Highlights

Our research begins by analysing firms by practice area in their geographic locations against local competitors. For Australia, we researched 83 practice areas and eight geographic jurisdictions: Sydney, Melbourne, Canberra, Brisbane, Perth, Adelaide, Darwi and Tasmania. Through our localised research, we awarded 4,114 regional rankings. Once the regional awards were determined, the research team evaluated firms with a national presence in 25 national practice areas. Of the eligible firms, 85 in Australia are also highlighted for their national coverage, servicing clients in multiple locations. The final awards determined are our “Law Firm of the Year” designations bestowed to a singular firm for professional excellence amongst all others in a practice area. Twenty firms have received this pinnacle of honours.

Methodology

Relying on the industry-vetted Best Law Firms research methodology, established in the United States in 2009 and refined over 15 years ago, we analysed the feedback of clients, lawyers and firm leaders, along with the firmographic details supplied by the firms. Firms are eligible for Best Law Firms consideration after receiving individual professional recognition in The Best Lawyers in Australia™.

For the inaugural year, firms, clients and lawyers participated in our research process in staggering numbers.

Eligibility

Firms with at least one lawyer recognised in the current edition of The Best Lawyers in Australia™ in a practice area ranked by Best Law Firms are eligible to receive a firm ranking in that practice area in Australia. For more information on Best Lawyers® awards, please visit www.bestlawyers.com.

Practice Areas

Practice area rankings are produced across states and nationally across Australia. Some practice areas are highly specialised, with limited firms participating, preventing sufficient data collection for proper evaluation informing the rankings. National practice areas are specialties that have a preeminent national presence within a specified legal practice and inform the Law Firm Leader Survey.

We researched 83 practice areas and eight geographic jurisdictions: Sydney, Melbourne, Canberra, Brisbane, Perth, Adelaide, Darwi and Tasmania

Submission Process

As part of our research process, eligible firms are sent submission packets in November. This packet includes information about a firm’s eligibility, access to their law firm survey, and the portal to provide clients and professional references. Our researchers ask law firms to provide us with firm composition data, practising lawyer demographics, client and professional references and other data that speaks to the strengths of a law firm’s practice area(s).

The Best Law Firms™ methodology remains consistent and unchanged since we began awarding law firms in 2010.

Additional Feedback

Analysed

We ask clients and professional references to provide feedback on firm performance addressing six criteria: expertise, responsiveness, understanding of a business and its needs, cost-effectiveness, integrity and recommendability. References also have the option to add names of additional law firms they have worked with on other matters and within practice areas beyond those the referring firm asked to comment on. Some clients choose to write a comment about their experience with the law firm. These comments are for reference only and do not contribute data points to the formal evaluation process.

Additionally, as part of the foundational Best Lawyers research process, we ask lawyers to provide individual and organisational feedback on competitors in their fields. The survey prompts voting lawyers to consider expertise, responsiveness and whether they would refer a matter to a firm and consider a firm a worthy competitor.

A Law Firm Leaders Survey provides personal insight into the legal landscape surrounding the nationally ranked practice areas. We ask this group to vote on law firms with a preeminent national presence within specified legal practice areas they know well.

Rankings by Tiers

The quantitative and qualitative data collected is combined into an overall Best Law Firms score for each firm in Australia. This data is then compared to other firms within the same geographic region and national level. Because slight differences in overall scores often separate firms, we use a tier system rather than ranking law firms sequentially. The first tier includes those firms that score within a certain percentage of the highest-scoring firms; the second tier consists of those firms that score within a certain percentage of the following highest-scoring firms; the third tier comprises firms that score within a certain percentage under the second tier. We determine national rankings on regional awards, the number of offices each firm has, the level of legal activity in each jurisdiction and the direct feedback from “Law Firm Leader” interviews. The number of tiers included in each practice area ranking varies, and some specialties may not rank in areas where there is not enough data to provide rankings in a particular specialty.

“Law Firm of the Year”

Best Law Firms awards a singular “Law Firm of the Year” recognition in the 20 nationally ranked practice areas. Law firms receiving the “Law Firm of the Year” designation have an outstanding overall performance in that specialty. The same factors for determining national rankings also apply to these awards. Reference reviews, peer-lawyer feedback and industry leader interviews determine the top firm in a practice area. Additionally, a firm can only win in two practice areas in a particular edition.

