finance law, 2010) led a team of attorneys advising a client in a $110.5 million acquisition of a Washington, D.C., apartment complex. Jon M. Laria (land use and zoning law; real estate law, 2007) was tapped to lead Baltimore Mayor Stephanie Rawlings-Blake’s Bicycle Advisory Commission, which serves to promote and facilitate safe and convenient biking in Baltimore. Laria’s leadership was also covered in the Baltimore Business Journal article, “How real estate lawyer Jon Laria became an unlikely leader for Baltimore’s bicyclists.”

Bowie & Jensen: Mark T. Jensen (closely ► held companies and family business law,

2014), a martial arts enthusiast, has earned a second-level black belt in Tae Kwon Do and has competed in several state and national championships. Michael Siri (construction law, 2015) was part of a team that won a unanimous victory from the Maryland’s Court of Appeals for a homeowner’s association, winning the association a right to further litigate their case against a homeowner who wanted to build a second residence on their lot, in contravention of the association’s rules.

Brown Goldstein Levy: Andy Freeman ► (commercial litigation; employment law –

individuals; litigation – labor and employment; mass tort litigation / class actions – plaintiffs, 2012) was part of a team that represented an African American woman who was fired from her job as a waitress at a Hooter’s restaurant for having blonde highlights in her hair, in supposed opposition of the company’s “image policy.” The arbitrator ANDY FREEMAN in the case decided that Hooter’s had discriminated against the waitress and awarded her $250,000. Dan Goldstein (civil rights law; commercial litigation; criminal defense: white-collar, 2012) represented the National Federation of the Blind and two blind students in their complaint against a local community college. The complaint was resolved when the school agreed to include improvements to school computers to make them accessible for the blind and address alleged discrimination against the students. Andrew D. Levy (betthe-company litigation; commercial litigation; criminal defense: white-collar; litigation – labor and employment; litigation – real estate, 1999) received the Mosaic Community Services’ 2015 Visionary Award for his advocacy for the civil rights of the mentally ill.

DLA Piper: Brett Ingerman (commercial ► litigation; legal malpractice law – defendants,

2011) is part of a team representing a Baltimore prisoner who lost one of his eyes in retaliation for not cooperating with a prison gang. The man is suing the Baltimore City Detention Center.

Gallagher Evelius & Jones: Ward B. ► Coe III (litigation – banking and finance;

bet-the-company litigation; commercial litigation; litigation – ERISA; litigation – trusts and estates, 1995) was honored with the University of Maryland law school’s Benjamin L. Cardin Public Service Award.

Clements, Bekman, Marder ► &Salsbury, Adkins: E. Dale Adkins III (medical

malpractice law – plaintiffs; personal injury litigation – plaintiffs, 1993) and Paul D. Bekman (admiralty and maritime law; arbitration; mediation; medical malpractice law – plaintiffs; personal injury litigation – plaintiffs; product liability litigation – plaintiffs, E. DALE ADKINS 1989) are part of a team representing over 750 Guatemalans who were intentionally infected with syphilis and other STDs in the 1940s and 50s as part of an experiment by a forerunner of the U.S. Department of Health and Human Services. The plaintiffs allege that the government agency was assisted by Johns Hopkins University, the PAUL D. BEKMAN Rockefeller Foundation, and other organizations, which they are suing for a total of $1 billion in a Maryland court.

Goldstein & Russell: Thomas C. ► Goldstein (appellate practice, 2008) argued

at the Shakespeare Theatre Company’s 2015 Mock Trial in Washington, D.C. The mock trial was based on Cervantes’ classic novel Don Quixote. Goldstein appealed a guardianship decision for Don Quixote to the Supreme Court of La Mancha, presided over by U.S. Supreme Court Justice Ruth Bader Ginsburg. The court ruled “that without impossible dreams there would be no progress” and that Quixote does not need a guardian to look after him.

Gordon Feinblatt: Abba David Poliakoff ► (commercial litigation; corporate law;

securities / capital markets law; securities regulation, 2007) was appointed by Governor Larry Hogan to co-chair Maryland’s Regulatory Reform Commission, established to examine what Hogan says are “outof-control regulations” that are “making it impossible for businesses to stay in Maryland.” Michael C. Powell (environment law; litigation – environmental, 1995) has become the managing member and chief operating officer of the firm.

