What interested you about going into your particular area of law? The different products and their compounds or make up

proud of? Settling a class action of 35,000 members, well under authority. As a result of my settlement of that class action, the president of the company invited me to a luncheon in New York. How has the legal industry in your field changed in the last 30 years? The use of discovery and experts. What does being including in Best Lawyers for 30 years mean to you? It is the most prestigious lawyer list in that it requires the votes of your peers. Some new lists try to promote themselves as

having a reputation, but in fact they take anyone who agrees to buy an advertisement. What is one piece of advice you would give to new attorneys? To be innovative in your approach to the case. Do not rely on old tactics but be assertive in creating new approaches to the trial. What is the biggest obstacle you see for your practice area in the next 30 years? The expansion of package inserts and warnings.

certainly less professional. When I started, a lawyer’s word was his bond, and that is no longer always the case. Additionally, mediation is becoming more prevalent, particularly in custody cases, and that is a good development. There are fewer trials today than when I first started practicing because of various screening processes employed by our courts. What does being included in Best Lawyers for 30 years mean to you? Being included in Best Lawyers for 30 years is a high point of my career. It is very rewarding to be recognized by your peers for your work over an extended period of time. What is one piece of advice you would give to new attorneys? I think the most important thing for “new attorneys” is to understand

that they are problem solvers, not creators. It is most important that they care for their clients, their problems, and that the clients know that they care, and that is demonstrated by quality work, responsiveness, and empathy mixed with objectivity. Integrity is always critical. What is the biggest obstacle you see for your practice area in the next 30 years? I think that as time passes, there will be more legislation attempting to move people towards mediation in family disputes, as opposed to litigation. This could be good for the clients, but attorneys may earn less money. Of course, there will always be those clients who are not suited for mediation.

en Saunders began his railroad practice in 1974 as a plaintiff’s attorney when he tried his first FELA case for a railroad worker with a brain injury in federal court in New Orleans. Since 1975, he has concentrated almost entirely in the FELA field of practice. He has obtained half million to multi-million dollar results on cases he has handled in Louisiana, Mississippi, Alabama, Georgia, Florida, South Carolina, North Carolina, Texas, Virginia, and Washington D.C. Over the last ten years, he has taught FELA Law at AAJ seminars. He has spoken on the New Orleans Bar Association television program, It’s the Law, and wrote the often quoted “Truth Wins Lawsuits” article for a NOBA Legal Seminar. He has testified as a plaintiff’s expert in FELA at Lloyd’s of London in England and served as Chairman of the Designated Legal Counsel for the Brotherhood of Locomotive Engineers (BLE) from 19992002. While serving as Chairman of the Designated Legal Counsel for the BLE, he promulgated the Rules of Conduct for its Designated Legal Counsel Program. He also served as Chairman of ATLA’s Railroad Law Section and as President of the American Rail Labor Attorneys (ARLA) from 1999-2000. He is a member of the Past President’s Advisory Committee and its Legislative Committee. Today he is also a SMART-UTU Designated Counsel.

Early on, the firm was known for its corporate, tax, and real estate practices. But beginning in the 1970s, its litigation practice grew from its base in antitrust litigation into securities, oil and gas, utility regulation, bank regulation, insurance, toxic tort, environmental, class action, and multidistrict litigation. The firm’s business practice evolved as well, expanding to meet its clients’ needs for real estate development, capital markets,

mergers and acquisitions, family wealth planning, and intellectual property. “We have a very strong litigation practice, and for years we have handled a lot of high-profile litigation in Louisiana and the Gulf South,” says Wittmann, who joined Stone Pigman in 1961 and concentrates his practice on commercial litigation, class actions, toxic tort litigation, products liability, and antitrust matters. For example, Stone Pigman served as counsel for Cameron International Corporation in the Deepwater Horizon Gulf Coast Oil Spill multidistrict litigation. The firm also obtained the dismissal of multiple class actions brought against Washington Group International alleging causation of floodwall breaches during Hurricane Katrina. Recently, the firm successfully defended MoveOn.org against trademark infringement claims brought by the lieutenant governor in an effort to force the removal of a MoveOn.org billboard that criticized the governor’s decision to refuse federal Medicaid expansion dollars using a parody of the state’s tourism marketing campaign. Moreover, Wittmann served as defendants’ liaison counsel on behalf of Merck in the Vioxx multi-district litigation. “Our reputation is based on a longstanding record of successful client representation in complex litigation,” Wittmann notes. On the business side of its practice, Stone Pigman has a history of being involved

in some of the region’s most significant transactions, ranging from major industrial projects along the state’s petrochemical corridor to office, retail, and mixeduse projects to sports and entertainment and hospitality venues. Recent representative transactions include handling the redevelopment of Benson Tower and Champions Square; representing the city’s development entity in the redevelopment of the historic Saenger Theatre and other Canal Street properties; representing the Saints and Pelicans in stadium and arena negotiations; handling the acquisition and development of the Royal Orleans, Windsor Court, Loews, and Wyndham Riverfront hotels; representing domestic and foreign companies coming into Louisiana to develop or finance projects along the Mississippi River; and working with a major research university for its new oncampus stadium. Talley, who co-chairs the firm’s Real Estate Practice group, observes: “Our firm has been honored to work on these projects.
