CATASTROPHIC INJURY MEDICAL MALPRACTICE WRONGFUL DEATH
O
VER THE PAST SEVERAL DECADES, Steve Yerrid and the trial law yers of The Yerrid Law Firm, P.A., have built one of the most successful civil trial practices in the country. Led by Yerrid, who has represented clients in a multitude of high-stakes and precedent-setting cases, the firm has secured more than 300 settlements and verdicts of $1 million or more (which includes numerous 8 and 9 figure results) for individuals and the families of those injured or killed by the wrongdoing of others. “We exert every effort to ensure that our clients have the strongest possible voice in court, even against the most formidable and well-funded wrongdoers,” Yerrid said. “We strive to secure appropriate monetary reparations, but also to make a difference and prevent similar incidents and tragedies from repeating—whether that’s in a specific circumstance or in a nationwide industry. That year, he successfully defended John Lerro, the harbor pilot who commanded the 608foot bulk freighter that struck the mammoth Sunshine Skyway Bridge in Tampa Bay, causing its collapse and 35 fatalities. As a result, the new Sunshine Skyway Bridge, which opened in 1987, serves as a template for the construction of new bridges not only in the United States, but throughout the world. The enormity of the case drew international attention and continues to resonate with the Tampa Bay community, so much so that in 2019, a needed documentary about the event and its dramatic courtroom aftermath will premiere. The Skyway Bridge Disaster explores how then-30-year-old Yerrid won Lerro’s complete exoneration using an “Act of God” defense, in which he proved that nothing humanly possible could have been done to change the outcome or alter the course of events that took place. “Defending John Lerro was an unforgettable experience and truly an honor,” said Yerrid,
who produced The Skyway Bridge Disaster with Florida filmmaker Frankie VanDeBoe. “It was one of my earliest professional achievements and my relationship with John— even since his passing years ago—keeps me grounded every day.” Yerrid was in the national spotlight again in the 1990s when he was tapped as the youngest member of the 11 trial lawyers selected by the late Governor Chiles, referred to as his “Dream Team,” in the State of Florida’s historic lawsuit against the then-undefeated cigarette industry on behalf of Florida taxpayers and children. The case resulted in a $13 billion settlement which at the time, was the largest civil monetary settlement in U.S. history. Of equal importance were the advertising restrictions mandated to the cigarette industry and the subsequent societal sea change that drastically reduced youth smoking. “That outcome yielded unprecedented concessions that stopped child pandering, eliminated billboards, vending machines, and Joe Camel and permanently retired the

Marlboro Man, as well as created tobacco prevention programs built around youth,” he said. “Ironically, as part of the settlement, we required Big Tobacco to fund the Truth.org campaign, which continues to lead a major anti-smoking movement in the United States.” In 2006 he obtained a $216 million verdict, which remains the largest medical malpractice verdict in Florida history. In 2010, when the Deepwater Horizon oil spill caused one of the largest maritime disasters in the nation’s history, Florida Governor Crist appointed Steve Yerrid as the special counsel to handle the tragedy and its aftermath. Subsequently, Yerrid was retained by Mayor Buckhorn to represent the City of Tampa in its litigation, and he secured $27 million, the largest recovery BP Oil paid to any United States city. Given his proven talents both in and out of the courtroom, Yerrid has received many accolades. He has been named “Lawyer of the Year” by The Best Lawyers in America © on several occasions. In 2016, he was
honored to be inducted into the National Trial Lawyer Association’s Hall of Fame—a group comprising the countr y ’s mos t distinguished trial law yers, who have all earned recognition as champions for justice. He has received numerous awards and recognitions throughout his career, and he is particularly proud to have been a member of the Inner Circle of Advocates for the last 25 years. The Inner Circle is an invitation-only elite organization composed of the top 100 plaintiffs’ lawyers in the country. Most recently, The Yerrid Law Firm has been repeatedly hired to handle matters that involved sports fatalities and catastrophic events. The results Yerrid and his firm have achieved on behalf of both college and high school student-athletes who were injured or died during practices and conditioning drills have resulted in widespread changes to both university and high school safety protocols. Currently, he is also one of the lead lawyers in a “bellwether case” against MGM Resorts International representing victims of the

Banker Lopez Gassler: Chris W. Altenbernd (Appellate Practice, 2019) is representing Hillsborough County Commissioner Stacy White in an appeal against a tax known as All For Transportation that was approved by voters in November 2018. White is arguing that a state statute is being violated by the charter amendment. A circuit court judge in Hillsborough County already struck down some provisions of the law but left the tax in place. White is asking that his appeal be joined to another lawsuit that is challenging a tax bond validation in the same law. The Chair of All For Transportation, Tyler Hudson plans to have his group move forward with implementation in spite of the appeal.

