Ultimate Members Draw Terms and Conditions 2024

The Ul�mate Members Draw Terms and Condi�ons About the Promo�on 1. Bankstown Sports’ Member Promo�on – ‘The Ul�mate Members Draw’ (referred to as ‘Promo�on’ or ‘Members Draw’) will commence from Wednesday 13 December 2023 to Thursday 7 March 2024 with weekly draws commencing from 11 January 2024.

2. The Members Draw will consist of eight (8) weekly draws and a Major Draw on week 9 . The total prize pool for this Promo�on will be a combined total of $82,264.

[Weekly Draws (refer to Sec�on 7): Totalling in $8,000 cash across 8 weeks ($1,000 in cash per week = 8 weeks), Major Draw: Volkswagen T Roc: $54,264 & Major Draw Consola�on Prize Pool: $20,000 – subject to prizes being claimed in accordance with these terms and condi�ons.]

3. The promoter is Bankstown District Sports Club Limited ABN 88 000 243 916 (referred to as ‘BDSC’) of 8 Greenfield Parade Bankstown NSW 2200, phone 02 9722 9888.

4. Entry into the Promo�on is subject to the acceptance of these Terms and Condi�ons.

5. If there is any inconsistency between the Terms and Condi�ons and anything else that refers to this Promo�on, these Terms and Condi�ons will prevail.

6. Each draw will be conducted by a Promo�onal Host at Bankstown District Sports Club located at 8 Greenfield Parade, Bankstown NSW 2200, using a promo�onal system & computerised virtual barrel (Virtual Barrel). Winners will be drawn by their BDSC Membership number, and it will be displayed on selected screens at BDSC. The membership number will also be announced over the public address system. In the event of a technical failure, membership numbers may not be displayed on screens and/or draws may be postponed. In the case of a postponed draw, an extra finalist will be selected the following week on the scheduled draw day.

Who can enter the Promo�on?

7. Subject to sec�on 8, entrants for the Promo�on must be: a. Financial and current members of BDSC throughout the promo�onal period to be eligible to win (Members); b. Over the age of 18 years; and c. Agree to and comply with these terms and condi�ons.

Excluded Par�cipants 8. You cannot par�cipate in the Promo�on if: a. You have been suspended from BDSC at the �me of the draws. You will not be eligible to enter the draw or claim prizes. b. You are a director, employee or contracted personnel of BDSC (or any related en�ty) or you are an immediate family member of a director, employee or contracted personnel of BDSC (or any related en�ty). c. In rela�on to the Major Draw prize, any par�cipant that has been selected from the Weekly Draw.

9. To successfully claim the weekly prizes, Members must provide proof of Membership. For the Major Draw, the winning Member must provide proof of Membership and proof of

Iden�fica�on. In the event, that a winner cannot provide suitable proof of iden�fica�on, the winner will forfeit the prize in whole and no subs�tute will be offered to them.

Weekly Draws 10. The Weekly Draws will take place every Thursday from 7pm, commencing from Thursday 11 January 2024 and concluding on Thursday 7 March 2024 (a total of 9 Draws).

11. All entries received will form part of and be drawn from the Virtual Barrel for the Weekly Draws.

How to enter the Weekly Draws: 12. Members can enter the Weekly Draws by doing any of the following: a. Members will receive one (1) entry into the Virtual Barrel for swiping or scanning their Membership card at the nominated screens every hour, on the hour each promo�on week (see subject 13 for Promo�on period dates). b. Members will receive five (5) entries into the Virtual Barrel for every $20 spent at any par�cipa�ng outlets at BDSC (excluding San Churro, Lady Banks Roo�op, Al Aseel, Monkey Mania and Ultrafade) each promo�on week (see subject 13 for Promo�on period dates). Entries will be allocated as follows: i. One membership card can be swiped or scanned per transac�on to earn the entry into the Virtual Barrel. The membership card must be scanned or swiped at �me of transac�on by the Member. ii. Members can make a purchase through BDSC’s online ordering system (known as ‘me&u’) to earn entries. Entries from purchases made a�er 7:59:59pm each Thursday through me&u will go into the Virtual Barrel and will be included in the following week’s draw. iii. Members must enter their membership number into me&u before payment, to earn entries. Entries will not be made retroac�ve in the event that a member does not enter their membership number at �me of transac�on. iv. Me&u is a separate legal en�ty and is en�rely unrelated to BDSC. BDSC is not responsible for any entries that are provided to it late or otherwise not provided to it by me&u. v. All POS transac�ons made during the Promo�onal period but before the Weekly Draw will be included in the Virtual Barrel (entry may take up to 10 minutes to be counted due to processing �me. If this occurs, the �cket will be included in the next draw, or if the weekly draw has finished, it will go into the next week’s draw).

