Riverside County reports new mpox case in Coachella Valley, total now 317

For the first time in more than six months, Riverside County reported a new confirmed or probable mpox case in the Coachella Valley on Thursday, raising the overall number to 317.

Riverside County has reported a total of 317 probable or confirmed cases of mpox, formerly known as monkeypox, with nearly half of them in Palm Springs and the last case reported in December 2022, according to the latest Riverside University Health System data. Additional data can be found at ruhealth.org/mpx-data.

“This is a good reminder that there is a mpox vaccine and clinics are held regularly,” Riverside University Health System spokesman Jose Arballo said Thursday.

Vaccines and testing for mpox are available in various areas including DAP Health, Palm Springs Community Health Center, Eisenhower Health and Indio Family Care Center, all located in eastern Riverside County. The California Department of Public Health asks individuals to self- evaluate their risk for mpox infection and to prioritize getting the vaccine for individuals who

are high-risk, according to RUHS.

New Riverside council ward boundaries take effect this week

New Riverside City Council ward boundaries approved through the Reshape Riverside process take effect on Thursday and will be in play for next year’s council elections, officials said last week.

The council’s 5-2 vote on June 13 ended the 10-month Reshape Riverside process that featured community meetings and “extensive public input,” Riverside officials said in a statement. Council members Clarissa Cervantes and Chuck Conder voted against the new district lines, “saying they preferred different maps.”

The new ward map will determine the boundaries for City Council elections in wards 1,3, 5 and 7 in March and November 2024. The new boundaries for wards 2, 4 and 6 will apply to the 2026 elections.

“These new ward boundaries reflect hours of community input, staff analysis and council

provide vaccine to any patients who may be at risk, and persons who request vaccination should receive it without having to attest to specific risk factors,” RUHS officials said in a statement.

Mpox is generally spread through intimate skinto-skin contact, resulting from infectious rashes and scabs, though respiratory secretions and bodily fluids exchanged during extended

physical episodes such as sexual intercourse can lead to transmission, according to the CDC.

Symptomsinclude pimples, blisters, rashes, fever and fatigue. There is no specific treatment. People who have been infected with smallpox, or have been vaccinated for it, may have immunity to mpox.

People with symptoms are urged to visit a medical provider, cover the rash area with clothing, wear a mask and avoid close or skin-toskin contact with others.

The CDC particularly recommends those steps for people who recently traveled to an area where mpox cases have been reported or who have had contact with a confirmed or suspected mpox case.

As of Wednesday, a total of 5,774 mpox cases have been reported in California — the highest of any state — while nationwide, the aggregate count is 30,555, according to the latest CDC data. A state-by-state tally of cases is available at cdc.gov/poxvirus/mpox/ response/2022/us-map.html.

Plane crash in Riverside County leaves 1 dead, 3 injured

One person was killed and three others were injured Tuesday after a plane crashed in Riverside County, authorities said.

The crash occurred around 2:45 p.m. in the 37000 block of Industry Way in French Valley.

The single-engine aircraft involved in the crash was a Cessna 172, according to the Federal Aviation Administration. The plane had four individuals on board when it crashed shortly after taking off from the nearby French Valley Airport.

Televised news footage captured the aftermath of the tragic incident, showing the small Cessna upside down in a parking lot near a business. The scene was chaotic, with emergency personnel rushing to help the victims. The Riverside County Fire Department swiftly responded to the crash and provided updates via social media.

City of Riverside obtains $38.5M for transportation infrastructure improvements

The city of Riverside will receive $38.5 million from the state for several transportation infrastructure projects, officials said Friday.

The California State Transportation Agency announced Thursday that Riverside will get $22 million via the Port and Freight Infrastructure Program to finish the Third Street at the BNSF Railroad Grade Separation Project.

Riverside officials had previously been alerted that the city would receive $15 million in federal Rail Crossing Elimination funds for the $74 million project in downtown’s northwest corner, just east of Highway 91, officials said. The project is now is fully funded and aims “to eliminate traffic delays and increase safety for trains, motorists, pedestrians and bicyclists.”

The Third Street project’s $22 million from the state’s Department of Transporta-

tion comes about a week after the California Transportation Commission, or CTC, notified the city it is receiving about $16.5 million for three other initiatives, such as upgrades to the downtown Civil Rights Walk and two projects to enhance pedestrian and bicycle safety in the La Sierra area.

Officials said that $16.5 million in 2023 funding from the state’s Active Transportation Program was garnered after the Riverside Public Works Department applied for the grants, and about 30% of the ATP funding dedicated to Riverside County is directed to those three projects.

“We are working hard to bring state and federal resources home to Riverside,” Mayor Patricia Lock Dawson said in a statement.

“These projects will enhance the downtown experience while increasing safety at Third Street and on the west end.”

Riverside ATP projects include:

-- Five Points Neighborhood Pedestrian Safety Improvements, which include five high-visibility crosswalks, Riverside’s first Pavement-to-Parks project and 1.5 miles of sidewalk — the CTC funded $6.525 million of the $7.416 million total cost;

-- Riverside Civil Rights Walk, “which calls for installing pavement markings and location markers to connect 17 points of historic interest over 3.4 miles; develop an app-based virtual tour and augmented reality (AR); build pedestrian crossing enhancements such as highvisibility crosswalks and LED edge-lit signs; and installation of ADA ramp improvements,” officials said — the CTC approved the entire $3.216 million cost of the project; and the

promote walking and cycling, which involves the completion of a community trail between Campbell and Hole avenues,” officials said — the CTC funded $6.756 million of the project’s $7.465 million total cost.

