David Wayne DePape, 42, of Richmond was charged Oct. 31 with assault and attempted kidnapping in violation of federal law in connection with the break-in at the residence of Nancy and Paul Pelosi in San Francisco on Friday.

According to the complaint, DePape was arrested on Friday inside the Pelosi residence by San Francisco Police Department police officers responding to a 911 call from Paul Pelosi, husband of U.S. House of Representatives Speaker Nancy Pelosi. Paul Pelosi later described to police that he had been asleep when DePape, whom he had never seen before, entered his bedroom looking for Nancy Pelosi.

According to the complaint, minutes after the 911 call, two police officers responded to the Pelosi residence where they encountered Paul Pelosi and DePape struggling over a hammer. Officers told the men to drop the hammer, and DePape allegedly gained control of the hammer and swung it, striking Pelosi in the head. Officers imme diately restrained DePape, while Pelosi appeared to be unconscious on the ground. As set forth in the complaint, once DePape was restrained, officers secured a roll of tape, white rope, a second hammer, a pair of rubber and cloth

gloves and zip ties from the crime scene, where officers also observed a broken glass door to the back porch.

A criminal complaint is merely an allegation. The defendant is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

DePape is charged with one count of assault of an immediate family member of a United States official with the intent to retaliate against the official on account of the performance of official duties, which carries a maximum sentence of 30 years in prison. DePape is also charged with one count of attempted kidnapping of a United States official on account of the performance of official duties, which carries a maximum sentence of 20 years in prison.

U.S. Attorney Stephanie M. Hinds for the Northern District of California, Special Agent in Charge Robert K. Tripp of the FBI San Fran cisco Field Office, and Chief J. Thomas Manger of the U.S. Capitol Police made the announcement.

The Special Prosecutions Section of the U.S. Attor ney’s Office for the Northern District of California is pros ecuting the case.

The FBI San Francisco Field Office, the U.S. Capitol Police, and the San Fran cisco Police Department are investigating the case.

Nov. 8 is fast approach ing, and it’s impor tant to know what you’re voting on. First, check your voter status visit, voter status.sos.ca.gov/. All counties have early voting and drop-off locations. Voter centers open on Saturday, Oct. 29. In-person votinglocations offer same-day voter registration, replacement ballots, acces sible voting machines, and language assistance to those who need it. If you choose to vote by mail, all voteby-mail ballots returned by mail must be postmarked on or before 8:00 p.m. on Nov. 8, and received by Nov. 15. Visit sos.ca.gov/elections for further details.

A “yes” vote supports amending the state consti tution to prohibit the state from interfering with or denying an individual’s reproductive freedom, which is defined to include a right to an abortion and a right to contraceptives.

Legalizes sports betting at American Indian gaming casinos and licensed racetracks in California. Sports betting is defined as wagering on the results of professional, college, or amateur sport and athletic events. This does not include high school sports or California college teams. A minimum age to partici pate is 21. Sports betting is legal in 30 other states.

Additionally, this measure would legalize

roulette and dice games at tribal casinos.

A “yes” vote supports this ballot initiative to (i) legalize sports betting at American Indian gaming casinos and licensed race tracks in California; (ii) tax profits derived from sports betting at racetracks at 10%; and (iii) legalize roulette and dice games, such as craps, at tribal casinos.

The “Yes on 26, No on 27Coalition for Safe, Responsi ble Gaming” is a PAC leading the campaign in support of the ballot initiative. The coalition is supported by the Pechanga Band of Luiseno Indians, Yocha Dehe Wintun Nation, Agua Caliente Band of Cahuilla Indians, Feder ated Indians of Graton Rancheria, and the Barona Band of Mission Indians. The campaign raised nearly $123.4 million.

A “no” vote opposes this ballot initiative, thus continuing to prohibit sports betting in California and roulette and dice games at tribal casinos.

“No on 26 - Taxpayers Against Special Interest Monopolies” is leading the campaign against the proposal. The campaign, along with a terminated PAC No on the Gambling Power

Grab, raised $43.1 million. The top donors to the oppo sition are gambling-related companies, including the California Commerce Club, Inc, Hawaiian Gardens Casino, and Knighted Ventures LLC.

Legalizes mobile sports betting. Proposes to autho rize a gaming tribe, an online sports betting platform with an operating agreement with a gaming tribe, or a qualified gaming company with a market access agree ment with a gaming tribe may operate online sports betting for individuals 21 years of age or older in the state, but outside of Indian lands. This proposed law would create the “Division of Online Sports Betting Control within the Depart ment of Justice.” Addition ally, would establish the California Online Sports Betting Trust Fund where revenue, after deducting regulatory costs, would be

allocated to “California Solutions to Homelessness and Mental Health Support Account” (85%) for perma nent and interim housing and 15% to the “Tribal Economic Development Account,” which would be established by the initia tive to suppliment Indian tribes for expanding tribal government, public health, education, infrastructure, and economic development.

A “yes” vote supports legalizing online and mobile sports betting for persons 21 years of age or older, establishing regulations for the mobile sports betting industry, imposing a 10% tax on sports betting revenues and licensing fees, and allocating tax revenue to an account for homelessness programs and an account for tribes not operating sports betting.

Californians for Solu tions to Homelessness and Mental Health Support is leading the support campaign. Donors include Betfair Interactive US LLC (Fanduel Sportsbook), Crown Gaming, Inc. (Draft kings), BetMGM LLC, FBG Enterprises LLC and Penn National Gaming, Inc.

Californians for Tribal Sovereignty and Safe Gaming and Coalition for Safe, Responsible Gaming are leading opposition campaigns. Would require a minimal source of annual funding for public schools, including charter schools, to fund art and music programs. The

annual minimum amount established by the law would be equal to, at minimum, 1% of the total state and local revenues that local educa tion agencies received under Proposition 98. Prop 98 amended the state constitu tion to require a minimum percentage of state budget spent toward K-14 (two year community college).

A “yes” vote supports this ballot initiative to:

1. require an annual source of funding for K-12 public schools toward arts and music education equal to, at minimum, 1% of the total state and local revenues that local educa tion agencies receive under Proposition 98;

2. distribute a portion of the additional funding based on a local educa tion agency’s share of economically disadvantaged students; and

3. require schools with 500 or more students to use 80% of the funding for employing teachers and 20% to training and materials.

The “Vote Arts and Minds” campaign is lead by “Yes on 28 - Californians for Arts and Music in Schools.” The campaign reported receiving over $9.3 million in contributions accord ing to its latest campaign finance filings.

A “no” vote opposes all three of the above.

There are no formal opponents to this ballot.

Los Angeles man arrested for allegedly breaking into bank in Arcadia

A 34-year-old man from Los Angeles was arrested on suspicion of commer cial burglary for alleg edly breaking into a bank in Arcadia, authorities said Sunday. Officers were sent to Chase Bank, 60 E. Hunting ton Drive, at about 10:20 p.m. Saturday regarding a report of glass being broken at the location and spotted a man inside the bank, the Arcadia Police Department reported. The suspect fled through the front doors upon seeing police and ran to a nearby commercial building. Officers located him in a nearby parking lot and he was taken into custody. Abel Lopez of Los Angeles was arrested on suspicion of commercial burglary. No further information was released.

