ince 1977, Kinnard, Clayton & Beveridge has offered personalized attention and determined advocacy to victims of others’ negligence. The firm’s attorneys have more than 100 years of combined experience, and together they represent clients injured through negligence of all types, including car accidents, bad or faulty drugs, medical malpractice, and other acts of carelessness. “By limiting the scope of our practice to helping seriously injured clients or those who have lost loved ones, we have been able to maintain high standards of professionalism, dedication, and personal attention in every case,” notes Randall Kinnard, the firm’s founding partner. While Kinnard, Clayton & Beveridge’s main focus

is on obtaining compensation for injured victims, the firm’s attorneys are more than just advocates for their clients: they are proponents of safety, accountability, and justice for society at large. “What we do amounts to more than pursuing a case for a client,” Kinnard says. “We help drive change in instances of unsafe conduct, and we are especially proud of the many policy changes at hospitals that have come about because we attacked improper or outdated policies that caused patient injury or death.” The firm’s success is reflected in the many record-setting personal injury and medical negligence results it has achieved over the years. In addition, its lawyers are often asked to speak on subjects relating

to their field at conferences for other attorneys and judges. And all three of the firm’s name partners have been selected by their peers for inclusion in The Best Lawyers in America. Above all, the firm’s lawyers make a priority of bringing their passion, professionalism, and genuine care to the broader community. From their annual support of Prevent Child Abuse Tennessee to their participation in Wounded Warriors Project and Not Alone, they are continually giving back to Middle Tennessee while working to advance national causes as well. “Our commitment goes beyond surface-level activities,” Kinnard notes. “Instead, we are intricately involved in making our community the best it can be.”

METHODOLOGY Inclusion in Best Lawyers is based entirely on peer-review. The methodology is designed to capture, as accurately as possible, the consensus opinion of leading lawyers about the professional abilities of their colleagues within the same geographical area and legal practice area.

Best Lawyers employs a sophisticated, conscientious, rational, and transparent survey process designed to elicit meaningful and substantive evaluations of the quality of legal services. Our belief has always been that the quality of a peer-review survey is directly related to the quality of its voting pool.

The Best Lawyers editorial staff reviews the votes and comments. Selected lawyers are checked against state bar association sanction lists to make sure they are in good standing with the ethics committee of their state bar.

Listed lawyers are notified of inclusion and the list is released to the public.

Q&A

30

YEARS with Aubrey B. Harwell, Jr. of Neal & Harwell, PLC, listed in The Best Lawyers in America for 30 years

What interested you about going into your particular area of law? Growing up in rural Middle Tennessee, I spent many days on small town courthouse squares and sitting in courtrooms watching cases being tried. Seeing trials intrigued me and was the predicate for my deciding I wanted to practice law. What would you say is the most rewarding aspect of practicing in your area of law? The most rewarding aspect of being a trial lawyer is defending an innocent

client and having the jury return a verdict of “not guilty.” It creates a huge adrenaline surge different from those resulting from other experiences. What has been the key to your success? The keys to my success include hard work, incredible preparation for trial and a willingness to put everything aside while a lawsuit is being tried. What is one example of a case/ matter that you are particularly proud of? The jury verdict of some 30-plus years ago in Winamac, Indiana in the prosecution of the Ford Motor

Company for reckless homicide in regard to the design of the Ford Pinto was certainly a shining example of a case/matter of which I’m particularly proud; my law partner from Neal & Harwell tried these cases. How has the legal industry in your field changed in the last 30 years? The profession has become more of a business, and less of a profession, with much greater focus on the economics of the practice of law and the billable hour. What does being included in Best Lawyers for 30 years mean to you? It is certainly an honor to be included in Best Lawyers. To be included for 30

years is a phenomenal compliment, for which I am grateful. What is one piece of advice you would give to new attorneys? No case, no client, no cause justifies a lawyer acting in an inappropriate way, be it legally or ethically inappropriate. What is the biggest obstacle you see for your practice area in the next 30 years? The biggest obstacle I see regarding trial lawyers in the next 30 years is the trend toward ADR, be it by mediation or arbitration, and the rapidly diminishing number of cases that are tried before a jury.

