What interested you about going into your particular area of law? Our Senior Partner assigned several litigation cases to me in my first year of law practice. I tried cases including jury trials within my first five years and, having good success, was hooked on the challenge and excitement of
trials, especially jury trials. What would you say is the most rewarding aspect of practicing in your area of law? Assisting individuals and small businesses in literally saving them or their businesses from financial ruin, sometimes under extremely emotional situations. What has been the key to your success? Mostly hard work, detailed preparation, creativity in thinking “outside the box,” and a learned ability to communicate with jurors. What is one example of a case/ matter you are particularly
proud of? In a case where a bank lender had sold a repossessed bank to another banker and had purposely misrepresented the loan portfolio, I proved the fraud to a jury and saved the banker from a loss in foreclosure of his other banks which were cross pledged. How has the legal industry in your field changed in the last 30 years? Everything now moves at “warp” speed with the Internet and technology. E-discovery has been the single biggest change. What does being included in Best Lawyers for 30 years mean to you? It has been a tremendous honor to be
recognized by your peers for 30 years based upon your expertise, results and your professionalism. What is the biggest obstacle you see for your practice area in the next 30 years? An assault on the jury trial system and a loss of true professionalism, courtesy and mutual respect among trial lawyers. What do you like best about your profession? I have clients who have been loyal to me now for over 40 years. Relationships with long-standing clients and other trial attorneys developed over my 42 years of law practice are very special to me.

What interested you about going into your particular area of the law? I was a tax lawyer until 1970 when a senior partner died suddenly. I was asked to substitute for him at a pre-trial conference. That led to me taking over the defense of the case, which lasted full time for about a year. I got a satisfactory result and never looked back. What would you say is the most rewarding aspect of practicing in your area of the law? I deal with
business matters that have gone awry. Dealing with complex facts in a contentious and adversarial environment is challenging, and when a conclusion is reached, you hope that it is one you and the client can comfortably live with and then get on with the rest of their lives. What is one example of a case/ matter you are particularly proud of? My first jury trial involved $984 in Oklahoma estate taxes against a widow who, along with her pharmacist husband, ran a drug store in Tulsa. The husband went to World War II for five years, during which time the wife closed the pharmacy but singlehandedly ran the soda fountain and sold all other non-pharmaceutical goods. After the war, he returned and reopened the pharmacy and she continued to run the front part of the store. When
the husband died in 1966, the wife, executor and sole heir, claimed that she and her husband owned the store 50-50. A tax auditor said a woman could not contribute any value and

The widow paid the estate tax but filed for a refund, which was denied. She then sued in state
court. The jury awarded her 50%; the Tax Commission appealed; the appeals court affirmed and she got her money back. How has the legal industry in your field of law changed in the last 30 years? Exchanges of paper have been virtually eliminated in favor of electronic discovery. Computer assisted analysis of information has eliminated hours of toil by lawyers and paralegals. Breadth of discovery has expanded greatly. Overall, I have observed an improvement in civility among the trial bar. What is one piece of advice you would give to new attorneys? There is no such thing as over-preparation. What is the biggest obstacle you see for your practice area in the next 30 years? We must find faster and less expensive means to solve most disputes.

What interested you about going into your particular area of law? I was doing tax returns for oil and gas
operators raising drilling money from investors using tax benefits. I thought it would be more fun to go into law practice and work on the front end structuring these transactions. On more than one occasion I was able to structure an innovative transaction that was ultimately approved by the taxing authorities. Ten great years until the oil bust, then I learned new tricks. What would you say is the most rewarding aspect of practicing in
your area of law? Helping widows left with big tax problems by their deceased husbands. What has been the key to your success? In every case it has been reading the law and the court decisions very closely and deciding what position will ultimately be sustained. Of course I’ve lost some cases, mostly ones I know were high risk. One where I knew I was right, I appealed on a contingent fee so my client would not suffer. I still lost.
What is one example of a case/ matter you are particularly proud of? A widow called and said she needed tax help but would not be able to pay, at least not much. I asked her where she got my name. She said she went on the Net and searched for “best tax lawyer in Oklahoma City” and my name came up. How could I turn her down? Ultimately she was held to be an “innocent spouse” and free of the unreported income of her gambling deceased husband.