“The Civil Rights Walk on the Main Street Mall has drawn people to our downtown for years, and I look forward to these enhancements expanding that effort onto surrounding streets,” Mayor Pro Tem Erin Edwards, who represents the downtown area, said in a statement. “This project will take the Civil Rights Walk to a new level.”

The state’s Active Transportation Program supports active modes of transportation, which are basically ways of getting around without the use of a motor vehicle, officials said. The program aims to increase the proportion of trips achieved by biking and walking; promote an increase safety and mobility

for bicyclists and pedestrians; advance the active transportation efforts of regional agencies to achieve goals pertaining to greenhouse gas reduction; enhance public health; make sure underserved communities share equitably in the ATP’s benefits; and offer projects that serve the interests of many types of active transportation users.

The state transportation funds come two years after the Riverside City Council approved a comprehensive pedestrian safety, active transportation, complete streets and trails planning effort called the Riverside PACT.

Felon charged with trying to sexually assault Moreno Valley woman at knifepoint

Aparolee and another man suspected of forcing their way into a Moreno Valley home and attempting to burglarize it until an alert neighbor called 911 and deputies swarmed the location were behind bars Thursday.

Pedro Alejandro Rodriguez, 31, of Mead Valley, and Antine Avery, 33, of Perris, were arrested and booked into the Robert Presley Jail in Riverside Wednesday night on suspicion of first-degree burglary, felony vandalism, conspiracy, possession of controlled substances and resisting arrest. Rodriguez was additionally booked for alleged parole violations. He was being held without bail, and Avery was being held on $35,000 bail.

According to Riverside County sheriff’s Deputy David Barr, about 9:30 p.m. Wednesday, the pair allegedly perpetrated a “door kick” break-in at an unoccupied residence in the 25000 block of Iris Avenue, near Perris Boulevard.

A neighbor was alerted to the activity and watched as the suspects roamed “inside (the house) with flashlights,” Barr alleged.

“Deputies arrived within minutes and began setting up a perimeter,” he said. “Both suspects fled as deputies approached.”

With the help of a sheriff’s helicopter crew, patrol deputies located and apprehended the two men as they attempted to run away, according to the sheriff’s spokesman.

No one was injured.

The estimated damage to the house was unavailable, as was background information on the suspects.

Afelon accused of holding a Moreno Valley woman at knifepoint and trying to sexually assault her after she met him for a date was charged Thursday with assault with intent to commit rape and other offenses.

Marque DeShone Rogers, 41, of Moreno Valley, was arrested Monday following a Riverside County Sheriff’s Department investigation.

Along with assault with intent to commit rape, Rogers was charged with assault likely to cause great bodily injury and a sentence-enhancing allegation of using a deadly weapon in the commission of a felony.

He was being held in lieu of $135,000 bail at the Robert Presley Jail and was slated to make his initial court appearance Thursday afternoon at the Riverside Hall of Justice.

According to sheriff’s Deputy Jomar Vanderhoof, in the predawn hours Sunday, the defendant arranged to meet the victim, whose name was not released, after the two connected via an online dating application, which wasn’t identified.

Rogers picked up the woman in his car and “drove her behind a business (near the intersection of Alessandro and Perris boulevards), held a knife to her neck and demanded that she perform sex acts on him,” Vanderhoof said.

“The victim was able to escape the suspect’s vehicle without being harmed and dialed 911,” the sheriff’s spokesman

said.

Over the ensuing 24 hours, detectives gathered sufficient evidence to obtain an arrest warrant, which was served on the defendant at his Perris Boulevard residence Monday afternoon. He was taken into custody without incident.

Court records show that Rogers has prior convictions for firearm assault and receiving stolen property.

Former federal prosecutor Stephanie S. Christensen was sworn in Wednesday as a U.S. magistrate judge in Los Angeles federal court.

Christensen — who succeeds former Magistrate Judge John E. McDermott — has served in multiple roles in her 15 years at the U.S. Attorney’s Office for the Central District of California.

As the acting U.S. attorney in 2022, she led an office of nearly 600 personnel and managed all federal government trial and appellate litigation in the Civil, Tax, National Security, and Criminal Divisions of the office. Since 2018, she has served in executive leadership as first assistant U.S. attorney, executive assistant U.S. attorney, and special counsel to the U.S. attorney.

Christensen oversaw and approved major settlements in a broad array of federal defensive and offensive litigation, including constitutional torts, medical malpractice, employment, tax, class action, qui tam, fraud, civil rights, social security, bank-

ruptcy, criminal and national security matters.

Prior to her service in executive leadership, she led the Cyber and Intellectual Property Crimes Section of the office, focusing on cyber-attacks impacting national security, as well as trademark and copyright infringement, theft of trade secrets, and economic espionage, according to Kiry K. Gray, the top clerk and executive for the Central District.

Christensen has also done pro bono work, and recently helped to launch a pro bono program for federal executive branch attorneys in Los Angeles.

In 2021, she was appointed to serve as a temporary judge for the Superior Court in Los Angeles County. In that role, with the consent of the parties, she has voluntary presided over small claims trials, unlawful detainer proceedings, and conducted settlement conferences.

The judge is also an adjunct professor at Loyola Law School teaching a Cyber and Intellectual Property Crimes course.

CHP: 68 people died in California crashes during holiday weekend

Atotal of 68 people were killed in crashes throughout California during the Independence Day maximum enforcement period, which began at 6:01 p.m. Friday and concluded at 11:59 p.m. Tuesday, the California Highway Patrol said Thursday.

