By Laura Coleman Whether or not voters give Metro a blank check in November should the Measure R “forever tax” go through, the fact remains that the L.A. transportation authority is on the hook to explain to residents why it decided to spend $200 million more on a subway tunnel that runs under Beverly Hills High School rather than explore over a dozen alternatives previously identified. The decision, filed Friday in Central District Court, comes after weeks of waiting for U.S. District

and Monique Mass Gibbons in their capacities as authors of Arguments in Favor of the Beverly Hills Garden and Open Space Initiative. The suit takes issue with the argument written in favor of the initiative that will appear in the voter’s pamphlet. Ordaz alleges that the Beverly Hills North Homeowner’s Association endorsement for the initiative is false because two of the organization’s board members wrote a letter to the editor in the Courier saying they did not support it, and the suit also claims that the organization is (see ‘LAWSUIT’ page 17)

Having first joined the district in 1976 as an employee, the former BHUSD student truly lives and breathes school pride. Now beginning his second year at the helm of the five Beverly Hills public schools, and well versed in the accompanying politics that impact the role, Kessler is committed to doing everything in his power to make the district even better. Below is the the Courier’s exclusive interview with Kessler. The Courier: What have you learned? Steve Kessler: I think my first year as superintendent has been very similar in learning a new job, just like when I was in my first year

By Victoria Talbot After years of mounting evidence that loopholes in the City’s existing Hillside Ordinance have become entitlements for developers to build projects that undermine the health and safety of residents and the continuity of neighborhoods, the Beverly Hills City Council has passed a Hillside Ordinance to address those weaknesses. Following a pattern that has plagued the Los Angeles hillside area in response to rising property values, developers have exploited the desirable hillside areas. Small lots on narrow, winding streets often on unstable land that was once considered unbuildable have become worthwhile investments using new building technologies and loopholes to artificially inflate pad size, exca-

vate basement square footage and cantilever structures over hillsides to create megamansions on marginal parcels. Tuesday the Beverly Hills City Council passed a series of ordinances that will give the City and the community greater oversight on these projects to ensure the health and safety of the surrounding residents. With Vice Mayor Nancy Krasne and Councilmember Lili Bosse absent on recusal, Mayor John Mirisch and Councilmembers Kathy Reims and Julian Gold voted 3-0 to adopt an ordinance requiring a minimum level pad of 20 feet by 20 feet and an R-1 review for projects with more than 1,000 square feet of floor area off the level pad.

The City of Beverly Hills has prepared a Draft Environmental Impact Report (Draft EIR) for a proposed condominium project located at 9908 South Santa Monica Boulevard as more fully described below. The Planning Commission will hold a public hearing to review the Draft EIR on September 8, 2016 at 1:30 p.m., or as soon thereafter as the matter may be heard. The purpose of this meeting is to review the content and adequacy of the Draft EIR. The merits of the project will not be discussed at this meeting, and no decisions will be made with regard to the Planning Commission’s recommendation regarding project approval or denial. At a future date, a separate, noticed public hearing will be held by the Planning Commission to review the merits of the proposed project and develop a recommendation to the City Council regarding the project. Project Location: The property is located in the City of Beverly Hills, at the southwest corner of the intersection of Charleville Boulevard and South Santa Monica Boulevard. The 36,002 square foot site consists of five parcels that are currently vacant and being used as a parking lot. The address for the project site is 9900-9916 South Santa Monica Boulevard, and the Assessor’s Parcel Numbers are 4328-002-010, -011, -012, -013, and -034. Project Description: The Proposed Project would involve the construction of a new 27-unit luxury condominium building with units ranging from one to four bedrooms. The Project would include approximately 89,988 square feet of floor area and would be five stories, including four full stories of residential units plus a setback fifth penthouse level. The Project would also include one level of underground parking containing a gym, bike storage, and a total of 74 parking spaces for residents and guests. Parking would include 3 accessible spaces, 43 standard single spaces, 11 tandem spaces, and 17 stacker spaces. The perimeter of the Project site would include landscaping along the 10-foot setbacks. Rooftop areas of the Project would include one common pool and an amenity garden on the roof of the fifth floor as well as private terrace space and two private pools on the penthouse level. The Project would be 66 feet in height and would have a floor area ratio (FAR) of approximately 2.5:1. The project site is currently zoned C-3 for general commercial uses, and the proposed use of the site for a multi-family residential condominium requires a Zone Text Amendment. Environmental Review: In accordance with the California Environmental Quality Act (CEQA), the City of Beverly Hills has prepared a Draft EIR to analyze potential environmental impacts associated with development of the project. Specifically, the Draft EIR analyzes the following potentially significant environmental effects of the project: • Aesthetics • Air Quality • Greenhouse Gas Emissions • Hazards and Hazardous Materials • Land Use and Planning • Noise • Transportation and Circulation • Mandatory Findings of Significance Based on the studies in the Draft EIR, with mitigation, no significant environmental effects are anticipated as a result of the project. Horace Mann Unveils New School Building By Laura Coleman Fresh on the heels of Sunday’s historic celebration at Horace Mann to debut Beverly Hills Unified’s first ground-up construction project using Measure E funds, students at the K-8 actually began to learn inside the district's first truly 21st century classroom building as of this week. Horace Mann Principal Dana Findley, now in her first year leading the school, lauded the new building, which currently houses both elementary and middle school classes over multiple levels. In two years time, the school will have an additional new building, thereby completing Horace Mann's top-to-bottom redo. “Make no mistake about it