IN2023 , our team endeavoured to identify and recognise the top-performing law firms across Australia. This initiative stems from our commitment to providing valuable insights to legal professionals, clients and stakeholders, fostering excellence and transparency within the legal industry. More than a decade of experience researching law firms prepared us for this project, and I had complete confidence in our team’s ability to bring our established methodology of awarding firms to a new global region.

Our research process is anchored in rigorous evaluation criteria, encompassing various facets and experiences with a firm such as client satisfaction, legal expertise, innovation and peer review. Using

quantitative and qualitative data analysis, we offer a holistic assessment that truly reflects the calibre and achievements of each firm. The overwhelming response from the legal community during our research phase—despite this being the first year we collected data on a firm level—underscores the significance of this initiative. The enthusiastic participation by clients, lawyers, leadership and marketing teams further highlights the value it holds for both the legal profession and consumers of legal services.

INSIGHTS FROM THE BEST LAW FIRMS™ SURVEY:

A Look at Australia’s Legal Industry

The global legal industry is ever-evolving, and understanding the trends and priorities of top law firms is crucial for staying competitive. In its first phase of global expansion, Best Law Firms conducted a comprehensive survey of law firms in Australia, utilising the same rigorous methodology and research process we employed in the United States for more than a decade. This article aims to provide insights into Australia’s leading law firms’ operational focuses, revenue sources and pro bono commitments.

A Note on the Data: Participation in the Law Firm Survey is voluntary, and respondents are not required to answer every question. Thus, a cross-comparison of the highlighted data points above may not be an accurate representation.

LAW FIRM SURVEY SNAPSHOT 10 BEST LAW FIRMS ™ AUSTRALIA 2025 EDITION

DOMESTIC FIRM LOCATIONS: A SPECTRUM OF PRESENCE

The survey data reveals an interesting distribution of firm locations across Australia. While most responding firms (58) operate from a single central office, there is a notable presence of firms with multiple offices nationwide. Seventeen firms boast a widespread national presence with five or more locations, while others maintain a strategic presence in key cities with two to four offices.

This diverse range of firm sizes and geographical distributions highlights law firms’ varied strategies to serve their clients effectively and establish a strong market presence.

GLOBAL JURISDICTION: BALANCING DOMESTIC AND INTERNATIONAL CASEWORK

Regarding the focus of their casework, most of the surveyed firms reported that their primary focus lies within Australia. Half of the respondents stated they do not engage in international casework. However, a few firms maintain a balanced mix of domestic and foreign cases, with five firms reporting that 50% to 74% of their work is Australian and three firms stating that 25% to 49% of their caseload is domestic.

These findings suggest that while the Australian legal market is primarily domestically oriented, a subset of firms actively engage in cross-border work, catering to the needs of international clients and businesses.

PRO BONO COMMITMENT: HIGHLIGHTING EXCEPTIONAL CONTRIBUTIONS

Pro bono work is a valued contribution from the legal profession, and the Best Law Firms survey collected data on the pro bono hours contributed by participating firms over the past year. The surveyed firms reported an impressive combined 16,488 pro bono hours. However, a select few firms stood out as exceptional contributors, with the top firms recording between 7,566 and 9,870 pro bono hours.

This dedication to pro bono work demonstrates the commitment of Australia’s leading law firms to social responsibility and access to justice, setting a solid example for the legal community as a whole.

JURISDICTION AND REVENUE: EXPLORING THE FINANCIAL LANDSCAPE

The survey also delved into the financial aspects of law firms, examining the relationship between jurisdiction, client proximity and annual revenue.

Among the 23 firms that reported their annual revenue and a 100% focus on the Australian market, only four stated that all their work serves clients in the same location as their headquarters. Most of these firms (11) reported that 70% or more of their work serviced clients in the central office location, with the remaining casework coming from other parts of the country.

Firms focusing solely on the Australian market reported a combined revenue of $1,389,754,829. In contrast, the 19 firms that reported serving both Australian and foreign markets generated a total revenue of $3,773,025,434, highlighting the financial significance of international casework.