Nearly half of the vehicle occupants who died within CHP jurisdiction were not wearing a seat belt.

The total numbers for Los Angeles County and Orange County were not immediately available.

Officers made 1,224 arrests for driving under the influence and issued 9,700 citations for speeding, according to the CHP.

“The results of this MEP are concerning and reinforce the need for responsible behavior behind the wheel,” said CHP Commissioner Sean Duryee. “All of these deaths were preventable, and the loved ones they leave behind will be forever impacted.”

The next MEP was scheduled for Labor Day weekend.

U.S. Attorney’s Office, Christensen worked as an associate at two law firms litigating civil disputes and defending indigent individuals accused of federal crimes.

Including the position now occupied by Christensen, the Central District of California has 24 full-

time and one part-time magistrate judge positions. The Central District comprises Los Angeles, Orange, Riverside, San Bernardino, Ventura, Santa Barbara and San Luis Obispo counties. It serves more than 19.3 million people, nearly half the population of the state.

Spector’s daughter adds dad’s ex-wife as defendant in auction suit

The daughter of the late music producer Phil Spector, having previously obtained a temporary restraining order preventing the sale at auction by Juliens Auctions LLC of memorabilia that once belonged to her father, has now added his ex-wife as a defendant in her lawsuit.

On May 18 Torrance Superior Court Judge David K. Reinert issued a TRO in favor of Nicole Spector, preventing any auction from going forward before a July 27 hearing on whether a preliminary injunction should be issued pending the full outcome of the case. Nicole Spector’s original suit, filed May 16, states she obtained a detailed probate court order after her father’s death “specifically confirming” that the personal property at issue belongs to the trust established by Phil Spector in 2016, which names her as the sole trustee.

Nicole Spector maintains she obtained the probate order after her father’s ex-wife, Rachelle Spector, refused to turn over or allow the plaintiff access to property that remained in the former spouse’s possession after the divorce was final.

In an amended suit filed Friday, Nicole Spector has added Rachelle Spector

as a defendant, alleging conversion of property by her father’s onetime spouse. Nicole Spector seeks a preliminary injunction stopping Rachelle Spector from “taking possession of any items of the Spector property” or offering or advertising it for sale or auction.

“Rachelle intentionally took possession of, prevented Nicole from having access to, and thus substantially interfered with Nicole’s right to possession of the Spector property,” according to the revised suit, in which Nicole Spector seeks punitive damages from Rachelle Spector.

In a sworn declaration submitted in support of her request for a preliminary injunction, Nicole Spector says a Julien’s representative stated that the Spector property was obtained from a woman associated with Antiques on Magnolia in Burbank, who claimed to have obtained the property from a woman purporting to be the musician’s daughter.

“Based on Rachelle’s prior behavior, and what I understand Julien’s to have represented regarding the manner in which it obtained the Spector property, I believe that Rachelle impersonated me, or a representative of the estate, and provided the items to Julien’s, personally

or through a third party, on the pretense that Rachelle was me and thus was entitled to sell the Spector property,” Nicole Spector says.

The property at issue includes gold and platinum records, awards from the Songwriter’s Hall of Fame and numerous others, original master recordings, music and lyric sheets, a framed photo montage given to Phil Spector by John Lennon and many other valuable items.

In her own sworn declaration, Rachelle Spector said that of the items listed for auction, many were not identified as being granted to Phil Spector in the divorce settlement because they were deemed to be her property at the time.

“The remaining items in the Julien’s auction are my property as they had been left behind by Nicole back in January 2019,” Rachelle Spector said. “I now wish to sell my property at auction and I understand that any delay would likely cause a substantial decrease the value of these items.”

Phil Spector died in January 2021 at age 81 while serving a sentence of 19 years to life for the murder of actor Lana Clarkson. The cause of the “Wall of Sound” producer’s death was complications from the coronavirus, Nicole Spector said at the time.

Space shuttle Endeavour prepares to go vertical as ambitious project advances

UCSD researchers develop tech to ‘edit’ malaria-spreading mosquitoes

California Science Center officials later this month will begin the process of reconfiguring the space shuttle Endeavour into a planned vertical display with rocket boosters and external fuel tank, marking the first time such a feat will have been performed with a shuttle outside of a NASA facility.

The shuttle has been on display horizontally at the Science Center for 11 years. But construction began last year on the center’s $400 million Samuel Oschin Air and Space Center, which will house the shuttle in the vertical launch position with the rocket boosters and fuel tank.

The new center is not expected to open until 2025, but July 20 will mark the beginning of a six-month “Go for Stack” process. The effort

will begin with the installation of “aft skirts,” on which the solid rocket motors will be stacked to form the solid rocket boosters. After that, the effort will begin to lift the massive external fuel tank, known as ET-94, into vertical position, followed by the intricate lifting of the shuttle itself by a large crane to its new location and positioning into a 200-foot-tall vertical display.

“Endeavour will be the star attraction of the Samuel Oschin Air and Space Center, a launchpad for creativity and innovation that will inspire future generations of scientists, engineers and explorers,” Jeff Rudolph, president and CEO of the California Science Center, said in a statement. “We are grateful to be at this point in the construction of the new Air and Space Center, and

thrilled to start ‘Go for Stack’ on July 20 to commemorate Space Exploration Day.”

The move means the space shuttle Endeavour will be unavailable for public viewing after Dec. 31. It will remain off-limits until the new Oschin facility opens.

The 200,000-square-foot Oschin center in Exposition Park will nearly double the Science Center’s educational exhibition space, officials said. The building will include three multilevel galleries, themed for air, space and shuttle. The new facility will also house an events and exhibit center that will house large-scale rotating exhibitions.