Beverly Hills, the modernization of the Beverly Hills Unified School District is well underway,” declared BHUSD Superintendent Steve Kessler at Sunday's back-to-school “Open House” at Horace Mann, which first opened in 1929. The modernization construction project, which kicked off in fall 2014, followed the unveiling of the school's fully renovated historic auditorium earlier that same year. This phase also included a multipurpose/community room, new playground areas, and an underground parking structure just below a synthetic turf guaranteed to engender Husky pride with its custom-matched “Horace Mann purple” color.

At Sunday’s celebration, which was presented by the Horace Mann PTA, new and current school families, along with community members who supported the project and had personal ties to the campus, got a glimpse of the brand new, state-of-the-art facility. The hours-long event, which included snow cones, lemonade, quesadillas, hot dogs, and cupcakes, to name a few of the goodies on hand, also included remarks by City leaders. “I'd like to congratulate the school board in getting it right,” Mayor John Mirisch said. “The schools continue to be so important for our City and kids.”

TUTORING—The Beverly Hills Academic Tutoring Program is set to return again for another year, beginning with orientation on Tuesday, Sept. 6, from 4-5:30 p.m. at Roxbury Park Auditorium. The program is seeking volunteers to work with elementary school children having social and/or academic difficulties. Legendary Director, Former Academy President Arthur Hiller Dead At 92 By John L. Seitz Legendary director Arthur Hills, a 45-year Beverly Hills resident and former president of the Academy of Motion Picture Arts and Sciences and the Directors Guild of America, died Wednesday after a long illness. He was 92. Ironically, his popular wife of 68 years, Gwen, to whom he had first proposed at age 8, died seven weeks ago. Born in Edmonton, Alberta, on Nov. 22, 1923, Hiller spent three years in the Royal Canadian Air Force, flying bombing raids over Germany in World War II bombing raids over Germany during World War II. After attending the University of Toronto, he began producing and directing talk shows and radio documentaries

before helming live TV dramas for the Canadian Broadcasting Corporation. He came to California in 1955 to direct for NBC’s Matinee Theatre and Playhouse 90 for CBS. He went on to direct multiple episodes of other series like Naked City, Route 66, Perry Mason, Alfred Hitchcock resents, Gunsmoke, Ben Casey and I’m Dickens, He’s Fenster. Hiller then began directing a myriad of feature films, notably Love Story, Silver Streak, The Out-Of-Towners, Plaza Suite, Man Of La Mancha, Author! Author!, See No Evil, Hear No Evil, The Lonely Guy, Outrageous Fortune, etc. He was involved with the Motion Picture and Television Fund, public TV station KCET, Amnesty International, Inner

Council Rejects Outreach Plan For Townscape’s Gehry Project By Victoria Talbot A meeting to collect public comments on what to do with 6.5 acres of City-owned property in Beverly Hills’ Industrial/Entertainment District – east of City Hall – turned into a debacle Tuesday when staff instead produced a framework focused only soliciting feedback for a project proposal for a Frank Gehry development. The process for outreach presented by Community Services Director Susan Healy Keene, was soundly rejected by every council member, and it is unclear how Community Development staff could have made such a colossal miscalculation. “This proposal is. . . the antithesis of what the council directed,” said Councilmember Lili Bosse. “I cannot even tell you how insulting this is.” The proposed Gehry project calls for entertainment, media and tech office space, along with condominium suites, retail and restaurants, a public park and a hotel. The proposal introduced by MIG Consultants was for a process that would have disenfranchised a large segment of the community while creating a captive audience of a small

hand-selected segment of the population for the Townscape Partners project. In Phase 1, the consultant would “host nine one-hour focus groups to engage stakeholders in a dialogue about the future of the site,” read the agenda. The focus groups would come from businesses, neighborhood groups, task forces and commissions. “The input obtained. . . would inform a Virtual Town Hall meeting.” Such a meeting would be “attended” by computer. In Phase II, the consultants would introduce “details about the proposed project” in a single “City-wide community meeting,” including “impacts, benefits and trade-offs” in small group discussions to solicit feedback on the project. Phase III would result in a “set of guiding principles and direction,” that could be used to solicit Request for Proposals on the property. The $111,600 process would be paid for by the developers as part of an agreement concluded in April to accept a $1 million deposit from Townscape Partners to explore, “What the community wants for potential uses of the land [and] community involvement,” in a “transparent (see ‘TOWNSCAPE’ page 30)