Larson & Larson: Justin Miller (Litigation – Intellectual Property, 2017) is representing the family of Imani Bell, a 16-year-old student of Elite Scholars Academy in Clayton County, who died after participating in outdoor activities that saw temperatures over 100 degrees. After running stairs in temperatures that were reportedly 109 degrees, Bell collapsed and later died after paramedics rushed to the scene. The school appears to have violated district policy that mandates all outside athletic activities be stopped once the heat index reaches 95 degrees. “The school has a policy,” Miller said. “The Georgia High School Athletic Association has a policy. Everyone has a policy, but no one was making sure the policy was being followed.” Miller has stated that the school has been reluctant to provide information regarding the circumstances of Bell’s death. Miller is also a cousin of Bell. Morgan & Morgan: David ► Henry (Personal Injury Litigation
- Plaintiffs, 2020) represented the Shaka Bar in Pensacola, FL. from a rival bar that sought to have the name changed because it sounded too similar. The owner of Sandshaker Bar reached a compromise with the Shaka Bar’s owners to have a Hawaiian ‘hang loose’ hand gesture underneath their logo to further David G. Henry symbolize a Hawaii theme. In the original lawsuit, the Sandshaker contended that tourists were often confusing The Shaka bar with The Sandshaker and were losing business. The lawsuit lasted over three years and in the end, the owners of the Shaka Bar were able to keep their name. “We always contended it was an action without merit and that is what it was,” Henry said.

INJURED VETERAN FIREFIGHTER SEEKS JUSTICE FROM CITY
obert F. McKee: Robert F. McKee (Employment Law – Individuals, Labor and Employment Law, 2012) is representing firefighter Lt. Jason Francis, who received a thyroid cancer diagnosis, against the city of St. Petersburg. A new state law provides benefits to firefighters who are diagnosed with cancer, but the city claims that his diagnosis came in May of 2018, well before the July 1, 2019 date the law went into effect. Francis, a 16-year veteran of the St. Petersburg Fire Department underwent surgery to have his thyroid and several lymph nodes removed. “The principal benefit is assistance with all the out-ofpocket expenses that a cancer patient undergoing treatment would endure,” said McKee. “As far as the city’s concerned, he’s out of luck.” Francis and McKee dispute the city’s claim and contend that the diagnosis came in January of 2019. “I have no idea where they got that from,” Francis said at a press conference when asked about the May 2018 date. “I have medical documents from the
hospital that state I was diagnosed on January 9 of this year.” In spite of the diagnosis arriving before the law went into effect, they feel that the city should provide some assistance. “I’m just not looking forward to the battle. I thought they would treat me like a human asset,” Francis stated. In a statement to WFLA, a St. Petersburg City spokesperson argued that Francis did not qualify for the benefit under the law because his diagnosis occurred in May 2018, whereas the law went into effect July 1, 2019. However, McKee believes that the lawsuit will force the courts to test how far back retroactive coverage will be allowed. Other than the dispute regarding date of diagnosis, Francis meets all criteria for assistance under the new law. State Rep. Chris Latvala, a sponsor of the bill, released a statement from his office criticizing the city for the treatment of Francis and noted that the intent of the bill was not to make July 1, 2019 a hard cutoff date.

A federal appeals court restored Palin’s lawsuit and her opportunity to prove her claims that the newspaper wrongly accused her of inciting a mass shooting that severely wounded former Arizona congresswoman Gabriel Giffords. The 2 nd U.S. Circuit Court cited procedural concerns with the lower court tossing out the claim too quickly before Palin could obtain evidence that might aid her claim. The lawsuit still has a long road to go as she will need to prove that The New York Times acted with actual malice. “Nothing in this opinion should therefore be construed to cast doubt on the First Amendment’s crucial constitutional protections,” the 2nd Circuit said. It said it recognized that “First Amendment protections are essential to provide ‘breathing space’ for freedom of expression.”

Yerrid’s historic actions against Big Tobacco and BP Oil are well documented, and his more recent cases and resolutions in the areas of student and public safety have furthered the legal protections of Floridians and Americans. “Our involvement ultimately leads to one thing: justice,” Yerrid says. “Our clients always clearly convey their definition of justice. Whether it’s a change in the law, how a company conducts business or compensates those injured and killed as a result of their wrongdoing, or a combination of those, we fight to secure justice on our clients’ behalf.” RIGHTING WRONGS AND PREVENTING FUTURE HARM For several years, Yerrid has been representing college and high school