I also assisted Vanderbilt in enforcing the first “buy-out clause” that I know of, against a former athletic coach who left for another university. How has the legal industry in your field changed in the last 30 years? I think the entire field has become much more competitive and the pressure put on lawyers—particularly young lawyers—is much greater than it was when I began. Young lawyers are paid a lot more than young lawyers received when I started and, like pro sports, there is a lot of pressure to perform quickly. What does being included in Best Lawyers for 30 years mean to you? I was honored by being included in the first edition of Best Lawyers and in continuing to be listed every year since. There are a lot of “rating” services for

lawyers today, but Best Lawyers is still the gold standard. What is one piece of advice you would give to new attorneys? Preserving and protecting your integrity is extremely important. As a litigator, you want judges to reach the point where they rely on you as an advocate and know that they can trust what you tell them about a case you are arguing or presenting to them. What is the biggest obstacle you see for your practice area in the next 30 years? I think the financial pressures on lawyers will continue to grow. Many corporate clients are taking steps to reduce their outside legal expenses by either bringing work in-house or looking for alternative billing arrangements. As a result, I think the competition between lawyers and between law firms will only intensify.

Explosion cases are always complex matters. They require investigation, expertise and analysis. Eddie has extensive experience and success in this highly specialized litigation both as a lawyer and as a consultant. or nearly four decades, personal injury and medical negligence attorney Randall Kinnard has thrived on the combat of trial. While a growing trend has been for insurance agencies to settle with plaintiffs outside the courtroom—often for less than what the injured person deserves—Kinnard remains committed to preparing every case as if it will be tried to verdict. And if insurance companies fail to offer his clients fair compensation, Kinnard has a history of seeking justice by taking cases to trial. “We have earned our success by winning cases in the courtroom,” Kinnard notes. “We investigate our cases carefully, retain the best experts, and constantly plan for battle—the key to our success is a wellexecuted plan, and our tenacity pays off for our clients.” In 1987, Kinnard achieved a record jury verdict for a 32-year-old woman who suffered permanent brain damage after a doctor cut her intestine during a tubal ligation. At the time, the largest verdict for any case in Middle Tennessee was $1 million, and the insurance carrier that was a defendant in the case offered Kinnard’s client that same amount to settle the matter. But Kinnard notes, “I calculated what my client would need to finance her care for the rest of her life, and I refused to accept a penny less than that number—$1.3 million. So I told the insurance company to pay that amount or we would let the jury decide the case.” When the carrier refused, the case went to trial, where the jury awarded Kinnard’s client $6.7 million. “Not only did that verdict ensure that my client was taken care of for the remainder of her life, but it helped get the word out so that we could help more people,” Kinnard says. In 2010, Kinnard again made history when he and Daniel Clayton achieved a $22 million verdict for a client who was left paralyzed from the waist down after problems developed during her surgery for a broken leg. The award was the largest for a medical malpractice case in Tennessee history. “The insurance companies had offered our client $4 million to settle, but this was

an injury that should never have happened,” Kinnard says. “My client went into the hospital with a broken lower leg and came out a paraplegic.” Most recently, Kinnard obtained the largest verdict in Weakley County history—a $15.2 million award in 2013—for the family of a 23-yearold man who Randall L. A Firm of Best Lawyers WITH EVERY MEMBER RECOGNIZED, MILOM HORSNELL CROW ROSE KELLEY PLC OFFERS CLIENTS CONSUMMATE EXPERTISE IN ENTERTAINMENT AND INTELLECTUAL PROPERTY LAW by Sean Stonefield

T

here aren’t many law firms composed exclusively of Best Lawyers, but this year the Nashvillebased team of entertainment and intellectual property attorneys at Milom Horsnell Crow Rose Kelley PLC (MHCRK) achieved that distinction for the second year running, with Mike Milom, Chris Horsnell, David Crow, Natalya Rose and Page Kelley all being named in the publication. In reflecting on this feat, Milom attributes the firm’s success to the personal contact it maintains with its clients. “Over the years, we have made a point of dedicating ourselves to our clients’ matters—we won’t take on any work where we feel we can’t commit our full attention to the issues at hand,” he says. Crow adds, “Ultimately, we view ourselves as being part of our clients’ advisory team, particularly in the case of our artist clients. We realize that it takes a highly skilled team to guide artists’ careers, and we are grateful for the opportunity to work with some truly great artist teams. Our professional success is measured by the level of success of our clients in terms of achieving their shortand long-term career goals.” Indeed, MHCRK enjoys a national reputation for its thoughtful, pragmatic approach to entertainment and intellectual property matters. For years, its lawyers have maintained leading practices in music publishing, recorded music, and copyright protection, and they have since expanded into the areas of media and technology. As a result, MHCRK has been ranked Tier 1 in Nashville by U.S. News – Best Lawyers “Best Law Firms” for copyright law, motion pictures and television entertainment law, music entertainment law, and trademark law. “We have been incredibly privileged to be able to dedicate ourselves exclusively to entertainment and intellectual property

