Origin: Citizens Subject: Gambling and American Indian issues Legalizes sports betting at American Indian gaming casinos and licensed racetracks in California. Sports betting is defined as wagering on the results of professional, college, or amateur sport and athletic events. This does not include high school sports or California college teams. A minimum age to partici pate is 21. Sports betting is legal in 30 other states.

Additionally, this measure would legalize roulette and dice games at tribal casinos.

A “yes” vote supports this ballot initiative to (i) legalize sports betting at American Indian gaming casinos and licensed race tracks in California; (ii) tax profits derived from sports betting at racetracks at 10%; and (iii) legalize roulette and dice games, such as craps, at tribal casinos.

The “Yes on 26, No on 27Coalition for Safe, Responsi ble Gaming” is a PAC leading the campaign in support of the ballot initiative. Riverside County’s jobless rate returns to 4 percent

OC workers’ comp attorney gets 4 years in prison for fraud

Losses in construction, hospitality and other sectors were offset by gains elsewhere in the regional economy, nudging Riverside County’s unem ployment rate back down to 4% last month, according to figures released last week by the California Employ ment Development Depart ment.

The jobless rate in September, based on prelim inary EDD estimates, was three-tenths of a percentage point lower than in August.

According to figures, the September rate, which matched the rates of June and July, was almost 2.5 percentage points lower than the year-ago level, when countywide unem ployment stood at 6.4%, as the statewide coronavirus public health lockdowns were gradually eased.

An estimated 46,100 county residents were recorded as out of work in September, and 1,120,500 were employed, according to EDD.

Coachella had the highest unemployment rate county wide last month at 10.8%,

followed by Cherry Valley at 7.4%, Mecca at 6.4%, Rancho Mirage at 6%, and Indio at 5.8%.

The combined unem ployment rate for River side and San Bernardino counties in September was 3.9%, down from 4.3% in August, according to figures.

Bi-county data indi cated payrolls expanded by the widest margin in the public sector, which added 4,800 positions as teachers and support personnel at grade schools throughout the region returned to work after the summer hiatus.

Additional gains were

documented in the trans portation — mainly ware housing — health services and agricultural sectors, which altogether grew by 3,200 jobs. Miscellaneous unclassified industries also expanded by 1,600, the EDD said.

Officials said that payrolls declined in the construction, financial services, hospitality, infor mation technology and manufacturing sectors, which shed an aggregate of 5,300 positions.

Data indicated that the statewide non-seasonallyadjusted unemployment rate in September was 3.7%.

Aworkers’ compensa tion applicant attorney from Orange County has been sentenced to four years in state prison and ordered to pay over $700,000 in restitution to seventeen different insurance carriers for participating in two separate insurance fraud referral schemes.

Jon Woods, 61, of Cypress, was convicted in August of 37 felony counts of insurance fraud along with an aggravated white-collar crime sentencing enhance ment, the Orange County District Attorney’s Office announced Friday.

District Attorney Todd Spitzer said his office is “committed to ensuring a level playing field for business owners and insur ance companies. By prosecut ing bad actors and recovering fraudulently paid funds, we are helping business owners remain competitive and protecting consumers from increased premiums.”

Woods was one of 10 similar attorneys charged in June 2017 as a result of a complex insurance fraud investigation. Charges were also filed against Carlos Arguello, Fermin Iglesias, and Edgar Gonzalez, along with four chiropractors, and several employees working for Arguello.

Arguello, his employees and Iglesias have all pleaded guilty in their Orange County Superior Court cases. Arguello and Iglesias were also charged in federal court for violating federal laws related to their scheme with medical providers, result

ing in a four-year federal sentence for Arguello and a five-year federal prison sentence for Iglesias, accord ing to the Orange County DA’s Office.

Prosecutors said that from 2011-16, Woods paid Arguello for workers’ compensation clients procured through Arguello’s attorney market ing business, Centro Legal International, and later Tu Justicia Legal, as well as Centro de Abogados.

Targeting mainly Hispanic neighborhoods across the state, Arguello’s business handed out more than four million flyers per month to attract prospective clients for Arguello’s scheme. The flyers contained differ ent toll-free numbers that all rang to a call center located in Tijuana, Mexico, where operators served as a sales force, dispatching a “signup” representative from Arguello’s network to the caller’s home within 24-48 hours to sign legal paper work to hire the law firm and start the injury claim.

In addition to paying a monthly fee for obtaining clients, Woods also sent records subpoena work to companies controlled and operated by Arguello, in an amount equal to the number of clients he received from Arguello, prosecutors said. These companies billed the workers’ compensa tion insurance policy of the worker’s employer for all the records subpoena services they provided for Woods because the law requires that cost of an injured worker proving his/

her workers’ compensa tion claim must be paid by the employer’s workers’ compensation insurance — including expense for obtaining records through subpoenas ordered by the injured worker’s lawyer.