student-athletes—locally and across the country—who have been injured or died related to training or medical complications. Two of his most influential results occurred in Hillsborough County, Florida. In 2016, Yerrid represented Wharton High School football player Sean McNamee following a severe head injury during practice that put him in a coma. In addition to negotiating a $2 million settlement with the Hillsborough County School Board on behalf of the NcNamee family, Yerrid convinced the board to agree to provide an additional $1 million in general liability coverage above the very limited cap of $300,000 in total damages allowed under Florida’s Sovereign Immunity Law that “protects” public entities. The board also established new safety guidelines patterned after the NFL’s concussion protocol. “That was a great first step,” Yerrid notes, “but our next mission is to see that the other 66 counties in Florida follow suit, increase their coverage, and institute appropriate protections and protocols for all studentathletes and their families.”
In 2019, when Middleton High School 14-year-old freshman Hezekiah Walters lost his life in a football “conditioning” drill, his parents turned to The Yerrid Law Firm. Following Walters’ death, which was attributed to overexertion during conditioning, it was revealed that no medical professionals or trainers were onsite while Walters was suffering. This is an oversight Yerrid and his firm have set out to correct throughout Florida. He has thus far praised the district for taking initial corrective measures to ensure student safety but has publicly said that he hopes the board will institute other recommended changes to ensure no one suffers the same fate and to possibly avoid litigation. In an almost immediate response, the school board passed a measure requiring the hiring of full-time athletic trainers at every school during practices, conditioning drills, scrimmages, and official games. Further, additional safety procedures were instituted along with a requirement that all coaches attend every practice and game. “Parents entrust the welfare of their children to public schools, and those schools

need to validate that trust by considering the health risks of any student-athlete stepping onto a playing field,” Yerrid says. “These matters deal with far more than money— families sincerely want to change protocols to ensure no one else endures such horrific experiences. And we’re making sure their voices are heard.”
HOLDING CORPORATIONS ACCOUNTABLE Yerrid is one of the lead lawyers in what has been labeled a “bellwether case” against MGM Resorts International, representing Todd and Lori Kammer, two Los Angeles County deputy sheriffs who were on vacation and attended the Route 91 Harvest music festival in Las Vegas on October 1, 2017. That night, the married couple and parents of three found themselves amid a hailstorm of bullets that killed 58 and wounded more than 500, during what was the deadliest mass shooting by a single gunman in U.S. history. The hundreds of plaintiffs claim that MGM’s Mandalay Bay Hotel, where the shooter was perched, was negligent in allowing him to bring a large

amount of weaponry into the building and set up his shooting gallery. “Lori and Todd’s training kicked in, and they sprung to action to help protect victims and bystanders,” Yerrid says. During the chaos, a bullet shattered Lori’s pelvis and caused severe internal injuries. “The Kammers showed incredible bravery and saved lives during one of the worst crises of our time. They are heroes, and they deserve justice and compensation in order to help them heal physically, emotionally, and psychologically,” Yerrid says. “It is an honor to represent this family in this historic and tragic case.”
GIVING BACK In addition to his exceptional legal career, Yerrid serves as President and Chairman of the Board of The Yerrid Foundation, his self-funded, nonprofit organization which has donated millions of dollars to hundreds of charities over the years, many of which focus on causes to benefit children. Yerrid has also served as a patron and is a past Chairman of the Gentlemen’s Committee of The Children’s Home, one of Tampa’s leading charitable organizations dedicated to abused and neglected children. AMILY AND COMMUNITY. That is at the core of Marie Tomassi’s legal practice. The 2020 St. Petersburg “Lawyer of the Year” honoree in Appellate Practice found it to be “such an honor and very rewarding” to receive the recognition from her peers. The field of appellate practice captured her attention right from the start. In what is seemingly a contradiction, the routine procedure of appellate law work and the variety of the cases is what satisfies the modest attorney. Tomassi couldn’t single out any specific cases over the past year and felt the body of work she has handled is what earned her the award. Tomassi still practices at the same firm she clerked for in law school. “I had no idea how lucky I was,” she said when describing how she got her start at Trenam Law. “I was trained by the best of the best.” That same firm still produces a unique energy and dedication to their practice that provides her with an enthusiasm to deliver. “I love the people—we really do have a great group of people,” Tomassi exclaimed. “It is very team
focused. There is a collegial culture and a standard of excellence here.” Tampa-St. Peterburg is a glimmering society soaked in the western Florida sun. There is a vibrant expanse of culture, sports, entertainment, restaurants, malls, beaches, and blend of people that come from all walks of life. The two areas separated by just over 20 miles of the Tampa Bay are frequently spared from the devastating hurricanes that strike Florida every year. As Hurricane Dorian prepared to strike the area, Tomassi and her firm were ready to help however they could. “When Hurricane Dorian came through, we organized water, generators, and supplies for people in need.” That isn’t the extent of their generosity. This year her firm also plans to build a home in the community through Habitat for Humanity. “I love the Tampa community. I love St. Pete.” Tomassi stated. “I would like to continue practicing with the lawyers and judges and community. The level of commitment I have received from all of them, I would hope to match what I have received.”
