Methodology

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives

fax or email ballots; the other half is polled by phone. Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. Veteran family law attorney Susan Rhode never pictured herself in the practice. Far from it: Rhode, an attorney at Moss & Barnett, thought she was more of the M&A type, or perhaps someone who would try criminal cases. But clerking in the court of appeals during law school for a former family law judge nudged her into the practice—and it’s where she has been ever since. “It turns out that family law had all of the elements I was interested in,” says Rhode, a former junior high teacher who went to law school on a dare issued by her younger brother, himself an attorney. “It has the business element that I wanted along with some of the action of criminal cases. I equate my job to being an ER doctor, moving from unique problem to unique problem. Sometimes the patient has a cold and sometimes it’s a missing limb.” Regardless of the problems with which clients come to her, Rhode says the objective is always the same: to get them to the other side. Increasingly, that means mediation, says Rhode, who has extensive experience as a mediator and who also represents clients in the ADR process. But at the end of the day, it’s all about one thing. “It’s an honor to help people heal,” says the well-credentialed Rhode, who has been involved in several key cases that have helped shape Minnesota law. “The best part of my job is that I get to watch the transformation.” n

Plaintiffs’ attorney William Sieben began his legal career as a staff member to Walter Mondale during the Carter presidency, writing political briefs and handling Minnesota-centric matters and issues relating to Native Americans. That may have been nearly 35 years ago, but Sieben’s political beliefs and his practice are as tightly intertwined today as they were when he was a young lawyer in the White House. “The kind of work I do goes hand in hand with my political philosophy,” says Sieben, a partner at Schwebel, Goetz & Sieben whose family has been deeply involved in Minnesota law and politics for generations. “Mondale, who is still a role model and mentor, is a populist and a progressive who did things for the masses. I represent injured individuals against huge corporations. The values are pretty similar.” With adversaries such as Wal-Mart, huge is something of an understatement. Sieben, a top Minnesota trial lawyer who still finds himself in the courtroom a half-dozen times a year, was co-lead counsel in a 56,000-member class action suit against the discount retailer that settled for a record $54 million in 2008. But going head-to-head against the world’s largest retailer—not to mention the other equally formidable opponents he has faced over the years—is all in a day’s work for Sieben, who won the first case he ever tried inside a courtroom and has been amassing an impressive record of verdicts and settlements ever since. “Lawyers can make an incredible difference in the lives of worthy individuals,” he says. “It’s what I’ve spent my career trying to accomplish.” n
