Much like the weather, the market appears to have once again picked up. Whilst uncertainty remains over what the Bank of England will do with regards to interest rates over the coming months, I have found consumer confidence appears to have stabilised, instructions are increasing weekly, and I hope all our members are having a similar experience coming into Spring.

In January SLS responded to two SRA Consultations Proposals to change how the English or Welsh language proficiency of qualified lawyers is assured – relating to proposals to change when and how the SRA seek assurance that a qualified lawyer who has been granted an exemption from SQE2 has the English or Welsh language proficiency needed to practise as a solicitor of England and Wales, and Changes to the rules on Solicitors Qualifying Examination (SQE) exemptions – relating to a new rule that would prevent qualified lawyers from being granted an exemption from part or parts of the SQE that they have previously attempted and failed. An analysis of the responses and any corresponding policy decision is yet to be published.

On 7th March I was invited to host the inaugural County Societies Group (CSG) Conference, a pioneering collaboration uniting the local law societies of Cheshire & North Wales, Devon & Somerset, Kent, Leicestershire, Newcastle, and our very own Surrey. The County Societies Group Conference was a testament to our shared commitment to delivering affordable training to our collective members. Born out of a dedication to accessibility and relevance, this conference series represented the culmination of efforts from societies across the country and the breaking down of geographical barriers. The conference programme offered an invaluable opportunity to gain up to date knowledge on key issues affecting conveyancing practitioners with helpful and informative insights from Ian Quayle, Allie Parsons, Sally Redman, Andrew Roddy and Richard Snape, each an authority in their respective fields.

April will see SLS host further educational seminars in the way of Private Client and Family Law updates and a Guide for Conveyancers on navigating properties let on an Airbnb basis in the UK. Booking is available via the SLS website.

Later this month I have been invited to the University of Law's Awards Evening at Guildford Campus to present an award to the Winner of Highest Mark in PgDL/MA Conversion and I will look

forward to sharing the details of the successful aspiring Lawyer in the next edition of the SLS magazine. On 9th May Helen Opie CEO of SLS and myself will be attending the Local Law Societies Town Hall Meeting which will include a chat with the Attorney General and Nick Emmerson, President, Law Society of England and Wales.

Cancer Research UK is my nominated charity and one which is incredibly close to my heart. Cancer has been very much brought to the forefront of the news in recent weeks with both King Charles and Princess Catherine having been diagnosed with Cancer. I am therefore delighted to announce that SLS will be hosting an exciting new fundraising initiative “Sailing for a Cure” on 26th April 2024 where we will be inviting members to join us to cruise along the Thames aboard the New Southern Belle, a vibrant Missisippi-style sternwheeler, embarking from Kingston and journeying along a stunning part of the Thames from Hampton Court to Richmond. Tickets are now on sale and will include a drinks reception, delectable bowl food, live music and a raffle/auction. We have secured more than 20 incredible donations including flight simulator experiences, hot air balloon rides, afternoon tea at the Ritz and a 1969 Series E-Type Roadster for the weekend. We will be joined by representatives of Cancer Research UK who will provide branding for the event. This is an excellent opportunity for member firms to showcase their philanthropy and corporate responsibility. Helen and I have worked really hard to organise a fantastic evening in a beautiful setting where we can let our hair down whilst hopefully raising as much money as possible for Cancer Research UK and I very much hope to see as many of you there as possible.

Finally, a reminder that nominations for the 2024 SLS Legal Awards will close on 26th April. The Awards have grown year on year. As well as being a fantastic social evening and networking opportunity the awards are an excellent opportunity to showcase the wealth of incredible talent that our membership has to offer. pring is upon us, and it has been a busy start to 2024 with the implementation of the Society’s new membership database, which dramatically improves the previously outdated system that had been in place for many years. Elouise has worked tirelessly to manually upload the most current and accurate data for our members, and you will hopefully have received by now the details of the information we hold for you and your firms. We hope that the new system will streamline our communications in the coming months so that you receive the information most relevant to you, with the ability to control your preferences and interests. We have also been busy with the preparation of the 2024/25 membership renewals and hope that members have received their invoice for next year’s subscription by now.

In March, the Society spearheaded the inaugural CSG Conference, a groundbreaking collaboration with esteemed counterparts from the local law societies of Cheshire & North Wales, Devon & Somerset, Kent, Leicestershire and Newcastle. The online conference focussed on conveyancing and examined Future Frontiers in Conveyancing – Unveiling Trends, Tackling Challenges, and Elevating Expertise in 2024. Members from all six societies came together to hear expert speakers talk on the Building Safety Act, Climate Change Reporting, the Digitisation of Conveyancing and Leasehold Reform, and we are grateful to Ian Quayle, Richard Snape, Alison Parsons and Sally Redman from Landmark Information and Andy Roddy from HM Land Registry for their excellent presentations.