Stein Sperling Bennett De Jong Driscoll: ► Paul T. Stein (commercial litigation; criminal

defense: non-white-collar; family law, 2012) successfully defended a police officer accused of perjury. Stein argued, in part, that the officer had not been familiar with the rules of the court when representing himself in a previous case decided in his favor, and that the prosecutor in the case took the officer back to court for perjury, seemingly out of spite and to protect his own reputation. The circuit court found that the prosecutor failed to adequately prove his case.

Janet, Jenner & Suggs: Robert K. Jenner ► (mass tort litigation / class actions – plaintiffs; personal injury litigation – plaintiffs, 2006) helped win $36 million for a construction worker who was severely burned and paralyzed while working on a power company substation.

Joseph Greenwald & Laake: ► David Bulitt (family law, 2007)

Venable: Thomas M Lingan (environmental ► law; litigation – environmental, 2011) was part

of team that helped get the permits to open a new gold mine in South Carolina, along the Carolina slate belt. Gold mines have been operating sporadically in this area since the early 19th century, but this is the first new gold mine in many years to be permitted for construction in the eastern U.S. Kevin THOMAS M. LINGMAN L. Shepherd (real estate law, 2006) is part of one of the teams composed of attorneys from eight different firms who are representing seven players in the complicated $675 million sale and purchase of a 36-story Manhattan skyscraper.

Levin (criminal ► defense: non-white-collar; criminal defense: white-collar, 2013) co-authored an op-ed in The Baltimore Sun about the charges brought by State’s Attorney Marilyn Mosby against six Baltimore police officers in the death of Freddie Gray. The op-ed is entitled “Mosby has a second chance to get the Freddie Gray charges right.”

Lastly, we ask you to help us find a solution to a sensitive issue that’s been rightly noted by our readers. It is widely acknowledged that law is still one of the least diverse professions in the United States. This is something that firms large and small are making conscious efforts to improve. According to the National Association of Law Placement (NALP), which has been tracking diversity in the legal profession since the 1990s, the percentage of minorities in associate positions is increasing, but the number of those at or above the partner level remains startlingly low. According to NALP’s 2014 survey of Baltimore law firms, minorities made up only 4.05 percent of partners; of those, 1.35 percent were women. That is notably lower than the national average of 7.33 percent and 2.45 percent, respectively. The good news? Minority representation among associates in Baltimore has shown significant gains and is now at 15.89 percent. That’s great news for everyone, and we hope to see the names of these emerging leaders included in the Best Lawyers list in the near future. So, we ask you to look for the names of those you consider to be the “best” lawyers in your community inside the pages of this supplement. If you don’t see them listed here, let us know. Gregory K. Wells Product Liability Litigation - Plaintiffs Washington, D.C. ■ Rockville’s Gregory Wells is a legal polymath. In addition to product liability litigation, the partner at Shadoan, Michael & Wells takes on mediation and, occasionally, business litigation cases, focusing his practice especially on representing plaintiffs in catastrophic personal injury, wrongful death cases, and medical malpractice, where he finds the most intellectual stimulation. Although Wells exudes solemn confidence in much daunting legal territory, he is no less impressive on stage, where his guitar playing runs the gamut from blues and jazz to blues-rock and R&B. “Music is what I do when I’m not at work. My major influences growing up were probably a tossup between Jimi Hendrix, Carlos Santana, and B.B. King.” Wells got his start in law representing defendants in medical

malpractice cases and spent 15 years working on behalf of hospitals in complex situations. “When I was defending cases, I sometimes represented patients or families of deceased patients who died as a result of medical negligence, when there was no conflict. I was always drawn toward helping injured people, and to their gratitude, no matter what the result,” says Wells. Wells recently litigated a major medical malpractice case with partner Robert Michael in which three defendants squabbled in court over who was responsible for what happened to the firm’s client. Wells and Michael won a $3.5 million verdict for their client, who was left paraplegic and wheelchair-bound after symptoms of a serious disorder were misdiagnosed in the emergency room.

