Client Testimonials

I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later.

You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself.

You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D.

I hired Ely to assist with my parents estate planning and it was a wise decision. He is a true expert in navigating through complex elder care law and procedures. His guidance was invaluable and his communication excellent. I would strongly recommend his services. – Tom C.

Watermark Retirement Communities™ introduces revolutionary “THRIVE DINING” for Individuals with cognitive or physical challenges

Thrive Dining restores the dignity, nutrition and enjoyment of mealtime for individuals with cognitive, neuromuscular or physical challenges, who have difficulty using a knife and fork. Thrive Dining features Watermark Retirement Communities’ Chef recipes and high quality, freshly prepared, gourmet menu items, transformed into delicious, nutritionally balanced, “finger food” meals. Watermark Chefs start by using the innovative Grind Dining process of grinding, combining and preparing the cooked foods on that day's traditional meal menu in a unique way that retains their taste, texture, nutrition and flavor. Then they beautifully present the same meal served as one-bite and two-bite hors d'oeuvres, intended to be eaten by hand, so that every individual is empowered to thoroughly enjoy their fresh meal without assistance, and without a diet relegated to chicken nuggets, fish sticks and other processed foods. Thrive Dining engages the senses, promotes a healthy appetite, guarding against unintentional weight loss and significantly enhances the dining experience for those with cognitive or physical challenges and for their loved ones. In announcing Thrive Dining, David Barnes, President and CEO of Watermark Retirement Communities comments, “We are pleased to offer this innovative, quality of life enhancing Thrive Dining meal service to our residents and neighbors. We strive to create extraordinary communities where our residents thrive, and to be positive contributors to our neighbors.”

Inaugural Golf and Tennis Outing to benefit My Second Home PAGE 8

October, 2017

A day of golf and tennis at Mt. Kisco Country Club on October 10 will benefit My Second Home, an award-winning intergenerational adult social day program operated by Family Services of Westchester (FSW). The inaugural event, which begins with a brunch at 11:00 a.m. and concludes with dinner at 6:30 p.m., will feature a talk by Holly Heston Rochell, the daughter of Academy-award winning actor Charlton Heston. Heston Rochell has been dedicated to raising awareness of Alzheimer’s disease ever since her father was diagnosed with Alzheimer’s disease more than a decade ago. FSW created My Second Home as a way to help cognitively and physically impaired older adults, including those with Alzheimer’s disease, stay in their homes while providing respite to their caregivers. My Second Home is the only program in Westchester County to combine a traditional social-model adult day service with a pre-school program at the same site to provide daily interactions between children and seniors. At My Second Home, children, teens, and seniors come together at one site to participate in programs, share experiences, and benefit from one another, just as they would in a family setting. Research has shown that programs like these help participating seniors feel more involved in their community, less lonely, and more productive, while children in the program gain self-confidence, empathy, and sensitivity. At the same time, their caregivers gain invaluable peace of mind. “My father was a very busy man but was always there 100 percent. He was passionate about the causes he believed in, and he was committed to helping people understand the challenges of Alzheimer’s disease,” said Heston Rochell. “I understand the importance of

quality care—for both seniors and their caregivers—and I want to call attention to programs like My Second Home that help maintain the dignity of seniors suffering cognitive losses while at the same time offering respite for their caregivers.” Charlton Heston, who served as president of the Screen Actors Guild for three terms and received the Presidential Medal of Freedom, won the Jean Hersholt Humanitarian Award in 1978 in honor of his longtime advocacy of civil rights. In 1960 he received an Oscar for best actor in Ben-Hur. He also appeared in several Hollywood classics, including The Ten Commandments and Planet of the Apes. In 2002 he revealed that he had symptoms consistent with Alzheimer’s disease, saying, ''If you see a little less spring in my step, if your name fails to leap to my lips, you'll know why. And if I tell you a funny story for the second time, please, laugh anyway.” He helped raise awareness of the condition before his death from pneumonia at age 84 in 2008. “We are so grateful to Holly Heston Rochell for addressing the issue of Alzheimer’s disease and highlighting the importance of quality senior care,” said FSW President and CEO Susan B. Wayne. “Studies have shown that social day programs like My Second Home can bring meaning to seniors’ lives and offer a costeffective way to provide relief for their caregivers. Holly’s support of our program will help people struggling with the disease realize that they have options for care and support.” The fund raiser will honor local residents Peggy and Roger Froehlich, whose experience with My Second Home is chronicled in a video about the program. In addition to Heston Rochell’s support, the golf and tennis outing also benefits from