BANKING & FINANCE

One of Australia’s most significant construction funding transactions over recent years took place, with law firm Maddocks advising lead alternative real estate investment managers Qualitas on $600 million in funding for a new Aura Aqualand luxury development in Sydney.

According to Maddocks CEO David Newman, Qualitas is one of Australia’s largest alternative funders, making it a unique option for property developers. Maddocks has advised

on a series of funding for propertyrelated matters, the most recent including the funding package for the new Monarch Residences developed by Consolidated Properties Group in Brisbane.

“A key issue arising in these transactions is the risk allocation between the sponsor and the contractors and the extent to which a financier can seek a reallocation of this risk in the current climate. There is an increased scrutiny on the assignability of third-party contracts,” said Newman.

CORPORATE LAW

The following cases highlight the broad spectrum of events that fall under corporate law. The first involves the sale of the iconic Australian brand Akubra, which was family-owned for over a century.

Maintaining its manufacturing in Australia was integral

to the deal, where, according to advising firm Dentons, selling a family business was a completely different proposition from a corporate sale.

“By their nature, family businesses don’t have much or any experience in M&A deals, so extra care needs to be taken to help them through the process. Working with a family business means you really get to know the business you’re selling, the people who created it, and [so you] do your absolute best for them,” said Dentons Partner Jill Milburn.

The second significant commercial law case was a highprofile inquiry that captivated the Australian public— DHI22 v. Qatar It involved a baby being abandoned, a subsequent police investigation into the attempted murder of the infant and women being subjected to a physical inspection by a nurse in an ambulance on the tarmac. sought damages for personal injury, alleging negligence, assault and battery and false imprisonment. The event took place at Hamad International Airport in October 2020.

Simon Morris, Partner at Qatar Airways’ acting firm, Morris Mennilli, who represents legally and factually complex and often unique cases, commented on the lawsuit.

“The Qatar Airways instructions are legally significant because the resolution of the proceeding, granting summary judgement in favour of Qatar Airways, provides the 60 international airlines who operate in Australia and the millions

of passengers who utilise those airlines’ services, certainty that the Montreal Convention is an exclusive and single, universal treaty governing airline liability,” Morris said.

Aviation is a global industry operating across jurisdictions, and the Federal Court’s decision in the Qatar Airways matter gives certainty that principles governing carrier liability will apply equally in Australia as they do in the 132 other countries party to the Montreal Convention.

“In the Qatar Airways instructions, our client was faced with a novel claim, and we devised and executed a strategy that exposed the claims brought against the airline as defective and liable to be summarily dismissed,” Morris added.

He said the negligence claims failed to grapple with the exclusivity of the Montreal Convention, and the elements of the Convention that affix liability to carriers for passenger death and injury could not be satisfied.

DISPUTE RESOLUTION

Australian Consumer Law (Section 18) outlines protection

against misleading or deceiving the public regarding goods or services. A significant dispute regarding the mandatory fuel consumption label on the Triton vehicle between Mitsubishi Motors and a motorist reached the High Court of Australia.

The motorist claimed the Triton’s fuel consumption exceeded the values listed on the label, with Mitsubishi responding that the specifics of the label were stipulated by law.

Thomson Geer, Mitsubishi’s legal counsel, said the unanimous decision to rule in favour of the carmaker set a legal precedent, affecting the entire motor vehicle industry in Australia and all market participants subject to mandatory labelling laws.

Adrian Tembel, Chief Executive Partner at Thomson Geer, said this case arose from the firm’s long-term relationships with Japanese clients.

Another significant dispute resolution regarding a major carmaker witnessed MercedesBenz’s new agency sales model coming into question.

The changes made by MercedesBenz Australia/Pacific to its automotive franchise arrangements and dealer network structures resulted in a $650 million dispute led by 38 Australian car dealers. They claimed Mercedes-Benz was bypassing dealers and selling directly to customers. The case

has since garnered international interest.

Maddocks CEO David Newman reported that Mercedes-Benz Australia/Pacific won the landmark agency model case in late 2023.

“The decision in the MercedesBenz case is significant as it clarifies several previously unresolved significant areas of law concerning the application of good faith when exercising contractual power and the termination of existing contractual arrangements,” Newman said.