Bill to name Glendale post office after former navy secre tary introduced

A bill to name a post office in Glendale for former U.S. Navy Secretary Paul Ignatius, a son of one of the first Armenian families to settle in the city, has been introduced by Rep. Adam Schiff. "I'm pleased by this honor for a special reason — I worked at the Glendale post

office as a temporary clerk when I was a college student," Ignatius said in a statement. The bill would name the post office at 6444 San Fernando Road for Ignatius. He was born on Nov. 11, 1920, in Glendale. His family was one of the earliest Armenian families to settle in Glendale in 1911. Glendale now has the second-largest Armenian population of any U.S. city, behind only Los Angeles.

Man, 22, shot dead in Pasadena

A 22-year-old man was found dead by police Sunday after being shot. Officers from the Pasadena Police Department responded to a call regarding a person down at around 1:30 a.m. Sunday in the 100 block of Painter Street. The victim was pronounced dead at the scene. He was later identified as Martrell Eric Robinson from Rialto, according to police. No motive or suspect information was imme diately available. Anyone with information about the death was encouraged to call Pasadena police at 626-7444241 or anonymously at 800-222-8477.

Woman fatally shot in Long Beach; suspect in custody

A 47-year-old man was in custody Monday for alleged ly fatally shooting a 36-yearold woman he had been

dating in Long Beach. Long Beach Police Department officers were called about 7:50 a.m. to the 700 block of East Wardlow Road, near the San Diego (405) Freeway, on reports of a woman bleeding in a vehicle, and they found Adriana Silva of Paramount in the area suffering from a gunshot wound to her upper body, according to the LBPD. Paramedics were called and pronounced Silva dead at the scene. A prelimi nary investigation into the killing revealed that Silva and the suspected shooter — later identified as Jose Luis Vidal — were "involved in a dating relationship" with one another, police said.

Orange County Man gets 10 years for OC rampage

A 36-year-old man was sentenced Friday to 10 years in prison for a rampage on a June morning three years ago, attacking four people in two Orange County cities, including a Fullerton police officer. Kenneth Alexander Heimlich was convicted Aug. 23 of two counts of robbery, one count of battery with serious bodily injury and two counts of assault with force likely to produce great bodily injury — all felonies — as well as with misdemeanor counts of assault on a peace officer and assault. Jurors, who deliberated for about a day, also found true sentencing enhancements for causing great bodily injury, leaving a victim comatose or paralyzed and inflicting great bodily injury on another victim. A mistrial was declared on an attempted murder charge when jurors deadlocked on that count.

Anaheim Man charged with phoning in threats to Anaheim police

A 34-year-old man was charged Thursday with phoning in a bomb threat to Anaheim police. Carlos Alberto Catalan Jr. is accused of phoning in a threat Saturday to a detective and falsely reporting a bomb, according to the criminal complaint. Catalan was charged with single felony

counts each of criminal threats and falsely report ing the planting of a bomb. He pleaded not guilty in the jail courtroom in Santa Ana and was ordered to return to court on Nov. 4 in the North Justice Center in Fullerton.

Proposed resolution declares county's opposition to anti semitism

The Board of Supervisors Tuesday approved a reso lution declaring Riverside County's condemnation of acts of antisemitism within the county and anywhere else they may occur. "River side County stands for openness, acceptance and diversity, and residents should never have to fear for their safety," according to the resolution, jointly proposed by Supervisors Karen Spiegel and Manuel Perez. "All people deserve peace and respect over hate. Religious liberty is an unalienable human right and among the foundations of our great country." The resolution doesn't reference any specific acts of antisemi tism in the county. However, it points to an Oct. 22 protest on a 405 Freeway overpass in Los Angeles, during which a few demonstrators report edly traded Nazi salutes and hung banners in support of Kanye West, who landed in hot water over an antisemitic social media post.

Temperatures to nosedive in Riverside, snow possible in mountains with arrival of storm

Temperatures will plunge and dustings of snow around Idyllwild and other mountain locations are possible midweek as a storm system rolls in from the north, with the tail end of it sweeping across the Inland Empire, according to the National Weather Service. "This incoming system will bring a chance of rain and mountain snow," the NWS said. "Snow levels will fall to around 6,000 feet on Wednesday and 4,000 to 4,500 feet for early Thursday. There could be a few inches of snowfall, mainly above 6,000 feet."

According to forecasters, the cold front, originating from the Gulf of Alaska, will push the mercury down 20 degrees, with highs in the Riverside metropolitan area peaking at only 60 degrees on Thursday, with overnight lows around 40.

State funds to aid in relocating homeless staying in Corona, other county cities

An $11 million state grant awarded to Riverside County will provide funding for programs intended to help transients encamped along the Santa Ana River relocate to transitional housing and other accom modations, officials said Thursday. The Continuum of Care grant was received by the county's Department of Housing & Workforce Solu tions and will go directly to costs incurred by the Santa Ana River Bottom Multidis ciplinary Team, comprised of personnel from several county agencies, a nonprofit and the cities of Corona, Eastvale, Jurupa Valley, Norco and Riverside. The goal is to relocate more than 200 people currently spread among some three dozen encampments, according to officials.

At 10:45 a.m., an officer re sponded to the front counter of the Arcadia Police Department regarding a disorderly conduct incident that occurred at the Shops at Santa Anita, located at 400 S. Baldwin Ave. The officer discovered an unidentified male suspect took photographs of a group of juvenile females while they were changing clothes in various stores throughout the mall. The suspect is described as a White male between the ages of 20 and 40 years old, approxi mately 5-foot-10 with an aver age build and “shaggy” hair.

At 5:11 p.m., an officer re sponded to JC Penney, located at 400 S. Baldwin Ave., regarding a grand theft report. A store rep resentative stated the unknown male suspect stole a $16,000 necklace. He is described as a Black male, approximately 25 to 30 years old, around 5-foot-9 tall, with brown eyes and a black face mask.

At 10:30 p.m., an officer responded to a residence in the 1000 block of Sunset Boulevard regarding a battery report. An investigation revealed an alter cation between a husband and wife resulted in the female half reporting a history of domestic violence. The suspect, a 42-yearold male from Arcadia fled be fore the officer’s arrival.

Oct. 24

At 1:19 a.m., an officer responded to Wing Hop Fung, located at 400 S. Baldwin Ave., regarding a burglary investiga tion. The officer determined a group of suspects cut a hole in the roof of the business and fled with a large amount of high-end alcohol products. The suspects appear to be a group of three to four males.

At 1:59 p.m., an officer re sponded to Los Angeles County Agricultural Commissioner Department, located at 12300 Lower Azusa Rd., regarding a commercial burglary report. Surveillance footage captured two male suspects cutting the chains to a security gate and attempting to gain access to a storage container, but they fled empty-handed. The suspects were seen fleeing in a white pickup truck.

At 9:36 p.m., an officer re sponded to Macy’s, located at 400 S. Baldwin Ave., regarding a stolen vehicle report. Sometime between 1 p.m. and 9:35 p.m. on Oct. 24, someone stole the vic tim’s 2001 Honda Accord from the mall parking lot.