Science Center officials are continuing fundraising efforts for the construction project, with about $320 million raised so far for the $400 million project.

Researchers at UC San Diego have engineered a way to genetically suppress populations of mosquitoes that spread malaria in Africa, it was announced Wednesday.

Professor Omar Akbari’s laboratory led the research — published Wednesday in the journal Science Advances — which genetically “edits” the mosquitoes who spread the pathogen causing the deadly disease.

“This technology has the potential to be the safe, controllable and scalable solution the world urgently needs to eliminate malaria once and for all,” Akbari, a professor in the Department of Cell and Developmental Biology, said in a statement. “Now we need to transition our efforts to seek social acceptance, regulatory use authorizations and funding opportunities to put this system to its ultimate test of suppressing wild malariatransmitting mosquito populations.

“We are on the cusp of making a major impact in the world and won’t stop until that’s achieved,” he said.

Each year, malaria infections result in hundreds

of thousands of deaths, with the majority of fatalities occurring in children under 5 years old. The U.S. Centers for Disease Control and Prevention recently announced that five cases of mosquito-borne malaria were detected in the United States, the first reported spread in the country in two decades.

First-author Andrea Smidler, a postdoctoral scholar in the UCSD School of Biological Sciences, along with former master’s students and co-first authors James Pai and Reema Apte, created a system called Ifegenia, an acronym for “inherited female elimination by genetically encoded nucleases to interrupt alleles,” which uses the CRISPR technology to disrupt a gene that controls sexual development in Anopheles gambiae mosquitoes.

The researchers genetically modified two families of mosquitoes and crossbred them.

“We crossed them together and in the offspring it killed all the female mosquitoes,” Smidler said in a statement. “It was extraor-

dinary.”

According to the researchers, male mosquitoes inherit Ifegenia but the genetic edit doesn’t impact their reproduction. They remain reproductively fit to mate and spread Ifegenia. Parasite spread eventually is halted since females are removed and the population reaches a reproductive dead end, they write.

“Through modeling, we demonstrate that iterative releases of non-biting Ifegenia males can act as an effective, confinable, controllable and safe population suppression and elimination system,” the authors note in the paper.

The researchers said this method could help eliminate the increasingly ineffective and polluting use of insecticide.

They also note that the technology behind Ifegenia could be adapted to other species that spread deadly diseases, such as mosquitoes known to transmit dengue, chikungunya and yellow fever viruses.

PetSmart to pay $1.46M to resolve lawsuit alleging overcharging of customers

South Coast AQMD awarded $76M for zero-emission projects

PetSmart will pay $1.46 million to settle a lawsuit filed by prosecutors in Los Angeles and other California counties alleging the retailer overcharged customers for items that were advertised for lower prices.

According to the Los Angeles County District Attorney’s Office, PetSmart admitted no wrongdoing in the settlement, but it will pay $1.25 million in penalties, $100,000 in restitution to support future enforcement of consumer protection laws and $110,000 in investigative costs.

The company is also barred from engaging in false or misleading advertising, or from charging an amount higher than the lowest advertised price for an item. It will also have to implement additional audit and price-accuracy procedures in stores over a three-year period.

“Charging customers prices higher than what was advertised is misleading and unfair,” District Attorney George Gascón said in a statement. “Customers have the right to expect that the prices they see advertised will be honored. It’s important for companies to adhere to advertising regulations and ensure transparency in their pricing practices.”

The lawsuit was filed in Santa Cruz County. Prosecutors in Alameda, Contra Costa, Marin, San Diego and Ventura counties also took part in the lawsuit.

The South Coast Air Quality Management District has been awarded over $76 million by the California State Transportation Agency for zero-emission projects that are aimed at helping transform goods movement in the San Pedro Bay Port corridor, it was announced Thursday.

More than 80% of air pollution in Southern California is associated with mobile sources, including trucks, trains, planes and ocean-going vessels, and zero-emission technologies is essential to reducing air pollution, according to the AQMD.

The projects developed by the funding will create 7,600 jobs and reduce 1.7 tons of fine particulate matter, specifically PM2.5, and 632 tons of nitrogen oxides — a precursor to smog, the agency said.

“Southern California is home to the two largest ports in the nation which have a profound air quality impact to the surrounding neighborhoods,” said Vanessa Delgado, South Coast AQMD’s governing board chair.

“That’s why investments in zero-emission technologies like this are so important,” Delgado said. “They not only support the goods movement industry but reduce air pollution to better protect overburdened communities.”

South Coast AQMD said it will use the $76.25 million in CalSTA’s Port and Freight Infrastructure Program to demonstrate one first-of-its-kind hydrogen fuel cell locomotive that will operate in and around Southern California, install 376 Direct Current Fast Chargers and 19 hydrogen refueling dispensers across seven locations for trucks used for goods movement.

South Coast AQMD is the regulatory agency responsible for improving air quality for large areas of Los Angeles, Orange, Riverside and San Bernardino counties, including the Coachella Valley.

SDG&E completes 2 energy storage facilities in Imperial, San Diego counties

San Diego Gas & Electric has finished two energy storage facilities totaling 171 megawatts in Fallbrook and Imperial Valley, it was announced Thursday.

The facilities have the capability to power nearly 130,000 homes for four hours, the utility company said in a statement.

“The beauty of energy storage is it can help California solve two problems simultaneously,” said Miguel Romero, SDG&E’s vice president of energy innovation. “It can soak up surplus renewable energy during the day, so solar and wind farms don’t have to cut off production when demand on the grid is low.