The Society has also kicked off its traditional training programme and had a sell-out in-person course on the Bank of Mum & Dad delivered by John Bunker and James Lister, which was held at the incredible offices of Stevens & Bolton in Guildford. We have also hosted excellent webinars on The Family Procedure (Amendment No.2) Rules 2023 with Karen Barham and Charting the IHT Course with Helen Forster, which were available free to SLS members.

Perhaps the most exciting addition to the programme is, however, our Sailing for A Cure Legal Charity Event, which will take place on Friday 26th April. We have recently been excited to announce the launch of our 2024 Supporting Surrey Programme on Financial Wellbeing, run in collaboration with SLS Premium Patron Evelyn Partners. The programme is a series of 3 webinars, free to SLS members and subscribers to the Surrey JLD mailing list and will provide attendees with valuable insights into financial planning at every stage of their careers.

TWM strengthens Corporate and Commercial presence in Guildford with new partner hire and solicitor promotion

John specialises in corporate law and will work closely with the team to cover London and the South market. John has 20 years of top-tier City and Surrey experience in the field and advises on the whole spectrum of corporate transactions, both domestic and cross-border, for businesses ranging in size from SMEs to multinationals. A free money advice and wellbeing support service is available to people living and working in Epsom & Ewell. The Financial and Wellbeing Support Service (FWSS) is delivered by Citizens Advice Epsom & Ewell (CAEE) for expert benefits and money advice, and by mental health charity Mary Frances Trust (MFT) for specialist wellbeing support.

If managing your finances is causing stress and anxiety or mental health challenges are impacting your ability to manage your finances, the threeyear project funded by The National Lottery Community Fund will provide a range of free services and resources to help residents to get help during this difficult time.

The aim of the project is to empower the client, and:

• Increase financial resilience and independence

• Improve overall mental and/or emotional wellbeing

• Reduce stress and anxiety

• Increase engagement with local community and reduce social isolation

• Be more informed about how to manage finances and wellbeing going forward.

Patrick Wolter, CEO, Mary Frances Trust, said: “With CAEE and MFT working so closely together, the client only has one point of contact to help them get the full support they need. We are thrilled to offer this free service to the residents of Epsom and Ewell.”

New Hires Increase Meadows & Co.’s Client Offerings

Hannah Bourke, a New Zealand qualified solicitor and barrister also joins us as a lawyer in the firm’s private client department. Hannah graduated from the University of Otago in New Zealand in 2020 with a BA majoring in Psychology and a LLB in Law. While studying, Hannah worked as a Law Clerk for a high-end boutique Law firm in Auckland focusing on Private Client and Residential Property Law, which is the position she took on permanently after graduation.

Bethany Fowler is the third of our new hires as a paralegal in our property department. Bethany has recently completed the SQE1 exams, and we look forward to working with Bethany as her career progresses.

On 22 February 2024, a new first-of-its-kind report by UK charity, the Centre for Crime and Justice Studies (CCJS), has been published with a landmark strategy to resolve a 21year state miscarriage of justice in UK prisons: Imprisonment for Public Protection (IPP).

Now recognised as infamous, IPP sentences were a form of indefinite prison sentence, described subsequently as the “single greatest stain” on the UK’s criminal justice system [1]. However, nearly 3,000 prisoners, many of whom are very low-level offenders, remain behind bars in prisons today. The reason is that, despite this controversial sentence being ‘abolished’ in 2012 following widespread concern over its implementation and psychological impact on inmates, this decision was non-retrospective and did not apply to those already in prison.

The new report – ‘How to resolve the IPP crisis for good’ –presents a five-point plan for resolving the tragedy once and for all and comes as momentum is building around proposed IPP amendments to the Victims & Prisoners Bill, currently making its way through the House of Lords.

The report presents clear measures designed to protect the most despairing prisoners, reduce numbers of IPPs unnecessarily filling prisons, and prevent future similar crises. It calls on the UK Government to:

1. Release the most distressed prisoners on compassionate grounds.

2. Launch a recovery and reparations programme alongside expanded mental health and social support.

3. Ease restrictions for over tariff IPP prisoners.

4. Commit to review all forms of preventative detention.

5. Complete a review of resentencing for all IPPs, effective immediately.

The CCJS emphasises that this plan could not only resolve a national scandal – which has destroyed the lives of thousands; unnecessarily filled prisons; cost taxpayers billions and breached British values and standards of law – but also make a crucial step on a pathway to ending the UK prison capacity crisis.

With almost 3,000 IPPs in prison today – equivalent to four average-sized UK prisons – expediting the release of over-tariff and distressed prisoners will have a large and immediate impact on reducing pressure on UK prisons, currently at 98% capacity according to latest official figures, and reportedly set to run out of spaces by spring 2024 [2]. Ambitious IPP reforms should also prevent alternative expensive and contentious proposals to ease capacity pressures, such as renting prison places for UK prisoners overseas, as far away as Estonia [3].

