METHODOLOGY

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or email ballots; the other half is polled by phone.

Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. rom the outset of his career, E. Powell Miller knew that he wanted to become a trial lawyer, and by starting at Honigman Miller Schwartz and Cohn LLP, one of Michigan’s top law firms, he soon found his way: “They taught me how to be a trial lawyer,” says Miller of his experience at the firm. “At a very young age, they gave me the opportunity to try major cases with outstanding attorneys who helped shape me into the lawyer I am today.” By 1990, Miller had made partner at the firm, and three years later he set out on his own, forming The Miller Law Firm. “I wanted to be entrepreneurial and try building my own practice,” he says. “In the early 1990s, there were very few lawyers in Michigan prosecuting class actions, so I wanted to be one of the first to have a meaningful presence in that area.” Miller has continued to focus on complex commercial litigation, and his firm is now a recognized leader in the area, having been ranked Tier 1 in Detroit by U.S. News-Best Lawyers “Best Law Firms” for commercial litigation. Miller was

also selected by his peers in 2010 as Best Lawyers’ Lawyer of the Year in Detroit for bet-the-company litigation. He is regularly retained by Fortune 500 companies—such as Johnson Controls and Penske Automotive Group—to handle litigation throughout the United States; moreover, he has built a national reputation for prosecuting and defending class actions. ttorney Russell Gregory is one of the best and most widely recognized birth-trauma litigators in the state of Michigan, a reputation he’s painstakingly built over the better part of three decades in practice. Eugene Driker is a founding member of Barris, Sott, Denn & Driker, PLLC, where he concentrates on complex business litigation. As part of his practice, Driker handles bet-the-company litigation, for which he was named as Best Lawyers’ Detroit Lawyer of the Year in 2011 and 2013. He was also named as a Detroit Lawyer of the Year in 2012 for ethics and professional responsibility law. “Experience is a great teacher,” Driker says of the recognition he has received during his 51-year career. “I’ve been doing this for a long time, and whenever you handle a case there is an accretion of knowledge that helps you the next time around.” Driker began his career working on antitrust cases, first for the U.S. Department of Justice in Washington, D.C. and later as a private practitioner. From there, he made complex business litigation his primary focus, and he has since handled many significant matters: In one of his most notable cases, Driker represented a Michigan public utility in a $500 million fraud and breach of contract action brought by a major industrial firm. The case involved one of the longest civil trials in Michigan court history, and the parties ultimately settled the matter with a business arrangement. “The clients’ business interests must be paramount, and oftentimes that means achieving a consensual resolution that will allow the client to get on with its business,” notes Driker, who also serves as a court-appointed mediator for a number of Federal district court judges in Detroit. n

Since his first job out of law school, attorney Paul Rosen has focused his practice on plaintiffs’ personal injury law. “By luck I walked into probably the best personal injury firm in the state of Michigan—if not the country—way back nearly 50 years ago,” he says. In addition to personal injury, the firm Rosen started at handled civil liberties and civil rights law, and he soon became involved in a number of notable cases. “During my career I was fortunate enough to take a case to the United States Supreme Court with William Kunstler, the longtime civil rights lawyer of Chicago Seven fame,” Rosen recalls. Their argument in the case, which involved racially segregated swimming pools in Jackson, Mississippi, has since been named in the book May It Please the Court: The Most Significant Oral Arguments Made Before the Supreme Court Since 1955 (The New Press, 1993). In the area of personal injury, Rosen has become particularly well known for his work in products liability cases. This year, he was named as Best Lawyers’ Detroit Lawyer of the Year for plaintiffs’ personal injury litigation. Rosen is also a member of the American College of Trial Lawyers and a recipient of the Michigan Defense Trial Council’s Respected Advocate Award. “I’d like to think that I’ve been professional in my practice and that the honors I’ve received are a testament to that,” Rosen says. Currently, he serves on the Michigan Judicial Selection Task Force and teaches constitutional law at the University of South Florida. n

t first glance, E. Powell Miller’s office could easily be mistaken for a sports memorabilia museum. Making a Difference for Good: Robert Z. Feldstein on the Good That Comes from the Practice of Matrimonial Law

R

obert Z. Feldstein’s career as a matrimonial lawyer handling mainly high-asset, complex divorce cases was already well established when a client who would ultimately help propel him to the national stage approached Feldstein for assistance with the dissolution of his marriage. Feldstein’s client was the well-known chairman of a global automobile manufacturer with deep roots in Michigan, and it was obvious that the divorce would make headlines—both around the country and the world. “The case heightened the public’s awareness of my involvement in the field,” he says. “It definitely ratcheted up my profile and recognizability.” But it was all in a day’s work for the meticulous Feldstein, an old-school lawyers’ lawyer—he has represented countless attorneys and wives of attorneys in their divorce proceedings—who has been consecutively listed in Best Lawyers for well over 20 years and counting.