Paul R. Foster: Championing the Cause of Oklahoma’s Community Banks

P
aul Foster often says with a grin that he decided against tax law as a specialty because the laws and regulations change so often—and the joke is definitely on him. With bank legal and regulatory work as his emphasis and championing the cause of Oklahoma’s community banks as his passion, it is with great interest that he stays on the cutting edge in these fields. Paul Foster Law Offices, P.C., located in Norman, Oklahoma, represents a steady stream of Oklahoma community banks requiring regulatory guidance, or seeking to establish or sell branches, merge with or acquire other banks, or establish a new bank charter. With nearly three decades of experience including work as a private attorney and as a regulator, Paul has seen these transactions from all sides, benefitting his effectiveness for the client. Beginning in 1989, Paul served in the Oklahoma State Banking Department as its general counsel until 1999. This was, as it turned out, a very historic time in the history of banking in both the U.S. and in Oklahoma. The state transitioned from the unit banking model to a less restrictive branching system, and Paul was there to assist in drafting the revised banking code (Title 6). During this time period he was also very involved in community bank causes nationally, as well as assisting in the drafting of
the Oklahoma comments for UCC Revised Article 9 and the Uniform Trust Act for various states. Crediting the state’s Bank Commissioner, Mick Thompson, for making him a better lawyer, Paul says, “Mick makes everyone around him better.” In 1999, Paul Foster Law Offices was created with his wife and law partner, Carrie L. Foster, and together they put action to Paul’s vision for Oklahoma’s community banks. During the period of 19992007, banks experienced a boom, and found Paul’s depth of knowledge in the regulatory field very beneficial. The firm worked on new bank charters, mergers, buy/sell agreements, bank capital issues, and, of course, representing banks in regulatory matters. During this time, Paul had the opportunity and privilege to work with the “dean” of

Oklahoma bank law, Marion Bauman, until Marion’s recent retirement. “Marion is a gentleman’s gentleman, and vastly knowledgeable in our field,” Paul observes. Paul also joined the Community Bankers Association of Oklahoma as its general counsel in 1999 to date, receiving its prestigious Chairman’s Award in 2012. This continued association

work has enabled Paul to share his knowledge and engage in projects that benefit all Oklahoma banks. Likewise, the attorneys of PFLO participate in the Oklahoma Bar Association’s Financial Institutions and Commercial Law Section, for which Paul has served as Chair and Program Coordinator. Paul is also a member of the Business and Corporate Law Section of the Bar. It is no surprise that Paul is a frequent speaker on banking law/regulatory subjects. In 2008, the environment of the entire world-wide banking system was altered, and no less dramatic was the change for community banks. Paul’s calling as a champion of the community bank has come to the fore in these challenging
times. He has assisted troubled banks since 2008, harkening back to his early experience in complex commercial litigation during the aftermath of the Penn Square period of bank failures. His great joy is to work with banks in good times and bad, offering his experience to assist with regulatory issues and structuring and shepherding bank transactions. GAMING L AW TULSA As general counsel to the Oklahoma Indian Gaming Association, GableGotwals shareholder Dean Luthey balances the unique needs of sovereign nations against a complex host of state and federal laws that regulate the industry in which they operate. It’s a push and pull that Luthey has learned to navigate on behalf of the association which includes 30 or so gaming tribes in the state—and the issues can be as complex as they are fascinating. “The purpose of gaming is to generate revenue to be self-sufficient and to move the ball forward on self-determination,” says Luthey, a veteran litigator and accomplished business lawyer who first entered the gaming practice in the late 90s. “It’s extremely important to the tribes.” Which means that Luthey takes his responsibility—whether he’s helping sort out jurisdictional issues, conflicts between tribes and gaming vendors, or negotiating interactions with the federal government—very seriously. The key? “You have to develop a sensitivity to sovereign relationships,” he says. “That and the fact that all of this occurs under the federal Indian Gaming Regulatory Act, which attempts to define the parameters of those relationships.” If it sounds complicated, that’s because it can be. But Luthey, who describes himself as a trial and appellate lawyer, is nothing if not up to the challenge: He once argued a tax case in front of the United States Supreme Court on behalf of the Choctaw and Chickasaw nations under the Indian Gaming Regulatory Act. “I’ve always been interested in public policy, and being a lawyer is one way that you can have an impact on that policy without being part of the government,” he says. “To me it’s the best of both worlds.” www.bestlawyers.com | 11

Geoffrey M. StandingBear NATIVE AMERICAN LAW GAMING LAW His Native American practice has included representation of the Muscogee (Creek) Nation, Navajo Nation, Seneca-Cayuga Tribe of Oklahoma, Quapaw Tribe Gaming Commission, Gaming Operations Authority Board of the Muscogee (Creek) Nation, Pawnee Nation, the Cheyenne-Arapaho Tax Commission, and several other tribes and native communities. As General Counsel for the Oklahoma Indian Gaming Association, StandingBear participated in the rapid growth of the Oklahoma Indian gaming business. StandingBear has served his own people of the Osage Nation as elected Assistant Chief from 1990 through 1994 and is currently an elected Member of the Osage Nation Congress in Pawhuska. In a landmark 1985 case StandingBear represented the Muscogee (Creek) Nation in successfully restoring tribal jurisdiction of Indian lands in Eastern Oklahoma. This pioneering federal case established the legality of Indian gaming in Oklahoma. He later brought another court case to Washington, D.C. for reestablishing the tribal court systems among the Five Civilized Tribes.
