovation, d'où l'instauration il y a quinze ans d'un programme de Réseaux de Centres d'Excellence pour favoriser les partenariats industrie-université-gouvernementorganismes à but non lucratif. En 2003-2004, près de 900 entreprises, plus de 200 ministères et organismes provinciaux et fédéraux, une cinquantaine d'hôpitaux, plus de 180 universités et 300 autres organisations canadiennes et internationales ont participé à ce programme.2 Le Canada compte également plusieurs pôles biotechnologiques répartis à travers le pays. Ces réseaux et pôles donnent accès à des ressources hautement qualifiées et à des expertises uniques. Cette distinction confère ainsi un avantage compétitif aux partenaires locaux ou internationaux.

Plusieurs observateurs croient qu'une collaboration avec une compagnie de biotechnologie est une façon de relancer le pipeline pharmaceutique. Les biotechs canadiennes donnent aux entreprises des choix intéressants et variés pour compléter leur pipeline avec des risques réduits. Les risques monétaires sont également limités dû à des incitatifs fiscaux et des coûts de revient réduits.

En effet, une étude KPMG, effectuée en 2004 sur les coûts d'affaires internationaux, a conclu que le Canada est le leader mondial avec des coûts d'affaires de 9 p. 100 plus bas que ceux des entreprises américaines.3 Finalement, le Canada offre des ressources uniques et des idées créatrices permettant des avancées compétitives à des entreprises d'ici et d'ailleurs.

en years ago, Canada and biotechnology in the same sentence wouldn’t necessarily have captured international attention. But these days, the Canadian industry is synonymous with biotech achievements in health research, agriculture and nutrition, and bioproducts and bioprocessing.

Canadian companies and institutions have exhibited the fastest rate of growth among G7 countries in terms of the number of workers devoted to R&D, external patent applications and business expenditures on R&D. Canada is among nations with the lowest cost of doing business, and it is the number one trade and investment destination, with the most highly educated workforce and highest computer literacy rates in the G7.1

This Federal Perspective explores the achievements that have made Canada an international biotech leader, including our business environment, public support of biotechnology, and Canada’s research excellence.

Canada’s business environment Canada ranks among the top five countries globally in terms of government spending on biotechnology R&D. With a number of federal funding agencies, small Canadian companies and research institutions are able to take advantage of opportunities to grow their discoveries into commercialized products.

On average, the federal government invests $582 million in biotechnology annually, and overall R&D investment has grown three-fold since 1997 to $1.5 billion.2 Canada is ranked among the top three nations, on par with the United Kingdom and behind the U.S., in terms of biotechnology market capitalization. In fact, the majority of cash flow for Canadian biotech firms derives from product sales, with research funding and royalties comprising the remaining two-thirds.3 insights Spring/Printemps 2006

Le milieu des affaires au Canada Le Canada se classe parmi les cinq pays à travers le monde en matière d’investissements gouvernementaux attribués à la R.-D. en biotechnologie. Grâce à de nombreux organismes de financement fédéraux, les petits établissements de recherche et entreprises du Canada peuvent espérer voir la commercialisation de leurs découvertes. En moyenne, le gouvernement fédéral investit chaque année 582 millions de dollars dans les biotechnologies. Au total, les investissements en R.-D. ont triplé depuis 1997 pour atteindre aujourd’hui 1,5 milliard.2 Le Canada fait partie du trio de tête des pays – à égalité avec le Royaume-Uni et derrière les États-Unis – en matière de capitalisation boursière en biotechnologie.

En fait, la majorité des rentrées de fonds des entreprises biotechnologiques canadiennes proviennent de la vente des produits, le financement de la recherche et les droits d’exploitation comptant, eux, pour les deux tiers.3 La plupart des entreprises de biotechnologies canadiennes sont engagées dans la recherche en santé, ce qui permet au Canada de faire partie des cinq premiers pays au monde en matière de bénéfices issus de la santé.4 De plus, le Canada affiche aussi un fort potentiel dans les secteurs de la BIOTECanada

The majority of Canadian biotech companies are engaged in health research, with Canada among the top five nations in terms of health revenues by country.4 However, Canada is also demonstrating strengths in food processing and the environmental sectors. When compared with the U.S., the UK, Japan and India, Canada is ranked number one. And in terms of biotech crop plantings, we are fourth in the world with 14.3 million acres.5 With the country’s rich resources for biomass (both new and waste, such as corn straw, tree branches and municipal landfill) and biological processes, Canada’s burgeoning bioproducts sector also contributes to a strong industry and better quality of life. Bioproducts are mainly everyday items such as shingles, insulation, plastics, detergents, fibreboard, etc. Biomass is cheaper than oil, with one ton of dry biomass costing $30–$50, equal to 2.86 barrels of oil at $100–$140.6 The biomass sector holds great potential to reduce pollution and waste, decrease energy use and provide alternatives to some chemical processes.