Arguello’s scheme required that all clients procured through Arguello’s marketing would be sent to clinics chosen by his orga nization, prosecutors said.

Like the lawyers partici pating in his scheme, a group of doctors or chiro practors were also paying Arguello for workers’ compensation patients, they added.

Woods was also found guilty of participating in a second fraud scheme in which he referred addi tional records subpoena work to USA Photocopy, a subpoena company owned by Edgar Gonzalez.

Gonzalez paid various business expenses for Woods’ law firm as a bribe to receive the firm’s records subpoena work, according to the DA’s Office.

Arguello and Gonzalez’s records subpoena compa nies had offshore offices in El Salvador, where employ ees reviewed subpoenaed records to identify more businesses that they can serve with more records subpoenas on Woods’ behalf.

These companies billed workers’ compensation insurance companies for each individual subpoena.

Senior Deputy District Attorney Noor Hasan of the Insurance Fraud unit pros ecuted the case.

Riverside County’s crop values decline slightly in 2021

RiversideCounty’s agricultural sector contracted last year, declining 1% in value, though some commodities remained robust, according to a report furnished to the Board of Supervisors Tuesday.

In a 5-0 vote without comment, the board received and filed Agricultural Commissioner Ruben Arroyo’s “2021 Agricultural Produc tion Report,” the highlight of which was the $12.32 million slide in aggregate crop values.

The agricultural base countywide was valued at $1.40 billion last year, compared to $1.42 billion in 2020, which boasted the greatest commodity values of the last five years.

“Using historical economic values, the total agricultural contribution to Riverside County’s economy is approxi mately $3.9 billion,” Arroyo said.

He pointed out tree and vine crops, vegetable crops and field and seed stocks declined year-to-year.

The best performer in percentage terms was nursery stock, which includes Christ mas trees, ornamental shrubs, cut flowers and plants. The countywide value of nursery stock increased 8%, and total production amounted to $267.54 million, according to the report.

Despite their decline in value, vegetables continued to remain the dominant crop, netting $324.89 million in 2021, as opposed to $334.43

million in 2020. Broccoli, lettuce, artichokes and corn held the highest values.

Though Riverside County, particularly the western half, has its roots in citrus produc tion, the total value for citrus in 2021 was only $127.47 million, ranking behind trees and vines, milk and livestock and poultry.

The 2020 value of citrus crops was $126.56 million, according to the report.

Total land set aside for

citrus cultivation last year was roughly 19,400 acres. Among the leading citrus products were lemons, mandarins and ruby grapefruit.

The smallest crop countywide was aquaculture, valued at $4.87 million in 2021, compared to $4.59 million the year before.

Catfish and Tilapia were the main farm-raised fish in that category within Riverside County.

LA controller: City regains financial footing after pandemic but caution urged

Los Angeles has regained its financial footing since the worst of the pandemic, but economic conditions remain unstable, L.A. Controller Ron Galperin said Wednesday.

In the just-issued 2022 Preliminary Financial Report, a snapshot of the city’s balance sheet for the fiscal year that ended on June 30, Galperin found that while city revenues were up from the prior year and had mostly rebounded to pre-pandemic levels, a recession could be looming.

“We are still seeing record high levels of inflation and the threat of a possible recession in the near future looms large,” he said in a statement. “To ensure the city can continue providing neighborhood services and equity-focused program ming, Los Angeles should keep its reserves strong and exercise financial caution in case an economic downturn comes our way.”

Galperin warned that economic conditions remain unstable as cyclical COVID-19 trends, rising inflation, supply chain disruptions and inter national conflicts continue to

impact global markets. Urging fiscal restraint, Galperin advised maintaining L.A.’s rainy day fund to insulate against future economic downturns.

According to the report, total revenues in budgeted funds were $10.2 billion last year, a 10.4% increase over the prior year and 12.2% more than before the pandemic. This figure does not include federal funds received as part of the American Rescue Plan Act.

Total expenditures were $9.4 billion, 5.4% higher than the year prior as spending increased across nearly every category, the report says.

The city’s Reserve Fund balance in July 2022 was the second highest it has been over the last 10 years at $601.7 million, 8.1% of the General Fund.

Meanwhile, retirement costs increased slightly to $1.5 billion, 15% of overall spending.

In terms of the economic outlook, although the last fiscal year was solid thanks to an uptick in revenue and federal assistance, numerous economic challenges remain and difficult budgeting deci

sions could arise next year. While it is too soon to say that a recession is certain, high inflation and an unstable global economy put the city’s future financial health at risk.

To proactively address these issues, Galperin urged Los Angeles leaders to exercise caution when considering new spending

requests. While most revenue streams have recovered to pre-pandemic levels, now is not the time to overspend, he said.

Before approving new spending requests, the city must first evaluate its ability to maintain neighborhood services and equity-related programming, he said.