Oct. 25

At 5:32 a.m., an officer re sponded to the area of 900 W. Duarte Rd. regarding an aggra vated assault investigation. The victim stated he believed his mother-in-law vandalized his car, so he confronted her. During the confrontation, the motherin-law drove her vehicle toward him at a high rate of speed and made threats to run him over.

The suspect, a 63-year-old fe male from Arcadia, is outstand ing as of Nov. 1.

At 4:04 p.m., an officer responded to Arcadia High School, located at 180 Campus Dr., regarding a robbery report. The victim stated the suspect ripped his necklace off and fled. The suspect, a 17-year-old male from Temple City, was cited and released in the field.

At 4:06 p.m., an officer re sponded to a residence in the 200 block of San Luis Rey Road regarding a stolen vehicle re port. The victim stated he rent ed out his camper trailer on the “Outdoorsy” application to the suspect who failed to return it. The identity of the suspect has yet to be confirmed.

Oct. 26

At 12:23 p.m., officers re sponded to the 1000 block of West Duarte Road regarding a kidnapping incident. An investi gation revealed the male suspect locked his ex-girlfriend inside her apartment and hit her in the face. A records check revealed he was on parole at the time of the incident. The 30-year-old male from Compton was arrested and transported to the Arcadia City Jail for booking.

At 12:47 p.m., an officer responded to a residence in the 100 block of Country Oak Drive, regarding a forgery report. The victim determined one of her recently mailed checks had been altered and forged. The victim does not know the identity of the suspect or how they ob tained her check.

At 5:54 p.m., an officer re sponded to 99 Ranch Market, located at 1300 S. Golden West Ave., regarding a theft from ve hicle incident. The victim stated that while she was loading her groceries and child, an unknown suspect stole her purse from her open trunk. The suspect is described as a Black male, ap proximately 20 years old, with short black hair, 6-feet tall, and seen wearing a blue t-shirt. The suspect fled in a black BMW.

Oct. 28

At 3:10 a.m., an officer re sponded to a residence in the 2400 block of South Baldwin

Avenue regarding a burglary re port. An investigation revealed the suspect, the victim’s son, was prohibited from entering the lo cation but did so anyway and was also in possession of meth amphetamine. The 37-year-old male from Arcadia was arrested and transported to the Arcadia City Jail for booking. While in custody, the suspect damaged jail property. This offense was added to his list of charges.

Oct. 29

At 5:22 p.m., an officer re sponded to Nordstrom, located at 400 S. Baldwin Ave., regard ing a robbery report. The officer discovered the suspect stole a pair of shoes and pants from the store and when he was con fronted by the loss prevention staff, he brandished a firearm. The suspect is described as a Black male in his mid-twenties, approximately 5-foot-9 and 150 pounds, wearing a black t-shirt and blue jeans.

Oct. 20

At 1:27 a.m., an officer was conducting extra patrol and no ticed two subjects in a park in the 600 block of South Sham rock after hours. He detained the subjects and discovered one was in possession of drugs. The subjects were arrested, cited and released on the scene.

At 7:54 a.m., a victim in the 300 block of South Fifth called to report the catalytic converter from his vehicle had been stolen. This investigation is continuing.

At 3:13 p.m., a business owner in the 100 block of East Chestnut called to report some one stole merchandise. This in vestigation is continuing.

At 4:46 p.m., an officer saw a vehicle commit a traffic viola tion and conducted a traffic stop in the area of Shamrock and Huntington. A computer check on the driver revealed two out standing warrants. He was ar rested per the authority of the warrants and taken into custody.

At 7:50 p.m., a caller re ported a female being assaulted in the 100 block of West Hun tington. Officers arrived and lo cated the female, but the male suspect had fled. This investiga tion is continuing.

At 8:09 p.m., officers were patrolling when they saw a sub ject matching a suspect descrip tion in the 100 block of West Huntington. A records check revealed that the subject was not the suspect, but he had a warrant for his arrest. He was arrested per the authority of the

warrant and was taken into cus tody.

At 10:32 p.m., officers were dispatched to the 700 block of West Lemon regarding an as sault with a deadly weapon. A male suspect became upset dur ing an argument and assaulted the victim with a bat. The sus pect was gone prior to the offic ers’ arrival. This investigation is continuing.

Oct. 21

At 1:27 a.m., a domestic violence was reported in the 200 block of Parkrose. The victim re ported her boyfriend assaulted her and fled the location. Offic ers arrived and searched the area but could not locate the suspect. The suspect was later detained. He was arrested and taken into custody.

At 1:44 a.m., a caller report ed his vehicle was broken into in the 500 block of West Hunting ton and his laptop was taken. This investigation is continuing.

At 7:15 a.m., while in the area of Fifth and Huntington on an unrelated call, officers rec ognized a male subject from a wanted flyer. The subject was contacted and identified. He was arrested and taken into custody.

At 10:55 a.m., an officer re ceived information of a wanted suspect in the 500 block of West Duarte. Officers responded and contacted the suspect. A com puter check revealed she had a warrant for his arrest. He was arrested and taken into custody.

At 2:35 p.m., officers were dispatched to the 500 block of King. A resident called and re ported the catalytic converter was stolen from his vehicle sometime overnight. This inves tigation is continuing.

Oct. 22

At 1:41 a.m., a caller report ed a vehicle had just crashed into a parked vehicle in the 700 block of South Canyon. Officers arrived and located an intoxicated driv er. The driver was arrested and transported to the MPD jail to be held for a sobering period.

At 1:24 p.m., an officer pa trolling the area of Myrtle and Duarte saw a bicyclist commit a traffic violation. While talking to the rider, the rider admitted to having a meth pipe. He was arrested and released with a ci tation.

At 3:17 p.m., officers re sponded to the 700 block of West Huntington regarding a vehi cle fire. The fire was a result of mechanical problems with the vehicle.

Oct. 23

At 12:26 a.m., an officer was patrolling the area of May

flower and Huntington when she saw a motorist commit a driving violation. A traffic stop was con ducted and the driver displayed signs of being intoxicated. A DUI investigation determined she was driving under the influence. She was arrested and transport ed to the MPD jail to be held for a sobering period.

At 2:23 a.m., officers re sponded to a possible fight be tween a male and female in the 300 block of South Stedman. When officers arrived the male had left and the female was found to be uninjured. Officers located the male sitting in his vehicle. Officers contacted him and found he was heavily intoxi cated. He was arrested and trans ported to the MPD jail to be held for a sobering period.

At 8:38 a.m., an employee reported that someone burglar ized a business in the 200 block of West Duarte. This investiga tion is continuing.

At 11:37 a.m., a carjacking was reported in the 1400 block of South Shamrock. The suspect used a handgun to take a vehicle from a car dealership employee. The suspect's driver’s license was on file at the dealership and after a computer check, it was learned that this same suspect had been contacted by our officers in the past. Officers located the suspect in a nearby parking lot. He was ar rested and taken into custody.