“Working with families and clients who have been catastrophically injured and are dealing with the consequences of those injuries, while at the same time going through trial preparation and the trial process, is always challenging,” Wells notes. Wells also provides pro bono representation in other types of cases. “If I am able to help someone and feel strongly that they are not getting what they deserve and need help, I occasionally take cases to help folks who can’t afford to pay.” After 9/11, Wells worked pro bono for a young man who was left without family support after his father was killed at the Pentagon. Says Wells, “I was able to successfully pursue a claim for him and get him a substantial award, which allowed him to go on with his college education.” Written by Nathaniel Barr

A HISTORIC SETTLEMENT IN A CASE THAT ROCKED MARYLAND negligently failed to supervise Dr. Levy; negligently credentialed him; and negligently failed to observe, report, prevent, or stop his unlawful activity. In the following months, Schochor and his team met with more than 2,000 victims, and Schochor says he was moved by their circumstances. “Many victims quit the medical system because of this—they stopped seeing any obstetricians/ gynecologists, they did not get their tests and studies. Many even stopped taking their children to doctors and became dysfunctional in the workplace or at home with their spouses or significant others. Most required counseling from religious leaders, professionals, and friends.” As a result, Schochor put together a steering committee and later filed a joint motion for class certification, both of which were approved. He was, in turn, selected to head the steering committee. “After obtaining class certification, our focus turned to increasing the number of patients registered in the class action, which was 3,800 women at the time of certification,” Schochor notes. To that end, Schochor and his committee worked to notify Dr. Levy’s more than 12,000 former patients of the lawsuit both through formal correspondence and by publicizing the case in newspapers and magazines and on television, social media, and the Internet. A website was set up and telephone operators were made available to register clients. During this period, Schochor also made it a priority to ensure Dr. Levy’s photos would never become public. A motion filed in January 2014 to seal those images confiscated by the Baltimore police was later granted. “As we were interviewing additional victims and researching the kind of support they would need to move on with their lives, we saw how important it was to make sure there wouldn’t be

his past September, a Baltimore judge approved a $190 million class action settlement for the more than 8,000 patients of a Johns Hopkins’ gynecologist who secretly photographed and filmed women during exams. A clinical technician had been working alongside Johns Hopkins gynecologist Dr. Nikita Levy when she began noticing something odd: Dr. Levy usually wore a pen on a lanyard around his neck, and while performing pelvic exams, he would stand and pull the pen down, directing it at his patients. The technician suspected the pen was in fact a camera, and one day in early February 2013 she surreptitiously took it home with her. There, she was able to connect the device to a computer, and what she found confirmed her suspicions—stored on the pen camera was nearly an hour of invasive footage. After the technician reported Dr. Levy, Johns Hopkins Hospital opened an investigation and subsequently discharged the doctor for allegedly taking secret videos and photographs of his patients. “This was a gross violation of doctor-patient trust, and when Dr. Levy’s conduct became public the outcry was huge,” recalls Jonathan Schochor, who is chairman of the Plaintiffs’ Steering Committee in the class action lawsuit against the hospital, and served as lead counsel throughout the litigation. “A large concern remains that Dr. Levy shared some or all of these images on the Internet, and while no conclusive evidence has been found, his patients—women ranging in age from 13 to 70—felt and still feel betrayed.” Seeking closure for Dr. Levy’s patients, Schochor filed the first class action complaint against the hospital, alleging that it

any further violations of their privacy,” Schochor says. By the time Johns Hopkins Hospital finally agreed to a settlement in July 2014, more than 8,000 women had been registered in the class action. And the result, a $190 million recovery, is reputed to be the largest settlement for a singleperpetrator sexual abuse case in the history of the United States. In addition to helming one of the largest class-action settlements in Maryland history, the firm has recovered nearly a billion dollars in verdicts and settlements for its clients. “Medical malpractice law was still in its infancy when we founded the firm, and from the start we sensed that there was a better way to represent victims than the way it was being done,” says Schochor, the senior managing partner at the firm. “The success we’ve found