This proposed law would create the “Division of Online Sports Betting Control within the Department of Justice.” Additionally, would estab lish the California Online Sports Betting Trust Fund where revenue, after deduct ing regulatory costs, would be allocated to “California Solutions to Homelessness and Mental Health Support Account” (85%) for perma nent and interim housing and 15% to the “Tribal Economic Development Account,” which would be established by the initiative to suppli ment Indian tribes for expanding tribal government, public health, education, infrastructure, and economic development.

A “yes” vote supports legalizing online and mobile sports betting for persons 21 years of age or older, establishing regulations for the mobile sports betting industry, imposing a 10% tax on sports betting revenues and licensing fees, and allo cating tax revenue to an account for homelessness programs and an account for tribes not operating sports betting.

Californians for Solutions to Homelessness and Mental Health Support is leading the support campaign. Donors include Betfair Interactive US LLC (Fanduel Sportsbook), Crown Gaming, Inc. (Draftk ings), BetMGM LLC, FBG Enterprises LLC and Penn

Would require a minimal source of annual funding for public schools, including charter schools, to fund art and music programs. The annual minimum amount established by the law would be equal to, at minimum, 1% of the total state and local revenues that local educa tion agencies received under Proposition 98. Prop 98 amended the state constitu tion to require a minimum percentage of state budget spent toward K-14 (two year community college).

A “yes” vote supports this ballot initiative to:

1. require an annual source of funding for K-12 public schools toward arts and music education equal to, at minimum, 1% of the total state and local revenues that local education agencies receive under Proposition 98;

2. distribute a portion of the additional funding based on a local education agency’s share of economically disad vantaged students; and

3. require schools with 500 or more students to use 80% of the funding for employing teachers and 20% to training and materials.

The “Vote Arts and Minds” campaign is lead by “Yes on 28 - Californians for Arts and Music in Schools.”

The campaign reported receiving over $9.3 million in contributions according to its latest campaign finance filings.

A “no” vote opposes all three of the above.

There are no formal opponents to this ballot.

Proposition 29 Requires On-Site Licensed Medical Professional at Kidney Dialysis Clinics and Establishes Other State Requirements. Initiative Statute. (PDF)

Subject: Healthcare Prohibits clinics from refusing to care for a patient based on the patient’s form of payment, whether the patient is an individual payer, the patient’s health insurer, Medi-Cal, Medicaid, or Medicare. Addition ally, enacts staffing require ments, reporting require ments, ownership disclosure, and closing requirements for chronic dialysis clinics. This includes

1. requiring clinics to have at least one physician, nurse practitioner, or physi cian assistant - with at least six months of experience with end-stage renal disease care - onsite during patient treatments;

2. requiring clinics to report dialysis-related infections to the California Department of Public Health (CDPH);

3. requiring clinics to provide patients with a list of physicians with an owner ship interest of 5% or more in the clinic;

4. requiring clinics to provide the CDPH with a list of persons with ownership interest of 5% or more in the clinic; and

5. requiring clinics to obtain the CDPH’s written consent before closing or substantially reducing services to patients.

A “yes” vote supports this ballot initiative to require dialysis clinics to have at least one physician, nurse practitioner, or physician assistant while patients are being treated; report data on dialysis-related infections; and not discriminate against

patients based on the source of payment for care.

The “Kidney Patients Deserve Better” campaign is lead by “Californians for Kidney Dialysis Patient Protection.” It is fully supported by SEIU United Healthcare Workers West.

A “no” vote opposes this ballot initiative to require dialysis clinics to have at least one physician, nurse practitioner, or physician assistant while patients are being treated; report data on dialysis-related infections; and not discriminate against patients based on the source of payment for care.

Opposition is lead by “Stop Yet Another Dangerous Dialysis Proposition.” The initiative is also opposed by the Republican Party of Cali fornia, California Chamber of Commerce, and California Medical Association. DaVita, Inc., Fresenius Medical Care, U.S. Renal Care Inc., Satel lite Healthcare, Inc., Dialysis Clinic Inc., Media ed.

Proposition 30 Provides Funding for Programs to Reduce Air Pollution and Prevent Wildfires by Increasing Tax on Personal Income Over $2 Million. Initiative Statute. (PDF)

Local political legend Roz Wyman, who helped lure Dodgers to LA, dies at 92

Rosalind “Roz” Wiener Wyman, who was the youngest person ever elected to the Los Angeles City Council and is credited with playing a key role in luring the Dodgers to Los Angeles from Brooklyn, passed away Wednesday, Oct. 26, at the age of 92.

“I’m heartbroken at the passing of Roz Wyman, one of my friends and someone who made a real difference for Los Angeles and for Democratic politics,” Sen. Dianne Feinstein, D-Cali fornia, said in a statement.

“... Roz was a real force of nature whenever she set her mind to something. Whether it was politics or dragging a baseball team 3,000 miles across the country, Roz had a passion that was infectious and she really got things done.”

Her family announced her passing in a statement to the Los Angeles Times.