“By extending the availability of clean energy to peak evening hours, energy storage can also help California achieve its clean energy goals by reducing reliance on conventional power plants to meet peak electricity

demand.”

The 131 MW Westside Canal project in Imperial Valley is the largest storage asset in SDG&E’s energy storage portfolio, while the 40 MW Fallbrook project is the second largest in its portfolio.

Utility leaders said SDG&E’s energy storage portfolio is expected to reach 345 MW of power capacity by the end of the year — equivalent to 15% of its customers’ load on a typical day and 7% on a system peak day.

These facilities and others like them participate in the energy markets managed by the California Independent System Operator, allowing CAISO to store and dispatch clean energy from the facilities to meet electricity demand as needed. According to SDG&E, in recent years, as wind and solar generation capacity has grown in California, renewable genera-

tion facilities have had to increasingly curtail, or scale back, energy production to keep the grid balanced.

“With our state experiencing more frequent climate extremes such as record heat waves and droughts, it is essential to invest in innovations like energy storage to make sure we can continue to power the world’s fourth largest economy reliably,” said CAISO President and CEO Elliot Mainzer. “The rapid growth of energy storage in California in recent years gives me optimism about our state’s future and its capacity to respond to climate change.”

The Westside Canal project is made up of more than 800 cubes of stacked lithium-ion batteries across roughly 16 acres. It began commercial operation in June. The Fallbrook energy storage project is also made up of stacks of lithium-ion batteries and began commer-

cial operation in May.

“Both facilities are equipped with safety features, remote monitoring, and automation technologies,” reads a statement

from SDG&E. “When smoke or other anomalies are detected, the units will automatically shut down.”

Toxic algae continues to threaten sea mammals, raises concern on future blooms

After almost six weeks of a widespread toxic algae bloom that has sickened or killed more than 1,000 marine animals along the Southern California coast, officials said Thursday there were signs indicating the bloom was nearing its end, but urged beachgoers to remain cautious and not approach sick animals.

Los Angeles city, county and wildlife officials gathered Thursday afternoon at Charlie’s Beach in Marina del Rey to discuss ongoing efforts to address the marine mammal crisis. In recent weeks, dozens of sea lions and dolphins became sick due to the bloom.

“We are currently treating and caring for more than 120 animals in our hospital. Then we have a resting zone in Marina del Rey, where ... animals have been brought here to be kept in a more restful, peaceful environment with some basic medical care from a vet that we have here full time,”

John Warner, CEO of the Marine Mammal Care Center in San Pedro, told City News Service.

County officials previously reported the crisis is being caused by a natural phenomenon — an algae bloom producing domoic acid, a neurotoxin produced by the bloom of toxic marine algae called pseudo-

nitszchia.

“What we’ve seen starting in late May and early June are large numbers of dolphins and sea lions stranded on beaches up and down Southern California, especially in Los Angeles County and Santa Barbara,” Warner said.

The toxin damages the brains of marine mammals, leaving them dazed and lethargic on beaches, often leading to death. Sea lions are particularly susceptible due their foraging habits, which involve consuming

shellfish that eat the deadly algae.

With treatment, sea lions can recover within 72 hours, but some retain brain damage, resulting in memory loss. The damage is determined by how much tainted seafood the animal has devoured.

In the beginning of June, MMCC rescued a few animals. By the third and fourth week, the agency rescued so many animals it reached capacity of its facility.

The city and county stepped in to make sure

animals had places to go and also kept the public safe from animals that were sick and can be dangerous, Warner said.

He noted blooms in the past lasted anywhere from four to eight weeks.

“We’ve seen blooms for hundreds of years, usually occurring every three to seven years,” Warner said. “The frequency of it, the size of it, the intensity of it, and it’s (impact) on marine life have been greater in the last 20 years than ever before.”

Warner said the size of

the bloom is exacerbated in nature due to warming, ocean temperatures, and acidification of the ocean — all human impacts.

According to Warner, the algae bloom should be in week six or seven, but MMCC is waiting for an update from the National Oceanic and Atmospheric Administration regarding the current status of the bloom.

“The last couple of days we’ve seen many fewer animals on the beaches, but that doesn’t tell us anything

Former LAPD captain accepts reduced emotional distress award

Aretired Los Angeles police captain has accepted a 50% reduction in the $9 million emotional distress damages granted her by a jury in her discrimination/retaliation suit against the city, avoiding a new trial on those same damages.

Former Capt. Stacey Vince was granted $9 million in past and future emotional distress damages by a jury on March 17, which Los Angeles Superior Court Judge Christopher K. Lui found was excessive and the “product of passion or prejudice.”

The judge said that the city was entitled to a new trial on those damages unless Vince agreed to have them pared to $4.5 million. The city and the judge did not challenge the award to Vince of $1.1 million in past and future economic losses.

On Wednesday, Vince’s

lawyers filed court papers confirming her acceptance of the $4.5 million award.

Vince was a lieutenant in the detective bureau when a new deputy chief, Kris Pitcher, became her direct supervisor in 2019 and eventually began shunning her, her suit filed in October 2020 stated.

Vince’s husband, LAPD Lt. Lou Vince had previously worked under Pitcher at Operations Valley Bureau and suffered retaliation and discrimination on account of a physical disability, Lou Vince alleged in his lawsuit.

When Lou Vince complained, the LAPD command staff threatened him that his wife’s career would be adversely affected, his suit stated. Stacey Vince reported the retaliation against her husband, including the allegations against Pitcher, according to her

suit.