13. Claiming the Weekly Draw Prize 14. The Weekly Draw prize is $1000 cash. In addi�on to the cash prize, winner will secure a ‘finalist posi�on’ at the Major Draw to be drawn on Thursday 7 March 2024.

15. The Weekly Draws are drawn from the Virtual Barrel of Members who received entries for the week leading up to the Thursday draw. Any entry that is generated a�er 8pm the Weekly Draw will go into the following Weekly Draw.

16. The drawn Member will have four (4) minutes from the �me of announcement to claim their prize at the dedicated Promo�on area as announced by the Promo�on host. If the prize is unclaimed a�er four (4) minutes, redraws will occur every fi�een (15) minutes between 7pm un�l 10pm that night. If a winner is not present by the 10:00pm draw, the ‘finalist posi�on’ will be carried over to the following week, where two winners will be chosen.

17. If a Member has claimed the prize for the Weekly Draw, no further Weekly Draws on that night will occur.

18. Members can only win one Weekly Draw which means only one finalist posi�on and $1000 cash prize per member. If the same Member from a previous Weekly Draw has been selected, a redraw will occur un�l a winner is found.

Final Night – Bonus Draws 19. On the final night, Thursday 7 March 2024, BDSC will carry out an addi�onal four (4) draws from the Virtual Barrel at 7pm, 7:15pm, 7:30pm and 7:45pm (Final Night Draws). A total of four (4) winners will be found in these draws, unless more finalists are required to ensure there are 12 finalists for the Major Draw.

20. Entry into the Final Night Draw is only permited between Thursday 29 February 8:00pm 2024 to Thursday 7 March 2024 7:59pm.

21. Members can enter the Final Night Draw by doing any of the following: a. Members will receive one (1) entry into the Virtual Barrel for swiping the or scanning their Membership card within the Bankstown Sports Club venue.

b. Members will receive five (5) entries into the Virtual Barrel by making a purchase at a dining and beverage outlet at Bankstown Sports or External Venues (excluding San Churro, Lady Banks Roo�op and Al Aseel) and scanning or swiping their member card at �me of purchase. Members will gain five entries per $20 spent. c. Members who swipe their Membership card from 4:00pm to 7:59pm on Thursday 7 March 2024 will also reac�vate all �ckets they have accumulated over the Promo�on into the Virtual Barrel. d. All ME&U and POS transac�ons must be made before 7:50pm on Thursday 7 March 2024 to be included in the Final Draw Virtual Barrel (entry may take up to 10 minutes to be counted due to processing �me).

22. The prize for the Bonus Draws is for one of the four (4) finalist posi�ons at the Major Draw.

23. The drawn Member selected will have four (4) minutes to claim their prize at the Promo�on area as announced by the Promo�on host.

24. Redraws will take place every four (4) minutes un�l a winner is found.

25. The total Final Draw Night – Bonus Draw prize pool is a minimum of four (4) posi�ons to find finalists for the Major Draw. Any addi�onal draws for the finalist posi�ons will be dependent on any unclaimed prizes and unregistered finalists as referred to in ‘Sec�on 27’.

Major Draw 26. The Major Draw will take place on Thursday 7 March 2024 at approximately 8:30pm.