Improving conditions and mental health support, also recommended in the report, would be expected to slow the rate of self-harm and suicide among IPPs. According to IPP campaign organisation, UNGRIPP, 90 people given IPPs have committed suicide in prison between 2005 and the end of 2023, with the total number feared much higher due to the difficulty of recording

deaths of IPPs on licence in the community [4]. With a reported 19 in just the past two years (over 20% of the all-time total reported), this number is accelerating fast [5].

The report also comprises a comprehensive analysis of reforms made by successive UK governments, judging these as piecemeal, unambitious, and ineffective, including the Government’s ‘misnamed and underpowered’ IPP Action Plan, released in April 2023. Furthermore, it argues that recent Government-proposed changes to IPP licence periods – bringing automatic licence termination down from ten years to five years following release – will not solve the crisis, due to the high proportion of recalls occurring within the first five years. Licence period changes also do nothing to expedite the release of the 2,852 IPP prisoners currently behind bars, 1,227 of whom have never been released.

Additional analysis in the report, based on a prior collaboration with data analysis consultancy, Justice Episteme, projects future IPP populations. Based on long-term trends, the analysis shows that over 1,000 IPP prisoners will still be in prison in 2030. At this point, it will be 18 years since these prisoners’ sentence was ‘abolished’.

Justice Secretary, Alex Chalk, is coming under increasing pressure to look at IPP ‘resentencing options’ as the House of Lords is set to debate a series of amendments to the Victims & Prisoners Bill on 12 March 2024, including an amendment, proposed by Baroness Fox of Buckley, which would commit the Government to resentencing IPPs.

Richard Garside, Director of the Centre for Crime and Justice Studies, commented: “This really is a scandalous situation. The current IPP ‘Action Plan’ remains tied to an outdated and discredited approach to IPP. Something has to change, otherwise we will be sat here again, in another 12 years’ time since these ‘indefinite’ sentences were abolished, with this deadly crisis still going. After 21 years, at least 90 lives lost, and hundreds of families broken, surely it is time for the Government to grasp the nettle and take decisive action. I urge the Government to adopt our recommendations without delay, to end the political inertia that has allowed this stain on the British justice system to persist for over 20 years.”

Will Aid is an annual charity Will-writing scheme that sees hundreds of solicitors donate time in the month of November to write basic Wills. The Surrey Law Society is delighted to announce the opening of nominations for the highly anticipated SLS Legal Awards 2024. This annual event serves as a platform to recognise and celebrate the exceptional achievements within Surrey’s legal community, highlighting the talent, dedication, and innovation that define the legal profession across the county.

With an increased lineup of 14 categories, this year’s awards offer a comprehensive reflection of the diverse contributions across the Surrey Law Society membership. Noteworthy among these categories is the revamped Law Firm of the Year Award, now divided into two distinct sections to ensure equitable representation for firms of all sizes. Whether a small to midsize practice with under 20 fee earners or a larger entity, we eagerly anticipate submissions from firms across the board, keen to spotlight the excellence driving our profession forward.

Adding to the excitement are two new categories: the Client Care Award and the Access to the Profession Award. These additions underscore the Society’s commitment to recognising not only legal excellence

Definition of Junior Lawyer: The Law Society defines a junior lawyer as solicitor apprentices, LPC students, LPC graduates (including those working as paralegals), trainee solicitors, and solicitors with up to five years of post-qualification experience.

This award recognises individuals who go above and beyond in creating opportunities for aspiring legal professionals. The criteria for this award include:

• Placements Quantity and Quality: Facilitation of enriching work experience opportunities.

• Diversity and Inclusivity: Commitment to diverse and inclusive work experience opportunities.

• Mentorship and Guidance: Providing mentorship and guidance to enhance professional development.

• Advocacy for Accessibility: Advocacy for increased access to work experience in the legal field.

Council Member’s Report

As I write this report I hope we step into Spring with some sunshine in the air.

We have all seen the Spring budget and the Law Society had submitted recommendations to the government on how the Spring budget could be used to maximise the economic value of legal services. A number of matters affect the profession and we have to be prepared. There will be the digitising of jury bundles, the family courts to offer online targeted guidance and earlier legal advice to shorten wait times and support families through noncourt dispute resolution. There are also plans to introduce a new online information and guidance tool to support earlier resolution of family disputes and divert cases away from the family courts. The expanding of Legal Aid to encompass early legal advice in private family law proceedings for parties considering an application to the family court for childcare arrangements.

There will also be support for small businesses to develop AI skills of the future, which will complement the SME Digital Adoption Taskforce that is due to launch soon. There are also initiatives within the property sphere, aimed at boosting long-term rentals, streamlining inheritance tax procedures, and refining housing investment strategies. Concerns have been raised about the new Transaction Forms (TA6) in conveyancing and it is back on the drawing table to be looked into carefully. There is a lot to look out for and when I have more information from the Law Society I will let you know.