At 3:59 pm, officers re sponded to the 100 block of West Cherry regarding the victim being threatened by his adult son. An emergency protection order was issued. The son was arrested and taken into custody.

At 7:37 p.m., officers re sponded to the 1500 block of Encino regarding a possible at tempt suicide. Officers arrived and spoke with the female sub ject and determined she was a threat to herself. Officers arrived and determined she needed to be evaluated by a mental health pro fessional. She was transported to a local facility for treatment.

Oct. 24

At 4:51 a.m., officers re sponded to a burglary alarm in the 100 block of South Myrtle. Officers arrived and saw the front door of the business was forced open. Further investigation re vealed items were taken from the business. This investigation is continuing.

At 7:25 a.m., officers re sponded to the 600 block of West Huntington regarding an open storage shed that is normally secured. This investigation is continuing.

At 2:25 p.m., a stolen wallet

was reported in the 600 block of West Huntington. The victim re ceived notification of fraudulent activity on her account. This in vestigation is continuing.

At 5:08 p.m., a fire was re ported in the 1100 block of South Mountain. A witness provided the description of a subject seen running from the location. Offic ers and MFD responded to the location. The surrounding busi nesses were evacuated. Fire De partment eventually got the fire under control and extinguished. The suspect was arrested and taken into custody.

Oct. 25

At 1:26 a.m., while on pa trol in the 2100 block of South Myrtle officers notice two sub jects parked in a red zone. Of ficers stopped to investigate and noticed open alcohol containers and loose mail in the vehicle. The mail belonged to different addresses. One subject was ar rested for mail theft and the oth er was arrested for an outstand ing warrant.

At 2:11 a.m., officers were dispatched to the 100 block of West Foothill regarding a burgla ry alarm. When officers arrived they noticed a broken window. No one was located inside the location when inspected. This investigation is continuing.

At 12:56 p.m., a caller re ported there was a possible kid napping taking place in the 1600 block of South Primrose. Officers responded and identified the parties involved. They deter mined a male subject confronted a man and his granddaughter in the park. The transient pushed the male, causing him to fall and strike his head on a large rock causing great bodily injury. The transient picked up the grand daughter and ran approximately 100 to 150 feet before being stopped by an alert witness in the area who also detained the suspect. The suspect was arrested and was taken into custody.

At 4:28 p.m., officers were dispatched to the 900 block of West Duarte regarding a vehicle burglary. The victim’s vehicle window was smashed and items were taken. This investigation is continuing.

At 4:36 p.m., the victim came into the lobby to report that he was attempting to rent a resi dence off Craigslist. He was asked to wire $2,000 to an unknown subject and complete a detailed credit application. When the vic tim inquired further about the location, he discovered the resi dence was not for rent and had been scammed. This investiga tion is continuing.

Report states Pasadena officer's fatal shooting of suspect complied with policy

APasadenapolice officer who fatally shot a Black man running from a 2020 traffic stop — prompting months of protests — acted within department policy, accord ing to the results of an internal investigation released last week.

The report from the department's Use of Force Review Board, and affirmed by interim Police Chief Jason Clawson, found that the use of force employed by Officer Edwin Duma guindin in the Aug. 15, 2020, shooting of Anthony McClain was in compliance with the department's useof-force policy.

The city noted, however, that disciplinary action is still pending against the officer for failing to activate a body-worn camera in a timely manner at the onset of the confrontation.

"The Pasadena Police Department takes all uses of force seriously, espe cially those which result in the loss of a person's life," Clawson said in a statement. "I am commit ted to holding myself and the other members of the department accountable for our actions, individually and collectively, and I am confi dent that we took a critical and comprehensive look at what happened.

"I encourage the public to review the complete investigation. Ultimately, this incident resulted in the loss of Mr. McClain's life, and it was tragic for all those involved and for the community."

McClain, a probationer, was a passenger in a vehicle that was pulled over by officers near Raymond Avenue and Grandview Street about 8 p.m. Aug. 15, 2020. The 32-year-old man was shot at least once in the upper body after he got out of the vehicle and began running, and died that night at a hospital, authori ties said.

Then-Police Chief John Perez later released police videos of the shooting, saying the fleeing McClain could be seen holding a gun in his waistband as he bolted from the passenger seat of the car, and that he then held it in his left hand as he ran.

Attorneys for McClain's father allege the fleeing man was holding his belt buckle and that a gun recovered across the street was not tied to him but was "planted" by officers. A gun is not clearly visible in the video footage released by the police department, but McClain is seen with his hand at his waist as he begins to run.

Pasadena police have said that a DNA test estab lished a link between the firearm recovered at the scene and McClain. The DNA test, which was conducted by the sheriff's Scientific Services Bureau, determined that McClain's DNA and no one else's was found on the firearm, according to the department.

Earlier this year, the District Attorney's Office declined to file any criminal charges against the officer, concluding there was "insufficient evidence to prove beyond a reasonable

doubt that Dumaguindin's decision to use deadly force was unreasonable." Prosecu tors found that "the evidence presented strongly supports that McClain possessed a firearm."

McClain's shooting -- occurring about three months after the death of George Floyd at the hands of police in Minneapolis -- set off waves of protests against the Pasadena Police Department and allegations of excessive force. Relatives of McClain filed multiple lawsuits.

The city last year reached a $7.5 million settlement with the three mothers of three minor children fathered by McClain. A separate lawsuit by McClain's father and other relatives is still pending in Los Angeles federal court. Relatives contend that McClain was shot in the back.

"I don't see no reason why he should have been shot in the back and killed," McClain's father, Archie Barry, said shortly after his son was shot. "I don't know if I can live with this the (rest) of my life."

The city of Pasadena has also retained the Office of Independent Review to investigate the shooting. That report is still pending.

The manufacture and removal of single-use plastics, such as water bottles, create significant greenhouse gas emissions contributing to global warming. There are approximately 75 million to 200 million tons of plastic waste in the Earth's oceans right now.

By using water filters at home instead of buying bottled water, consumers can help decrease greenhouse gas emissions and reduce harmful waste. The U.S. Environmen tal Protection Agency offers guidelines to help consum ers choose water filters that best fit their needs, as filters can range from those fitted to bottles, taps, or pitchers to more complex reverse osmosis

systems.

And before you head out, don't forget to fill up a reusable aluminum thermos or bottle so you have water on the go.

Sort trash into compost or recycling bins

Recycling reduces waste and saves natural resources, prevents pollution, and conserves energy. Items accepted for recycling can vary across the United States, but common items include plastic bottles, aluminum and steel cans, glass containers, and newspapers. Important for proper recycling is to ensure mediums aren't mixed: Jars with peanut butter still in them, for example, can't be recycled; it's essential materi als are all well-cleaned before ending up in the bin.

Food and yard scraps comprise nearly one-third of trash—a metric that can be all but eliminated by compost ing. Compost bins can be

established indoors or out and provide essential benefits to the soil while decreasing greenhouse gas emissions and limiting what ends up in the waste stream. Be sure to keep animal products out of the bin so as to not attract pests and rodents. Examples of some items that can be included are: Fruits, veggies, coffee grounds, dried egg shells, leaves, grass clippings.