27. The weekly finalists must physically and personally be present at Bankstown Sports Club, 8 Greenfield Parade Bankstown NSW 2200 on Thursday 7 March 2024. They must bring their current membership card and a valid form of iden�fica�ons including a Driver’s License, Passport or Photo Card Iden�fica�on. Atendance must be registered before 6:30pm on Thursday 7 March 2024 in the Rainforest Lounge by BSC staff and they must be physically present in the Rainforest Lounge from 8:00pm for the Major Draw. Any finalist not present will be automa�cally forfeited and another finalist will be selected to take their place for the Major Draw.

How to Enter in the Major Draw 28. Once all 12-finalists posi�ons from the Weekly Draws and the Bonus Draws have been filled, then the Major Draw will commence. This should commence approximately 8:39pm and no earlier.

29. The Major Draw will take place as follows: a. The 12 finalists will select a number of their choice from all remaining selec�ons. The first person to select their chosen number is the first finalist confirmed from week 1 of the Weekly Draws and the finalists will then be asked to select their numbers in chronological order, based on what week they became a finalist. b. The prizes will be drawn in order of smallest to largest cash domina�on before the Major Prize – the Volkswagen T-Roc. c. The Promo�onal host will randomly select a number out of a bag. The first number drawn will be the winner of the first prize and this will con�nue un�l there are 2 finalists remaining. d. Once the last 2 finalists are found, the Promo�onal Host will draw the WINNER of the car, and the runner up will win a cash prize.

Condi�ons of Accep�ng Major Prize 30. All winners are required to present proof of iden�ty and/or their Membership card to claim their prize. In the event, that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no subs�tute will be offered.

31. The winner of the Volkswagen T Roc must have a valid Australian Driver’s License. This is to ensure that the prize can be registered in the winner’s name. Should the winner not hold a valid Australian Driver’s license, the prize be reallocated to another party nominated by the winner. BDSC retains unfetered discre�on should the winner need to reallocate the prize.

Realloca�on can only occur when the original winner does not hold a valid Australian Driver’s License.

32. All prize winners will be announced the following business day. Announcements may be made on all BDSC’s communica�on channels, including but not limited to BankstownSports.com, Facebook, Instagram, and local media. Winner names (First name and/or surnames), residing suburb, details of the prize won and images may be used in the announcement/s unless told specifically by the par�cipant otherwise.

33. The Major Prize is: a. A Volkswagen T Roc R-Line, and b. Lapiz Blue 34. In accep�ng the Major Prize, the winner agrees and acknowledges: a. All registra�on costs and any addi�onal on-road costs including but not limited to comprehensive and third-party insurance will be at the winner’s expense. b. A copy of the winner’s Driver’s License (subject to sec�on 34) must be supplied to Bankstown Sports Marke�ng Team, so the transfer of registra�on can take place. c. The winner will receive the exact car that is on display in the Mona Foyer at Bankstown Sports. d. BDSC will not be liable in any way for any defects or faults of the Volkswagen T Roc and the Member accepts full responsibility for the car. e. In entering the Promo�on and accep�ng the Volkswagen, the Member acknowledges that BDSC makes no representa�ons and warran�es, express or implied, regarding quality, suitability, merchantability, fitness for a par�cular purpose or otherwise, of the Volkswagen. f. Excluding reasons outlines in ‘Sec�on 34’, the Volkswagen cannot be transferred, exchanged, or redeemed for cash. g. The Volkswagen cannot be taken on the ‘Major Draw’ night and will have to be collected from Bankstown Sports on the following business day or nominated day agreed to by the winner and BSC Marke�ng Team. h. Any other specific details about the car’s insurance, capabili�es and features can be obtained from the manufacturer of Volkswagen.

General Terms and Condi�ons Applicable to the Promo�on 35. The BDSC reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Condi�ons of Entry or who has, in the opinion of BDSC, engaged in conduct in entering the Promo�on which is fraudulent, misleading, decep�ve or generally damaging to the goodwill or reputa�on of the Promo�on and/or BDSC. 36. The BDSC’s decision is final and the BDSC will not enter into correspondence regarding the Promo�on result or any other decisions the BDSC makes in connec�on with the Promo�on.