In 2022, another jury heard trial of Lou Vince’s claims and awarded him $4.37 million for his retaliation and discrimination claims.

In addition to reporting and opposing the department’s alleged discrimination and retaliation against her husband, Stacey Vince was a witness in an Internal Affairs proceeding concerning her husband’s claims, according to her court papers. She also complained about what she believed to be disparate treatment of her while she was assigned to the detective bureau, her court papers stated.

“As a result of her protected activity, plaintiff was retaliated against in multiple ways, including ... being administratively transferred out of the detective bureau against her will,”

Stacey Vince’s court papers stated.

Stacey Vince’s discrimination claim was based upon her association with her husband and his disability claims, according to her court papers.

“(Stacey Vince) had pride in her career being a good police officer and excelling at her job, but that was taken away from her by the Department through its covert, reprehensible retaliation and discrimination, all because she and her husband had the audacity to report retaliation as she was trained to do,” Stacey Vince’s attorneys stated in their court papers.

Stacey Vince, who was promoted to captain in November, says she chose to retire rather than accept a transfer to a less prestigious position. She also is seeking $1.2 million in attorneys’ fees and $11,710 in related costs. A hearing on those

Councilwoman Traci Park, who represents the 11th District, one of two coastal districts in the city of Los Angeles, agreed with Warner’s sentiments.

“I take my obligation to protect our sensitive marine habitat and our ocean wildlife very seriously and that means investing in upstream infrastructure to keep stormwater, chemicals, trash and pollutants out of our ocean,” Park said.

“I look forward to partnering with my colleagues on the City Council. The Pacific Ocean is a precious resource to the city and every resident. The obligation as humans and as policymakers to protect our incredible coastline is something that falls on all of us.”

Twin ports to benefit from $1.5 billion state infrastructure grants

The ports of Los Angeles and Long Beach will receive more than $600 million in grant funding provided by the state in an effort to complete essential infrastructure projects to streamline and sustain the goods-supply chain, officials announced Thursday.

Of the $1.5 billion allocated by the state, the Port of Los Angeles will receive $233 million while $383 million will go to the Port of Long Beach. The funding is part of the state’s work to “enhance safety, reduce emissions and keep goods and people moving,” according to a statement from the California State Transportation Agency.

“No other state has a supply chain as critical to the national and global economy as California,” Gov. Gavin Newsom said in a statement. “These investments — unprecedented in scope and scale — will modernize our ports, reduce pollution, eliminate bottlenecks and create a more dynamic distribution network.”

During a ceremony at the Port of Long Beach Thursday morning, Transportation Secretary Toks Omishakin said state funding will put port projects in a “strong position to compete for significant federal infra-

structure dollars.”

Projects receiving funding will help boost capacity to move goods through the ports of Los Angeles and Long Beach — the busiest ports in the western hemisphere — and enhance trade throughout the state from San Diego to the Central Valley to the Bay Area, officials said.

In response to the $233 million grant, Los Angeles Mayor Karen Bass thanked the governor and secretary for awarding these “critical funds.”

“When we invest in infrastructure, we are also investing in our workforce, in our nearby communities and in the port’s ability to safely and consistently send and receive goods,” Bass said in a statement.

State funding will support three infrastructure projects at the Port of LA — the Maritime Support Facility Improvement and Expansion Project; the Rail Mainline/Wilmington Community & Waterfront Pedestrian Grade Separation Bridge; and State Route 47/Seaside Avenue and Navy Way Interchange Improvements.

The $198.2 million MSF project will provide chassis and empty container storage for all 12 container terminals at the twin ports. The funding will also allow

the project to expand from 30 to 71 acres and support improvements to utilities, drainage, sewage, power, water supply and a paved perimeter roadway.

The $5.62 million bridge project will introduce a 400-foot pedestrian bridge over freight tracks, which is intended to create a safer connection between the Wilmington community, local schools and the waterfront area.

The $62.98 million state Route 47 project will modify the intersection of Navy Way and Seaside Avenue to improve traffic operations, reduce collisions and enhance safety.

“This nearly quarterbillion investment in critical Port of Los Angeles projects — along with an additional $191 million in supporting regional projects — will accelerate efforts to boost competitiveness, create jobs and enhance decarbonization efforts,” said Port of Los Angeles Executive Director Gene Seroka.

At the Port of Long Beach, nearly $225 million will fund a variety of zeroemission cargo-moving equipment and supportive infrastructure projects, including “top handlers” and other manually operated cargo-handling equipment such as tugboats

and locomotives.

Additionally, $158.4 million will go toward the planned Pier B On-Dock Rail Support Facility, which will shift more cargo from trucks to on-dock rail, where containers are taken to and from marine terminals by train.

The facility will be built in phases, with construction scheduled to begin in 2024 and be completed in 2032.

“This game-changing grant will make a tremendous difference in our efforts to bring more business and jobs to the harbor, enhance

the efficiency of cargo movement and accelerate the Port of Long Beach’s ongoing transformation to zero-emission operations,” said Port of Long Beach CEO Mario Cordero.

Of the $1.5 billion funding by CalSTA, approximately $250 million will be allocated for zero-emission infrastructure, locomotives, vehicles and vessels.

Woman drops wrongful termination suit against diet supplement company

Aformer compliance specialist for Herbalife International of America Inc. has dropped her lawsuit against the dietary supplements company in which she alleged she was wrongfully fired in 2022 for cooperating with an internal investigation of another employee’s complaint against the firm and for requesting to work from home in order to care for her parents.