Billionaire businessman Daren Metropoulos announced this week that escrow closed on his $100 million purchase of the Playboy Mansion in Holmby Hills. The deal allows Hefner, 90, to continue living at the mansion for the rest of his life. Metropoulos said: “The Playboy Mansion is one of the most iconic properties in the world and the crown jewel of Holmby Hills and the platinum triangle. “For the last 45 years, Mr. Hefner has imbued the estate with a rich and storied legacy. The property's heritage is not only that of a famous address. It is a true masterpiece in design, constructed by a noted architect for a family who played an important role in the development of Los Angeles in the early 20th Century.” The sale was handled by Hilton & Hyland’s Gary Gold

After consistent dialogue with Bel-Air Association leaders over construction parking running rampant near the east side of Bel-Air Road – north of Bel-Air Court – the Los Angeles Department of Transportation (LADOT) this week announced a “No Parking Anytime” restriction for that neighborhood. The street in question had become overrun with large construction trucks going back-and-forth in both directions, when Bel-Air Association leaders reached out in May to find a solution.

Judge Rules In Mohamed Hadid’s Favor On Hastain Hiking Trail, But Battle Likely To Continue By Matt Lopez As he continues to fight back against what appears to be an increasingly uphill battle in Bel-Air with his 901 Strada Vecchia megamansion, celebrity developer Mohamed Hadid appeared to notch a small victory in court earlier this month when an appellate court ruled hikers must stay off his privately-owned section of the popular Hastain hiking trail. The trail has been the subject of an ongoing court battle for years. In 2012, a lower court ruled in favor of letting the hikers use the trail.

The battle, however, appears long from over. Friends of the Hastain Trail, the group that filed the original lawsuit, have already indicated they plan to pursue a rehearing. The Hastain Trail runs through Beverly Crest’s Franklin Canyon Park and privately-owned land by Hadid. According to the Los Angeles Times, Hadid’s approximately 100-acre property–which he has owned since 2002–is zoned to hold up to 13 homes. Hadid has said he will gift some of the property to the Santa Monica Mountains Conservancy, although there

appears be no covenant in place holding him to such a claim. Hadid plans to include an alternate loop through the property that hikers may use, but Friends of the Hastain Trail say the land is at a much lower elevation and only has minimal lookouts facing west. Until a rehearing is filed, the ball will be in the court of the city of Los Angeles, who will have to decide whether or not to grant any construction permits to Hadid in the meantime.

group representing the Loma Linda Trust, commonly known as “the Aquilini project,” on Loma Linda Drive. The development incorporates liberal use of cantilevered floor area, retaining walls to inflate pad size and extensive excavation to create below grade floor area. Sitting together, the group openly laughed at resident Debbie Weiss, a mother of two, when she voiced her support for the ordinance, using the Aquilini project as an example. Minutes later, Aquilini attorney Alan Hearty verbally attacked Weiss, who says the project threatens the health and safety of her children. The lawyer, for several minutes, made exaggerated charges that she, too, is a “developer” because she is building a home in Malibu that is 10,000 square feet. The property constitutes 35.4 acres of mostly flat land and does not incorporate cantilevers or offpad floor area. “Aquilini’ s Loma Linda Trust representatives, including a member of the bar, chose to personally attack me rather than argue their case. The way they compared their project with mine was an apples and oranges distortion of the facts. I believe this was done to take focus off their own client’s missteps and misrepresentations that have resulted in a total lack of trust from the City and surrounding neighbors,” said Weiss.

In an email to the Courier, Hearty wrote, “Mr. Aquilini is not the owner of the properties,” a statement that belies comments Aquilini made himself in front of the Planning Commission, when he said he was building a home for his L.A. base. A billionaire developer in Canada, Aquilini is the owner of Aquilini Investment Group, the Canucks hockey team and the Rogers Arena it plays in. “The trust owns the properties. Mr. Aquilini is not the trustee of the trust. Nor is he even a beneficiary of the trust. Furthermore. . . the properties are under contract to be sold. . . Destroying Mr. Aquilini’s stellar name and reputation is. . . highly improper and unethical.” The ordinance accomplishes the following: • Requires an R-1 review for projects with more than 1,000 square feet of floor area off the level pad, resulting in greater review of projects involving large amounts of cantilevered or overslope development. • Requires that a level pad include a 20-foot by 20-foot level buildable area to be used in calculations of the maximum floor area allowed on a property as a disincentive to developing sites with multiple series of closely spaced retaining walls to artificially create long and narrow flat areas that artificially inflate square footage. • Reduces the “by-right” limit of export/import of earth from 3,000 cubic yards in a five-year period to 1,500 cubic yards for those properties immediately