If you're living in a city and don't have room for your own compost bin, look for local compost collectors to pick up your scraps for a monthly fee.

Swap in LED lightbulbs instead of buying new CFLs

Lighting is responsible for 5% of greenhouse gas emis sions and 15% of electricity use worldwide, according to the U.S. Department of Energy. Switching to LED lights—the highest-efficiency bulbs on the market—could cut U.S. elec tricity use in half, making this a

simple way to increase sustain ability in the home.

LED bulbs use an estimated 15% less energy than compact fluorescent light bulbs, and don't contain the dangerous mercury vapor found in the latter. Combine this with their higher efficiency and lower greenhouse gas emissions and it creates a greater cost savings for consumers.

The Department of Energy is moving the needle on this shift with new regulations related to light bulbs imple mented in April 2022.

Buy new parts instead of new appliances

Repairing home appli ances before buying new ones saves money while promoting sustainability.

Buying parts and repairing broken appliances yourself, or having a professional do the repairs, may be a good option if repairs cost less than half of a new appliance or if the appli

ance is less than 10 years old. Consumer Reports even offers interactive online tools to help consumers make smart deci sions about repairing appli ances including refrigerators, dishwashers, and washing machines.

When the issue is more aesthetic than functional, upcy cling is an option to increase the longevity of an appliance. For example, painting kitchen appliances a new color is much more environmentally friendly than discarding refrigerators and dishwashers that are in working order. And when it is time to finally say goodbye to a well-used appliance, the Envi ronmental Protection Agency offers guidelines through its Responsible Appliance Disposal Program.

Let your fans do the work

A study released by Austra lia's University of Sydney in April 2022 reported that using fans in homes helps residents

stay cool without using as much air conditioning. Cooling costs decreased by nearly 70%, marking a significant reduction in greenhouse gas emissions. This is an impor tant finding to help address climate change, as air condi tioners and fans comprise nearly one-fifth of electricity used globally, and air condi tioners produce almost 4% of greenhouse gas emissions worldwide.

Many varieties of fans are available for use in the home, including ceiling fans, window fans, and tower fans. Pro tip: When using ceiling fans in the summer, set the blades to spin counterclockwise to push air down and keep rooms cool.

Judge strikes former West Covina mayor's defamation claim against legislators

Ajudge has dismissed a former state assem blyman's defamation claim against two sisters who are current members of the state Legislature — includ ing one who is the plaintiff's ex-wife — whom he alleged maligned his reputation while speaking out on domestic violence issues.

Pomona Superior Court Judge Peter A. Hernandez issued his ruling last week in the suit brought by ex-Assem blyman Roger Hernandez — who is unrelated to the judge — against the plaintiff's ex-spouse, 51-year-old state Sen. Susan Rubio, and her 53-year-old sibling, Assem blywoman Blanca E. Rubio.

The Rubio sisters filed a motion under the state's anti-SLAPP — Strategic Lawsuit Against Public Participation — law, which is intended to prevent people from using courts, and potential threats of a lawsuit, to intimidate those who are exercising their First Amendment rights.

The judge heard argu

ments on the motion on Sept. 7, then took the issues under submission before ruling on Thursday. In his opposition to the anti-SLAPP motion, Hernandez maintained in his court papers that the motion was "frivolous and nothing more than an attempt to harass plaintiff at this earliest stage of litigation."

Hernandez, now 47, was elected at age 24 to the Rowland Unified School District Board of Education. He later won a seat on the West Covina City Council, then served from 2010-16 in the state Assembly before being termed out.

Susan Rubio is a former Baldwin Park city council woman who was elected to the state Senate in 2018. Blanca Rubio succeeded Hernandez in his former Assembly seat in 2016.

Hernandez and Susan Rubio were wed in June 2013 and he filed for divorce in December 2014. In his suit filed on May 6, Hernandez, in addition to defamation, also alleges intentional interfer

ence with contractual rela tions and intentional inter ference with prospective economic relations.

According to the judge's ruling, Hernandez alleged that in October 2021, Susan Rubio was a keynote speaker at a conference in which she stated that Hernandez committed various acts of violence against her. Hernandez alleged that a month later, Blanca Rubio said Hernandez said during a live panel discussion hosted by UC Irvine that the plain tiff was actively grooming other women for domestic violence and abuse.

The judge said that Hernandez and the Rubios are all public figures and that statements made by two public figures about a third are "likely to be deemed a matter of public interest."

The Rubios made the statements while discuss ing their ongoing efforts to promote legislation to protect domestic violence victims, according to the judge, who also noted that Blanca Rubio

was expressing an opinion and that she actually said Hernandez was grooming other women to disbelieve her sister and not that he was grooming them for domestic violence.

The judge additionally noted that a judge granted Susan Rubio against Hernan dez in 2016 and that it was extended by another bench officer in 2020.

In his court papers, Hernandez maintained that Susan Rubio's domestic violence claim against him was false and that Blanca Rubio's statement that he was grooming other women for abuse was "outrageous."

Hernandez's court papers further stated that he did not dispute that the disputed comments by the Rubios arose from protected speech, but only whether he could "demonstrate a probability of prevailing on the merits" of his defamation argument. The judge concluded he could not and found no actual malice on the part of the Rubios.

ORDINANCE NO. 2022-08

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MON ROVIA, CALIFORNIA, REPEALING THE EMERGENCY MORA TORIUM ON THE EVICTION OF RESIDENTIAL TENANTS FOR NON-PAYMENT OF RENT DUE TO COVID-19 FINANCIAL HARD SHIPS AND “NO-FAULT” RESIDENTIAL EVICTIONS

WHEREAS, on March 4, 2020, the Governor of the State of California (“Governor”) declared a state of emergency to make ad ditional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help the state prepare for broader spread of “coronavirus disease 2019” (“COVID-19”); and

WHEREAS, on March 16, 2020, the Governor issued Executive Order N-28-20, which suspended “[a]ny provision of state law that would preempt or otherwise restrict a local government’s exercise of its police power to impose substantive limitations on residential or commercial evictions” of certain tenants affected by the COVID-19 pandemic; and

WHEREAS, on March 17, 2020, the City Council ratified the City Manager’s proclamation of the existence of a local emergency in response to the COVID-19 pandemic; and

WHEREAS, on March 19, 2020, the Los Angeles County Pub lic Health Officer issued a countywide health order for residents to remain “safer at home,” and the Chair of the Los Angeles County Board of Supervisors (“County Board”) issued an Executive Order that imposed a temporary moratorium on evictions for non-payment of rent by residential or commercial tenants impacted by COVID-19 (“County Eviction Moratorium”); and

WHEREAS, as a result of the public health emergency and the precautions recommended by health authorities, many residential tenants in Monrovia experienced sudden and unexpected income loss; and

WHEREAS, on March 31, 2020, the City Council adopted emer gency regulations (“Urgency Ordinance No. 2020-04U”) prohibiting residential evictions for non-payment of rent due to COVID-19 fi nancial hardships and “no-fault” residential evictions, and requiring rent to be paid in full within six months following the expiration or termination of the local emergency; and