Earlier this month, on Wyman’s 92nd birthday, the Los Angeles County Board of Supervisors voted to name the fountain overlook in Grand Park the “Roz Wyman Court.” It also agreed to install a plaque at the Music Center to honor her.

In 1953, at 22 years old, Wyman won a seat at the Los Angeles City Council, becoming the youngest person ever elected to serve on the council and only the second woman.

On the council, Wyman worked to lure the Dodgers to move to Los Angeles from Brooklyn, and the Lakers to move from Minneapolis.

“If you bleed Dodger blue, you can credit that love to Roz as she helped bring the Dodgers to Los Angeles,” Supervisor Hilda Solis said in a statement after the board’s Oct. 4 vote. “She was also behind the idea of connecting Los Angeles City Hall up to Grand Avenue through a park where all Angelenos could gather. That idea took 60 years to become a reality, but that is why Roz is a visionary whose dreams changed both this city and county.”

Wyman was also a strong advocate for the arts, advo cating for the construction of the Music Center in the 1960s. She was a member of the National Endowment for the Arts, and served two terms as president of the Los Angeles County

Arts Commission and the Los Angeles City Cultural Affairs Commission.

House Speaker Nancy Pelosi, D-San Fran cisco, issued a statement Thursday calling Wyman “a visionary leader of Los Angeles and godmother to the Democratic Party.”

“Roz, then-mayor Dianne Feinstein and I had the privilege of leading the 1984 Democratic National Convention in my hometown of San Francisco as our party nominated the first woman ever for Vice President of the United States.

“Generations of activ ists and elected offi cials respected Roz as a godmother of the Demo cratic Party because she nurtured young people, mentored candidates and helped elect dozens of women to office,” Pelosi said. “She took special pride in electing her dear friend, Dianne Feinstein, to the Senate. Roz had words of advice and wise counsel for everyone, from presidents to precinct workers. She cared deeply about our Democracy, about women’s equality, and about opening parks, arts and public service to everyone.”

Wyman was honored last month at Dodger Stadium, receiving the inaugural Tommy Lasorda I Bleed Dodger Blue Award, recognizing a member of the Los Angeles community that embodies the passion,

enthusiasm and love for the Dodgers Lasorda possessed.

The award will annually be presented on or around the anniversary of Lasorda’s birth.

“The name Tommy Lasorda is synonymous with the Dodgers, so it’s only fitting that we intro duce a new award which encompasses his incredible passion for the organiza tion,” Dodger President and CEO Stan Kasten said at the time. “For the inaugural award, we have selected Roz Wyman because, without her, there might never have been a Los Angeles Dodgers baseball team.

“Her persistent pursuit and dedication to ensuring the team came to Los Angeles embodies the concept of the Tommy Lasorda I Bleed Dodger Blue Award to a tee.”

Wyman called being part of Lasorda’s legacy “a great honor.”

“He was a very dear friend of mine and I’ll always remember him for telling me `If it wasn’t for Roz Wyman, I would be a shoe salesman,”’ said Wyman, who was a season ticket holder at Dodger Stadium since it opened in 1962.

Wyman also has a plaque honoring her at the Los Angeles Memorial Coliseum’s Court of Honor. The Dodgers played at the Coliseum from 1958-61. Wyman also persuaded John F. Kennedy to give his accep tance speech for the 1960

Democratic presidential nomination at the Coliseum. In the speech, Kennedy used the term “The New Frontier” for the first time. It would become a label for his administration’s domestic and foreign programs.

County Supervisor Janice Hahn asked Thursday that the Coliseum’s torch be lit in Wyman’s honor.

“I grew up admiring Roz,” Hahn said. “She was one of the few women in Los Angeles politics and I saw, up close, her work with my father to bring the Dodgers to Los Angeles. She was a force to be reckoned with, which is why it is appropriate that she is now enshrined in the Los Angeles Memorial Coliseum Court of Honor. This city lost a great woman and I am sure the entire Dodgers organization is mourning the loss of their number one fan.”

Wyman remained on the council until 1965 when she was defeated in a re-elec

tion bid by Ed Edelman. She ran for the council again a decade later but was defeated by Zev Yaroslavsky.

But Wyman remained a powerful figure in local politics.

Los Angeles City Attorney Mike Feuer said Thursday that Wyman “continued to have a tremendous impact on the political scene here and across the country.”

“Roz’s house was the go-to place for leaders from throughout the United States when they were trying to generate support for their political campaigns,” Feuer said. “... I was very privi leged to be Roz’s friend, to get her counsel to have her support.”

Gov. Gavin Newsom called her a “trailblazing icon who inspired genera tions of women in politics to pursue their dreams.”

“Roz Wyman’s passion, perseverance and leader ship live on as an inspiring example to people every

where, and the countless ways she enriched Califor nia will never be forgotten,” Newsom said in a statement.