adjacent to a street that is less than 24 feet wide. Requests for more than 1,500 cubic yards would require an R-1 review, thus providing another level of oversight and input from the community and City Planning to increase safety. To adopt the two provisions as an urgency ordinance would have required 100-percent of the three votes. Gold would not make the findings for an urgency ordinance, but it passed as a regular ordinance with the first reading Tuesday night. The second reading will be at the Aug. 30 City Council meeting. The ordinance will become law 30 days after the second reading. The ordinance was passed without a “grandfather” provision or vesting. “All projects with a completed application can move forward without regards to the ordinance,” said Wiener. The ordinance does not apply to a project that has filed a complete application for a building permit, provided it has not expired or lapsed, and precludes changes other than those needed to satisfy project design from planning. Krasne and Bosse returned for the import/export, however, restoring the council to five members. The draft ordinance from the Planning Commission recommended 2,000 cubic yards of export/import earth on streets less than 24 feet in width in order to trigger an R-1 review. The council reduced that to 1,500 cubic yards, consistent with regulations in neighboring Bel-Air.

“I can’t get the accidents (on Loma Vista Drive, which killed two LAPD officers in runaway vehicle accidents). I would rather go down to 1,500 to trigger an R1 review,” said Reims. “It is a higher level of protection.” “It doesn’t mean they can’t build their dream home,” said Bosse. “This is common sense. It’s just a review process. What I do think is important is looking again at safety on those streets. . . This should be an urgency ordinance. The findings for that is that there is a current and immediate threat to public health, safety and welfare. That warrants review and. . . I can make the findings.” This ordinance applies to 14 streets in the Hillside area, and possibly three others that are still being analyzed to discover if they are less than 24-feet, leaving 46 streets over 24-feet. Under questioning by Bosse, it was determined that three current projects could be caught by the urgency ordinance, including the two in the Loma Linda Trust. The Urgency Ordinance was adopted, “to protect the public safety, health, and welfare from an event, occurrence, or set of circumstances different from the event occurrence or set of circumstances that led to the adoption of the prior interim ordinance. Specifically, fatal accidents involving construction vehicles on City streets have occurred since the prior interim ordinance was enacted, warranting closer project review and imposition of appropriate conditions of approval and mitigation meas-

ures. With more intense development experienced in the City additional safety issues associated with construction parking and traffic have arisen. Further, three slope instability issues requiring remediation in the Hillside Area have occurred in the last two years, again warranting closer project review and imposition of appropriate conditions and mitigations. The prior interim ordinance was not based on the slope stability and fatal accidents that occurred after that prior interim ordinance, or the recent intensification of development in the Hillside Area of the City, which has intensified to such a degree that consistency with General Plan policies is being implicated,” said City Attorney David Snow. The urgency ordinance passed 5-0, thus the ordinance governing excavation is effective immediately. Urgency ordinances extend for 45 days and can be renewed. However, the ordinance was also passed as a regular ordinance for projects that are vested, as defined by the state of California. That would require that permits are issued and that the project employs the permit by beginning construction (“shovel in the ground”). Therefore, the first reading being Tuesday night/Wednesday morning, the second reading of the ordinance will be at the Aug. 30 City Council meeting and the ordinance will go into effect 30 days after the second reading. That would follow the expiration of the 45-day urgency ordinance.

By Laura Coleman Every time Beverly Hills resident Janet Rosenblatt hears the sound of Yiddish being spoken, it immediately whisks her back to childhood. The daughter of Holocaust survivors, Rosenblatt has endeavored to keep the Jewish language alive in her own home. To that end, over the past few years, she has culled a group of Yiddish-speaking women, primarily children of survivors, who meet monthly in her home for what she calls “inspiring evenings” where everyone converses in Yiddish. Over the years, the women, roughly 15 of them, have formed deep bonds rooted in their shared history and their passion for the historic language. Earlier this week, one of the ladies, Carol Stulberg, a child of survivors who now serves as the director of Leadership

Giving for the United States Holocaust Memorial Museum, arranged for the group to visit the museum’s “State of Deception: The Power of Nazi Propaganda” exhibition which runs through Aug. 21 at the Los Angeles Central Library downtown. Almost 80 years have now passed since Adolf Hitler led the German annexation of Austria in 1938; and the exhibit’s depiction of just how the monstrous leader rose to power is harrowing. More than 31,000 people have already visited the multimedia environment that vividly illustrates the insidious allure of Nazi propaganda. In light of the Holocaust that murdered 6 million Jews, all the women agree that it continues to be crucial that people think critically about the messages they receive and news they read.