As to the matter relating to 60 Carey Street, whether we should retain it and develop it, or sell it, the Council overwhelmingly voted for Carey Street to be retained and developed to make it accessible and to be used for the benefit of our members.

What does the future hold for 2024?

In Landmark’s latest residential market research, over 100 residential property professionals, along with 500 home movers, shared their thoughts to help us to understand what the future holds for the industry.

An uncertain market

Times have been tough for conveyancers. Each year, it seems, there are additional responsibilities for fee earners to master and extra pressures to assimilate.

Landmark data reveals that the average time from instruction to completion takes 77% longer than it did in 2007. At the same time, most law firms would probably say the work their conveyancers carry out on each transaction has doubled over the past 16 years. Yet fees have not.

No wonder 80% of residential property lawyers and conveyancers are concerned about the negative effect the current economic climate, interest rates and the cost of living are having on the property market.

But is there also reason for optimism?

Insight as a platform for improvement

Our recent market research gives us invaluable insights into the residential property market. It shows us what’s currently of concern to conveyancers and where they see future opportunities to help drive the success and profitability of their businesses.

It also places a revealing lens on home movers’ perspectives –their expectations, thoughts on the industry, and views on what can be done to improve the home-buying experience.

Certainty in short supply

This year, we spoke to 100 residential property solicitors and conveyancers. Each will have their own individual concerns and priorities, but what jumps out at me is how much the sector as a whole is having to grapple with a lack of certainty, whether that’s chain instability or debates around who should provide customers with certain types of information. For instance, 72% are concerned about the impact protracted transaction timescales are having on chain certainty.

Public Affairs Update: The Law Society of England and Wales

The Law Society’s public affairs and campaigns team is at the heart of our work influencing the government, parliament, and key stakeholders in the UK. We are pleased to provide the following update on the latest developments.)

Spring Budget

The Chancellor of the Exchequer, Jeremy Hunt, presented the government’s Spring Budget to Parliament on Wednesday 6 March 2024 which made plans to address inflation and grow the economy. The Law Society submitted recommendations to the government on how the spring budget could be used to maximise the economic value of legal services.

Most of the measures included in the budget had been previously leaked or speculated, leading to analysis that there might be another fiscal announcement before the next general election. Hunt stated that due to the government’s emphasis on fiscal responsibility, “permanent cuts in taxation” could be implemented.

The chancellor followed through on these rumours by cutting employee national insurance contributions by 2% from 10% to 8% and self-employed national insurance contributions to 6%.

On justice, the government committed £170million to deliver what it calls “a justice system fit for the modern era”. This includes several investments into different aspects of the system. Firstly, £12million is being invested in expanding legal aid to encompass early legal advice in private family law proceedings for parties considering an application to the family court for childcare arrangements. The government also committed to investing £10million into the Crown Prosecution Service (CPS) to digitise jury bundles in the criminal courts, reducing paper wastage and unnecessary trial delays. Meanwhile, £55 million is being channelled into family courts to offer online targeted guidance and earlier legal advice to shorten wait times and support families through non-court dispute resolution.

There are also plans to introduce a new online information and guidance tool to support earlier resolution of family disputes and divert cases away from the family courts, where appropriate. The

tool will help families navigate the range of options available by suggesting suitable interventions based on need and provide early legal advice. Lastly, the government wants to improve the experiences of the courts for victims and survivors of domestic abuse through the Private Law Pathfinder Pilot. This scheme will identify needs earlier and provide specialist support to victims and survivors of domestic abuse.

Elsewhere, the chancellor announced measures to strengthen the regulatory framework for the tax advice market and plans to increase the Economic Crime Levy from £250,000 to £500,000.

A £7.4 million upskilling fund pilot was announced to support small businesses develop AI skills of the future, which will complement the SME Digital Adoption Taskforce that is due to launch soon. The pilot has a focus on professional services with less than 260 employees, and we would encourage our members who fall within this category to consider participating and express their interest in the pilot. The government is also extending the Recovery Loan Scheme, which offers a 70% government guarantee on loans to SMEs of up to £2 million in Great Britain and £1 million in Northern Ireland, to the end of March 2026. The government also announced an extension to the full expensing scheme with extra targeted support for small businesses.

The government also announced initiatives within the property sphere, aimed at boosting long-term rentals, streamlining inheritance tax procedures, and refining housing investment strategies. To encourage landlords to sell properties, the government is reducing the higher rate of capital gains tax from 28% to 24%, with hopes that this will increase availability for buyers, especially first-time homeowners. From 1 April 2024, personal representatives of estates will no longer need commercial loans to pay inheritance tax before probate, easing financial burdens and hopefully expediating the process. Lastly, the Government is abolishing the Multiple Dwellings Relief after evidence that the scheme has not had the desired effect of boosting private housing investment.

