Baker & Hostetler: Nancy Frandsen (copyright law; intellectual property litigation, 2012) was named among the World’s Leading Trademark Professionals by World Trademark Review 1000. Henrik Parker (intellectual property and patent litigation, 2006) was recognized among “The World’s Leading Patent Practitioners” in the 2014 edition of the IAM Patent 1000. Ballard Spahr: Brenden K. Collins (environmental law and litigation, 2006) and Robert B. McKinstry, Jr. (environmental law and litigation, 2009) led a litigation team that successfully defended a regulation that limits emissions of mercury and other toxins from coal-fired power plants. David H. Pittinsky (bet-the-company litigation and commercial litigation, 2006) became the fourth Ballard Spahr attorney to receive The Legal Intelligencer’s Lifetime Achievement Award. A team led by Alan S. Ritterband (real estate law, 2009) helped secure a joint venture agreement and a long-term lease on the building for the new Comcast Innovation & Technology Center, the largest private development project in Pennsylvania’s history. Blank Rome: Bonnie Glantz Fatell (bankruptcy and creditor debtor rights/ insolvency and reorganization law and litigation, 2006) was a recipient of the 2014 Women of Distinction award by the Philadelphia Business Journal. Lawrence E. Ashley (patent law, 2014) joined Caesar, Rivise, Bernstein, Cohen & Pokotilow as partner. Console Law Offices: Carol Mager (individuals’ employment law, 2006) helped obtain a $9.5 million class settlement in a decade-long dispute between former Owens-Illinois employees and the company. Cozen O’Connor: Michael J. Heller (corporate law; venture capital law, 2009) was re-elected to a second three-year term as president and CEO of the firm. Dilworth Paxson: Marc A. Feller (public finance law, 2012) was unanimously elected to become a fellow of the American College of Bond Counsel. Only 18 attorneys in the United States are elected and Mr. Feller is the only lawyer in Pennsylvania elected this year. DLA Piper named Carl Buchholz (commercial litigation; government relations practice, 2005) managing partner of the firm’s Philadelphia office. Duffy + Partners: Thomas J. Duffy (plaintiffs’ personal injury litigation, 2003) was awarded the Hispanic Bar Association of Pennsylvania’s “La Justicia” award. Fox Rothschild: The Philadelphia Business Journal named Abraham Reich (betthe-company and commercial litigation, 2006) an honoree for its 2014 Most Admired CEO Awards. Kairys, Rudovsky, Messing & Feinberg: Jules Epstein (appellate practice; criminal defense: non-white-collar and white-collar, 1995) secured a ruling in a capital case that led to his client’s removal from death row. Kaplin Stewart Meloff Reiter & Stein: Marc B. Kaplin (land use and zoning law and litigation, 2007) secured a ruling with Pamela Tobin in favor of their client, setting a new precedent for state rights in the Third Circuit Court of Appeals. Pennsylvania’s Premier Workers’ Compensation Law Firm At Krasno, Krasno & Onwudinjo, representing injured workers is a family tradition

ince 1936, when the Honorable Isadore Krasno—a workers’ compensation judge— established his practice, three generations of the Krasno family have practiced at Krasno, Krasno & Onwudinjo (KK&O). And while the firm has grown to comprise 16 lawyers and 11 offices, it has retained both its tight-knit atmosphere and its commitment to helping workers’ compensation and social security disability clients. “No matter how big we get, our clients will always feel the close bond that we have here at this firm,” says managing partner Jason Krasno, Isadore’s grandson. “The primary reason we’ve been able to grow and be successful over all these years is that we are a clientoriented practice—clients come first before anything and everything, and that’s evident in the high level of service we continue to provide. “For example, back when the firm was a two-man operation consisting of my father and grandfather, people who called the firm would always talk to a member of the Krasno family. And that same approach holds true today: when someone calls us, they’re not going to speak to four different people before they get to a lawyer; they’re going to get their questions answered by a lawyer right away.”