Florence Foster Jenkins is a film about a slightly off-balance wannabe opera singer suffering from the effects of syphilis? Why? On the other hand, a film starring Meryl Streep (Florence Foster Jenkins) and Hugh Grant (St. Clair Bayfield), a ne’er-do-well Shakespearean actor who became her flamboyant partner/manager. Why not? The stars don’t disappoint and Simon Helberg (The Big Bang Theory) as Jenkins’ flustered and embarrassed accompanist (Cosme McMoon) hits the right notes as his performance is a welcome addition to Nicholas Martin’s screenplay, acing every comedic facial expression and line reading.

Jerry Cutler On Film It’s New York heiress Jenkins’ money, not her voice, that fills the venues and Bayfield’s business acumen that distributes the dollars as an inducement for members of the private clubs Jenkins supports, and elderly sophomoric music lovers to attend. Although Stephen Frears’ direction and Martin’s writing are, for the most part, praiseworthy the underlying question is do we revel in Jenkins’ strong desire to sing opera and be recognized as an accomplished diva or do we cringe and pity her because she is delusional —obviously suffering from the effects of her illness? Does the humble career and terrible singing of Florence Foster Jenkins deserve our money at the box office? Madeleine Dahm Helms Premiere Of Oktoberfest Musical Thanks to Madeleine Dahm and the creative team of Oktoberfest The Musical—An Almost True Story, people don’t have to travel to Bavaria to celebrate this year. Dahm is directing and choreographing the musical that tells the Oktoberfest story—a celebration following the marriage of Crown Prince Ludwig and Theresa von SaxonHildburghausen on Oct. 17, 1810— in music, dance and comedy. Opening Friday, Aug. 26, the setting will be Westwood’s Crest Theatre (1262 Westwood Blvd.), transformed into a German beer hall, complete with that traditional beverage and pretzels, served at long tables with benches. Dahm, also a resident artist at The Wallis Center for the Performing Arts, was approached by Ginger Perkins, producer and concept developer, about the project. “I was intrigued,” says Dahm. The conceit is that the play’s serious producer wants a historically

accurate dramatic show. The emcee she hires, deems it too serious and turns it into “an almost true” musical romp. When the producer unexpectedly returns, the cast and emcee have Madeleine Dahm to convince her to let them do it their way. Another attraction for Dahm was getting to work with show creators Grammy-winning composer Harold Faltermeyer (Beverly Hills Cop), actually from Germany, and Philip LaZebnik, book and lyrics along with Faltermeyer. “They’ve both been great to work with,” says Dahm. “And Harold has created a textured score,

to be played by a live band, including the traditional tuba, that features ragtime, blues, a folk feel, jazzy burlesque and a beautiful love duet that could come from a movie.” With authentic period costumes by Georgia Richardson, the show also gives Dahm the chance to bring traditional Bavarian dance moves to her modern sensibilities. In London, she studied with both Pina Bausch and Martha Graham Dahm joined the The Wallis Center for the Performing Arts last year and helped develop the Art of Choreography program. She spent a year mentoring 16 young choreographers culminating with Mo.men.tum which she directed and staged at The Wallis in May. Thanks to the combined efforts of Beverly Hills’ GP DEVA X-Power Gallery and L.A. Arts Alliance, patients at Children’s Hospital Los Angeles (CHLA) will have new artwork to move and inspire them. The gallery worked with one of its collectors, Peter Drivas, founder of the Los Angeles Arts Alliance, to organize an “Art and Charity” event last month, centered on artist Cindy Thornton’s debut Beverly Hills exhibition, “Dreamers.” The goal of the ticketed event was to raise money to “donate as many paintings in the collection as possible to the hospital,” said Gallery Manager Rachael Hsin. Ticket proceeds and a 20percent donation from the gallery for each sale (five sold at the event) raised enough money to allow the alliance, a local nonprofit focused on continuing art eduction for children, to buy five paintings for the hospital. “At this charity event, people could see they were raising money for something tangible,” said Hsin. “Their donations went to paintings that