Piper Alderman represented Zoetis Australia in a landmark dispute. The case was between horse owners and veterinary vaccine developer Zoetis Australia. In a $53 million class action case, horse owners alleged the vaccine caused side effects in horses.

“In terms of human and animal health, it related to the only vaccine available to reduce the risk of the transmission of Hendra virus, a zoonotic virus that has killed hundreds of horses and four humans. The award-winning vaccine is vital and was therefore very significant in defending its quality and safety,” said Anne Freeman, Dispute Resolution & Litigation Partner.

The firm reported that the class action commenced without warning Zoetis, having received notice from a journalist. It became apparent that the lead applicant had commenced the claim without the benefit of expert veterinary, vaccine or epidemiological assistance while alleging the vaccine caused side effects in horses.

The lead applicant also sought to support her case by relying on evidence from 50 other horse owners. That meant a significant amount of extra factual investigation, including with experts and preparation of cross-examination of over 30 witnesses. This additional evidence

was later withdrawn.

The firm had previously defended class action but not a significant consumer class action.

The judge concluded that the vaccine did not cause the alleged side effects and was of acceptable quality under the Australian Consumer Law.

EMPLOYMENT LAW

Employment law is a multi-faceted part of the legal apparatus, with employee and employer protection cases. It impacts the business landscape in Australia, which is why employment cases are of particular significance.

Specialist workplace law firm Kingston Reid cited multiple significant employment law cases.

Kingston Reid assisted international food delivery platform Hungry Panda in obtaining urgent interim injunctions to prevent Easi employees from sharing confidential information with competitors after an acquisition. It became clear that Easi had illegally sold data to a new direct competitor, Fantuan. The case involved crossborder jurisdictions, with Kingston Reid acting with the firm White and Case to represent Hungry Panda in various applications against Fantuan.

Kingston Reid sought injunctive relief in the Federal Court of Australia against multiple respondents. While the case remains active, financial damage was limited by ordering individuals involved to return confidential information.

In a different type of employment law case, Kingston Reid developed work health and safety training for the mining group Fortescue—in the lead-up to the work safety legislation introduced in Western Australia. With penalties for safety breaches up 300% and a changing conversation about what is considered a “safety matter”, the need for bespoke training in high-risk industries has increased prominence.

Kingston Reid’s customised training program has been rolled out across the company, from employees to the board.

From metal to mining, commercial firm Mills Oakley acted for Rio Tinto Limited subsidiary in a significant case for Australian labour law. The case related to its “Fair Treatment System Policy” and whether the “safety net contractual entitlement” was considered a policy document, which was ruled as not. It’s one of the first cases in Australia offering clarity to Australian employers and the position regarding the law for future similar scenarios.

Australia is a world leader in clean energy strategies, aiming to reach net zero emissions by 2050. In the first quarter of 2024, renewables constituted one-third of Australia’s electricity usage. Meeting the nation’s ambitious climate goals in the coming decades requires new legislation impacting Australia’s industries.

Law firm Grondal Bruining commented on the major reforms to the Australian Safeguard Mechanism and their potential implications for the international competitiveness of Australia’s industries.

One of the country’s significant energy projects is the AustraliaAsia PowerLink (SunCable), a

The Commonwealth and Northern Territory Governments have awarded it major project status and added it to Infrastructure Australia’s Priority Initiative List. Infralegal Principal Owen Hayford reported that its significance lies in its pioneering export potential.

“From a legal perspective, building and maintaining the electricity transmission infrastructure within an operational railway corridor leased to Aurizon under a [Public-Private Partnership] (PPP) arrangement will require novel adjustments and additions to the existing PPP contracts,” Hayford said.

From energy transmission to public transport, Infralegal advises the National Roads and Motorists’ Association on its contract with Transport for New South Wales to provide the Manly Fast Ferry service, which thousands of city and north shore commuters use.

Infralegal’s role includes advising on contractual targets and incentives to reduce the ferry service’s Greenhouse Gas (GHG) emissions by more than 65%, enabling Transport for New South Wales to achieve its 2030 target of 65% GHG emission reductions.