Key bills moving through Parliament

There are several bills of note making their way through Parliament. Firstly, the Safety of Rwanda (Asylum and Immigration) Bill which seeks to respond to the Supreme Court’s judgment from last year on the legality and lawfulness of the Rwanda deportation scheme by asserting that Rwanda is a safe country. The Law Society has questioned the workability and compatibility of this bill with core tenets of the rule of law and have continued to work with peers since it entered the Lords to formulate and lobby for amendments. The bill had its third reading in the Lords on 12 March, before heading into “ping pong”, where the Commons and the Lords will vote on whether to accept the others’ amendments. We will be pushing hard to ensure amendments are taken forward to mitigate some of the worst impacts on the rule of law and access to justice.

Post Office (Horizon System) Offences Bill looks to quash the convictions of those affected by the scandal, particularly those whose convictions were made off the basis of flawed evidence by the Post Office in relation to the Horizon system. This is an exceptional step, with the government making a clear intervention in the court process. The Law Society have welcomed the move in this instance but have been clear that this exceptional circumstance cannot set a precedent for further interventions.

The second reading of the Leasehold and Freehold Reform Bill in the Lords will be on 27 March 2024. This bill implements commitments to take forward many of the leasehold reform recommendations made by the Law Commission in its 2020 reports. The bill is the second part of a legislative package to reform leasehold law and follows the Leasehold Reform (Ground Rent) Act 2022. We want the leasehold system to operate fairly for leaseholders and not cause delays in the home buying and selling process, and support the general commitment in the bill to make it cheaper and easier for existing leaseholders in houses and flats to extend their lease or buy their freehold.

The bill delivers on the government’s commitment to ban the sale of new leasehold homes, a move we support. We welcome proposals to require more transparency for both financial and non-financial information provided on leaseholders’ service charges. Providing these in a standardised format for service charges is a useful step, and the information should be offered in ways that are both accessible and easily understandable for consumers. We support the proposals to create more transparency and regulation in relation to estate management; would support maximum fees for home buying and selling services provided by managing agents/freeholders, with some caveats; and would support the aim to cap unfair ground rents.

The proposals in the bill would make it easier for solicitors and conveyancers to provide transparency when consumers are looking to establish the costs involved in their purchase. Women Would Need To Work An Extra 19 Years To Close The Gender Pension Gap

• Today, women retire on average with pension savings of £69,000, compared to £205,000 for men, new research by NOW: Pensions and PPI reveals.

• In order to close this gap, a girl would need to start pension saving at just three years old, to retire with the same amount of money as working men.

• Career gaps owing to childcare and other factors result in an average ten-year career gap for women, amounting to £39,000 in lost pension savings.

Anew report launched by UK pension provider NOW: Pensions in partnership with the Pensions Policy Institute (PPI) reveals that by the time women reach retirement age (67), they will have average pension savings of £69,000. This is £136,000 less in pension savings than the average man, who will have saved £205,000 in the same period.

The 2024 gender pension gap report finds that for women to retire with the same amount of money in their pension savings as a man, they would need to work and save for an extra 19 years on average. As automatic enrolment starts at 22, this means that by age three, girls are already falling behind boys in their provision for later life.

Women make up 79% of workers who earn less than the automatic enrolment earnings threshold – this means that 1.9 million women in employment are not automatically enrolled into a workplace pension. If both age and earning thresholds were removed from automatic enrolment, an additional 885,000 young women in employment would become eligible for a workplace pension.

Working, childcare and career gaps

On average, women spend 10 years away from the workforce to raise families or take on other caring responsibilities. This career gap amounts to an average of £39,000 in lost pension savings.

Furthermore, the spiralling cost of childcare is a hindrance to many working households, with the average cost of full-time nursery for a child under age two in 2023 being £14,800 a year, and in London the average annual nursery fees are £20,000 or more per child. Consequently, by their late 50s, women will have built up just 62% of the pension wealth of men.

Pensioners in poverty

On average, women live around seven years longer than men, meaning women’s pension wealth needs to go further. A lifetime of earnings and other inequalities results in two thirds of pensioners currently in poverty being women, with single women making up half of this number.

NOW: Pensions’ 2024 gender pensions gap report suggests policy proposals to narrow the current savings gaps to help savers achieve the retirement they deserve.

Joanne Segars OBE, Chair of Trustees at NOW: Pensions said: “It’s hard to believe that by the time a young girl starts school at four, she will already be falling behind a boy of the

same age when it comes to providing for her retirement. Yet this is the reality many girls face as they leave education and enter the world of work.

Despite enacting some important policies in recent years to improve financial opportunities, outcomes and equity between men and women - like auto enrolment and gender pay gap reporting - our report is a timely reminder of the work that still needs to be done. We believe it can and it must.