learned as much as I could. I feel that I will be a much more knowledgeable superintendent in my second year. I’ve learned a lot, and I think that what I’ve learned is very valuable for moving the district forward. I’ve learned that, obviously, you have to take a more global look at the district in my position. You have a Board of Education [and] they are my direct supervisors, so obviously I have to deal with that. But I also take a global look on making sure that all five of our schools are doing well. The Courier: Given your unique position within the district over the years, how has this primed you to successfully lead the City’s five public schools. Kessler: Being from Beverly Hills and teaching this long, community relations have been very strong with me. I feel as though we have made some real headway in our relationship with the City of Beverly Hills. I feel that being involved with various groups around the City (including Rotary and the Chamber of Commerce) I have been able to spread the word about our district in a more positive light. I think one of the more important things I did in my first year was I attended at least two PTA meetings at every single school, as well as two staff meetings at every single school. So, obviously, I’m trying to make myself visible, trying to engage as many different people as I can. The biggest thing overall I’ve learned...when you work in a school district where so many people care about what’s going on you have to be receptive to all different thoughts and ideas and allow for individual differences because even though people come from different perspectives I really believe, for the most part, that they do have the best interest of the district at heart. So you have to be respectful to different peoples’ thoughts and ideas. Being educators, I think it’s important that we listen to all that. The Courier: For this year, what new and continuing programs are you most enthusiastic about? Kessler: Let’s talk about what happened over my first year. In a collaboration of the board and the superintendent as well as other site administrators and the community too, there are new Beverly Hills High School graduation requirements. We’re not lowering academic criteria, but allowing for different pathways and allowing for individual differences amongst our kids. For the first time, every child who comes to Beverly will have to sit down with a counselor and map out a four-year plan for them to go to a four-year university. Every one of them. So

BEVERLY HILLS you go with your parent, you meet with a counselor, and you map out your plan. From there, if there’s any adjustments to the plan, you have to reconvene with the counselor and the parent and the student. The most important thing is I do see the need to increase obviously our test scores, our four-year graduation rate, all the things that people have been talking about, and I do believe these Beverly Hills High School graduation requirements affect all these things. I’m really really happy about that. The second thing is that the board and I have, for the first time now, rejuvenated the reading specialist at all of our K-8 schools. The board has graciously allowed four new reading specialists and four new math specialists to go to every single school to help our kids who need help accessing the curriculum. The other thing that the board approved is a separate health course which was, for some reason, imbedded into the biology course. The teachers weren’t happy that they were having to teach health as part of biology. When we were able to meet with the high school teachers just now and tell them of different high school graduation requirements as well as this health class, they were really happy about that. You could see that their spirits were lifted by that. The other thing is obviously modernization. It’s taking up a huge part of my day every day. We’re affecting all five campuses. We are. And very shortly we’re going to be holding a study session on Hawthorne School to see which direction the board wants to go with that because right now the only thing they’ve approved is doing the Hawthorne auditorium. The Courier: In light of the uphill battle the board is facing going forward with a new bond this year, what do you expect the financial picture to look like surrounding the decisions around Hawthorne. Kessler: Does the board want it to be another Horace Mann with underground parking? They have to make a final determination because, as you know, Horace Mann is set. I heard the nicest thing from a kid when I went by there the other day. I said “What do you think of your school?” The kid looked at me and said “Coach, all the kids are talking...we’re in a luxury hotel to go to school!” Isn’t that so sweet. Out of the mouth of babes. So modernization is going to be a big thing.

“inactive and suspended by the California Secretary of State.” Organization president Robert K. Tanenbaum has denied this and says he submitted copies of the minutes of a June 29 board meeting to the City where members present voted unanimously in favor of the initiative. The two members who did not attend are the two that wrote the letter opposing the initiative. The suit also alleges that a separate signed covenant to guarantee the garden and open space will be permanently protected with two hours of free parking for Beverly Hills residents is false, because the initiative does not guarantee free parking or an easement to protect public access to the opens space. A Hilton spokesperson says that such a covenant is “in the process” of being written, providing the initiative passes. The suit also alleges that the

argument in favor is false and misleading for not stating the height of the combined eight story and 18 story building. In fact, there is no height stated in the pro argument. “This is a frivolous lawsuit,” said Tanenbaum. More interesting than the lawsuit is the committee funding the newly-formed committee “Beverly Hills Residents and Business to Preserve Our City.” The committee is sponsored by Wanda Beverly Hills Properties, LLC and Athens BH Development, with major funding from Lakeshore East Parcel P, LLC, a US-based Wanda organization, so that the money originates in the US. (Editors note: Direct foreign funding is not allowed in an election). Interestingly, in Chicago, Mayor Rahm Emanual was a strong advocate for the 88-story Wanda Vista Tower. An investigation later found that executives, employees and associates with Wanda’s partner in the project, the Magellan