Hayford concluded that with Australia’s transport sector a major producer of the country’s GHG emissions, contractual commitments to reduce emissions are becoming a key feature of contracts for the private sector’s provision of public transport services.

INTELLECTUAL PROPERTY

With the advent of technological innovations such as artificial intelligence and digital assets, advancements can outpace current intellectual property (IP) legislation, leading to unique legal cases.

The project will underpin a new phase of green industrial development at the Middle Arm precinct in Darwin, creating new renewable energy export markets for Australia and pioneering more innovative technology for renewable energy transmission.

A significant IP case in Australia was a breach of copyright in code. The case relates to copyright in source code used in a real estate online tool and subsequent marketing activities. The infringer was the software developer engaged by the real estate franchise. The case shed light on the swift action against the alleged copyright infringers and the consequences befalling unknowing parties involved, directly and indirectly.

The High Court of Australia ruled that companies that are “indifferent” to copyright infringement can be held liable; however, specific

evidence is required.

IP specialist firm George Legal reported on how non-fungible tokens (NFTs) fit within Australia’s current IP law. The potential for copyright infringements in the NFT space is a growing concern for artists and asset owners.

IP Australia has stated that an NFT is not a suitable service but a means of certification. NFTs aren’t currently recognised as legal assets or financial products. George Legal states NFTs are classified based on the applicable goods or service class.

A proposal for a regulatory apparatus involving digital asset platforms was presented in October 2023, which will further clarify NFTs’ place within IP law.

Griffith Hack has also represented a significant IP dispute regarding software and data tools—the most notable being the patent infringement proceedings regarding core drilling tools on behalf of Globaltech.

The firm also led a separate IP case in Australia, highlighting reputation’s relevance in trademark infringements. Griffith Hack represented Allergan, the multinational pharmaceutical company better known as the maker of Botox. The case elevated the legal question of possible trademark infringement while promoting an alternative product. This trademark case reached the High Court of Australia.

MERGERS & ACQUISITIONS

The Blackmores’ corporate acquisition was one of the largest in Australia in 2023. Thomson Geer advised the $1.8 billion merger with Japanese food company Kirin Holdings. The transaction attracted significant media attention as a household name and Australiangrown brand.

Adrian Tembel, Chief Executive Partner of Thomson Geer, said a cross-border transaction of this size involves many distinct aspects that must be managed to ensure a successful outcome.

“Among the elements that were particular to this deal were negotiating the transaction terms and major shareholder support; advising on due diligence and ensuring Kirin understood regulatory risks in the Australian context and multiple foreign jurisdictions in which Blackmores operates and helping Kirin to understand the Australian corporate governance structure for the acquisition and ensuring it aligned with Kirin’s,” Tembel said.

American media giant Omnicom increased its holding in one of Australia’s oldest advertising businesses, Clemenger Group. Unlike the usual scheme of arrangement between a bidder and a target, Clemenger’s scheme relates to their unique employee share scheme introduced in 1973—which allowed the shareholders to realise value for some of their Clemenger shares whilst requiring both the bidder and target’s shareholders to continue to work together in the future.

According to Corporate & Commercial Partner William Khong from advising firm Holding Redlich, a successful scheme of arrangement requires a multidisciplinary exercise involving corporate lawyers and litigation lawyers.

From communications to aged care, Holding Redlich acted for Life Care, a not-for-profit, in the sale to the national brand Opal Healthcare. Corporate & Commercial Partner William Kontaxis said this was significant because residential aged care is a highly regulated industry, and various national and state-based matters had to be considered.

“Aged care is a growing sector, and since this transaction, we have already seen more activity in this space,” Kontaxis reported.

Managing Director Duane Keighran said the apartment tower seeks to buck the trend of rising construction costs by presenting a high-end hotel and long-stay apartment project in the heart of Melbourne.

Keighran commented on the complexity of navigating Federal and State overlays in the regulated area of housing reform while ensuring projects are ‘shovel ready’ as quickly as possible.

“As the Federal and State government’s investment in solving the housing crisis intensifies, the projects will become larger and more complex, requiring dedication from all industry participants to ensure we are

all pulling in the same direction to alleviate housing concerns,” he concluded.

