insolvency and reorganization law, 2012) has become managing partner of the firm’s San Diego office, as reported by The Wall Street Journal.

Gerry Schenk Francavilla ► Casey Blatt & Penfield: David S. Casey, Jr.

(personal injury litigation – plaintiffs, 2006), served on a panel with former NFL linebacker and NBC San Diego sports reporter Jim Laslavic and others to discuss the future of football and the controversy over football injuries. Thomas Penfield (personal injury litigation – plaintiffs, 2011) was part of a team that helped win $425,000 for a client who was hit by a truck while in a crosswalk in 2011 and suffers from chronic pain.

The firm was recently honored ► Cooley: by the American Bar Association with

the Judge John Minor Wisdom award recognizing the firm’s pro bono work. Anthony M. Stiegler (commercial litigation; litigation – intellectual property; litigation – patent, 2006) accepted the award on behalf of the firm. Koji F. Fukumura (commercial litigation; litigation – regulatory enforcement [SEC, telecom, energy]; litigation – mergers and acquisitions; litigation – securities, 2008) contributed an article, “Shifts seen in the way M&A cases are litigated,” to the Los Angeles Daily Journal.

DLA Piper: Dr. Lisa A. Haile (litigation – intellectual property; patent law, 2006) was appointed to the scientific advisory board of OXIS, a biotech company that focusses on LISA A. HAILE cannabinoid-based drug therapies. Dr. Haile holds a PhD in microbiology and immunology in addition to her bachelors and law degrees. Robert W. Brownlie (commercial litigation; securities / capital markets law, 2007) successfully defended a medical device developer in a class action suit alleging that the company had made misleading statements to investors about Medicare payments. Stanley Panikowski (litigation – intellectual property; litigation – patent, 2011) was part of a team that helped clear Samsung of charges that it had infringed on patents related to Java programming code, according to Law360. Other defendants in the case included Microsoft, Nokia, and Amazon.

Fish & Richardson: Juanita R. Brooks (criminal defense: white-collar; litigation – intellectual property; litigation – patent, 1987) led a team that successfully defended a corporate client in JUANITA R. BROOKS a civil suit brought by a former employee, whose many claims included discrimination, harassment, wrongful termination, and breach of contract. All of the claims were dismissed by the jury in less than two hours.

malpractice law – defendants) and associate Jonathan R. Ehtessabian helped win a summary judgment on behalf of their client, a doctor who performed an experimental stem cell procedure on a patient as part of a study. The patient alleged that she was coerced into participating and not made fully aware of the experimental nature of the procedure, but the defense showed that she “knew exactly what she was doing,” had signed all consent forms, and had welldocumented conversations with the doctor before undergoing the procedure.

& Phillips: David B. Monks ► Fisher (employment law – management, 2013)

contributed an opinion article, “The Top 5 Personnel Mistakes that a Startup Can Make,” to the Times of San Diego news website.

Fletcher & Mack: The firm ► Higgs launched a new privacy and information

security practice group including William M. Low (medical malpractice law – defendants; personal injury litigation – defendants; product liability litigation – defendants, 2007) and Steven J. Cologne (personal injury litigation – defendants, 2008). Steven J. Cologne also contributed an opinion article in favor of the nonprofit LEAD San Diego’s programs for raising awareness of local issues among business, government, and community leaders to the Times of San Diego news website. Richard A. Shaw (litigation and controversy – tax; tax law, 1983) received the 2015 “Outstanding Attorney of the Year” award from the San Diego County Bar Association.

Iredale & Yoo: Eugene G. Iredale (criminal defense: non-white-collar; criminal defense: white-collar, 1987) was part of a team that helped win $3.5 million for plaintiffs EUGENE G. IREDALE in several wrongful termination cases against a translation services company that had administered polygraph tests to employees, according to Law360. The civil jury found that the nine plaintiffs were fired after failing their polygraph tests and that these tests were illegal to administer to them, despite the company being a contractor with the Drug Enforcement Agency and U.S. Immigrations and Customs Enforcement.

Sheppard Mullin Richter & Hampton: Guylyn Cummins (litigation – First Amendment; media law, 1995) served as counsel to inewsource.org, a non-profit journalism GUYLYN CUMMINS website based at San Diego State University’s School of Journalism and Media Studies, in its fight to obtain a report assessing the performance of 13 upper-level managers in the North County Transit District. The news website has published numerous articles on issues related to the transit district and the state appeals court ruled that the report should be “released for public review,” according to KPBS. Robert D. Rose (criminal defense: white-collar, 2007) and Karin Dougan Vogel (appellate practice, 2009) were part of a team that helped win a unanimous verdict from the U.S. Supreme Court in favor of their client Hana Bank in a trademark-related dispute.