Development Group, donated $63,000 to Emanuel’s campaign. Two days after the Athens Group filed a lawsuit against the Hilton initiative, COO Jay Newman sat in an executive board meeting of the Beverly Hills Chamber of Commerce during a presentation by Beny Alagem, asking the Chamber for their endorsement. The Chamber has long taken a stand in support of the Wanda project, endorsing the One Beverly Hills project in ads. But they have been slow to support the Hilton’s project, even keeping Alagem waiting in the lobby before he could make his presentation. Newman sat through the presentation and stayed in the room when Alagem departed while the Chamber Executive Board, of which Newman is a member, discussed whether or not they would support the project. Section 5233 of the California Corporations Code is

very specific about what a board must do when one of its members has a personal financial interest in a transaction that may affect that individual’s judgment. It could be construed that Newman, who will represent the initial sales of the condominiums for the project, will benefit financially. A decision to support the Hilton Initiative would support a business that has loyally supported the community for over 60 years and is the City’s largest employer. Since Alagem purchased the property in 2003, the Hilton has contributed $27,924,000 in Transient Occupancy Taxes and Sales, property and other taxes to the City coffers. Additionally, they report permit and related fees for the Waldorf Astoria construction have contributed $8,250,000 and additional Public Benefits for the Development Agreement and BHUSD school benefit fees totaling $7,160,000.

The 4th annual Ping Pong 4 Purpose celebrity tournament was held last last Thursday at Dodger Stadium, raising more than $500,000 for Kershaw’s Challenge. Launched by Los Angeles Dodgers’ Pitcher Clayton Kershaw and his wife Ellen, the goal is to encourage people to utilize their individual passions and talents for the betterment of others. Actress Susan Sarandon is honorary chair while Ann Higginbottom is executive director. Receiving the inaugural “Kershaw’s Challenge Impact Award” was Dennis Gilbert, founder of The Professional Baseball Scouts Foundation, a life insurance and former super sports agent. Co-host Will Ferrell welcomed the more than 500 guests and saluted sponsor Stiga for donating 12 of the ping pong tables used to local centers and five elementary schools through the Dodgers Community Outreach programs. The evening’s emcee was Matheiu Forget who explained the rules of play to the 60 celebrity, sports and VIP players featured a single elimination tournament. Taking home top honors were Mike Singer and Steve Kunimoto.

He appeared in several 1940s MGM musicals with such performers as Sinatra, Gene Kelly, Judy Garland, Jane Powell, and Kathryn Grayson, to name a few. They are dedicated to José Iturbi’s mission of creating opportunities to promote classical music in Los Angeles and the world. The Jose Iturbi Foundation’s motto is “Popularizing classic music – one note at a time!” Its blockbuster concerts feature international superstars and forums for classically trained young pianists and singers to debut their talent, launch their careers. Unless you were raised on a different planet, you probably learned to read–in large part–from comic books. Although “reading” is perhaps too strong a word when referring to these visually captivating picture books featuring outlandish heroes and villains in a constant struggle between the forces of good and evil. Over the past years, a movement called “Comic Con” has sprung up around the world featuring everything comic book, with the most noticeable feature being the lavishly costumed attendees, painstakingly made-up in the guise of their favorite comic book character. This year, the zombies unearth their coffins and un-holster their weapons on two separate occasions in the Coachella Valley. Comic Con Palm Springs (CCPS) takes place Aug. 26-28 and–note the name shift–Palm Springs Comic Con is slated for Nov. 19 and 20. Along with the traditional horror-show venders, CCPS will feature a discussion with best-selling author (The Devils Advocate) and Palm Springs resident, Andrew Neiderman. Also attending the CCPS is Stan Lee, legendary creator of Marvel Comics and its stable of zombies and heroes. Lee will hold a Q&A and be part of a VIP dinner for select attendees. ****** From a world entirely different than Comic Con, Sunnylands Center & Gardens has announced it will reopen for the season Sept. 22, and that for the first time since the Annenberg estate became accessible to the public four years ago, there is a change in the schedule for the constantly soldout sale of tickets for tours of the historic house. Tickets will be released at 9 a.m. the 15th day of each month for tours scheduled the following month. For example on Sept. 15, tickets will be released for tours in October; and October tickets will be on sale for tours in November. Further, Sunnylands Center & Gardens will be open Thursday through Sunday from 8:30 a.m. to 4 p.m. Admission to the Center & Gardens, which includes nine acres of desert gardens, art and educational exhibits, a café and a gift shop, is free. Tickets for the 90-minute Historic House Tour are $45, while the Open-Air Experience (a 45minute shuttle tour of the 200-acre grounds and golf course) are $25 per person, which can be purchased only in person on the day of the tour. Vice Mayor Krasne Bows To City Attorney Weiner On Recusal– But Not Without A Staunch Fight