“Our thoughts are with her family and many friends as they morn this great loss.”

Sen. Alex Padilla, D-California, added: “The daughter of an immigrant from Russia, Roz didn’t just embody the spirit of the American Dream, she carved out a path for future generations to achieve it, too. And because of her, young people, women, the children of immigrants, and countless Californians with hopes of making a difference in our country saw engaging with our government more acces sible. Because of Roz Wyman’s example, achiev ing change became more within reach.”

Wyman is survived by three children — Betty, Robert and Brad — and three grandchildren. Her husband, attorney Eugene Wyman, died in 1973.

Record number attend San Bernardino County’s children’s network conference

Children’s Network in San Bernardino County celebrated its first in-person conference since the pandemic on Sept. 14. The sold-out conference had a record number of more than 400 in attendance.

The one-day confer ence is one of the Inland Empire’s premier training events for professionals in the fields of social work, mental health, juvenile justice, child development, child welfare and nursing.

Two dynamic speakers who used life experi ences to address the needs of youth in the foster

care system and those with disabilities shared their stories. Workshops focused on providing better care and support to the children and families in the county.

The first keynote speaker, Regina Louise, lived in many foster homes, group homes and facilities. Louise is an accomplished author of the memoir, Somebody’s Someone, and has educated over 3.5 million people across the nation about the present state of youth in foster care. She is a child welfare executive coach and a trainer of cultural

humility and traumainformed care practices.

The second speaker, Gabriel Uribe, is the director of commu nity health at the Inland Empire Health Plan (IEHP) and professor of social work policy at La Sierra University. Uribe is a social service professional committed to the delivery of accessible health care for low-income and under represented communities.

He is president of the Inland Empire Disabili ties Collaborative (IEDC) which resources disability service professionals.

Project Roomkey demobilization is on schedule

Two of the three remaining sites for Project Roomkey -- a housing program in Los Angeles created during the pandemic -- have exited all participants as the program winds down, officials with the Los Angeles Homeless Services Authority told the City Council’s Homeless ness and Poverty Committee Thursday.

The remaining residents at Highland Gardens in Hollywood and Airtel Plaza Hotel in Van Nuys -- both of which will close to Project Roomkey participants at the end of the month -- have exited to permanent or interim housing. A few have been placed into hospitals or long-term care facilities, Nathaniel VerGow, deputy chief of systems at LAHSA, told the committee.

That leaves the Grand Hotel downtown as the only remaining Project Roomkey location. There are 291 participants living at the Grand Hotel, which VerGow said is ahead of schedule in demobilizing. It is sched uled to shutter at the end of January.

During the demobiliza

tion period, 29 people at Highland Gardens were exited into permanent housing and 17 into interim housing. At the Airtel Plaza Hotel, 26 were placed into permanent housing and 128 into interim housing. According to VerGow, the large number of interim housing placements at Airtel was consistent with the demobilization plan.

So far at the Grand Hotel, 30 participants have exited into permanent housing and 63 are in interim housing.

VerGow told the committee that LAHSA was focused on increasing the flow of Project Roomkey participants into perma nent housing, with several housing placement events taking place at the Grand Hotel.

LAHSA has been sharing data on a weekly basis with council offices that have Project Roomkey sites, as well as the mayor’s office on a biweekly basis, according to VerGow.

Project Roomkey was established during the pandemic to provide tempo rary emergency housing. It was funded by both the city

and the county, but the U.S. Federal Emergency Manage ment Agency provided full reimbursements through July. There were 37 hotels and motels contracted through the program at its height, with 4,000 rooms available.

The program provided shelter for more than 10,200 people experiencing home lessness over the past two years. Residents received meals, medical screenings and security services. More than 4,100 Project Roomkey participants found perma nent housing as of March, according to LAHSA.

In August, the City Council authorized $2.9 million in additional funding for the demobiliza tion of Project Roomkey, after previously authoriz ing $2.5 million to provide housing navigation services to program participants.

Doug Guthrie, president and CEO of the Housing Authority of the city of Los Angeles, told the commit tee in August that it’s been taking between 45 and 60 days for a voucher to be approved once a recipient finds a matching residence,

this and I want folks to know we do... We mean business.”

Newsom cautioned, however, that, “We can’t change decades of neglect overnight.”

Newsom said he visited Orange County because “I believe success leaves clues.”

He praised state Sen. Josh Newman, D-Fullerton, for leading the way for the new center.

Newsom praised the county for its efforts to send out vans of social workers to meet with transients to aid them.

“That’s a lazy mindset,” Newsom said. “That’s why I love these vans and data platform we’ve got..”

Newsom said a volunteer or staffer might see a chroni cally homeless person every night for years, but then one night “they’re finally ready” to accept help.

Assemblywoman Sharon Quirk-Silva, D-Fullerton, was also praised for her work on the issue over the years.

D-Santa Ana, said it was a “great day for Orange County, a testament to innovation, to leadership, to compassion and collaboration.”