Public support for biotechnology Investment isn’t the only driver to a biotechnology industry, however. Public awareness and acceptance of the technology is key. In a poll conducted by BIOTECanada late last year, we found an overwhelming majority of Canadians (81 percent) expect to see the benefits of biotechnology positively impact the environment, their health in general and the Canadian economy. Canadians, however, did not perceive their country as a world leader for the technology. But the numbers don’t lie. Canada has many advantages that put us ahead of other nations developing the technology, including a strong research environment.

Research Excellence Canada has embraced its capacity to innovate with outstanding achievements. Canadian scientists discovered the T-cell receptor in the 1980s. By 2002, Canadian researchers cracked the genetic code of the mosquito that carries the deadliest strain of malaria. The following year, we were touted internationally for our role in sequencing the genome of the SARS virus, and currently, Canadian researchers have a number of biotechnology applications under development, including: • Cancer therapeutics and vaccines, • Treatments for heart disease, arthritis, rare diseases, Alzheimer’s and diabetes, • HIV and AIDS treatments, • Stem cell research, and • Infectious disease treatments.

Canada’s health science research community has over 30,000 investigators in 16 medical schools, and over 100 teaching hospitals and research institutes. The University of Toronto and its affiliated research institutions comprise the 4th largest medical R&D community in North America.7 Sharing the top spot with Toronto, Montreal’s McGill University was co-ranked number one in the Medical insights Spring/Printemps 2006

Les bioproduits se retrouvent essentiellement dans les produits de la vie domestique tels que les bardeaux, les produits d’isolation, le plastique, les détergents, le carton, etc. La biomasse coûte moins cher que le pétrole puisqu’une tonne de biomasse sèche vaut entre 30 $ et 50 $ et équivaut à 2,86 barils de pétrole pour un coût estimé entre 100 $ et 140 $.6 Le secteur se démarque aussi par sa capacité à limiter la pollution et les déchets ainsi qu’à diminuer la consommation d’énergie et à offrir des solutions de rechange à certains procédés chimiques.

Dans un sondage mené par BIOTECanada à la fin de l’année dernière, nous avons remarqué qu’une immense majorité de Canadiens (81 p. 100) s’attend à ce que les biotechnologies jouent un rôle positif dans l’environnement, dans la santé en général ainsi que dans l’économie canadienne. Cependant, les Canadiens ne voient pas leur pays comme un des chefs de file de la biotechnologie, même si les chiffres, eux, ne mentent pas.

ioproducts and bioprocesses in Canada, as in many other countries are “under development,” but we are experiencing if not the winds of change, then at least strong breezes that precede a major shift in the weather.

Canada has a capacity for research and development in the bioproducts area that is as well respected as in other scientific areas. It has an unequalled abundance of natural resources to provide the feedstock for almost innumerable applications. It also has a development environment that relies on strong positive market forces, not subsidies, to succeed in the alternatives arena. All of these factors have put Canada on the leading edge in terms of product and process development.

Le Canada possède une compétence en recherche et développement dans le secteur des bioproduits aussi réputée que dans d’autres secteurs scientifiques. Il dispose d’une abondance inégalée en ressources naturelles lui permettant de fournir en matières premières une quantité presque innombrable d’usages. Il peut aussi compter sur un milieu favorable soutenu par un marché fort et réceptif, et non pas par des subventions, afin de réussir dans le domaine des produits de remplacement. number of years. Major cities run their bus fleets on domestic biodiesel and are adopting green buying protocols for other necessities. Applications of bioprocesses are providing electricity to small towns. They are developing complex composites for the aerospace industry, as well as fibre and plastics for the automotive industry.

Given the abundance of agriculture and forest land and the very positive attitude of provincial governments to alternatives—including alternatives to traditional jobs— Canada is taking up the opportunity to develop a positive approach to bioproducts and bioprocesses. Every region and most provinces have initiatives underway to support market research and development.

Scientific research at the federal level continues to expand, and there are strong indications a green procurement initiative will include fuels as well as other products.

Also, a number of federal departments from agriculture to natural resources, forestry, industry and the environment wrote bioproducts and bioprocesses into briefing books for the new government—a significant step in the mainstreaming of bioproducts and bioprocesses in policy and in the future of the Canadian economy.