TAX LAW

Tax disputes are long, arduous and cost-intensive, on both sides of the coin—for both the individual or business and the ATO. Tax matters can range from business setup and structures to allegations and disputes, as seen in the two significant cases led by Macpherson Kelley.

The firm’s tax team advised Australian and international clients in resisting default tax assessments, based on primary concepts of income. While the case remains active, Macpherson Kelley reduced the proposed audit position paper outcome from $185 million to $105 million. After the audit, the income tax assessments dropped to $33 million on objection.

Macpherson Kelley also led a significant tax matter, facilitating the successful acquisition of Global Hire & Services by Height 4 Hire, navigating several tax and operational complexities.

Commercial and tax dispute resolution specialists, Aptum Legal, is handling a taxation matter for an individual relating to assets valued at approximately $30 million with extraordinary procedural complexity, which involves funds passing through Australia to foreign countries.

Nigel Evans, Aptum’s Managing Director, said their tax practice has grown rapidly in the past few years, to the point where they are now regularly acting in highly technical Federal Court matters, as well as for ASX-listed clients, and are often being transferred matters from the taxpayer’s initial representation. As businesses expand globally with greater ease, commercial litigation is becoming more complex due

to cross-border transactions and disputes.

“Disruptive technologies, changing consumer behaviours and evolving business models are leading to more novel legal disputes, particularly in sectors such as fintech, e-commerce, and the sharing economy,” Evans said. “Commercial litigation is seeing a surge in electronic evidence and cyber-related disputes: data breaches, intellectual property infringements and disputes over digital assets. Today’s commercial litigators must adapt to these shifts and develop expertise in emerging areas of law,” he said.

“Disruptive technologies, changing consumer behaviours and evolving business models are leading to more novel legal disputes, particularly in sectors such as fintech, e-commerce, and the sharing economy.”

Evans revealed Aptum is seeing more international clients who require assistance with litigating in Australia.

“We worked with Asian Gas Partners Limited on an international dispute relating to assets valued at approximately US$500 million, where they required specialist litigation expertise for the Australian jurisdiction. Aptum has significant internal advocacy experience, so we were able to successfully navigate some fairly significant procedural, factual and legal complexity with minimal involvement of counsel,” he said.

Aptum noted the growing importance of using data and systems to effectively manage litigation, in a way that ensures all relevant information is accessed and leveraged. •

Striking the Balance Between Risk and Reward

AS AUSTRALIA EMBRACES

the potential of artificial intelligence (AI), particularly generative AI, it grapples with a critical question: how can we leverage AI’s power while ensuring its safe and responsible use?

Following the release of its discussion paper on Safe and Responsible AI in Australia in June 2023, the government issued an interim response to the consultation process in early 2024, indicating the likely future direction of AI regulation in Australia.

Highlighting the need for more safeguards (beyond voluntary guardrails), the government has flagged several views that will guide the direction of its regulatory response:

• Existing laws: Australia’s laws do not sufficiently address the risks presented by AI (particularly “high-risk” and frontier models designed for general-purpose applications).

• Regulation of AI: The government will seek to regulate AI rather

than rely solely on voluntary commitments. It will adopt a riskbased approach to implement additional guardrails for AI in “high-risk” settings.

• Strengthening existing laws: The government is currently undertaking work to enhance existing laws in areas that will help to address known harms with AI, including proposed privacy law reforms.

• International engagement: The government has declared its commitment to continue engaging internationally to help shape global AI governance.

Businesses in Australia that develop and use AI are already subject to various Australian laws relating to privacy, corporate regulation and antidiscrimination, which apply across all sectors of the economy. There are also financial services sectorspecific laws in Australia administered by Australian Prudential Regulation Authority and Australian Securities and Investments Commission, which impact the development and

deployment of AI in the sector. However, these existing laws are technology neutral.

Nitesh Patel, a Principal specialising in Cyber and Technology at insurancefocused law firm Gilchrist Connell, is well attuned to the complexities surrounding the use of AI.

“The demonstrated potential of generative AI is almost certainly just a taste of what will come. It has captured the imaginations of many but also raised concerns about how it can be leveraged prudently with proper governance and oversight.

Generative AI is, therefore, an exciting opportunity for our firm and our clients to enhance the services we provide and the way we work, but its implementation brings with it significant challenges,” said Patel.