Umberg praised Newman’s persistence on the issue.

Newman said, “Today’s ribbon-cutting builds on five years” of efforts to create “an innovative and promising model to address the root causes of homelessness -using data-centric, evidence approaches.”

Thursday hailed a new center in Fuller ton that will aim to address the root causes of homeless ness.

The Homeless Outreach and Proactive Engagement, or HOPE, Center will be a “unified command center” for social workers and local law enforcement to work together on helping tran sients get off the streets. The North Orange County Public

Safety Collaborative, which comprises officials from 11 cities, has received $35.8 million in state funding to address homelessness in a variety ways.

“You’ve seen a 23% reduction in your point-intime count (of homeless) in this county -- one of the best-performing counties in the state, and it’s because of the leaders here today,” Newsom said at a ribboncutting for the new center.

“Let’s keep up the good work.”

Newsom said the issue of homelessness in the state has suffered from years of neglect, but that is changing.

“What’s happening as it relates to homelessness in California is unaccept able,” Newsom said. “What’s persisted in this state for decades is unacceptable. One has to take responsibility and ownership. We need to own

In the spring of 2017, Newman said he met with multiple area police chiefs and city managers on ways homelessness could be addressed.

Out of that meeting, the group worked on a “regional, multi-city collaborative” approach to the issue, using data.

“And we’re doing it without arrests,” Newman said. “We are making progress without having to arrest our way out of it, and that’s a change that makes a huge difference.”

Judge denies request for diversion for man charged in Dave Chappelle attack

Ajudge Thursday rejected the defense’s request for a diver sion program that could have eventually resulted in the dismissal of charges against the man accused of attacking comedian Dave Chappelle on stage at the Hollywood Bowl in May.

Superior Court Judge Armenui Amy Ashvanian cited a string of prior arrests of Isaiah Lee and his conduct after his arrest for the alleged May 3 attack on Chappelle, ruling that the 24-year-old defendant is “not a suitable candidate for judicial diversion.”

Lee’s attorney, Alexan der Kirkpatrick, told the judge that his client has been homeless since he was about 18 and has struggled with mental illness, and called Lee’s actions “rash” and “impulsive.” He noted that he did not want to “minimize the crime” and that Lee would remain in custody even if he was granted diversion because he is awaiting trial sepa rately in a case in which he is charged with trying to kill his roommate.

Deputy City Attorney Patricia Rosman objected to the defense’s request for the diversion program, saying that Lee “made a very conscious decision to do what he did” and that “this is not the type of person or the type of situ ation” for which that type of diversion program is intended.

Lee is charged with one misdemeanor count each of battery, possession of a weapon with intent to

assault, unauthorized access to the stage area during a performance and commis sion of an act that delays an event or interferes with a performer.

Authorities said Lee rushed the stage at the Bowl around 10:45 p.m. May 3 while Chappelle was performing as part of the Netflix Is A Joke Festival.

Online video showed Chap pelle being thrown to the

ground by the suspect, prompting the venue’s security staff and Chap pelle’s crew to rush on stage to subdue the assailant.

Among those running to protect Chappelle was actor/ comedian Jamie Foxx.

The suspect tried to scramble backstage after the attack, but he was force fully subdued by security.

Subsequent footage showed the bloodied assailant with

facial bruises and a seem ingly broken arm being placed on a gurney and taken away in an ambulance.

Chappelle was not injured and he continued to perform.

Chappelle, during a subsequent performance at the Comedy Store in Holly wood, told the crowd he was able to speak to the attacker before he was taken away by paramedics. The comedian

said the suspect claimed to have carried out the attack to raise awareness of the plight of his grandmother in Brooklyn, who was displaced from her home due to “gentrification.”

But Lee told the New York Post in a jailhouse interview that he was trig gered by the comedian’s jokes about transgender and homeless people.

Lee remains behind bars

while awaiting a pretrial hearing Nov. 7.

He is due back in a downtown Los Angeles courtroom next Tuesday in the separate case, in which he was ordered Sept. 16 to stand trial on an attempted murder charge for allegedly stabbing his roommate at a transitional housing apart ment last December.

Lee was charged with the felony count May 18 in connection with the alleged attack on Dijon Washing ton, just under two weeks after he was charged by the Los Angeles City Attorney’s Office with four misde meanor counts stemming from the alleged attack on Chappelle.

Lee’s former roommate testified that he “needed to have my small and large intestine sewn back up” after the stabbing last Dec. 2, saying he spent about seven to eight days in the hospital.

Los Angeles County District Attorney George Gascón was criticized by Chappelle’s attorney for declining to file any felony charges involving the alleged attack on Chap pelle, but he maintained that what happened at the Hollywood Bowl was “misdemeanor conduct and rightfully referred to the City Attorney’s Office.”