The bioproducts sector is at the stage biotechnology in general was 15 years ago. The pioneering strides made by biotech on the regulatory and financial sides over the past decade and a half, and increasing economic and social imperatives to look beyond petroleum-based products, will significantly speed up the rate of success for bioproducts.

The increased interest of governments will also clear an easier path for the nascent industry. Recent estimates are that the number of companies engaged in the production of bioproducts has doubled in the last three years and shows positive projections for financial health and growth over the coming period.

Successes are already on the ground and running. Canada and BioProducts Canada in particular, look forward to showcasing Canada’s best and brightest at the World Congress on Industrial Biotechnology and Bioprocesses and Canadian Forum to be held in Toronto from July 11–14, 2006.

Not only will this event provide an opportunity to share and compare with the best in the world, but the spotlight will undoubtedly spur a very innovative and competitive Canadian industry on to tackle one of the new millennium’s most positive challenges with even more enthusiasm.

BIOGRAPHY Sally Rutherford is the Executive Director of BioProducts Canada. She has worked in agricultural policy for over two decades including with the Canadian Federation of Agriculture as Executive Director and as Director General of Agriculture and Agri-Food Canada. Prior to that time, Ms. Rutherford worked for a number of years for Canada’s House of Commons and Senate Committees and in the Research Branch of the Library of Parliament on a wide range of agricultural topics including trade, farm income support, food safety and science issues. insights Spring/Printemps 2006

Le secteur de bioproduits se trouve aujourd’hui au stade où se trouvait celui de la biotechnologie en général il y a une quinzaine d’années. Les avancées novatrices de la biotechnologie en matière de réglementation et de financement au cours des quinze dernières années, ainsi que l’augmentation des impératifs économiques et sociaux dans la recherche de solutions de remplacement aux produits à base de pétrole, accéléreront considérablement la percée des bioproduits. L’intérêt accru des gouvernements pavera nettement la voie à cette industrie naissante. On estimait récemment que le nombre d'entreprises engagées dans la production de bioproduits avait doublé au cours des trois dernières années et qu’elles affichaient des prévisions positives pour la période à venir en ce qui a trait à leur santé financière et à leur croissance.

Le succès est déjà au rendez-vous. accines have made a profound and long-lasting contribution to the health and well-being of all Canadians.

Certain infectious diseases, once so cruel and rampant in our communities, are now a distant memory. Indeed, most practicing paediatricians in Canada have never come across a case of small pox or polio.

The elimination and control of certain diseases is well documented. Yet vaccines remain overlooked and undervalued by many in the health care system despite the central role these medicines have and will continue to play in public health.

There is a certain irony in all of this, particularly now as governments around the world are looking to vaccine manufacturers to mitigate the impact of a potential bird flu pandemic.

However, this impression should come as no surprise. After all, it is difficult to appreciate the true value of a flu vaccine if it prevents a person from experiencing the illness in the first place. The fact is, vaccines are more about invisible than instant gratification.

Many preventative medicines face a similar predicament.

But the vaccine industry, as represented by the BIOTECanada Vaccine Industry Committee, must deal with some unique challenges as well, which we need to overcome in order to turn new discoveries into meaningful health care innovations.

Many vaccines are relatively inexpensive, and in many cases, represent no direct cost to the recipients. Some may equate low cost with low value, but we know the opposite is true, although the way in which we traditionally measure their contributions falls short of calculating the real worth of vaccines.

L’éradication et la maîtrise de certaines maladies sont bien documentées. Certains intervenants en soins de santé ont toutefois tendance à sous-estimer la valeur des vaccins et le rôle crucial qu’ils ont et continueront d’avoir en santé publique. Ironiquement, ce phénomène survient alors que les gouvernements du monde entier se tournent vers les fabricants de vaccins en vue de prévenir une éventuelle pandémie de grippe aviaire.

On ne devrait cependant pas s’étonner de ce désintérêt. Il est difficile d’évaluer la véritable valeur d’un vaccin contre la grippe, car celui-ci empêche la maladie de se déclarer.

Les vaccins n’entraînant pas de résultats visibles et instantanés, leur effet passe plutôt inaperçu.

De nombreux traitements prophylactiques subissent le même sort. Toutefois, notre secteur, représenté par le Comité des vaccins de BIOTECanada, aura en plus des défis particuliers à relever afin que les nouvelles découvertes se transforment en améliorations tangibles en matière de soins de santé.

