Cordes primarily represents individuals in employment, discrimination, civil rights, and constitutional law cases. He has tried more than 50 employment discrimination cases to successful verdicts, and he has successfully litigated 25 appeals before federal and state appellate courts, including the Supreme Court of the United States and the Supreme Court of Pennsylvania. Indeed, Cordes has had a profound impact on employment law in Western Pennsylvania, particularly through his active appellate practice. Among his prominent successes, Cordes convinced the federal appeals courts to permit the use of an employer’s corporate culture as evidence in proving a discriminatory atmosphere, and through a series of rulings he has made it easier to prove discrimination when the employer makes up an excuse.

ver a career spanning more than 25 years, Samuel J. Cordes has been called the “archangel of employment rights in Western Pennsylvania” by the Pittsburgh Tribune Review. Chambers USA has noted that Cordes is highly rated for employment litigation and that juries love him. And the Pittsburgh Post-Gazette has described him as “extremely smart in the scholarly sense” with “practical street-smart sense,” adding, “you don’t see that combination in too many lawyers.” Cordes is the only plaintiffs’ employment litigator in Pittsburgh ever to be named to the Top 100 Pennsylvania Super Lawyers list. He was also selected by his peers as Best Lawyers’ 2012 Lawyer of the Year in Pittsburgh for employment law - individuals, and he has been included in The Best Lawyers in America since 2004. ► Babst Calland: Shareholder Kevin Douglass (natural resources law, 2013) was appointed president of the Energy and Mineral Law Foundation in July 2014. EMLF is a national non-profit educational organization that fosters the study of the laws and regulations related to natural resource development and energy use. ► Bernstein-Burkley: Kirk B. Environmental Law Pittsburgh With an extensive academic background in environmental science, Kevin Garber serves as a key member and shareholder of Babst Calland’s Energy and Natural Resources Practice Group in the firm’s Pittsburgh office. Garber’s practice focuses primarily on natural resources and water law, and he is one of 25 lawyers at Babst Calland practicing environmental regulatory law on a daily basis. Founded in 1986 as a niche environmental law firm, Babst Calland has built a reputation in the Pittsburgh area and nationally for providing high quality, knowledgeable counsel to its clients. “We are fortunate to have our headquarters on top of the Marcellus Shale and energy capital of the East,” Garber said of Babst Calland’s founding. Pittsburgh and the surrounding region has a heavy industrial past and was one of the first areas to attract attention during the 1970s, when environmental policy and legislation became of interest nationally. Garber noted western Pennsylvania’s natural transitions throughout history and its relevance in the environmental and energy fields—from being the birthplace of the oil and gas industry in the nineteenth century, to being home to the heavy manufacturing and coal industries in the twentieth century, to leading unconventional gas production in the twenty-first century. “It’s the ideal location for an environmental and energy practice,” Garber said. The firm has added other practice fields to its offerings, such as title services, which complement the environmental services it provides clients. Garber joined the firm in 1996 after leaving Reed Smith’s Pittsburgh office. He has served as counsel for numerous clients in three main categories: private entities such as steel, coal, and oil and gas companies; trade associations that represent those industries; and public entities such as municipalities and public water suppliers. Garber said he found the environmental practice field rewarding because of the cooperative nature among all parties involved. “The Pennsylvania Environmental Bar is a relatively small group of practitioners. Counsels know one another, and we’re able to nearly always sit down and try to resolve issues,” he said. As an example, Garber cites the St. Michael’s Pennsylvania Project, for which he helped settle a deal between state, federal, and private entities that benefited all. Rosebud Mining Company built a $15 million water treatment plant to treat acid mine drainage from an abandoned coal mine. In exchange, the company was able to expand an existing mine and access the underground coal reserves adjacent to the treatment facility. “It’s the perfect example of state, federal, and private partnership to get this done,” he said. The Pittsburgh Business Times named Garber to its 2014 list of Who’s Who in Energy, a list recognizing more than 180 key players in the energy industry in southwestern Pennsylvania. Also of note: Garber is on the board of directors for the Greater Pittsburgh Chamber of Commerce as well as the Pennsylvania Environmental Council. -Maggie Burch

The Value of Trial Experience Pittsburgh’s Plaintiffs’ Product Liability Litigation Lawyer of the Year Victor Pribanic on his firm’s legacy of excellence by Sean Stonefield

t the personal injury law firm Pribanic & Pribanic, the firm’s attorneys have become trial-tested advocates for the injured and disabled through their many battles with large companies, hospitals, and insurance carriers in cases where everything is on the line. “Trial expertise counts for a lot in this field, and that’s one of the strongest aspects of this firm,” says founding member Victor Pribanic, who has been trying cases for the past 35 years. “It is our ability to try a range of cases in courtrooms throughout Pennsylvania and other states that has allowed us to succeed time and time again for our clients.” Given its success in the courtroom, the firm has for several years been ranked Tier 1 in Pittsburgh by U.S. News – Best Lawyers “Best Law Firms” in the areas of plaintiffs’ medical malpractice law, product liability litigation, and personal injury litigation. Pittsburgh Lawyer of the Year four times in the past six years: in 2010, 2012, and 2015 for plaintiffs’ product liability litigation, and in 2014 for plaintiffs’ medical malpractice law. “Some lawyers view trying cases with a great deal of trepidation, but you have to be prepared to take a case to trial, particularly when you’re in a cutting-edge situation Victor Pribanic that hasn’t been done before,” Pribanic says. Over its history, Pribanic & Pribanic has frequently taken on high-profile cases involving innovative legal issues. For example, the firm is currently handling a case in Washington, D.C., against a cellphone manufacturer, service provider, and lobbying group on behalf of a woman who died at the age of 24 after developing a brain tumor where her cellphone’s antenna had touched her head. Most recently, the firm filed a wrongful death lawsuit against the automaker giant General Motors, following the company’s massive recall of faulty ignition switches in more than a million of its vehicles. That case, originally filed in the United States District Court for the Western District of Pennsylvania and now in the Southern District of New York, is believed to be the first wrongful death or injury action filed in Pennsylvania against GM over the defective ignition switches. “We’re proud to be involved in cases of this magnitude,” Pribanic says. “Historically, trial lawyers have been responsible for making cars, homes, hospitals, and communities safer, and we believe these cases are in that same tradition.”
Pribanic adds that his firm has been able to take on these pioneering cases because of its comprehensive preparation, which includes conducting focus groups and mock trials to identify how a jury will perceive a client’s case. The firm’s attorneys also make a point of spending time with clients to get a sense of how their injury has affected them on a day-to-day basis. “We presume every case we take is going to be tried and we prepare them accordingly,” Pribanic says. “We obtain the best experts in a given field and we try to learn as much as possible about our clients before trial, which means really getting to know the hardships they have experienced because of their injuries.” This thorough approach has in turn allowed the firm to achieve considerable results for people who have been affected by medical malpractice and other forms of negligence, including car accidents and injuries relating to the Marcellus Shale Gas Field. Among Pribanic’s many victories, he has obtained a $103 million verdict in an accounting negligence/fraud suit, a $21 million settlement in a product liability/ medical and hospital malpractice case, and a $6 million verdict for the family of a young woman who died because of an undiagnosed and untreated brain aneurysm. In recent years, Pribanic and his firm have further resolved a number of major cases involving cardiac stents that were unnecessary, misplaced, or underdeployed. “While we can’t bring back people who died as a result of these violations, we can help their families in ways that are meaningful not just for a week or a month, but for a lifetime, and that’s very rewarding,” Pribanic says.