WHEREAS, on August 31, 2020, the Governor signed As sembly Bill 3088 (“AB 3088”) into law, which established statewide eviction protections for residential tenants who were negatively im pacted by COVID-19; and

WHEREAS, on September 1, 2020, the County Board amend ed the County Eviction Moratorium to, in part, establish the County’s eviction protections as the baseline for all incorporated cities within Los Angeles County, including cities with their own local eviction moratoria if those moratoria did not include the same or greater ten ant protections as the County Eviction Moratorium; and

WHEREAS, on March 15, 2021, the CA COVID-19 Rent Relief program began to accept applications for rent and utility support for up to 18-months in assistance covering the time between April 1, 2020 and March 31, 2022; and

WHEREAS, on October 1, 2021, the State eviction moratorium established by AB 3088, and extended and amended by subsequent legislation, for residential tenants who were negatively impacted by COVID-19 expired; and

WHEREAS, on January 25, 2022, the County Board voted to extend the County’s COVID-19 Tenant Protections Resolution (formerly the County Eviction Moratorium) for residential tenants impacted by COVID-19 with incomes at or below 80% of the Area Median Income (“AMI”), through December 31, 2022; and

WHEREAS, on September 13, 2022, the County Board voted to direct the Director of the Department of Consumer and Business Affairs, in coordination with others, to prepare and implement an im mediate coordinated strategy of the County’s emergency tenant pro tections phase out with a defined end date of December 31, 2022; and

WHEREAS, to align with the County ending its eviction protec tions on December 31, 2022 and to avoid any potential confusion on the applicability of regulations regarding residential evictions related to the COVID-19 emergency, it is in the City’s best interest to repeal Urgency Ordinance No. 2020-04U as of December 31, 2022.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MONROVIA DOES ORDAIN AS FOLLOWS:

Section 1. Findings. The City Council finds that each fact set forth in the preceding recitals is true and correct and incorporated by reference.

Section 2. Repeal of Urgency Ordinance No. 2020-04U. The City Council hereby repeals Urgency Ordinance No. 2020-04U in its entirety as of December 31, 2022.

LEGALS

Section 3. Repayment. Tenants previously protected by Ur gency Ordinance No. 2020-04U that have been unable to pay rent due to financial impacts related to COVID-19 and have otherwise complied with the requirements of Urgency Ordinance No. 202004U shall have six months following the effective date of this Ordi nance to repay unpaid rent.

Section 4. Uncodified. This Ordinance shall not be codified.

Section 5. Severability. If any provision of this Ordinance is held invalid by a court of competent jurisdiction, such provision shall be considered a separate, distinct and independent provision and such holding shall not affect the validity and enforceability of the other provisions of this Ordinance.

Section 6. Effective Date. This Ordinance shall take effect thirty (30) days after passage.

Section 7. Certification. The City Clerk shall certify to the adoption of this Ordinance, and the City Clerk shall cause this Ordi nance or a summary thereof to be published as required by law.

Monrovia Old Town report: Gratitude and giving thanks

As we enter into November, the days are getting shorter. The air is turning crisp. Just yesterday, I vacillated between jacket on or off; soup or chili for dinner? I made some preliminary, non-perishable purchases in preparation for Thanksgiving dinner. Halloween has been packed away for another year and I am planning to enjoy one solid month with no holiday decorations.

Lo and behold, today it’s raining. This is our seasonal change, tapping us on the shoulder and it is beautiful; however short-lived it may be. Fall is sort of synony mous with thankful. We celebrate the change in weather as the heat recedes for a bit, leaving us with cool nights and the option to use our fireplaces. Our bodies register these changes, causing us to be more reflec tive as we head toward the holiday season.

Gratitude is impor tant. It helps us feel more positive emotions and deal with adversity. It is a key factor in living your best, most authentic life and has recently been the focus of quite a few health and wellbeing studies. These studies show that people who practice gratitude consis tently, report numerous benefits, such as lower blood pressure, stronger immune

systems, higher levels of positive emotions, more joy, acting with more generosity and compassion and feeling less lonely and/or isolated. Gratitude is so much more than a kitschy calligraphed throw pillow.

We never know how many seasons we will be given and there is always so much to do. If only we lived our lives with this realization so that we could better prioritize the things that truly matter. I wish this knowledge or wisdom, if you will, came to us sooner in life so that we could enjoy the true bounty of what we have been given. So that we could understand and know a deeper sense of gratitude sooner.

There are many ways you can invite the practice of gratitude into your life. You can start by spending a few minutes alone every morning to pray or meditate and give thanks for the blessings you have, one of which is a new day. You can keep a gratitude journal or add gratitude to your current journaling ritual. Make a practice of going around the table and saying something you are thankful for at dinner. Send bedtime “thank yous” out for people, experiences or anything you feel grateful for.

Some of the people closest to me know that I

spend 15-20 minutes every morning doing self-guided meditation that is geared toward gratitude. It is a lovely way to start the day and I truly feel the benefits of it every day.

Pretty soon another season will be gently tapping us on the shoulder. If we are here to receive it, what will we do with it? Take this time of Autumn to reflect on what you planted last spring. On your summer. On how you can do better and be better in the future. A precursor of sorts for our New Year’s resolutions, perhaps. Leaves are falling from the trees and humans need to take the time to shed off the old to welcome the new, as well. The autumn leaves falling symbolize letting go. Let go of the hurts you hold or the stress you carry and be thankful for each day we get to see.

I read once that abun dance and prosperity begin with gratitude and appre ciation. Accept your flaws. Live intentionally. We all have much to be thankful for. If you think you do not, finding your own intro spective balance is key. Be patient, graceful and forgiving. Of others, but also yourself! The grass isn’t always greener on the other side. I prefer the mantra that the grass is greener where you water it.

Besides its fabulous soundtrack, my favorite scene of the movie “Zorba the Greek” takes place after a young woman meets a violent death, and Zorba (Anthony Quinn) asks his boss, who is an intellectual: “Why do the

young die?” And his boss, almost in a whisper, replies: “I don’t know.”

Then, a very angry Zorba asks him: “What do all your damn books tell you? And if they don’t, then what the hell do they tell you?” And his boss answers calmly, “They tell me about the agony of men who can’t answer questions like yours.”

All deaths are tragic, but not all are equal; some are more tragic than others. And the death of those who strive to leave our world a better place (and succeed), are the most tragic and the hardest to accept.

Ralph Walker’s life was among them. May he rest in peace.

Construction and Demolition Fees

The administrative fees is $373.31 (Non-Refundable), and deposit of $21,150.00 (Refundable).

A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of this public works project unless currently registered and qualified to per form public work pursuant to Labor Code Section 1725.5. It is not a violation of Labor Code Section 1771.1 for an unregistered con tractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded.

This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

Contractors and Subcontractors must furnish electronic certified payroll records directly to the California Labor Commissioner (aka Division of Labor Standards Enforcement).

Notice is hereby given that, in accordance with Pasadena City Charter, Section 404, the City Council of the City of Pasadena will accept applications from qualified registered voters residing in City Council District 3 to fill a vacancy by appointment created by the passing of the Honorable Councilmember John J. Kennedy.