Beaucoup de vaccins sont plutôt économiques et sont souvent administrés gratuitement. Certaines personnes peuvent être portées à associer leur coût peu élevé à une faible valeur. Nous savons que le contraire est vrai. Quoi qu’il en soit, la méthode traditionnellement employée pour déterminer la valeur des vaccins ne donne pas un aperçu fidèle de la réalité.

As Canadians, our focus has largely been on the direct benefits to the individual. Rarely have we considered the societal benefit as part of the value equation. More work needs to be done in understanding and conveying the full range of benefits provided by vaccines.

En effet, en tant que Canadiens, nous avons mis l’accent sur les avantages directs que représentent les vaccins pour les individus, mais avons peu tenu compte de leurs retombées bénéfiques pour l’ensemble de la société. economic burden associated with infectious diseases.

Moreover, we are only beginning to understand the full impact of vaccines. A recent study conducted in Alberta found there has been a decline of certain bacterial infections in adults as a result of an immunization program involving the infant pneumococcal vaccine called Prevnar®. Reducing the disease in children has reduced the spread of disease to adults—this is referred to as a “herd effect.” This effect has been seen previously and is clearly an important benefit of vaccination.

Conveying the true value of vaccines is not a vanity project.

It is critical for our health and well-being. That’s because the ability to turn ideas into innovation requires the ongoing support of decision makers in health care.

It is all the more pressing now. For one, this year marks the third and final year of federal government funding for the National Immunization Strategy. The BIOTECanada Vaccine Industry Committee has been a strong supporter of this funding and strongly believes a renewed commitment is imperative, especially now as the world faces the possibility of pandemic flu.

For another, the vaccine industry is on the cusp of a new era of discovery, where vaccine research is extending beyond the traditional realm of preventing infectious disease to treating other diseases such as certain cancers, Alzheimer’s, forms of addiction, and autoimmune deficiencies such as HIV. These innovations are complemented by ongoing work in preventing infectious diseases, such as methicillin-resistant Staph aureus (MRSA), which is a scourge in Canadian hospitals and health care facilities.

However, this new wave of innovation comes with an undertow that threatens to wash away some of the progress being made. Development costs are always a fundamental challenge.

Canadians need to truly appreciate the amount of time and resources required to develop a new vaccine. Most vaccines are more than 10 years in the making, and encounter a more rigorous development and manufacturing process than many other drug therapies. Despite this, most health care dollars are allocated to treatment rather than preventative therapies.

It is impossible to sustain innovation without ongoing and increased support. To this end, we must adopt a new view on vaccines, one that considers both the direct and indirect benefits of immunization. Only by doing so will we be able to ensure that exciting discoveries turn into innovative health care solutions.

en Alberta a fait état d’une diminution du taux de certaines infections bactériennes chez l’adulte après la mise en œuvre d’un programme d’immunisation des nourrissons par le vaccin antipneumococcique Prevnar®. En réduisant l’incidence de la maladie chez les enfants, on diminue également sa propagation chez les adultes – c’est ce qu’on appelle l’immunité collective. On a observé ce phénomène auparavant, et il s’agit certainement d’un important avantage de la vaccination.

Faire connaître la valeur réelle des vaccins n’est pas une entreprise futile, mais un projet essentiel à notre santé et à notre bien-être. Afin de transformer des idées en véritables innovations, il est nécessaire de jouir de l’appui constant des décideurs en matière de santé.

Il devient urgent que cet appui se manifeste, d’abord parce que cette année marque la troisième et dernière année de financement gouvernemental de la Stratégie nationale d’immunisation. Ayant toujours ardemment défendu ce programme de financement, le Comité des vaccins de BIOTECanada estime qu’un engagement à le poursuivre est essentiel, particulièrement aujourd’hui en raison de la menace de pandémie de grippe aviaire qui pèse sur le monde.

D’autre part, le secteur de la mise au point des vaccins est en pleine effervescence. La recherche explore de nouvelles avenues dont la lutte contre certains types de cancers, la maladie d’Alzheimer et des maladies immunodéficitaires tel le sida, tout en poursuivant dans la voie de la prévention des maladies infectieuses telle l’infection au staphylocoque aureus résistant à la méthicilline (SARM), un véritable fléau dans les hôpitaux et les établissements de soins de santé canadiens.

