Ballots are generated and distributed to listed lawyers. They are designed based on the voter’s practice area(s) and geographic region.

Best Lawyers asks voters the question: “If you were unable to take a case yourself, how likely would you be to refer it to this nominee?” Nominees are given a 1 -5 rating, with room to leave additional comments.

The Best Lawyers editorial staff reviews the votes and comments. Selected lawyers are checked against state bar association sanction lists to make sure they are in good standing with the ethics committee of their state bar.

LAS VEGAS Anthony Cabot has now handled gaming law for more than three decades, and he has almost exclusively focused his practice in the area for the majority of that time. Cabot notes that he became interested in the gambling industry relatively early in his career, after realizing it offered the opportunity to handle multiple types of law. “My work can range from contract law to privilege licensing matters to intellectual property issues,” notes Cabot, who was selected by his peers as Best Lawyers’ 2014 Lawyer of the Year in Las Vegas for gaming law. “And that makes this an interesting forum to be a general practitioner while also concentrating on a specific area of the law.” With clients spanning the entire gaming spectrum, Cabot offers services in all aspects of gaming law, as well as sweepstakes, contests, and Internet gambling. Indeed, he has worked on Internet gambling policy and legal issues since 1994, and he recently represented Ultimate Gaming in obtaining one of the first legal Internet gaming licenses in the United States. In addition, he regularly advises clients on the legality of different gambling methods. “The most rewarding part of my job is when a client comes to me with a new idea or a new way to approach gaming that requires either a new regulation or a new way of thinking about regulation,” Cabot says. “And although I’ve been doing this for a long time, I still enjoy working with regulators to introduce those new products or approaches.”

RE N O Jennifer Smith is a shareholder in Lionel Sawyer & Collins’ litigation department, where she has worked since gaining admission to the bar in 1984. Smith’s first interview at the firm was with a former bankruptcy judge who became her mentor, and she has consequently focused her practice on restructuring and bankruptcy, creditors’ rights, and related commercial litigation. In 1992, she became certified in business bankruptcy by the American Board of Bankruptcy Certification. “What I find stimulating about this area is that every conceivable business topic is addressed at some point in the bankruptcy court,” Smith says. “I also like that when it comes to bankruptcy versus other areas of law, time is rarely wasted on unnecessary litigation; instead, the focus is on achieving a positive economic resolution through consensus-building and negotiation.” Over her career, Smith has handled a number of significant bankruptcy matters, including one of the largest cases ever filed in Nevada—the Washington Group International reorganization case of 2001. “This was a very complex case involving a large multinational corporation, and it gave me the opportunity to work with very smart lawyers throughout the country,” Smith notes. Smith has twice been named as Best Lawyers’ Reno Lawyer of the Year: in 2012 for bankruptcy litigation and in 2014 for bankruptcy & creditor debtor rights / insolvency and reorganization law. Reflecting on these recognitions, she credits her success to an emphasis on creative problem-solving: “I strive to achieve the best possible business solution for my clients, and I think they appreciate that practical, goal-oriented approach to their problems,” she says.

And it has served her well since the start of her career, but never more than when Ashcraft struck out on her own as a solo practitioner six years ago after a long stretch with a large Nevada firm. “Sure, there was a certain amount of fear of the unknown when I decided to take the plunge,” she says. “But that went away pretty quickly and within the first six months I was wondering why I didn’t do it sooner.” A fiercely independent streak in Ashcraft isn’t surprising—would you expect anything less from a woman passionate about Formula 1 racing and who has been known to nudge her Ferrari up to over 120 miles an hour? Indeed, Ashcraft’s personality was made for the law, for the rigors of debate and for crafting airtight business strategies. “If someone took a position, I took the other one just for the fun of it,” says Ashcraft, who cut her teeth in the profession as a clerk in a federal public defender’s office. “I was not to be underestimated.” After spending time talking to Marti Ashcraft, it’s hard to imagine anyone who knows her making that mistake.

What interested you about going into your particular area of law? Prior to coming to Las Vegas I worked for the U. S. Treasury Department representing the administration on matters of tax policy. The most interesting item I worked on was the perceived abuses of generationskipping trusts and the various ways that advisors were planning to legally avoid the enormous and unnecessary loss clients will suffer for failing

to properly plan. I was fascinated with the creative and continuously evolving planning available using trusts to help and protect families, and that continues to be the centerpiece of our firm’s wealth planning recommendations. What would you say is the most rewarding aspect of practicing in your area of law? Enabling families to achieve multigenerational protection and preservation of family wealth, taking into account the human dimension of the estate planning process. What has been the key to your success? Working long hard hours to obtain technical proficiency as well as working with other advisors to help clients achieve their goals. What is one example of a case/ matter you are particularly proud of? An extremely challenging part

of my job is helping business owners plan where the business is the major asset and some children are in the business and some are not. Often the sharing of the asset creates family conflict. Resolving these issues so that each family unit is treated fairly is a challenge and successfully resolving the dilemma is extremely rewarding. How has the legal industry in your field changed in the last 30 years? There have been substantial changes in the estate planning field, both good and bad. The good changes include the fact that there are a substantial number of design strategies that enable the planner to be creative and to customize the planning for each different situation. Unfortunately, there are an increasing number of people getting into the field who are giving bad or inadequate advice, which is harmful. The

technical evolution has often resulted in lawyers using forms that do not match the proper planning for clients. What does being included in Best Lawyers for 30 years mean to you? It is wonderful to be recognized by your peers as being one of the best in their chosen field. What is one piece of advice you would give to new attorneys? To continue the learning process so that you can best help your clients. What is the biggest obstacle you see for your practice area in the next 30 years? The use of standard ‘one size fits all’ planning. Instead of being an “order taker”, we need to remember that we are counselors. Even wealthy clients and advisors who are not in the field do not recognize the value disparity between the skilled advisor and the unskilled practitioner.

How has the legal industry in your field changed in the last 30 years? It has gotten more national, if not international, in scope. Unfortunately it has also become more of a business and less of a profession.