Our research is an important step in identifying, defining, and addressing the problem and what we can do as a society to fight for fair pensions for all.”

Lizzy Holliday, Director of Policy and Public Affairs, NOW: Pensions comments: “Policymakers have made important decisions in recent years which are already making a substantial difference to the way workers and their employers are providing for retirement. Yet, as our research shows, the scale of the gender pensions gap remains vast and will require bolder policy actions. Some of the solutions are broader than traditional pension policy. Childcare and gender pay gap issues must be given the urgent attention they require. But setting out the roadmap for the future of auto enrolment including tackling the difficult issue of adequacy in retirement - which affects women disproportionately given lower pension wealth- should be front and centre of next steps.”

Lauren Wilkinson, Senior Policy Researcher, Pensions Policy Institute said: “While the Gender Pension Gap is widely recognised, there is a lack of clear consensus in terms of definition, magnitude and potential solutions. Measures of pension wealth and retirement income can both be useful to understanding the magnitude of the gap, but the approach taken in this year's edition of the underpensioned report provides a more nuanced analysis of the causes of the gap.

By their late 50s, women have average pension savings worth less than two-thirds of men's, with a substantial proportion of this difference stemming from inequalities in the labour market, including differing working patterns and the Gender Pay Gap. While there are some pensions policy options that could be introduced to potentially mitigate the Gender Pension Gap, it’s unlikely to significantly reduce without changes in labour market conditions and gendered divisions of domestic labour.”

The Law Society’s Diversity Access Scheme

From the high street to the high court, the legal profession should reflect the society it serves. That’s why every year we help talented, aspiring solicitors from less advantaged backgrounds to join the profession with our Diversity Access Scheme (DAS).

The DAS helps those with a lack of funding, industry contacts or opportunities to qualify as solicitors by offering vital scholarships, mentoring and work experience.

This year, we celebrate 20 years of our DAS which has helped around 300 aspiring solicitors enter the profession.

The current DAS application cycle opened on Wednesday 28 February, and ends on Saturday,13 April.

What does the Diversity Access Scheme offer awardees?

The DAS offers three key areas of support to awardees. Financial support through the provision of scholarships to help cover the costs of either the Legal Practice (LPC) or the Solicitors Qualifying Examination (SQE). The scholarships are funded by generous sponsors from the legal sector, who share the Law Society’s commitment to improving diversity and inclusion in the profession.

Support through mentoring opportunities. The DAS matches each awardee with a solicitor mentor who can provide advice, guidance, and encouragement throughout the journey to qualification. The mentors are qualified practising or non-practising solicitors who volunteer their time and expertise to support the next generation of solicitors.

Lastly, through work experience placements. The DAS arranges highquality work placements for its awardees, giving them the opportunity to gain practical experience and exposure to different areas of law and practice in areas of interest to them. The placements are offered by a range of employers, from large firms and in-house legal teams to public sector organisations and charities.

Who can apply?

Our awardees must be those with a strong interest in becoming a solicitor; and have completed, or are in the final year of, an undergraduate degree in law, a Graduate Diploma in Law (GDL), or have completed, or are in the final year of, a non-law degree and intend to take the SQE. There are no age restrictions to the DAS, and no barriers for those undertaking a career change to apply.

The Scheme is intended to support those that face one or more barriers to entering the profession. This could include those that come from a low-income household, or have experienced financial hardship; those that are the first in their family to attend higher education; those who are disabled or have a long-term health condition; those with caring responsibilities; those that have experienced discrimination or disadvantage due to their ethnicity, gender, sexual orientation, religion, or other protected characteristics; and those who have faced other significant challenges or obstacles which affected their education or career prospects.

Who we are reaching

Our awardee data over a five-year period has shown that we are successfully reaching the right candidates:

• 86% of DAS awardees grew up in low-income households

• 90% attended non-selective state schools

• 86% were part of the first generation of their family to go to higher education

• 31% of awardees disclosed a disability

• 44% of awardees are from Black or other minority ethnic backgrounds

How can you support the Diversity Access Scheme?

DAS is only possible because of the generous support of our members. As DAS enters its twentieth year, we hope that the number of awards offered can be increased and more individuals can be supported to achieve their goal of joining the legal profession.

We want to give the opportunity for as many individuals as possible to be supported by the DAS, but we need your help to make this happen.

If your organisation would like to support the scheme, you can make a contribution towards fees associated with completing the LPC or SQE; offer a work placement at your organisation or mentor a student from the scheme within a particular area of law.

During 2021 we carried out a review of DAS to assess its impact and whether the scheme is working in terms of its criteria and processes. The review included evaluation interviews with existing sponsors, all of whom said that they would recommend DAS to other firms, due to a combination of:

• Excellent candidates

• The reputation of the Law Society

• Little-to-no administrative burden on the sponsors

• A rigorous application process managed by experts

The combination of a strong eligibility criteria – that is inclusive and flexible – with a rigorous application process meant the sponsors were confident that DAS receives high-quality candidates that are deserving of financial and other career support.