If the City discovers after the Contract’s award that the Contractor is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active, the City may cancel the award, reject the Bid, declare the Bid Bond as forfeited, keep the Bid Bond’s proceeds, and exercise any one or more of the remedies in the Contract Documents.

6. Subcontractors’ Licenses and Listing. At the time of the Bid Deadline and at all times during performance of the Work, each listed Subcontractor must possess a current and active California contractor license or licenses appropriate for the portion of the Work listed for such Subcontractor and shall hold all specialty certifications required for such Work. When the Bidder submits its Bid to the City, the Bidder must list each Subcontractor whom the Bidder must disclose under Public Contract Code Section 4104 (Subcontractor Listing Law), and the Bidder must provide all of the Subcontractor information that Section 4104 requires (name, the location (address) of the Subcontractor’s place of business, California Contractor license number, California Department of Industrial Relations contractor registration number, and portion of the Work). In addition, the City requires that the Bidder list the dollar value of each Subcontractor’s labor or services. The City’s disqualification of a Subcontractor does not disqualify a Bidder. However, prior to and as a condition to award of the Contract, the successful Bidder shall substitute a properly licensed and qualified Subcontractor— without an adjustment of the Bid Amount.

7. Permits, Inspections, Plan Checks, Governmental Approvals, Utility Fees and Similar Authorizations: The City has applied and paid for the following Governmental Approvals and Utility Fees: All other Governmental Approvals and Utility Fees shall be obtained and paid for by Contrac tor and will be reimbursed based on Contractor’s actual direct cost without markup. See Instructions to Bidders Paragraph 14, and General Conditions Paragraph 1.01 for definitions and Paragraph 1.03 for Contractor responsibilities.

8. Bid Forms and Bid Security: Each Bid must be made on the Bid Forms obtainable from the City’s Bidding website listed in the paragraph 1 above. Each Bid shall be accompanied by a cashier’s check or certified check drawn on a solvent bank, payable to “City of Glendale,” for an amount equal to ten percent (10%) of the total maximum amount of the Bid. Alternatively, a satisfactory corporate surety Bid Bond for an amount equal to ten percent (10%) of the total maximum amount of the Bid may accompany the Bid. Said security shall serve as a guarantee that the successful Bidder, within fourteen (14) calendar days after the City’s Notice of Award of the Contract, will enter into a valid contract with the City for said Work in accordance with the Contract Documents.

9. Bid Irrevocability. Bids shall remain open and valid for ninety (90) calendar days after the Bid Deadline.

10. Substitution of Securities. Pursuant to California Public Contract Code Section 22300, substitution of securities for withheld funds is permitted in accordance therewith.

11. Prevailing Wage Resolution. Bidders are hereby notified that in accordance with the provisions of the Labor Code of the State of California, the City Council of the City has ascertained and determined by Resolution No. 18,626 (as amended), the general prevailing rate of per diem wages of a similar character in the locality in which the Work is performed and the general prevailing rate for legal holiday and overtime Work for each craft or type of worker needed in the execution of agreements with the City. Said resolution is on file in the Office of the City Clerk and is hereby incorporated and made a part hereof by the same as though fully set forth herein. 12. Prevailing Wages. This Project is subject to the provisions of California Labor Code Section 1720. Contractor awarded this Contract and all Subcontractors of any tier shall not pay less than the minimum prevailing rate of per diem wages for each craft, classification, or type of worker needed to perform the Work. The Director of Industrial Relations of the State of California, pursuant to the California Labor Code, and the United States Secretary of Labor, pursuant to the Davis-Bacon Act, have determined the general prevailing rates of wages in the locality in which the Work is to be performed. The rates determined by the California Director of Industrial Relations are available online at www. dir.ca.gov/DLSR/PWD/. Davis-Bacon wage rates are available online at www.wdol.gov/. To the extent that there are any differences in the federal and state prevailing wage rates for similar classifications of labor, Contractor and its Subcontractors shall pay the highest wage rate.

13. California Department of Industrial Relations ― Public Works Contractor Registration.

Beginning July 1, 2014, under the Public Works Contractor Registration Law (California Senate Bill No. 854 - See Labor Code Section 1725.5), contractors must register and meet requirements using the online application https://efiling.dir.ca.gov/PWCR/ActionServlet?actio n=displayPWCRegistrationForm before bidding on public works contracts in California. The application also provides agencies that administer public works programs with a searchable database of qualified contractors. Application and renewal are completed online with a nonrefundable fee of $300. General Scope of Work: Contractor shall furnish labor, materials, equipment, services, and specialized skills to perform work involved in the Project. 4. Acceptance or Rejection of Bids. The City reserves the right to reject any and all Bids, to award all or any individual part/item of the Bid, and to waive any informalities, irregularities or technical defects in such Bids and determine the lowest responsible Bidder, whichever may be in the best interests of the City. No late Bids will be accepted, nor will any oral, facsimile or electronic Bids be accepted by the City.

5. Contractor License. At the time of the Bid Deadline and at all times during performance of the Work, including full completion of all corrective work dur ing the Correction Period, the Contractor must possess a California contractor license or licenses, current and active, of the classification required for the Work, in accordance with the provisions of Chapter 9, Division 3, Section 7000 et seq. of the Business and Professions Code. In compliance with Public Contract Code Section 3300, the City has determined that the Bidder must possess the following license(s):

• a. Pursuant to Section 3300, of the Public Contract Code, the classification of the bidder’s Contractor’s License shall be “Class A and C-10”. Failure of a bidder to obtain adequate licensing at the time the contract is awarded shall constitute a failure to execute the Contract and shall result in the forfeiture of the Bidder’s Bond.

The successful Bidder will not receive a Contract award if the successful Bidder is unli censed, does not have all of the required licenses, or one or more of the licenses are not current and active. If the City discovers after the Contract’s award that the Contractor is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active, the City may cancel the award, reject the Bid, declare the Bid Bond as forfeited, keep the Bid Bond’s proceeds, and exercise any one or more of the remedies in the Contract Documents.

6. Subcontractors’ Licenses and Listing. At the time of the Bid Deadline and at all times during performance of the Work, each listed Subcontractor must possess a current and active California contractor license or licenses appropriate for the portion of the Work listed for such Subcontractor and shall hold all specialty certifications required for such Work. When the Bidder submits its Bid to the City, the Bidder must list each Subcontractor whom the Bidder must disclose under Public Contract Code Section 4104 (Subcontractor Listing Law), and the Bidder must provide all of the Subcontractor information that Section 4104 requires (name, the location (address) of the Subcontractor’s place of business, California Contractor license number, California Department of Industrial Relations contractor registration number, and portion of the Work). In addition, the City requires that the Bidder list the dollar value of each Subcontractor’s labor or services. The City’s disqualification of a Subcontractor does not disqualify a Bidder. However, prior to and as a condition to award of the Contract, the successful Bidder shall substitute a properly licensed and qualified Subcontractor— without an adjustment of the Bid Amount.