Roxana Baez filed court papers on Wednesday with Los Angeles Superior Court Judge Daniel S. Murphy asking that her case be dismissed “with prejudice,” meaning it cannot be refiled. The court papers do not indicate if a settlement was reached or if Baez is not pursuing the case for other reasons.

The lawsuit allegations included wrongful termination, retaliation, disability discrimination, failure to accommodate and engage in the interactive process and

both intentional and negligent infliction of emotional distress.

In their court papers, Herbalife attorneys maintained Baez’s position was eliminated due to “organizational changes and related cost-cutting efforts.”

Baez was hired in September 2015 and originally worked as executive assistant for Chief Compliance Officer Henry Wang, the suit states. Wang was originally a co-defendant in the suit filed on March 24, but was then dropped from the case by Baez on June 21.

After Wang became Herbalife’s general counsel, Julia Bailey was hired as the chief compliance officer and reported to Wang and in 2018, Bailey promoted Baez to a compliance specialist position, according to the suit.

Bailey was fired in August 2020 at about the time Herbalife reached a settlement with the Department of Justice and the Securities and

Exchange Commission, which conducted a Foreign Corrupt Practices Act probe into the company, the suit stated.

Bailey alleged that her termination was unlawful and accused Wang of inappropriate and unlawful conduct in the workplace, the suit states. Herbalife’s human resources investigated Bailey’s claims and interviewed Baez, who corroborated some of Bailey’s allegations regarding Wang’s conduct, according to the suit.

Herbalife and Bailey ultimately settled her claims, but Baez’s relationship with Wang became strained, the suit stated. Baez continued to work on her projects, but was no longer allowed to coordinate with outside counsel and auditors, nor was she permitted to communicate directly with senior management, the suit stated.

Baez also was excluded from meetings where her projects were discussed and she was not allowed to

provide reports regarding ongoing programs to senior management as she had done in the past, the suit alleged.

In October 2021, Baez moved to Banning to be near her parents and help with their care, the suit states. But in May 2022, Baez, who had been working remotely since March 2020 due to coronavirus restrictions, was told along with other employees to resume working in the office, the suit stated.

Human resources denied Baez’s request to continue working from home or have some flexibility in her schedule so she could tend to her father and mother, the suit stated.

Baez took a medical leave last August and received a company-wide email notification about the potential for layoffs within the company, but the plaintiff was assured they would not impact her, the suit stated.

However, when Baez returned to the office that

same month, she was told her position was eliminated due to budget constraints, even though Herbalife hired three new employees in her department within two months of her termination, the suit stated.

“Plaintiff’s termination obviously had nothing to do with budget constraints and everything to do with her having cooperated in the HR

investigation into Bailey’s termination and her requests for accommodations,” the suit alleged.

But according to the Herbalife attorneys’ court papers, the company decided to replace Baez’s job with a higher-skilled position in a lower-cost region that would handle responsibilities Baez “did not and could not effectively perform.”

for such Work. When the Bidder submits its Bid to the City, the Bidder must list each

Subcontractor whom the Bidder must disclose under Public Contract Code Section 4104

(Subcontractor Listing Law), and the Bidder must provide all of the Subcontractor information that Section 4104 requires (name, the location (address) of the Subcontractor’s place of business, California Contractor license number, California Department of Industrial Relations contractor registration number, and portion of the Work). In addition, the City requires that the Bidder list the dollar value of each Subcontractor’s labor or services. The City’s disqualification of a Subcontractor does not disqualify a Bidder. 4. Acceptance or Rejection of Bids. 5. Contractor License. At the time of the Bid Deadline and at all times during performance of the Work, including full completion of all corrective work during the Correction Period, the Contractor must possess a California contractor license or licenses, current and active, of the classification required for the Work, in accordance with the provisions of Chapter 9, Division 3, Section 7000 et seq. of the Business and Professions Code. In compliance with Public Contract Code Section 3300, the City has determined that the Bidder must possess the following license(s): a. Pursuant to Section 3300, of the Public Contract Code, the classification of the bidder’s Contractor’s License shall be “Class A” Failure of a bidder to obtain adequate licensing at the time the contract is awarded shall constitute a failure to execute the Contract and shall result in the forfeiture of the Bidder’s Bond.

• b. For federally funded projects, the Contractor shall be properly licensed at the time of award.

The successful Bidder will not receive a Contract award if the successful Bidder is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active. If the City discovers after the Contract’s award that the Contractor is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active, the City may cancel the award, reject the Bid, declare the Bid Bond as forfeited, keep the Bid Bond’s proceeds, and exercise any one or more of the remedies in the Contract Documents.

6. Subcontractors’ Licenses and Listing. 10. Prevailing Wage Resolution. Bidders are hereby notified that in accordance with the provisions of the Labor Code of the State of California, the City Council of the City has ascertained and determined by Resolution No. 18,626 (as amended), the general prevailing rate of per diem wages of a similar character in the locality in which the Work is performed and the general prevailing rate for legal holiday and overtime Work for each craft or type of worker needed in the execution of agreements with the City. Dog show winner to be sworn in as Palm

At the crash site, one person was pronounced dead, while the other three occupants of the plane were rushed to nearby hospitals for medical attention.

Authorities identified the deceased occupant Wednesday as Temecula resident Jared Alan Newman, who was also identified as the pilot of the downed aircraft.

County fire and sheriff’s deputies went to the location and discovered Newman dead and the boys seriously hurt.

FAA records indicate that Newman obtained his student pilot certificate in September 2020. Federal regulations prohibit a student airman from operating as lone pilot in command of any aircraft carrying passengers. Student pilots can fly with passengers if there is an instructor on board, or a licensed pilot who is at the controls.