Surrey Junior Lawyers Division Report

SJLD held its second Annual Gala on Friday 8th March 2024 at the Guildford Harbour Hotel & Spa, and what a success it was, if we do say so ourselves! We had over 100 attendees on the night, ranging from university students, to paralegals, to pupil barristers, to trainees, to junior solicitors and to junior barristers. We even had Surrey Law Society’s very own Sushila Abraham (Law Society Council Member for Surrey) in attendance on the evening (thank you, Sushila)! The photos speak for themselves on how well everyone scrubbed up!

On the evening, we enjoyed talks from SJLD Chair Bethany Walker, Zac Marshall from G2 Legal, Deputy Vice President of the Law Society Mark Evans and Director of the Halow Project Neil Wheeler, along with two incredible individuals benefitting from the work of the Halow Project. It was incredible to have Mark Evans in attendance on behalf of the Law Society, who gave an inspiring speech on his journey from junior lawyer to future President of the Law Society of England and Wales and how important it is to make the most of the network around you, especially at the junior stage of your career. Thank you to Mark for attending and we hope that he enjoyed himself and his very first visit to Guildford!

As touched on, it was also fantastic to have representatives from our chosen charity of the year, the Halow Project, in attendance on the evening too. We heard about the brilliant work that the charity does in supporting young people with autism and learning difficulties and are very pleased to announce that everyone who attended on the evening contributed to the fantastic £2425 raised for the charity, through a percentage of the ticket sales and through the proceeds from the raffle on the night. Congratulations to those who won a raffle prize on the evening (including a helicopter ride!), brilliantly organised by our Charity Representative, Joanna Earl, along with the support of Surrey Law Society Representative, Katie Foulds.

We then enjoyed some wonderful food, drinks and dancing to round off the evening, with a touch of magic from our magician.

The session was chaired by SJLD Vice Chair, Alex Watson-Lee, leading our panellists on the evening representing their respective practice areas, being Anoushka Nehra (Private Wealth Disputes), Natalie Dunn (Family), Chantelle de Filippis (Employment), Dean Outten (Corporate), Bethany Walker (Private Wealth), Martin Whitehorn (Property), Sarah Wilson (Personal Injury) and Olivia Bishop (Commercial Dispute Resolution). Thank you to our fantastic panellists who gave up their time to tell our aspiring lawyers why they should consider their respective practice areas and what made them fall for said areas in the first place, as well as to the 40 people who attended virtually on the evening to tune in!

Is there a new law text out there that is more topical than this? Not to mention more vital than this? Probably not -although many may well argue the point. It is indisputable, however, that mass migration, whether legal or illegal, has become an international problem, particularly for the UK -- and in the view of many -- it is a problem that is well-nigh insoluble. It is fair to say, however, that immigration lawyers in particular -- as well as anyone involved in, or committed to, achieving viable solutions to the problems inherent in migrant support -- will welcome the publication of this book by the Legal Action Group.

Authors Shu Shin Luh and Connor Johnston have noted that the book (conceived some six years ago) was painstakingly researched and written to ‘replace the irreplaceable’ “Support For AsylumSeekers” by Sue Willman and Steve Knaffer QC, published by LAG

in 2009. It is sobering to recall how much and how quickly and relentlessly the world has changed since then -- making the problem of asylum seekers ever more acute.

The publication of this book is therefore all the timelier. And certainly, the almost insoluble complexity of its subject matter is reflected in its more than 1,2000 pages of scholarly and thorough research presented (in the tradition of the LAG) in a clear, accessible style; accessible, that is, not only to lawyers, but to anyone interested in, or involved with, this detailed and certainly controversial and difficult subject, which has occasioned so much debate.

With its focus on the welfare and legal rights of migrants, the book provides in-depth coverage of, for example, housing and welfare, benefits, NHS access and provision and social services, as well as support for failed asylum seekers with reference to special cases; notably unaccompanied children and -- most heart-rending of all -the victims of human trafficking.

This is a handbook you could almost call encyclopaedic. Certainly, it offers specialists in this wide-ranging and many-faceted and complex area of law, a gateway to further research. Note that the first 150 or so pages contain tables of cases... statutes... statutory instruments... immigration rules... and a table of European and international legislation. Also, for a volume its size, it is remarkably easy to navigate, containing as it does, copious footnotes, a detailed table of contents and an even more minutely detailed index of at least 115 pages. A handy handbook? Absolutely.