The county’s top pros ecutor subsequently said “the publicity generated by the attack on Mr. Chappelle helped police solve” the case involving the stabbing of Lee’s roommate, which had previously been reported to police.

Palm Springs HS students produce holiday commercials for restaurant

An alumna from Cal State San Bernardino’s Palm Desert campus is producing holiday commer cials for I Heart Mac and Cheese with Palm Springs High School students, college officials said Wednesday.

Donnie Gerrell, who graduated with a bachelor’s degree and teaching creden tial in 2018, is offering media training opportuni ties for students as a teacher and technology department lead at the high school.

“Prior to PSHS, I worked for a local nonprofit where I would integrate digital storytelling into core classes,” Gerrell said in a statement. “I also free lanced creating short films for local clients and flying a

drone for several organiza tions. I knew my next step in my career was to enter the classroom.”

Gerrell’s class is current ly in the post-production process of holiday commer cials for the restaurant, according to college officials.

The restaurant, community, students and their families all collaborated to produce a variety of holiday commer cials.

About 190 PSHS students are juggling their other school assignments as they work to complete the ads, which will be featured on television through the four-year FILM Pathway program, college officials said.

Last year, students

worked to create COVID-19 commercials with the school’s Health Academy for the Desert Healthcare District and Foundation in an effort to encourage the community to be safe and get vaccinated.

“The valley is home for me and PDC gave me the chance to stay close to home and push myself to grow academically,” Gerrell said. “My goal is to work with the community in some way that allows my students to gain stronger professional soft skills to prepare them for their future.”

Gerrell is also starting a pilot drone-racing program for the Palm Springs Unified School District.

NOTICE IS HEREBY GIVEN that on Tuesday, November 15, 2022, at 7:00 p.m. at the Arcadia City Hall Council Chambers, 240 West Huntington Drive, Arcadia, California, the Arcadia City Council will conduct a public hearing to consider the following:

• The adoption of Ordinance No. 2394 amending Article VIII of the Arcadia Municipal Code relating to Building Regu lations and adopting by reference the 2022 Edition of the California Building Code, Volumes 1 and 2, and Appendix J, the 2022 California Green Building Standards Code, the 2022 California Plumbing Code, the 2022 California Electrical Code, the 2022 California Mechanical Code, the 2022 California Existing Buildings Code, the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, and the Los Angeles County Grading Code, with additions, amendments, and deletions.

• The adoption of Ordinance No. 2395 amending Article III of the Arcadia Municipal Code relating to Fire Regula tions and adopting by reference the 2022 Edition of the California Fire Code in its entirety, including Appendices Chapter 4, B, C, D, K, and O based on the 2021 Edition of the International Fire Code published by the Interna tional Code Council together with certain additions, in sertions, deletions and changes thereto.

At said time and place an opportunity will be afforded all those inter ested and the public in general to be heard. SPECIAL MEETING

of Public Hearing on the Central District Specific Plan Update

PROJECT DESCRIPTION: The Central District Specific Plan (CDSP) is the fourth specific plan to be updated as part of the General Plan Implementation Program. The City has prepared an update to the existing 2004 CDSP. The Proposed Plan will result in a refined plan vison, goals, policies, permitted uses, development and public realm standards and guidelines that will shape the built environment for the CDSP area and implement General Plan Land Use policies. The Proposed Plan will require the following approvals: General Plan Land Use Diagram Amendment, Specific Plan Amendment, and Zon ing Map and Text Amendments. PROJECT LOCATION: The Proposed Plan area is generally bounded by Corson Street and the I-210 Freeway to the north, Del Mar and California Boulevard to the south, Pasadena Avenue and Pasadena Avenue to the west, and Mentor and Wilson Avenue to the east. The Proposed Plan would refine the plan boundaries as shown on the attached map (Exhibit 1).

ENVIRONMENTAL DETERMINATION: An addendum to the 2015 Pasadena General Plan Environmen tal Impact Report (GP EIR) (State Clearinghouse No. 2013091009) to address the potential site-specific environmental impacts associated with the update to the CDSP has been prepared in accordance with the California Environmental Quality Act of 1970 (CEQA) (Cal. Public Resources Code Section 21000, et. seq., as amended) and its implementing guidelines (Cal. Code Regs., Title 14, Section 15000 et. seq., 2016). This Addendum has been prepared and will be processed consistent with CEQA Guidelines (Cal. Code Regs., Title 14, Section 15162 and Section 15164). The addendum found that the Proposed Plan will not result in any potentially significant impacts that were not already analyzed.

APPROVALS NEEDED: The Planning Commission will conduct a public hearing and consider the pro posed amendments and addendum to the GP EIR. The Planning Commission recommendation will be forwarded to the City Council. The City Council will make a final decision at a separately-noticed public hearing.

