What interested you about going into your particular area of law? Growing up in rural Middle Tennessee, I spent many days on small town courthouse squares and sitting in courtrooms watching cases being tried. Seeing trials intrigued me and was the predicate for my deciding I wanted to practice law. What would you say is the most rewarding aspect of practicing in your area of law? The most rewarding aspect of being a trial lawyer is defending an innocent

client and having the jury return a verdict of “not guilty.” It creates a huge adrenaline surge different from those resulting from other experiences. What has been the key to your success? The keys to my success include hard work, incredible preparation for trial and a willingness to put everything aside while a lawsuit is being tried. What is one example of a case/ matter that you are particularly proud of? The jury verdict of some 30-plus years ago in Winamac, Indiana in the prosecution of the Ford Motor

Company for reckless homicide in regard to the design of the Ford Pinto was certainly a shining example of a case/matter of which I’m particularly proud; my law partner from Neal & Harwell tried these cases. How has the legal industry in your field changed in the last 30 years? The profession has become more of a business, and less of a profession, with much greater focus on the economics of the practice of law and the billable hour. What does being included in Best Lawyers for 30 years mean to you? It is certainly an honor to be included in Best Lawyers. To be included for 30

years is a phenomenal compliment, for which I am grateful. What is one piece of advice you would give to new attorneys? No case, no client, no cause justifies a lawyer acting in an inappropriate way, be it legally or ethically inappropriate. What is the biggest obstacle you see for your practice area in the next 30 years? The biggest obstacle I see regarding trial lawyers in the next 30 years is the trend toward ADR, be it by mediation or arbitration, and the rapidly diminishing number of cases that are tried before a jury.

I think the entire field has become much more competitive and the pressure put on lawyers—particularly young lawyers—is much greater than it was when I began. Young lawyers are paid a lot more than young lawyers received when I started and, like pro sports, there is a lot of pressure to perform quickly. What does being included in Best Lawyers for 30 years mean to you? I was honored by being included in the first edition of Best Lawyers and in continuing to be listed every year since. There are a lot of “rating” services for

lawyers today, but Best Lawyers is still the gold standard. What is one piece of advice you would give to new attorneys? Preserving and protecting your integrity is extremely important. As a litigator, you want judges to reach the point where they rely on you as an advocate and know that they can trust what you tell them about a case you are arguing or presenting to them. What is the biggest obstacle you see for your practice area in the next 30 years? I think the financial pressures on lawyers will continue to grow. Many corporate clients are taking steps to reduce their outside legal expenses by either bringing work in-house or looking for alternative billing arrangements. As a result, I think the competition between lawyers and between law firms will only intensify.

A Warrior in the Courtroom RANDALL KINNARD OF KINNARD, CLAYTON & BEVERIDGE HAS EARNED HIS SUCCESS BY WINNING CASES AT TRIAL

F

or nearly four decades, personal injury and medical negligence attorney Randall Kinnard has thrived on the combat of trial. While a growing trend has been for insurance agencies to settle with plaintiffs outside the courtroom—often for less than what the injured person deserves—Kinnard remains committed to preparing every case as if it will be tried to verdict. And if insurance companies fail to offer his clients fair compensation, Kinnard has a history of seeking justice by taking cases to trial. “We have earned our success by winning cases in the courtroom,” Kinnard notes. “We investigate our cases carefully, retain the best experts, and constantly plan for battle—the key to our success is a wellexecuted plan, and our tenacity pays off for our clients.” In 1987, Kinnard achieved a record jury verdict for a 32-year-old woman who suffered permanent brain damage after a doctor cut her intestine during a tubal ligation. At the time, the largest verdict for any case in Middle Tennessee was $1 million, and the insurance carrier that was a defendant in the case offered Kinnard’s client that same amount to settle the matter. But Kinnard notes, “I calculated what my client would need to finance her care for the rest of her life, and I refused to accept a penny less than that number—$1.3 million. So I told the insurance company to pay that amount or we would let the jury decide the case.” When the carrier refused, the case went to trial, where the jury awarded Kinnard’s client $6.7 million. “Not only did that verdict ensure that my client was taken care of for the remainder of her life, but it helped get the word out so that we could help more people,” Kinnard says. In 2010, Kinnard again made history when he and Daniel Clayton achieved a $22 million verdict for a client who was left paralyzed from the waist down after problems developed during her surgery for a broken leg. The award was the largest for a medical malpractice case in Tennessee history. “The insurance companies had offered our client $4 million to settle, but this was

an injury that should never have happened,” Kinnard says. “My client went into the hospital with a broken lower leg and came out a paraplegic.” Most recently, Kinnard obtained the largest verdict in Weakley County history—a $15.2 million award in 2013—for the family of a 23-yearold man who Randall L.