He said that, in the context of law, “Generative AI has demonstrated its potential application to efficiently assist with labour-intensive tasks such as legal research, document review, document comparison and content generation.”

“However, it is imperative that

any generative AI tools that we as a firm deploy to assist with our processes have careful regard to our obligations to our clients and other stakeholders, including data privacy and security, confidentiality, output oversight and accuracy and longer-term impacts to the legal profession more generally,” he said.

THE NEED FOR SAFEGUARDS

Given AI’s myriad of uses, there are differing levels of risk associated with its various applications in different settings. Submissions made to the Safe and Responsible AI in Australia consultation identified a high level of risk associated with newer and more powerful AI models (“frontier” models).

As outlined in the government’s discussion paper, under a riskbased regulatory framework, AI development and application are subject to regulatory requirements commensurate to the level of risk they pose. This will allow low-risk AI development and application

to operate freely while imposing regulatory requirements for highrisk AI development and application.

The government has acknowledged that many AI applications that operate in “low-risk” settings (for example, automation of internal business processes) do not require a regulatory response. However, this must be balanced against existing laws and regulatory frameworks, which are likely inadequate to prevent AI-facilitated harm, particularly in legitimate but “high-risk” contexts.

As part of its proposed riskbased approach, the government has signalled that it will consider mandatory safeguards for those who develop or deploy AI systems in legitimate, “high-risk” settings to ensure that AI systems are safe. The government has indicated it will undertake further work to:

• define the criteria of risk categorisation

• further refine definitions of “high-risk” AI, taking into account

developments in overseas jurisdictions and

• identify the most appropriate guardrails and regulatory interventions for each category of risk.

The government has indicated that it will also consider possible legislative vehicles (amendments to existing laws or through a new dedicated legislative framework) to introduce mandatory safety guardrails for AI in “high-risk” settings and specific obligations for developing, deploying and using frontier or general-purpose models.

INTERACTION BETWEEN AUSTRALIAN LEGISLATION AND AI RISK

The submissions to the Safe and Responsible AI in Australia consultation identified that at least ten pieces of existing Australian legislation required amendments for relevance in an AI context, including competition and consumer law, health and privacy

law and copyright law.

The government’s final regulatory response to AI is subject to further consultation, including in the financial services sector. We expect to see proposed amendments to laws or new laws that will impact all sectors of the Australian economy shortly afterwards.

During a recent speech at the UTS Human Technology Institute Shaping Our Future Symposium, ASIC Chair Joe Longo commented on the current and future state of AI regulation, governance for corporations and the financial services sector.

Mr. Longo took the opportunity to highlight ASIC’s view that AI regulation already falls within the scope of its existing regulatory toolkit and remit over corporations and the financial services sector.

He stated, “All participants in the financial system have a duty to balance innovation with the responsible, safe and ethical use of emerging technologies – and

existing obligations around good governance and the provision of financial services don’t change with new technology”.

In that context, Mr. Longo cited directors’ duties under the Corporations Act 2001 (Cth) as an example of broad obligations that should cause directors to pay particular attention to how companies are deploying AI into their businesses.

Mr. Longo also referred to the 2022 Federal Court decision of ASIC v RI Advice Group Pty Ltd [2022] FCA 496, in which it was found that RI Advice had breached its Australian Financial Services Licence obligations under the Corporations Act to act efficiently and fairly and to have adequate risk management systems, which was found to include having adequate cyber risk management Mr. Longo’s view is that this line of thinking could be applied to the use and operation of AI by financial services licensees as the technology evolves and is deployed

in this space.

AI RISK – A GLOBAL ISSUE

In November 2023, Australia, the EU and 27 other countries signed the Bletchley Declaration at the first Global AI Safety Summit. This declaration affirms that AI should be designed, developed, deployed, and used safely and responsibly, prioritising a community-first approach.

The government has confirmed that it will uphold the commitments made in the Bletchley Declaration, which includes international collaboration on AI safety testing and developing risk-based frameworks across countries to ensure AI safety and transparency.

The government will continue to engage with international partners on domestic responses to risks posed by AI, aiming to strengthen and ensure interoperability between international responses and Australia’s domestic response to AI risk.•