7. Permits, Inspections, Plan Checks, Governmental Approvals, Utility Fees and Similar Authorizations: All Governmental Approvals and Utility Fees shall be obtained and paid for by Contractor and will be reimbursed based on Contractor’s actual direct cost without markup. See Instruc tions to Bidders Paragraph 14, and General Conditions Paragraph 1.01 for definitions and Paragraph 1.03 for Contractor responsibilities.

8. Bid Forms and Bid Security: Each Bid must be made on the Bid Forms obtainable from the City’s Bidding website listed in the paragraph 1 above. Each Bid shall be accompanied by a cashier’s check or certified check drawn on a solvent bank, payable to “City of Glendale,” for an amount equal to ten percent (10%) of the total maximum amount of the Bid. Alternatively, a satisfactory corporate surety Bid Bond for an amount equal to ten percent (10%) of the total maximum amount of the Bid may accompany the Bid. Said security shall serve as a guarantee that the successful Bidder, within fourteen (14) calendar days after the City’s Notice of Award of the Contract, will enter into a valid contract with the City for said Work in accordance with the Contract Documents.

9. Bid Irrevocability. Bids shall remain open and valid for ninety (90) calendar days after the Bid Deadline.

10. Substitution of Securities. Pursuant to California Public Contract Code Section 22300, substitution of securities for withheld funds is permitted in accordance therewith.

11. Prevailing Wage Resolution. Bidders are hereby notified that in accordance with the provisions of the Labor Code of the State of California, the City Council of the City has ascertained and determined by Resolution No. 18,626 (as amended), the general prevailing rate of per diem wages of a similar character in the locality in which the Work is performed and the general prevailing rate for legal holiday and overtime Work for each craft or type of worker needed in the execution of agreements with the City. Said resolution is on file in the Office of the City Clerk and is hereby incorporated and made a part hereof by the same as though fully set forth herein. Copies of said resolution may be obtained at the Office of the City Clerk.

12. Prevailing Wages. This Project is subject to the provisions of California Labor Code Section 1720. Contractor awarded this Contract and all Subcontractors of any tier shall not pay less than the minimum prevailing rate of per diem wages for each craft, classification, or type of worker needed to perform the Work. The Director of Industrial Relations of the State of California, pursuant to the California Labor Code, and the United States Secretary of Labor, pursuant to the Davis-Bacon Act, have determined the general prevailing rates of wages in the locality in which the Work is to be performed. OC declares health emergency due to rapid rise of RSV, COVID, flu

Citing a record number of pediatric hospital izations and emergen cy room visits, Orange County was under a health emergency declaration Tuesday, with the county health officer pointing to a sharp rise in cases of the respiratory infection RSV, combined with COVID-19 and flu.

Cases of RSV, or respira tory syncytial virus, have been on the rise nationally, exacerbating a health system still coping with the COVID pandemic and an earlier-thanusual onset of flu season.

"While there isn't a vaccine against RSV, we want OC residents to know there are many ways to protect children and at-risk indi viduals. Following preventive measures, including remain ing up to date with other vaccinations such as flu and COVID-19, can help reduce the severity of disease and can help reduce the burden on hospitals this fall and winter," Orange County Health Officer Dr. Regina Chinsio-Kwong

said in a statement. "Our best shot at protecting ourselves and our children from respira tory illnesses continues to be the same things we practiced throughout the pandemic including the use of masks when indoors around others and staying home when you are sick."

In addition to a countywide declaration of health emer gency, a proclamation of local emergency was also issued, allowing the county to access state and federal resources to address the rise in virus infec tions.

The Orange County Health Care Agency Emergency Medical Services is monitoring regional hospital capacity, and officials said they are working with hospitals experienc ing particularly high patient volumes in pediatric units and emergency departments.

RSV is a relatively common respiratory virus. According to the U.S. Centers for Disease Control and Prevention, most patients recover in a week or two, but it can become a

serious illness for infants and older adults. CDC officials have been tracking higherthan-usual infection numbers, reporting that some regions of the country are already nearing "seasonal peak levels" of hospi talizations and ER visits due to RSV.

The Orange County Health Care Agency recommended that parents seek medical

attention immediately for children showing warning signs, which may include difficulty breathing, signs of dehydration, persistent or high fever, or looking or acting very sick.

The Health Care Agency also offered a list of preventive actions:

-- Do not go to school or work when you are symptom

atic.

-- Avoid close contact such as kissing, hugging, and sharing cups or eating utensils with people who are sick, and when you are sick.

-- Cover your coughs and sneezes with a tissue or your upper shirt sleeve, not your hands. Mask when indoors or large group settings.

-- Wash your hands frequently, especially before and after eating and using the bathroom.

-- Get flu shots and COVID-19 vaccines to prevent complications from these viral illnesses.

In neighboring Los Angeles County, Public Health Director Barbara Ferrer said last week the county was seeing a higher-than-usual number of RSV cases, and health officials were monitoring the situation. Flu cases have also been rising earlier than usual, Ferrer said, coinciding with the recent lifting of many COVID-era prevention requirements, such as mask-wearing, which also served to reduce transmission

of flu and other viruses during the pandemic.

Los Angeles County Supervisors Kathryn Barger and Janice Hahn introduced a motion -- set to be heard during Tuesday's board meeting -- calling on the county to develop a public-outreach campaign to provide parents with information about RSV and preventative measures and encourage childhood vaccina tions. The motion also calls for a report from health officials on RSV case numbers and hospitalizations in the county.

Their motion contends that the positivity rate for RSV has nearly doubled in the past three weeks in the county, "and many hospitals are beginning to report capacity strains."

No exact figures were released, but health offi cials were expected to give an update to the Board of Supervisors Tuesday.

Pasadena hosting 4th annual Pasadena Adaptive Sports Festival on Nov. 5

The City of Pasadena in coordination with Triumph Founda tion, a nonprofit organiza tion working to improve the lives of people living with disabilities, will host the 4th annual Pasadena Adaptive Sports Festival on Saturday, Nov. 5, from 9 a.m. to 4 p.m., at Brookside Park, 360 N. Arroyo Blvd.

The Adaptive Sports Festival is a free, fun-filled day of sports and fitness activities for people of all abilities. Activities offered include hand cycling, wheel chair rugby, pickleball, disc golf, aquatics, tennis, boccia, adaptive archery, disc golf, boxing, power soccer, a resource fair, and more.

This event is meant to introduce the general public to adaptive sports, showcases individuals with disabilities and helps foster a more inclusive commu nity.

"The City of Pasadena is excited to partner with Triumph Foundation to offer this fun and exciting event,” said Brenda HarveyWilliams, director of Pasa dena’s Parks, Recreation and Community Services Department. “This is the fourth of what we hope will be many Pasadena-based events promoting acces sible and inclusive sports and fitness opportunities."

“In 2021, the festival attracted close to a thousand participants and really made an impact on everyone who attended. We are so thankful for our partnership with the City of Pasadena,” said Andrew Skinner, who founded Triumph Founda tion in 2008, four years after suffering a spinal cord injury in a snowboarding accident. “Events like this give people with disabilities a chance to push the limits of their ability, play games

with friends and family on a level playing ground, and enhance their quality of life through the benefit of exercise, sports and fitness.”