As immigration -- both legal and illegal -- will undoubtedly emerge as a prime issue during elections and beyond, this scholarly yet eminently readable volume will prove indispensable, not only to practitioners, but to anyone interested in the wide-ranging issues inherent in this undeniably difficult area of law. ■

“ Charging Orders on Land” has now arrived as a second edition from Falcon Chambers for 2024 -- an event which will certainly be welcomed by counsel embroiled in the specifics of charging orders, which, more often than not, present special problems. What we have here is a highly specialised and quite narrow area of law in which attention to minute detail is all too often imperative. The precedents at the back of the book are of great assistance to those involved in drafting orders.

Fortunately for practitioners and judges dealing with the challenge of changing orders, this distinguished text published by Wildy, Simmonds & Hill, presents up to date and authoritative help in what is now regarded as the definitive work on the subject.

Editors Cecily Crampin and Michael Ransom are assisted by nine contributors from Falcon Chambers, known as the set which specialises in land law and landlord and tenant work. Practitioners seeking guidance from this new and updated edition can be confident that they are in good hands. For example, there’s a new chapter on insolvency regimes, plus the inclusion of new CPR procedures and precedents.

This then, is an ample and detailed compendium of practical advice and guidance on ‘the enforcement of money judgements by means of obtaining a charging order.’ Initially, this may sound straightforward, except that all too often it isn’t, as any number of complications can occur within the various stages of enforcement on which there is a special chapter. Also read the chapter on priorities and problems and note the specialist advice on sanctions, tenanted property, overseas entities and much more, including the new chapter on corporate and personal insolvency.

Certainly the book can be depended upon to explain or clarify the various -- and seemingly endless -- snags and contingencies that frequently occur within this particular category of law, including (probably the most frequent of all) the cases which come under the heading of ‘Personal Circumstances: the family home’ which typically is balanced against the claims of the judgment debtor’s spouse... or possibly former, or divorcing spouse... or ‘any children who live in the property to be shared.’

It is also carefully pointed out that sometimes in such cases, the charging order can be withheld, or the interest of one party, for example, can be transferred to the other. Small wonder then that, in the opinion of quite a few practitioners, the concept of the charging order all too often presents a serious impediment to selling a house and clogging up the already stretched housing market.

Considering the often complicated and sometimes controversial area of law, it is reassuring for the busy practitioners that this comprehensive and carefully researched legal text is easy to navigate. The table of contents is almost minutely detailed, and the extensive appendices offer more than 100 pages of statutory material and precedents -- an invaluable resource which will be of special interest to counsel charged with drafting orders. Also note the tables of cases, statutes, and statutory instruments, plus tables of European conventions and other material.

Any practitioner involved in this highly specialised area will find this comprehensive and carefully researched legal text well-nigh indispensable. ■

I f you are a lawyer with a corporate client -- or clients -- facing financial distress and ultimately insolvency, you need this book, published recently by Globe Law and Business.

Note the usefully descriptive subtitle: ‘Unlocking and Preserving Value in Distressed Businesses’. This says it all, you may say, but as its processes are linked to a complex area of law, there is a lot more to be said, especially when multi-jurisdictional complications emerge.

With lengthy and detailed experience in this specialised area of consultancy, author Alan Tilley provides a broad range of authoritative advice, aimed specifically at those who are confronted with the undeniably challenging task of advising and managing companies teetering on the sharp edge of insolvency, with its intimidating spectrum of possible consequences.

The book and the wealth of advice therein is aimed primarily at those who find themselves in the role of turnaround manager. Such a role, as the author explains ‘usually involves operating in an executive rather than a consultative role’ and as such, ‘exposes the professional to the risks of personal liability.’ You have been warned.

However, no need to despair -- as Tilley adds that operating through a limited liability entity, with a properly constructed engagement contract reduces the risks. Proper professional performance is the ultimate guarantee of risk avoidance.

Anyone in the legal profession or accountancy and/or financial services, might well wonder how this increasingly obvious need for ‘turnaround management’ got started and whether or not it is proving itself effective.

The author’s positive answer is that turnaround management is becoming ‘increasingly recognized as an important part of business’ and that the understanding of its obvious benefits is growing. Tilley is confident that the concept has more than likely evolved as a result of the influence of Chapter 11 of the United States Bankruptcy Code of 1970, which is based on the concept of ‘giving entrepreneurs a second chance’ primarily by creating the concept, so called, of ‘debtor-in-possession’ (DIP) -- usually by means of a restructuring plan while the company is protected from creditors. Better results for shareholders certainly loom large here as a distinct possibility.

Although a complex subject, ‘turnaround management’ is explained in this book with admirable clarity, covering as it does, the risks involved, as well as the potential rewards. Based in the author’s 40-plus years of experience in this field, the consultancy, advice, and guidance contained in this compact volume is high-value indeed. Note too, the handy appendix which contains over 20 pages of useful guidelines and policy recommendations.

With its international orientation, as well as its straightforward advice, this book should be considered as an essential purchase for business and law professionals worldwide. ■