Litigation – Construction San Diego “I’ve had cases that involve tunnels, bridges, hotels, sanitation plants, water plants—you name it, I’ve probably litigated it,” says Peter Ippolito, an attorney at Dentons in San Diego. Ippolito has been practicing construction law in San Diego since 1975. Before rising to his status as a prominent construction litigator (and, more recently, an arbitrator and mediator), Ippolito served in Vietnam as an Army officer and worked as assistant general counsel to the U.S. Army Corps of Engineers in Washington, D.C. “I was in Vietnam for 20 months and it matured me,” Ippolito says. “I worked for the Corps of Engineers as a civilian and served under the Corps’ general counsel, Manning Seltzer. He was absolutely brilliant and started me off on my career as a lawyer doing exclusively design and construction disputes.” Ippolito has a strong sense of camaraderie with his legal colleagues and a deep respect for his clients, ranging from owners to contractors and designers, from security to insurance companies. “My clients, at all levels, take so much pride in their work and how they do their work that I am honored to work in their industry,” says Ippolito. Generosity is not the first thing that comes to mind when one pictures a seasoned litigator, but Ippolito has much of it in addition to his skill and experience, and it seems key to his success. The thing Ippolito finds challenging about working in construction law is keeping up with all the different engineering, construction, and design disciplines required to understand the cases he handles. Each case can present a different test and, as Ippolito puts it, “If you can’t understand the facts of the case, you can’t do your job.” Still, he seems to thrive on the demands and can easily point to a handful of construction issues that he looks forward to wrangling with, including hospital construction— “the most difficult, pound-for-pound”—and the construction of desalinization plants to address the looming water crisis in California. “Water is clearly going to be a problem,” says Ippolito. “Not today, not yesterday, not the day before yesterday, but we’ve got water issues in California. And I think we’re going to see large construction efforts to bring more desalinization plants online over the next ten years.” On the other hand, says Ippolito, “everything is heavily regulated and it’s quite a feat to get anything built in this state.” By Nathaniel Barr

Water rights have long been an issue in the American West, but historic droughts are ushering in changes. By Eva Saviano

W

ater worries are the talk of the town in 2015. The drought in California—the three years between 2011 and 2014 were the driest since record keeping began in 1895—has been much discussed. Other states in the West are, maybe belatedly, trying to get the jump on a water crisis, crafting new statewide water plans before they are in the same boat as California. That is to say: one run aground. “For well over 100 years, groundwater in California was not regulated,” says Kristen Castaños, a water law attorney at Sacramento’s Stoel Rives, of the state’s Gold Rushera system. “There was no statute or application process for a license or permit. If you pumped water, it was yours.” But that system is no more. On January 17, 2014, California Governor Jerry Brown declared the drought there a state of emergency, requiring a 25 percent reduction in water consumption, and on September 16, 2014, passed legislation amending the state water code to require agencies that utilize fast-depleting basins to draft sustainability plans and allow for water meters and fines for monitoring and enforcement. “The new law doesn’t create a process whereby you get a permit; it creates a process to protect groundwater. California is unique in that we have never had—and still do not have—a system for licensing groundwater rights,” says Castaños. “Which is pretty shocking given groundwater has always been a battle in California.” Water distribution in the West has always been a source of conflict—in Colorado, in Arizona, in California— since water diversion became a solution for populous communities in dry places. “In Colorado, most of the water is located on the west side of the state and the population is on the east, in areas like Denver and Colorado Springs,” says Mark Hermundstad of Williams, Turner & Holmes in Grand Junction, Colorado. “Trans-mountain diversions are tunnels under the mountains that transfer water east, and that is always a bone of contention; the East has needs they want to satisfy with west slope water.” Like California, Colorado doesn’t have a specific water plan, and its governor, too, is hoping to implement one. And that isn’t the only way in which those two states are linked. Across Colorado, Arizona, Nevada, California, Wyoming, New Mexico, Utah, and Mexico, the Colorado River irrigates almost 5.5 million acres of land, and is essential to at least 22 federally recognized tribes, 7 national wildlife refuges, 4 national recreation areas, and 11 national parks. At one time, it was believed to be ample resource for these tasks, but over-allocation, climate change, drought, and population 8

1922 growth have seen Lake Mead—the nation’s largest reservoir, fed by the Colorado—water levels plummet to 39 percent of its capacity, the lowest level since it was built in 1937. “We have a finite supply of water, and we have, if not an infinite population, certainly a growing one,” says Hermundstad. The worst case scenario, according to Mark McGinnis, an environmental and water rights attorney at Salmon, Lewis & Weldon in Phoenix, is a limitation on growth. “We can’t keep building subdivisions if there isn’t enough water,” says McGinnis. “We have been fairly proactive because of where we are, in the desert, and because we are most junior and we would be first to be cut off from the Colorado River.” Arizona has taken charge, launching public works initiatives such as the Central Arizona Project, the largest and most expensive aqueduct system in the United States, which brings about 1.5 million acre-feet

gallons of water are consumed monthly in the U.S. of Colorado River water per year to Pima, Pinal, and Maricopa counties, and its underground storage and recovery program. “It takes water we aren’t using yet and stores it underground, for use if they have to declare shortages on the Colorado,” says McGinnis. “As far as I know they haven’t technically done that yet, but it could be on the doorstep.” Suits for water rights haven’t seen major increases—yet—and each state is on the clock shaping water plans that might keep further water crises at bay. “Lots of alternatives have been suggested, says Hermundstad. “Import water from another basin, such as the Missouri, but that doesn’t go over well in the Missouri River basin; desalination of sea water, but those big-picture solutions are expensive.” Immediate options Western states might consider include fallowing agricultural lands in rotation and making even more efficient use of the water they have, allowing Lake Mead and Lake Powell to partially recover. “I would like to be more positive and think that these problems will create more collaborative approaches to our water challenges,” says Hermundstad. “We can’t look at things parochially; we have to have more cooperation between various water users.” But there is an old saying in the West: “Whiskey is for drinking and water is for fighting.” And that has been the battle for more than 100 years.

JULIA YOO CIVIL RIGHTS LAW Julia Yoo is a civil rights attorney representing clients whose civil rights have been violated.
