METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. s the President and CEO of the family law firm Sherr Puttmann Akins Lamb PC, Megan Sherr has become known for her tireless work ethic and her relentless commitment to her clients. “Megan has a true passion for her work,” notes Catherine Puttmann, who, along with Sherr, Tanya Akins, and David Lamb, is a founding shareholder at the firm. “People come to us at their most vulnerable, and she really believes in helping them get to a place where they can start a new life.” Sherr, a seasoned attorney, has nearly a decade of family law experience. “Alan likes to talk about how if you only love money, then life is not an enriching journey,” Peter says. “You miss so much because you’re only looking for tangible things.” At the time, Simpson had just left the Senate and was teaching at the Kennedy School of Government at Harvard University. He had been courted by a number of large New York and Washington, D.C. law firms to work as a lobbyist, but Peter notes: “Alan decided that he wouldn’t go knocking on his former colleagues’ doors, no matter how much someone paid him—that’s just not who Alan Simpson is.” Alan knew of Michael Burg through his son Bill Simpson, who had recently tried a Cody, Wyoming, gas explosion case with Michael in Wyoming Federal District Court, securing a verdict of $6.4 million. “Mike and Bill just had this wonderful synergy,” Peter says. “And it turned into a dialogue about merging the two firms.” As part of the deal, the Simpsons—Alan, Bill, and Collin—became part of the firm, and Michael assumed the new firm would be called Simpson Burg in deference to the former senator. But Peter notes, “Alan said ‘let’s go with Burg Simpson—Simpson Burg sounds too much like a small town in Wyoming that was homesteaded by my ancestors.’” Since becoming a part of the firm, Alan has continued his high-profile work as an influential public figure: In 2012, he was appointed to co-chair President Obama’s National Commission on Fiscal Responsibility and Reform; he also contributed to the Iraq Study Group in 2006. “When we completed the deal, Alan had one request,” Peter says. “He said, ‘the only thing I ask is that I worked my whole life for my name to mean something good, so don’t screw it up.’” Burg Simpson has since gained a reputation as a national leader in mass tort litigation. Peter Burg “We’ve had a wonderful record of success in the pharmaceutical arena,” Peter says. “I don’t think there’s another firm in the country that has had as many leadership appointments by federal judges as we have. Plus, we’ve helped a lot of people who have been injured by pharmaceutical companies that over promoted drugs or failed to warn the public of drug side-effects and harms they knew about—or should have known about—before exposing the public to such risks.” Michael, who has tried well over 100 cases, has assumed leadership roles in many national pharmaceutical mass tort cases. He was a member of the state liaison committee for the Vioxx litigation and was appointed to the executive committee in the Zyprexa litigation, which achieved a settlement in excess of half a billion dollars. Currently, he is co-lead counsel in the Yaz/Yasmin litigation, representing more than 10,000 women throughout the United States. As a co-lead lawyer in the Ortho-Evra litigation, Michael was joined by shareholder Janet G. Abaray, who heads Burg Simpson’s Cincinnati office, in settling around 3,000 cases. Peter, meanwhile, acted as co-chair of the plaintiffs’ steering committee and the

executive committee for the Gadolinium Based Contrast Agents litigation. In addition, shareholder Seth Katz has been appointed to the plaintiffs’ steering committee in the DePuy ASR hip implant litigation and is co-lead lawyer in the Pradaxa litigation. Beyond pharmaceutical litigation, Burg Simpson is currently representing victims of the Lower North Fork Wildfire, which stemmed from a prescribed burn by state officials. As part of the case, the firm is fighting to eliminate the state’s governmental liability caps. “We’re involved in testimony that’s going to occur at the state capital, because we believe that if you have caps you lose a deterring effect,” Peter says. Indeed, Burg Simpson often takes up meaningful causes that benefit its clients. For example, Peter, who has represented a number of people with brain or spinal cord injuries, serves on the operating and foundation boards for Craig Hospital, a not-forprofit rehabilitation facility for survivors of spinal cord and brain injuries. He is also the past-chair of the hospital’s operating board of directors. “Craig Hospital has changed my life,” Peter says. “I have the greatest partners in the world because they’ve allowed me to commit time to the hospital, and as a firm they’ve contributed substantial amounts of money over the years.” On March 1, Peter will co-chair Craig Hospital’s annual PUSH Dinner, which in 2012 raised more than $1.1 million for the hospital’s foundation; Burg Simpson will be the Presenting Sponsor of the event. “We have lofty goals for raising money,” Peter says. “This year we are committed to doing even more to help rebuild the lives of those who have survived catastrophic brain or spinal cord injuries.” Burg Simpson is further promoting Craig Hospital in the local community by running public service advertisements featuring Peter Burg and Alan Simpson discussing the hospital’s work. In addition, the firm airs promotions on local Denver radio stations publicizing the firm’s “Home Runs for Craig” and “Touchdowns for Craig” campaigns, which commit funds to the hospital whenever the Colorado Rockies hit a homerun or the Denver Broncos or Colorado Buffalos score a touchdown. “Craig Hospital is in our own backyard, but so many people in the community haven’t heard of it,” Peter notes. “So hopefully these ads will familiarize the public with what the hospital is doing and inform them that Craig Hospital is consistently ranked among the top spinal and brain injury rehabilitation facilities in the world.” Besides Craig Hospital, Burg Simpson supports more than 30 other not-for-profit organizations, including Kaps for Kendall, Make-a-Wish Foundation, Rocky Mountain Human Services, the Brain Injury Alliance of Colorado, the Wild Plum Center, and the Ali Meyer Foundation. “The spirit of giving back has really come to define this firm,” Peter says. “Trial lawyers have been painted in such broad strokes, but once people see how involved we are in the community, I think they understand that our main goal is to be good lawyers changing lives.” For more information go to www.bestlawyers.com | 1 1