Ce déferlement d’innovation est malheureusement accompagné d’un courant défavorable qui risque de balayer certains progrès accomplis. Les coûts associés à la mise au point de nouveaux vaccins représentent un défi considérable. Les Canadiens doivent mieux évaluer le temps et les ressources devant être consacrés à de tels processus. Il faut compter plus de 10 ans pour développer la plupart des vaccins, et leur mise au point ainsi que leur fabrication exigent plus de rigueur que d’autres types de médicaments. Malgré tout, les sommes investies en soins de santé sont principalement allouées au traitement plutôt qu’à la prévention.

Sans un soutien accru et constant, il est impossible de continuer d’innover. Nous devons donc adopter une nouvelle vision des vaccins, tenant compte à la fois des avantages directs et indirects de l’immunisation. Seulement ainsi pourrons-nous nous assurer de transformer des découvertes exaltantes en progrès novateurs en matière de soins de santé.

The BIOTECanada-Biogen Idec Teaching Excellence Award includes three annual cash awards, one for $5,000 and two for $2,500, granted to the winning teacher that is shared with his or her school to assist with the purchase of scientific equipment and materials.

In partnership with the Canadian Biotechnology Education Resource Centre (CBERC), the national award program recognizes the important contributions bioscience educators provide to Canadian students including creativity in the classroom, curriculum development, and fostering awareness of biotechnology.

The competition will be adjudicated by a panel of experts from within the Canadian biotechnology research and industry who will announce the winners during National Biotechnology Week 2006 (September 23–30).

It is fitting this story revolves around two immigrants from Hong Kong who moved to Canada to attend university and stayed to create a biotechnology company in Halifax, Nova Scotia.

MedMira was founded in 1994 by Hermes Chan and his wife Carlina Hui who moved to Nova Scotia to attend Acadia University. During their graduate research at the university, they developed a unique rapid test technology platform. This platform, a flow-through device where the human specimen flows vertically through the test zone, has the capability of detecting the presence of infectious disease antibodies in human blood, serum or plasma. This unique test takes less than three minutes to perform and the results can be ready instantly, once the test procedures are complete. Since its initial development, the HIV test has undergone various advancements and modifications to make it one of the leading rapid HIV tests in the world, and it holds the unique distinction of being the only rapid HIV test in the world to hold key regulatory approvals in Canada, the United States, Europe and China.

Besides its flagship rapid HIV test, the company developed a number of other products based on the flow-through technology that will be brought forward for regulatory approvals in the near future. Perhaps most promising among these is a combination HIV and Hepatitis C test that can diagnose both diseases in less than three minutes from a single specimen. According to the World Health 28

Au cours de leurs recherches supérieures à l’université, ils ont conçu un procédé technologique unique qui permet d’établir rapidement un diagnostic. Ce procédé – un test de diagnostic dynamique au cours duquel les échantillons cliniques traversent de part en part la zone de mesure – peut détecter la présence d'anticorps de maladies infectieuses dans le sang, le sérum et le plasma humains.

Regulatory approvals: Targeting the U.S. markets The road from research lab to commercialized product is not easy. A long and difficult path with many challenges faced MedMira as it developed real-world applications on the technology platform. As in most biotechnology companies, cash was always in short supply, and the team learned how to accomplish much with limited resources.

By 1997, the HIV product was developed and was proven in clinical trials carried out with the support of the Provincial Public Health labs in Nova Scotia and Newfoundland and Labrador. One year later, the company obtained approval from Health Canada.

At this point in MedMira’s development, Mr. Chan and the team turned their attention to obtaining regulatory approval for the test and prepared to market the product globally. This required key regulatory approvals, which meant time and money. The company filed for approval with both the Food and Drug Administration (FDA) in the United States and the State Food and Drug Administration (SFDA) in China. Over the next four years, MedMira worked with these regulatory bodies.

network, rather than trying to build its own sales team, focusing first on the U.S. This market was close to home and was reasonably well understood. Using an agent in the U.S., the company identified potential distributors.

Prior to obtaining FDA approval with MedMira’s U.S. master agent, a distribution agreement with Cardinal Health, a leading U.S. distributor of healthcare products, was completed. This agreement allowed the company to begin selling its product to laboratories and hospitals immediately following FDA approval in April 2003.

that was not known in the market, MedMira’s executive team first had to build relationships with key regulatory and government officials. The company sponsored a series of seminars dealing with HIV/AIDS and rapid testing, showcasing MiraWell Rapid HIV Test and how it could be used to help combat the spread of HIV in China. These seminars were very successful in developing and building key relationships with China’s government and Centres for Disease Control (CDC) officials.