At the time of the Bid Deadline and at all times during performance of the Work, including full completion of all corrective work during the Correc tion Period, the Contractor must possess a California contractor license or licenses, current and active, of the classification required for the Work, in accordance with the provisions of Chapter 9, Division 3, Section 7000 et seq. of the Business and Professions Code. In compliance with Public Contract Code Section 3300, the City has determined that the Bid der must possess the following license(s):

• a. Pursuant to Section 3300, of the Public Contract Code, the classification of the bidder’s Contractor’s License shall be “Class A” For sewer cleaning and video, use Class A, C-36, C-42, or D-38). Failure of a bidder to obtain adequate licens ing at the time the contract is awarded shall constitute a failure to execute the Contract and shall result in the forfeiture of the Bidder’s Bond.

• b. For federally funded projects, the Contractor shall be properly licensed at the time of award.

The successful Bidder will not receive a Contract award if the successful Bidder is unli censed, does not have all of the required licenses, or one or more of the licenses are not current and active. If the City discovers after the Contract’s award that the Contractor is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active, the City may cancel the award, reject the Bid, declare the Bid Bond as forfeited, keep the Bid Bond’s proceeds, and exercise any one or more of the remedies in the Contract Documents.

6. Subcontractors’ Licenses and Listing. At the time of the Bid Deadline and at all times during performance of the Work, each listed Subcontractor must possess a current and active California contractor license or licenses appropriate for the portion of the Work listed for such Subcontractor and shall hold all specialty certifications required for such Work. When the Bidder submits its Bid to the City, the Bidder must list each Subcontractor whom the Bidder must disclose under Public Contract Code Section 4104 (Subcontractor Listing Law), and the Bidder must provide all of the Subcontractor informa tion that Section 4104 requires (name, the location (address) of the Subcontractor’s place of business, California Contractor license number, California Department of Industrial Rela tions contractor registration number, and portion of the Work). In addition, the City requires that the Bidder list the dollar value of each Subcontractor’s labor or services. The City’s disqualification of a Subcontractor does not disqualify a Bidder. However, prior to and as a condition to award of the Contract, the successful Bidder shall substitute a properly licensed and qualified Subcontractor— without an adjustment of the Bid Amount.

7. Permits, Inspections, Plan Checks, Governmental Approvals, Utility Fees and Similar Authorizations: The City has applied and paid for the following Governmental Approvals and Utility Fees:

All other Governmental Approvals and Utility Fees shall be obtained and paid for by Con tractor and will be reimbursed based on Contractor’s actual direct cost without markup.

See Instructions to Bidders Paragraph 14, and General Conditions Paragraph 1.01 for definitions and Paragraph 1.03 for Contractor responsibilities.

8. Bid Forms and Bid Security: Each Bid must be made on the Bid Forms ob tainable from the City’s Bidding website listed in the paragraph 1 above. Each Bid shall be accompanied by a cashier’s check or certified check drawn on a solvent bank, payable to “City of Glendale,” for an amount equal to ten percent (10%) of the total maximum amount of the Bid. Alternatively, a satisfactory corporate surety Bid Bond for an amount equal to ten percent (10%) of the total maximum amount of the Bid may accompany the Bid. Said security shall serve as a guarantee that the successful Bidder, within fourteen (14) calendar days after the City’s Notice of Award of the Contract, will enter into a valid contract with the City for said Work in accordance with the Contract Documents.

9. Bid Irrevocability. Bids shall remain open and valid for ninety (90) calendar days after the Bid Deadline.

10. Substitution of Securities. Pursuant to California Public Contract Code Sec tion 22300, substitution of securities for withheld funds is permitted in accordance there with.

11. Prevailing Wage Resolution. Bidders are hereby notified that in accordance with the provisions of the Labor Code of the State of California, the City Council of the City has ascertained and determined by Resolution No. 18,626 (as amended), the general prevailing rate of per diem wages of a similar character in the locality in which the Work is performed and the general prevailing rate for legal holiday and overtime Work for each craft or type of worker needed in the execution of agreements with the City. Said resolution is on file in the Office of the City Clerk and is hereby incorporated and made a part hereof by the same as though fully set forth herein. Copies of said resolution may be obtained at the Office of the City Clerk.

12. Prevailing Wages. This Project is subject to the provisions of California Labor Code Section 1720. Contractor awarded this Contract and all Subcontractors of any tier shall not pay less than the minimum prevailing rate of per diem wages for each craft,

classification, or type of worker needed to perform the Work. The Director of Industrial Relations of the State of California, pursuant to the California Labor Code, and the United States Secretary of Labor, pursuant to the Davis-Bacon Act, have determined the general prevailing rates of wages in the locality in which the Work is to be performed. The rates determined by the California Director of Industrial Relations are available online at www. dir.ca.gov/DLSR/PWD/. Davis-Bacon wage rates are available online at www.wdol.gov/.

To the extent that there are any differences in the federal and state prevailing wage rates for similar classifications of labor, Contractor and its Subcontractors shall pay the highest wage rate.

13. California Department of Industrial Relations Public Works Contractor Registration.