The firm’s lawyers include attorneys who have been recognized as leaders in the firm’s areas of practice— workers’ compensation, social security disability, and employment law. The primary reason we’ve been able to grow and be successful over all these years is that we are a clientoriented practice. The continuation of this tradition is particularly gratifying to senior partner and CEO Lester Krasno, Jason’s father, who over his 45-year career has handled tens of thousands of workers’ compensation cases and won tens of millions of dollars in awards for his clients. “Working side-by-side with my son to protect injured workers makes this work even more worthwhile,” says Lester, who has also been included in Best Lawyers. Andrew Onwudinjo, who started at the firm right out of law school in 1989 and now runs its Reading branch. “I’ve had the privilege of working with Lester for the past 25 years, and the education has been priceless,” notes Onwudinjo, who is certified as a workers’ compensation specialist by the Pennsylvania Supreme Court. “I’m glad I caught his enthusiasm for workers’ compensation law, because it is such a thrill to see my clients’ joy and happiness when a decision is made in their favor or their case is settled.” Most recently, Onwudinjo settled a workers’ compensation case on behalf of a 39-year-old client for $2.4 million, with the settlement’s payments potentially yielding a total value of more than $3.6 million. “While six-figure settlements are common for our firm, seven-figure settlements are exceptional,” observes the Honorable Geoffrey Dlin, who returned to private practice and joined KK&O after 15 years as a workers’ compensation judge. “But that just shows the uniqueness of this firm.” Dlin, who has been listed in Best Lawyers, is certified as a workers’ compensation
specialist by the Pennsylvania Supreme Court and cochairs the Philadelphia Bar Association’s Workers’ Compensation Section. JACOBY DONNER P.C. is nothing if not a brand name in construction law—but that barely scratches the surface of what this Philadelphia institution can do for its clients. on social media and civil litigation BY MAGGIE BURCH How did you get involved with Aspatore's Inside The Minds series to write this book chapter, titled “Current Trends in Litigation Involving the Use of Social Media”? What is the book about as a whole? A The editors at Aspatore took notice of a recent article I wrote on the discovery of Facebook postings in civil litigation and asked if I was interested in being a part of their latest project. The book is titled Understanding the Use of Social Media in Litigation: Leading Lawyers on New Evidence Collection Methods and Necessary Precautions for Clients. Lawyers from various firms across the country (Baker Botts, McGuireWoods, Weil, Gotshal & Manges, among others) supplied chapters. Q When did you realize that social media was going to have an impact on court cases in various ways? A In the last five years, I noticed how people, mostly under 40, were willing to share with the world through social media just about everything they did and thought. For litigation lawyers, information is power. The more you know about the opposing party, the better you can control your case, modify strategy, and shape a more
favorable outcome. The information being revealed publicly in things like Facebook postings was especially valuable because usually it was not filtered by the person’s attorney, with the result that the information sometimes revealed more than one would ever get from an interrogatory or a deposition. Once that light went on, the fight over Facebook began. Q You suggest that searching social media accounts can help bolster an attorney’s case. Overall, do you think that assistance is a positive aspect of the trial process? A Yes. It is just another way of discovering information about parties, witnesses, and potential jurors. We always did it—now it is easier to do. It appears there is a large class of people who want to say, “Look at me! Look at me!” about all they do. Q What are a couple of ways using information from social media accounts can benefit a case? A First, cross-examination. A plaintiff claims he/she can’t do a certain activity post-accident. A photo is found on Facebook that shows him/her engaging in such activity vigorously. Second, picking a jury. Running
Q What is a way that using information from social media accounts can deter or harm a case? A Picking a jury. A social media search might turn up more information than you can process in the time frame of jury selection. Also, reliance on social media searches rather than gut instinct developed from your experience may not serve your client well. Q Can you give an example of this? A The postings are just one piece of information to evaluate, as are the appearance and responses of the potential juror during voir dire. You can’t rely on one to the exclusion of the other. But, in my experience, you can tell more about a person from seeing them interact with others and hearing them respond to questions. Q Which practice areas do you think will be most affected by the evolving inclusion of social media? A Family law, personal injury, and criminal defense. I think the gathering and use of this information to challenge jurors for cause, especially in regard to comments on Twitter and other sites about attitudes toward criminals, certain racial groups, and the judicial system will occur more often in the future. Q What types of rules and regulations are being determined regarding the legal and fair use of social media in trials? A [There are] ethics opinions from various states over issues such as the use of Facebook “friending” of parties, witnesses, and jurors for litigation purposes. […] If something is publicly posted, there is no reasonable expectation of privacy. We have a body of case law developed over many years that discusses what can and cannot be discovered in litigation. […]
Moreover, there are rules […] that address what contact lawyers and their staff may have with witnesses, parties, and experts. Those rules should also apply in the social media era. Q How should lawyers approach the topic of social media use with their clients? A If a lawyer has a client who is in litigation, especially in a family, personal injury, or criminal matter, he/she should counsel the client to stop posting and don’t delete what they have posted already to avoid claims of spoliation. Q What makes the information in a social media post more valuable to a lawyer than a verbal claim? A If someone in an employment suit claims in a post that he/she did something (e.g., “Yesterday I went to Great Adventure”), yet later claims that he/she was home sick that day, they can be crossexamined with that posting, as it goes to their credibility in a direct and effective way. Q How would the defense of “I didn’t really mean what I said” work in regards to an inflammatory social media post? People certainly take to social media when they’re most annoyed or fed up about something, and could claim the same defense. A They would be grilled on crossexamination about the statement that they tried to downplay, and it would be up to the jury to determine if their explanation was credible […]. Jury trials often come down to credibility of witnesses. It doesn’t matter substantively whether it is a social media posting or a written statement given to an insurance adjuster that the witness now tries to downplay or refute. It will still be the jury’s job to judge the credibility of that witness when he/she tries to distance him/herself from what was said before. John B. ■ As the child of two physician parents, Philadelphia plaintiffs’ attorney Carol Nelson Shepherd grew up fascinated by the medical profession.