Success in China required more than just personal relationships; a physical presence was necessary. To that end MedMira undertook two initiatives. First, in the fall of 2003, the company opened a representative office in Beijing, with one full-time staff person. This office allowed us to work with key regulatory and healthcare officials on a regular basis. In August 2005, MedMira formed a joint venture partnership with Tianhe Pharmaceutical Company in Guilin, China. This joint venture gives MedMira the necessary physical presence, and enables them to bring new products to the Asian market faster and reduce manufacturing costs and lead times.

Entering the European market Building on its experience in the U.S. and China, MedMira set its sights on Europe. In January 2006, MedMira received CE Mark approval in Europe for its MiraCare Rapid HIV test, after a year-long regulatory filing process.

Working in parallel with the regulatory process, the company’s sales and marketing team began identifying distributors for its product in several European countries.

The company signed a distributor agreement and received a large order prior to receiving approval, enabling them to sell to the market immediately upon regulatory approval being granted. MedMira plans to focus significant effort on continuing to grow and expand the distribution network throughout the European Union.

Mr. Gullage was most recently the CFO of one of North America’s largest IT solutions companies based in Halifax, Nova Scotia. PARTNERING: BUSINESS AND LEGAL INGREDIENTS TO SUCCESS

t is difficult to overstate the importance of partnering to the development and commercialization of biotechnology.

Partnering brings together non-profit and academic institutions (such as universities or public research centres) with capitalist operations, small or early stage biotechnology companies with large pharmaceutical conglomerates, and big pharma companies with each other.

The prevalence of partnering as a business strategy is due to a combination of factors: Partnering permits the combination of technologies across the ever expanding scope of biotechnology science and applications; it spreads out the high cost of research and product development as well as the risks of bringing products to market in an industry with high failure rates; and it permits access to funding and specialized expertise, markets and skills that parties by themselves are unlikely to fully possess. Yet, despite the potential power of biotechnology partnering, many alliances fail. Some of the key business and legal considerations in deciding whether or how to partner include the following: 1. Business Fit. Do the parties have complementary technology, skills or resources consistent with the business plan for the alliance? A classic example of business fit is a small biotechnology company partnering with a large pharmaceutical company. The smaller company benefits from the larger company’s resources, expertise in regulatory matters, manufacturing capacity, and access to markets.

The larger company benefits from access to the biotech company’s niche technology or product candidates.

2. Commonality of Objectives. Strategic alliances that fail often do so because the parties had different goals when entering into the relationship, or because goals change over time. In these circumstances, properly structured legal terms, such as termination rights based on objective measures of performance, can protect the parties from being trapped in an alliance that is not working.

3. Commitment and Track Record. Is the prospective partner a champion of the deal or only lukewarm?

Does the prospective partner have a good track record in successful partnering arrangements? If these factors are not present, a partner may ignore or seek to dominate the alliance once formed. Careful legal terms can mitigate negative effects when a partner engages in this sort of behaviour.

4. Resources. Does the partner have the financial, technological or corporate resources and capabilities to be able to perform its obligations?

Contractual strategic alliances are most often used when the alliance is expected to be short-term, but are also used for long-term alliances because the contractual mechanism allows for greater flexibility and control in structuring the relationship. If a contractual strategic alliance is used, all relevant matters must be properly covered in the contract in a manner appropriate to the transaction, since there will not usually be other sources of law (such as corporate statutes) to fill in gaps not covered by the arrangement.

Joint venture vehicles, such as specifically formed corporations or partnerships, are more complicated to establish and typically require more effort to manage and maintain once in place. Equity and technology contributions and management control must be determined, and settling the related agreements, such as the shareholders agreement or partnership agreement must be done. Once formed, the vehicle will likely have separate record-keeping and tax requirements, greater administrative costs, and corporations will have to comply with corporate laws. However, a joint venture corporation can limit the liability of the parties, and separate joint venture entities may permit access to local markets, government incentives or tax programs that are closed to foreign corporations.

6. Legal terms. Every provision in the contractual documents establishing the alliance should be examined against the business goals of the relationship. Take exclusivity as an example. License grants are typically exclusive or non-exclusive. If exclusive rights are granted, the licensor is committing to the partner to be able to accomplish the goals of the alliance. licenses can be akin to a disposition of the technology or licensed rights. The transferor of exclusive rights will most likely want to include protections to ensure the partner is obligated to perform, such as requirements to make investments, to devote resources, and to meet objective performance requirements such as minimum sales or revenues. The licensee in turn will typically ask that the remedy for failure to meet these commitments be limited to conversion of their rights from exclusive to non-exclusive (rather than termination of the agreement or the licenses), and that they have the right to “top up” any failure to meet minimum revenue targets. These solutions have potential problems for the licensor: if licenses merely convert to non-exclusive instead of terminating, the licensor cannot then grant exclusivity to someone else who would be able to deliver the desired performance, and if “top-up” rights are permitted for revenue shortfalls, it effectively allows the licensee to purchase its non-performance.