Teams Walk to fight heart disease and fund research PAGE 10

Boomers & Beyond - Westchester

The American Heart Association’s (AHA) Westchester Heart Walk is coming Sunday, October 1st at Kensico Dam in Valhalla. Registration for individuals and teams is open online at www.westchesterheartwalk.org. Many local companies and residents are forming teams to walk in support of the AHA’s mission to save lives from cardiovascular diseases and stroke. For some teams, walking in the Heart Walk is personal. Gina Palma of “Team Brave Heart” is walking for her 63-year old father, John Palma, who is on the heart transplant list waiting for a new heart. “We are walking for him and to raise awareness for this rare disease,” she said, “I would give my own heart to Dad if I could.” She’s doing the next best thing—walking to prevent heart disease while funding lifesaving research. Her father’s heart failed more than three years ago. He felt out of breath doing routine things and it took 20 minutes to recover. He thought it was asthma or pneumonia but was eventually diagnosed with cardiac amyloidosis— a rare form of heart disease where an abnormal amyloid liver protein deposits itself in the walls of the heart, making them stiff and unable to pump normally. There is no cure, but treatments can manage the symptoms. Ultimately, his heart failed. “Blood tests showed my kidney functions were getting worse and my breathing was worsening. Heart transplant was mentioned a while ago. I went through a barrage of tests and interviews. Now I am on the list.”

“I was near retirement, then I got hit with this. This wasn’t self-inflicted. A rare disease comes out of nowhere and you have deal with it,” he said.

Though he knows the wait is long and often an emotional rollercoaster, he feels lucky because his diagnosis was swift, his treatments are extending his life, and he has support of good friends and family. He hopes by sharing his story he will help raise awareness and remind people to get annual checkups. And he wants more funding for research.

John Palma.

Cardiovascular disease (CVD) is the No. 1 killer of all Americans. In fact, someone dies from CVD every 39 seconds. The Heart Walk is the AHA’s biggest annual event, raising more than $400,000 for AHA programs and research at last year’s event. Funds raised at the Heart Walk will support research to help prevent and treat heart disease, stroke, and pediatric heart disease. The American Heart Association’s

provided

funding for research is second only to the federal government. American Heart Associationfunded research has led to the discovery and development of many treatments and procedures that are now widely utilized to help save lives. They include heart bypass surgery, CPR, clot-busting drugs, stents, cardiac catheterization, and heart transplantation. Learn more at www.heart.org.

Monthly Tips for Seniors

Halloween Safety Tips for Seniors

Halloween is a time for scary costumes; scary faces, haunted houses, ghosts and ghouls. While this may be fun for some, it may also be a very scary time for seniors. Not just because of masked children in vampire suits, wolf men and wicked witches, in fact, children and their parents do not really pose a threat, it is the constant knocking and large masked visitors that can be very intimidating regardless of their intentions. This is a night when our nation’s older population, as well as many others, come in contact with, and speak to more unfamiliar faces in a few short hours than any other time of the year. Anyone planning on handing out candy has the responsibility of keeping themselves and their guests safe.

Connect the dots…

Osteoporosis Awareness Group Monday, October 2, 2017

Invite friends over: Ask a younger relative or neighbor to drop by for a few hours during the trick-or-treating hours, or maybe even spend the night. This will deter your home from becoming a target Remove hazards: Keep any open flames, or candle lit pumpkins away from walkways or stairs where costume tails or capes could come in contact with them. Also remove any decorations from footpaths that could pose a tripping hazard for trick-or-treaters.

Communicate: Talk to neighbors in advance about watching each other’s property, especially if one of you will be out that night. Or maybe make plans to get together and hand out treats together. The final and most important rule is to have fun! Once you have addressed your concerns and taken precautions to keep yourself and your property safe, Halloween offers a strong sense of community that brings along with it many smiles, giggles, laughs and fun that can be shared by everyone.

Light it up: Leave interior and exterior lights on even if you are away from home. You don’t want to alert vandals that your house may be empty by leaving all of the lights out. If you are handing out treats, make sure your exterior is brightly lit. This may deter troublemakers if they can be seen.

Keep all guests outside: Never invite trick-or-treaters inside, hand out treats on your steps or front porch only. If someone asks to use your bathroom or phone, don’t even consider this as an option unless you have a bunch of adults present in the home with you. Protecting your home means drawing a line and the front door is a good place to do just that.

ATTORNEYS AT LAW Many Years of Experience Protecting the Legal Interests of the Elderly & Special Needs Populations

Why should I spend money hiring attorneys to do asset protection planning for me and my loved ones?

Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid.

Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.

Why should I have a lawyer prepare my will?

If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate.

Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).

My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do?

Your concerns are certainly daunting, and heart-rending. Our firm offers you a caring hand, an open ear, and uncompromising professional competence, and commitment. We will help find for you solutions that best suit your needs, using the latest tax, trust, and other asset protection strategies available under the law. The law firm of Ely J. Rosenzveig & Associates, P.C. practices in all aspects of elder law, including trust and estate planning, administration, and litigation, tax counsel, asset protection and special needs planning, Medicaid, Medicare, and Social Security disability benefits, guardianships, long term care planning, spousal recovery claims, and Medicaid lien resolutions.