matters and build on our knowledge in that area,” Rose says. “We owe it to our clients, who have allowed us to focus solely on these areas of the law, and also to our tireless co-counsel, here in Nashville, across the United States, and in many parts of the world, who make it possible for us to meet all of our clients’ needs.” This year, Rose was selected by her peers as Best Lawyers’ Nashville Lawyer of the Year for trademark law. In addition to trademarks, Rose concentrates her practice on other issues related to intellectual property such as book publishing, e-commerce, and promotions. And while she handles matters for clients from a number of industries—including healthcare, ministry, education, and consumer products—she also works closely with her partners, assisting their clients in the entertainment industry. “The fact that Natalya is Best Lawyers’ Nashville Lawyer of the Year for trademark law is a recognition of how far forward she

has moved that practice in the context of our entertainment practice,” Milom says. “Her work in that area is well beyond what anyone in Nashville has done, not only in terms of brand protection, but also in the case of online initiatives, such as structuring domain name and social media portfolios.” Milom has been practicing law for 43 years, and in that time he has represented some of the most successful recording artists, producers, and songwriters in the music industry. As a leader in his field, he has also held a number of prominent positions in the legal community, serving as chair of the Tennessee Bar Association Section on Copyright, Entertainment, and Sports Law and as chair of the Entertainment Law Committee of the Nashville Bar Association. Milom has been listed in Best Lawyers since 1995, and in 2012 he was named as Best Lawyers’ Nashville Lawyer of the Year for copyright law.

“Mike has been around long enough to get attention from everyone in town,” Horsnell notes. “He’s the veteran of our group, and the rest of us look up to him, and if we have questions he’s the person we go to. And that’s true among clients as well as lawyers.” Horsnell has been practicing with Milom since 1979, his first year out of law school. He concentrates his practice in the areas of corporate, business, entertainment, copyright, and intellectual property, and in 2011 he was recognized as Best Lawyers’ Nashville Lawyer of the Year for intellectual property law. Beyond his practice, Horsnell has authored a number of articles on copyright and the music business for Music Row Magazine and the Nashville

Bar Journal. He has also taught copyright law and intellectual property law at Belmont University and Vanderbilt Law School. Crow has been professionally active in the music business for more than 30 years, and he has focused his legal practice exclusively on entertainment and intellectual property matters for the past 14 years. He brings to the firm his firsthand experience in the music industry, having played fiddle with the Osborne Brothers and served as an instrumental recording artist for Pinecastle Records prior to practicing law. Kelley has dedicated his practice to entertainment and intellectual property law since 1990. Before joining MHCRK, he worked as in-house counsel for both country and Christian music labels.

“ULTIMATELY, WE VIEW OURSELVES AS BEING PART OF OUR CLIENTS’ ADVISORY TEAM, PARTICULARLY IN THE CASE OF OUR ARTIST CLIENTS.”

Today, he concentrates his practice mainly on the representation of individual clients and independent record labels in contractual and transactional matters. “Each of us here brings something different to the table,” Kelley says. “Together, we’re able to draw on a broad base of experience, which is great for our clients. For me, working with our clients over time to help them achieve their goals, sharing in a small way in their progress and success, and doing that with people whom I genuinely like and respect—that’s a truly rare and wonderful thing.” MHCRK’s clients include recording artists, screen and broadcast talent, composers, publishers, authors, television and film distributers, entertainment industry executives and financiers, and companies that develop content branding strategies and delivery systems. While the firm does not disclose its client list, it’s known to represent such high-profile clients as Luke Bryan, Emmylou Harris, The Band Perry, Rascal Flatts, Taylor Swift, and Hank Williams Jr., as well as Vanderbilt University and the Country Music Hall of Fame and Museum. “Our clients exemplify the highest standards of creativity and innovation, and the most personally satisfying part of this job has been earning the trust of our long-term clients,” Milom says. “We’ve represented several clients in the entertainment industry for more than 30 years, and for lawyers, establishing those kinds of relationships is the ultimate reward.”

ince 1942, the lawyers at Cornelius & Collins have served as zealous advocates for their clients while adhering to the firm’s core principles of client service and professionalism. “Our mission is to partner with our clients to help them succeed,” notes managing partner Jay Chamness, “and we do so with the utmost integrity.” With their extensive knowledge and experience, the firm’s attorneys are able to advise and represent clients in a broad range of practice areas.