The contractual terms will have provided a measure of protection to both parties, but the business goals of the partnership will not have been met.

Other contractual terms to be matched with the business relationship of the parties include non-competition clauses and rights of first refusal, terms governing intellectual property (including improvements) ownership, prosecution and enforcement, dispute resolution procedures, liability limitations, term and termination rights, post-termination rights of the parties, confidentiality provisions, publication rights for research results, management and accounting provisions, royalties and milestone payments, performance requirements, indemnities and insurance.

In summary, a successful partner will be one that has the right business fit, objectives, commitment and resources for the alliance’s business plan. The legal structure and terms must be matched to the alliance’s business objectives in order to contribute to and not impede the success of the alliance, but the legal aspects will not determine the success or failure of the alliance. Many partnering initiatives in the biotech industry that are successful end in a merger or acquisition, since the contractual controls that were necessary for the parties to take the leap of faith of entering into a partnering arrangement, such as restrictive license provisions and non-competition clauses, can become impediments to growing the business if the relationship is successful.

The future outlook for agricultural biotechnology is shining bright with an 11 percent increase in biotech crop plantings in 2005, the addition of four new countries commercializing biotech crops and a quarter million more farmers planting biotech seeds.

This means 8.5 million farmers are planting biotech seed on 222 million acres in 21 countries. Most telling is that these global trends were announced against the backdrop of Brazil, a country that almost doubled its biotech soybeans to 23 million acres last year.

While American farmers lead the way in embracing biotech crops, it was Anderson Gomez from Brazil who put the face on the 10th annual report of the International Service for the Acquisition of Agri-biotech Applications (ISAAA) on January 11, 2006. His perspective on the economic and environmental benefits to Brazilian farmers in the Matto Grosso region is probably not that different from Indian farmers in the Punjab or other famous food-producing plains of the world.

Two key trends are emerging from the ISAAA report. First, developing countries adopted biotech crops at a rate five times faster than industrialized nations between 2004 and 2005.

Farmers in resource-poor countries such as China, India, South Africa and the Philippines are generating more profit and higher yields from planting biotech varieties. India, for example, tripled its Bt cotton production to 3.2 million acres in 2005. Importantly, Iran grew its first crop of pest-resistant rice, just months before China is expected to do the same.

Not part of the ISAAA report is the fact that Africa is seriously pursuing bio-fortification of subsistence crops such as sorghum.

When commercialized, the fruit of this research will substantially increase access to biotech crops in many remote parts of the globe, potentially in the next decade.

Secondly, despite the protests of French activist Jose Bove, the facts show that anti-biotech Europe is slowly dismantling its barriers. Biotech maize is being grown in five European countries including France, Portugal, Spain, Germany and for the first time in 2005, the Czech Republic. Public monies are actively pledged to significant research in everything from maize to grapes to potatoes.

Si ce sont les agriculteurs américains qui ont ouvert la marche en adoptant les cultures biotechnologiques, c’est Anderson Gomez, du Brésil, qui a donné le ton au dévoilement du 10e rapport annuel du Service international pour l’acquisition des applications de l’agrobiotechnologie (ISAAA) le 11 janvier 2006. En fait, sa vision des bienfaits économiques et environnementaux dont peuvent profiter les agriculteurs de la région du Matto Grosso ne diffère sans doute pas beaucoup de celle des producteurs indiens du Punjab ou des autres grandes plaines nourricières du monde.

Le rapport de l’ISAAA laisse entrevoir deux grandes tendances.

Tout d’abord, les pays en développement ont adopté les cultures biotechnologiques à un rythme cinq fois plus rapide que les pays industrialisés entre 2004 et 2005. Les agriculteurs de pays pauvres en ressources tels que la Chine, l’Inde, l’Afrique du Sud et les Philippines génèrent des rendements et des bénéfices supérieurs lorsqu’ils cultivent des variétés génétiquement modifiées. L’Inde, par exemple, a triplé sa production de coton Bt, qui a atteint 1,3 millions d’hectares en 2005. L’Iran a produit la première récolte de riz résistant aux ravageurs, alors qu’on s’attendait à ce que la Chine le fasse dans tout juste quelques mois. Par ailleurs, le rapport de l’ISAAA ne mentionne pas que l’Afrique travaille très sérieusement à la biofortification de cultures vivrières telles que le sorgho. Une fois commercialisés, les fruits de ces recherches auront pour effet d’améliorer de façon tangible l’accès aux cultures biotechnologiques dans plusieurs parties reculées du globe, potentiellement au cours de la prochaine décennie.