Three boys injured in a single-engine plane crash at French Valley Airport that killed their dad remained hospitalized Thursday in stable condition, all of them expected to recover.

Newman said that all of her sons are undergoing treatment at Rady Children’s

Hospital in San Diego.

She said that Caleb suffered a broken clavicle and some lung bruising, as well as lacerations, while Connor suffered a broken thigh that required surgery to place a rod in the femur for stability.

“Elijah sustained more serious injuries,” Newman said. “He has a broken jaw that he had surgery on last night. He has more significant pulmonary contusions than Caleb and a lacerated liver. He is stable, and everything looks good; we are just giving his body time to heal.”

One of the couple’s sons was not aboard the airplane.

The National Transportation Safety Board is investigating the crash and is slated to publish its preliminary findings in the next 10 days.

The Palm Springs pooch that won Best in Show at this year’s Westminster Kennel Club Dog Show is about to get another accolade — being sworn in as the city’s first “Canine Mayor.”

Buddy Holly, a 6-year-old Petit Basset Griffon Vendeen hound, will “take office” at 5:30 p.m. Monday in the council chamber at City Hall, according to a statement Thursday from the city.

Mayor Grace Garner, along with city council members, will perform the swearing-in ceremonies.

“As ‘Canine Mayor’ of Palm Springs, Buddy Holly looks forward to making many appearances around town as an ambassador for beautiful Palm Springs, California, while at the same time educating residents and visitors about his special breed — and along the way spreading smiles, laughter, and joy!” city officials said in a statement.

In addition to the swearing-in ceremony, Monday’s event will feature proclamations by city officials and the Friends of the Palm Springs Animal Shelter.

Buddy won the prestigious Westminster show in New York City against 2,500 dogs following two days of “Best of Breed,” “Group” and “Best in Show” competition. He became the first of his breed to claim the Best in Show crown.

He was bred by Gavin and Sara Robertson and is co-owned by Janice Hays, who was Buddy’s handler for the WKC victory, Lizzie Cadmore, Cathy O’Neill and Donna Moore.

Buddy started his career in the Coachella Valley and has since traveled to Portland, Oregon, Arizona, Texas, throughout California and most recently to New York.

He’s since returned to Palm Springs to retire a winner.

“Buddy and his mom Janice are excited to partner with the City of Palm Springs to attend ribbon-cuttings, Walk of Stars ceremonies — and a few surprises along the way!” the city statement said.

Riverside County offers residents master classes on organic waste composting

Riverside County residents can learn about composting organic waste in a new series of classes and workshops, according to the Riverside County Department of Waste Resources.

The county has provided Backyard Composting classes and workshops for 30 years to give residents the basic knowledge on how to safely and efficiently compost organic waste from a household’s kitchen and landscaping.

“In addition to these basic composting classes, the department will be offering a Master Composter Certificate Training program with a more advanced look at home composting and a variety of methods that can be used, more study of the compost-

ing process, and learning more about the waste stream in Riverside County,” officials said in a statement announcing the composting program.

To help reduce greenhouse gas emissions, a California law enacted last year requires municipalities to offer organic waste collection, composting education and other outreach efforts related to organic refuse.

The educational series features either online or in-person compost training.

The internet-based course began July 1 and allows six months for participants to study and complete the course utilizing online study materials and quizzes toward the goal of earning a Master Composter Training Certificate.

The in-person training session is scheduled for Saturdays, July 8-29 from 7 a.m. to 1 p.m. in Moreno Valley. The county provides books and study materials as an instructor leads students through the course, officials said.

“Students will build a compost pile and build their own vermicompost bin,” according to the county. “Limited seats are available for the in-person training course.”

Riverside County transportation projects receive $11.5M in state funds

Five transportation projects in Riverside County will receive a total $11.5 million in state funds for further development, it was announced Thursday.

The Southern California Association of Governments — SCAG — Regional Council awarded the money, which was made available under a $237 million California Department of Transportation Housing & Development award disbursed to agencies statewide, according to officials.

The largest allocation in the county is a $3 million grant for the Riverside County Transportation Commission’s Core Capacity Innovative Transit Study, which will evaluate transit improvement opportunities on Interstates 15 and 215.

Roughly $2.8 million has been earmarked for the Riverside Transit Agency’s GoMicro Microtransit Pilot Program Extension, which is focused on on-demand transportation opportunities in the Hemet and San Jacinto

Three men were arrested in connection with a robbery in Lake Elsinore, authorities said Thursday. Deputies responded to the 18000 block of Collier Avenue to a report of a robbery, according to Sgt. Carlos Garcia Villa of the Riverside County Sheriff’s Department.

Villa said three suspects entered the business wearing face masks and then fled northbound on Interstate 15 after allegedly taking numerous mobile devices.

According to Villa, sheriff’s deputies from the Lake Elsinore and Lake Mathews stations located the vehicle with the three suspects at about 7:05 p.m. Wednesday.

Lake Mathews deputies attempted to perform a traffic stop, but the suspects fled at high speed, prompting a pursuit that ended in San Bernardino County.

The three suspects arrested were Kentrel Forby, 23, of Rialto; Tyler Vansickle, 27, of Highland; and Handy Nathaniel Blocker, 19, of Highland. Villa said a fourth suspect remains at large.

A search warrant was executed where detectives discovered numerous electronic devices related to the robbery. Forby, Vansickle, and Blocker were all transported to the Cois Byrd Detention Center and booked for robbery, conspiracy, felony evading and organized retail theft. The investigation remains ongoing.