By Victoria Talbot Vice Mayor Nancy Krasne brought her own attorney to Tuesday’s City Council meeting Tuesday, reminding the community that Krasne is nothing if not a fighter for residents. Graciously relinquishing her position in opposition to recusal however, Krasne took the high road and exited Council Chambers with Councilmember Lili Bosse while the remaining councilmembers debated the first two of four ordinances on the proposed Hillside Development Ordinance. Krasne did not give up without first fully vetting her position on the recusal question. In front of a packed Council Chambers, Krasne presented her position. Brandishing extra-large panoramic photos of her neighborhood, Krasne explained that her own 27,000 square foot lot is flat pad, of which 7,000 square feet is front setback. Her argument was that the property did not require artificial expansion of the level pad by any means because the buildable area is 73-percent of the entire lot, with the slope occupying a required setback. “The line that was drawn [to mark the Hillside Zone] is arbitrary and capricious. The only people who can vote on the Hillside Ordinance must

prove they don’t live there, which disenfranchises the whole Hillside area. I just don’t want to recuse myself,” she explained, pointing out that former Mayor Maralee Goldman and former Planning Commissioner Jerry Magnin brought the original Hillside Ordinance forward, and they are hillside residents. Counsel Bob Weiss said that Krasne had no legal obligation to recuse herself because the ordinance affected every resident city-wide with view shed, truck traffic and loss of natural topography. Weiss argued that everyone who uses the streets is affected and that there was no material financial interest for Krasne that would trigger recusal. City Attorney Larry Wiener said that he had received a letter from Attorney Ben Reznik with similar arguments, and forwarded that to the Fair Political Practices Commission Senior Commission Counsel Zachary Norton in Sacramento. “Prior to June 2015 the standard was based on whether the ordinance would affect 10 percent of the City population. If you lived in an area. . . that comprised more than 10-percent of the City as a whole, you were part of a significant segment. In June of 2015 that changed to 25-percent,” said Wiener. “The problem with the

Despite Metro having failed to properly consider or respond to concerns over environmental effects and disruption from tunneling under Beverly Hills High School before approving station locations for the subway project, the proposed route for the extension of the purple line subway is still set to run under Beverly Hills High School. If Judge Wu had ruled to vacate the Record of Decision, as representatives for the City of Beverly Hills and the BHUSD advocated, Metro would then not have the funding in place, including a $1.2billion federal grant, to be able to move forward with the project as now planned. Wu wrote in his ruling that he was sensitive to that fact. Stated Board of Education President Howard Goldstein: “The judge found that the FTA violated federal law, specifically the National Environmental Policy Act (NEPA) when it approved the segment of the project that would go under Beverly Hills High School.” Goldstein added: “The judge also recognized that the further safety analysis that the FTA must do to correct those NEPA violations may well be superficial and if they turn out to be insufficient the BHUSD will have further claims against FTA.”

LETTERS TO THE  EDITOR Next Thursday night (Aug. 25), Beverly Hills Concerts on Canon will host the Stephen Wise Temple band, known for outstanding musical presentations at its reformed synagogue in Bel Air. This will be a family friendly pop music concert with some traditional Hebrew songs included. Yoshi Zweiback is the charismatic new senior rabbi at Wise Temple, only its 3rd in some 50 years. He leads the Wise band with his storytelling, singing and guitar. As a true visionary on the bima, he has developed quite a following in his first year there and has a real love for our City as regular patron of Nate N' Al, The Beverly Hills Hotel, and Factor's Famous Deli on Pico. Also at the concert will be Cantor Nate Lam, a Hollywood legend with his major talent showcased at Wise Temple for this, his 40th year. He has done multiple work in the entertainment industry as been a voice coach to major celebrities, while also bringing his brilliant baritone to the Wise congregation. Joining them for this very special night of music, the second to last concert of summer 2016 at Beverly Canon Gardens, will be bandleader David Kates, Cantor Emma Lutz, and supreme vocalists Sara Mann and Whitney Norton. However, I doubt that its repair will be taken seriously as the Safety Commission hasn’t even taken notice. I am not sure about what exactly is its job, but it is certainly not to our advantage. At the Feb. 2, 2016 City Council meeting, Gehry and Townscape Partners Managing Partner Tyler Siegel submitted the unsolicited proposal for a development designed by the Pritzker prize-winning architect. The proposal would eliminate, “inferior uses that denigrate the area. . . in order to transform the hotel’s surroundings into a location suitable for a five-star product,” according to the proposal. The area is currently the location of several synagogues, two animal hospitals and the Amanda Foundation, Lakeshore Entertainment, and several other businesses. “This proposal will give the opportunity for our community, through many public meetings, the ability to share their vision for how they want our City's last remaining open space property to be used,” said Councilmember Lili Bosse Feb. 2, noting that the focus was to be on public input, not the Gehry project. “Originally, we said to the developer and his agents that this is not something we are looking for in that area. Seeing how they are proceeding forward I don’t think we are going to get the feedback we want. We are wasting time. Return