in the decades since then is the result of a systematic approach to investigating, preparing and trying cases, which we’ve developed over many years of practice.” Prior to the firm’s inception, Schochor had already spent 10 years concentrating on medical malpractice law at a different firm. He credits his father-in-law, a board-certified obstetrician, for sparking his interest in the field back in 1974. “I became fascinated with medical law after my father-inlaw resolved to testify on behalf of injured plaintiffs against physicians and hospitals,” Schochor says. “Back then, it was very difficult and not very popular to testify on behalf of plaintiffs injured because of negligent medicine, but he was a man of great principle, and through him I learned a great deal about medicine.” Among its other recent results, Schochor, Federico and Staton was involved in a $123 million settlement in a class action lawsuit where the firm helped represent more than 1,300 plaintiffs affected by the former Delaware pediatrician Earl Bradley, who was accused of sexually abusing his young patients. “We represent plaintiffs who don’t have resources, who do not have access to the courthouse and who are unable to stand up to the large insurance companies and hospital systems—and we level the playing field for them,” Schochor says. “That’s why three decades later we are still going strong and achieving the results that make a real difference in our clients’ lives.” www.bestlawyers.com | 13

TAKING CARE Q In your opinion, what makes a good personal injury lawyer?

Q How do you decide whether someone has a case or not?

A The best personal injury lawyers get to know the client like a family member or a close friend. Unless the lawyer knows the client well, it will be impossible for that lawyer to adequately explain to a jury or a judge how the injury impacted the client. After getting to know the client, the best personal injury lawyers educate their client about how cases are reviewed and evaluated by insurance companies and the courts. It is critical that clients recognize that the insurance companies evaluate a stack of papers that include medical records and bills, lost wage forms, photographs, and police reports. In every case, this stack of papers does not perfectly reflect what the client endured. If the client knows from the start how cases are evaluated, the client can take steps to minimize the disparity between what they are going through and what is contained in a demand package. These initial steps lay the foundation for a lawyer to be effective at trial.

A We bring the potential client in for a detailed interview and determine whether additional investigative work is needed. We can usually assess liability for car accidents during the initial client interview. In cases where a person falls, we often need to independently inspect the location of the fall. In a recent case, an inspection of the location revealed that a building was designed with small oneinch diameter drains that allowed water, including melting snow, to drain across a handicapped parking space. During the winter months, this led to thin sheets of clear ice across a handicapped parking space. These drains were so small that they were not visible in photographs taken by the client. Medical malpractice cases often involve the death of a loved one or injuries to an elderly person in a nursing home where the lawyer needs to review medical records before being able to assess whether a case exists.

Q You call yours a “diverse personal injury practice”—what exactly does that entail? A The personal injury practice at RGPH covers everything from medical malpractice, premises liability, car accident, and defective products cases. Q Do you more often settle out of court, or go to trial? Is one preferable?

Q What challenges and rewards come along with practicing personal injury law?

A The goal at RGPH is to give the clients the best possible choice between a settlement and a trial. We often are able to to procure favorable settlement offers because of the work we perform with clients early in the case to make certain that the difficulties they endure after an injury are documented. Cases where the injuries suffered by the clients are poorly documented often require a trial to procure a fair result. Our experience is that clients prefer the option of considering a fair settlement offer over being forced to trial. Nevertheless, there are low property damage car accident cases and cases involving certain insurance companies where the expectation is that a lawsuit will need to be filed.

A Personal injury litigation is an adversarial process. Insurance companies and defense attorneys have duties that are typically against the interests of those injured in accidents. Almost every injury case is challenging because it involves a fight. The greatest reward is taking a difficult case that you believe in and obtaining a recovery that dramatically improves your client’s life. Q How do you navigate the sometimes sensitive issues for personal injury clients? A I often embrace the sensitive issues in a case because these sensitive issues tend to help a jury to relate to the client and sympathize with the difficulties

that the client had to endure. For example, I had a client that struggled with her weight all of her life. During the two years before an accident, she lost well over a hundred pounds through vigorous exercise. By the time the case was heard, she had regained all of the weight due to an ankle injury that prevented her from exercising. When the case was heard, two photographs were placed side by side. The first was a photograph of her two years before the accident and the other was a photograph of her a week before the accident. People naturally do not want to hear excuses about one’s weight, but any person that saw those photographs knew my client had worked extremely hard to lose this weight. They also knew my client would have continued to exercise had she been able to do so.