Deuxièmement, malgré les protestations de l’activiste français José Bové, les faits montrent bien que le bloc imperméable que semblait constituer l’Europe hostile aux cultures GM se

So what does the future look like for Canada’s ag biotech sector? Currently Canada sits fourth in the world with 14.3 million biotech acres, following the United States, Argentina and Brazil. Most of Canada’s growth is in canola, of which 82 percent of the crop is from herbicide-tolerant varieties, while the corn and soybean crops enjoy 60 percent adoption rates with both herbicide-tolerance and insect-resistance.

Within the canola sector, there is increasing excitement about high-stability oils, which farmers grow under contract to go directly to food processors. Expect this market to grow because these specialty canola oils meet a food manufacturing need for transfat-free products. Biotech corn varieties are also in demand for feed and industrial uses.

Some varieties are engineered to have a higher starch profile, which makes them more efficient when transformed into ethanol. Others are in demand for bioproducts that range from carpet to biodegradable cutlery.

Canada’s strong research record and its proximity to the United States means new advances in biotechnology are launched in North America first. Canada is one of a handful of countries to plant “stacked” traits, up to three traits in one crop. That means farmers have the option of planting corn seed that is not only herbicide-tolerant but resistant to two pests: corn borer and corn rootworm. Farmers can choose the appropriate mix according to pest prevalence and populations.

Seeds are universal, so it’s no surprise that farmers on a global basis have quickly understood biotechnology and its ability to solve persistent agronomic problems. The 10-yearold technology now moves into the second decade of research and development with promise of products that meet processing and industrial needs. Like the pharmaceutical industry, only one or two blockbusters will survive the crucial, rigorous clinical trials to be marketed to consumers.

Et quel est l’avenir du secteur agrobiotechnologique au Canada? Le Canada occupe présentement le quatrième rang mondial avec près de 6 millions d’hectares de cultures biotechnologiques, après les Etats-Unis, l’Argentine et le Brésil. Le canola est responsable de la plus grande partie de la croissance observée au Canada, 82 p. 100 du canola étant constitué de variétés tolérantes aux herbicides, alors que le maïs et le soja profitent d’un taux d’adoption de 60 p. 100 grâce aux variétés tolérantes aux herbicides et résistantes aux insectes.

Le secteur du canola connaît une effervescence croissante au sujet des huiles de haute stabilité que les producteurs cultivent sous contrat direct avec les transformateurs alimentaires. Comme ces huiles de canola spécialisées répondent à un réel besoin du secteur alimentaire pour des huiles sans gras trans, on peut s’attendre à une bonne croissance de ce marché. Les variétés de maïs biotechnologique sont aussi en demande pour des usages industriels, ainsi que pour l’alimentation animale.

Certaines variétés sont modifiées pour présenter une teneur élevée en amidon, ce qui les rend plus efficaces pour la transformation en éthanol. D’autres variétés servent à la fabrication de bioproduits, des tapis aux ustensiles biodégradables.

La grande force du Canada dans le secteur de la recherche et sa proximité des États-Unis font en sorte que les nouvelles percées de la biotechnologie sont d’abord lancées en Amérique du Nord. Le Canada fait partie du cercle restreint des pays où l’on cultive des plantes issues d’un « pyramidage de gènes », c’est-à-dire des plantes contenant jusqu’à trois gènes insérés. Autrement dit, un producteur agricole peut ainsi choisir de cultiver un maïs qui n’est pas seulement tolérant à un herbicide, mais qui est aussi résistant à deux ravageurs, la pyrale du maïs et la chrysomèle des racines du maïs, selon la présence de ces ravageurs et le risque qu’ils posent dans la région.

Les semences sont universelles. Il n’y a donc rien d’étonnant à ce que des agriculteurs du monde entier aient rapidement compris les avantages de la biotechnologie, dont sa capacité à résoudre des problèmes agronomiques persistants. Au terme de dix années de progrès, cette technologie amorce une nouvelle décennie de recherche et de développement avec la promesse de nouveaux produits qui répondront aux besoins de la transformation et des industries. Tout comme dans l’industrie pharmaceutique, un ou deux produits vedettes seulement survivront aux essais cliniques rigoureux indispensables avant la commercialisation.