37. All prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry.

38. In the event of a technical failure (including but not limited to the display screens, �cket printer, PA system or draw system), draws may be postponed or cancelled. Cancella�on or postponement of a draw is strictly at management discre�on. In the event of a cancella�on, prizes from cancelled draws are forfeited and the prize value of any such cancelled draws will be added to the Major Draw.

39. All winners of the Bankstown Sports Membership Bonus Points must redeem their points before they expire as per the General Member Condi�ons.

40. Independent financial advice should be sought as tax implica�ons may arise as a result of accep�ng the prize and BDSC will not be held liable in rela�on to any tax implica�on which does arise.

41. It is a condi�on of accep�ng the prize that the winner must comply with all the condi�ons of use of the prize and the prize suppliers’ requirements. It is the responsibility of the winner to confirm such condi�ons with the prize supplier or other relevant third par�es.

42. It is a condi�on of accep�ng the prize that the winner may be required to sign a legal release in a form determined by BDSC in its absolute discre�on.

43. All entrants agree that if they win the prize, they will not, and their companions will not, sell or otherwise provide their story and/or photographs to any media or other organisa�on, including via the internet, whether for considera�on or otherwise. Photographs will be allowed only at the discre�on of BDSC. 44. Subject to complying with all relevant State and Territory legisla�on, BDSC reserves the right to amend, cancel or suspend this Promo�on if an event beyond the control of BDSC corrupts or affects the administra�on, security, fairness, integrity, or proper conduct of the Promo�on.

45. BDSC may in its absolute discre�on cancel the Promo�on and recommence it from the start on the same terms and condi�ons, subject to any direc�ons given under State Regula�on.

46. BDSC and their external venues and companies assume no responsibility for any error, omission, interrup�on, dele�on, defect, delay in opera�on or transmission, communica�ons line failure, the� or destruc�on or unauthorised access to, or altera�on of entries, and reserves the right to take any ac�on that may be available.

47. BDSC reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to sa�sfy these terms and condi�ons.

Copyright, Statutory Guarantees, Waiver and Liability 48. In considera�on for BDSC awarding the prize to the winners, the winners hereby permit the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s par�cipa�on in the prize to appear in connec�on with Bankstown Sports or the adver�sing or marke�ng thereof, in any media whatsoever throughout the world and the winner will not be en�tled to any fee for such use.

49. Each entrant hereby assigns to BDSC all right, �tle and interest in and to all copyright and all moral rights in any material created or otherwise submited to BDSC in connec�on with that entrant’s entry or par�cipa�on in any aspect of the prize (Works). Each entrant warrants that BDSC is free to use the Works (including modifying, adap�ng or publishing the entry, whether in original or modified form, in whole or in part or not at all) and to exercise its rights in rela�on thereto and neither the entrant nor any third party will be en�tled to any fee for such use.

50. BDSC does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Compe��on and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permited by law and BDSC shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequen�al loss) or for any personal injury suffered or sustained in connec�on with any prize/s except for any liability which cannot be excluded by law. BDSC is not responsible for any incorrect or inaccurate informa�on, either caused by entrant or for any of the equipment or programming associated with or u�lised in this Promo�on, or for any technical error, or any combina�on thereof that may occur in the course of the administra�on of this Promo�on including any omission, interrup�on, dele�on, defect, delay in opera�on or transmission, communica�ons line or telephone, mobile or satellite network failure, the� or destruc�on or unauthorised access to or altera�on of entries.

51. BDSC reserves the right in its sole discre�on to disqualify any individual who BDSC has reason to believe has breached any of these condi�ons or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promo�on.

BDSC’s legal rights to recover damages or other compensa�on from such an offender are reserved.

52. All entries become the property of BDSC. BDSC collects personal informa�on about you for the purposes of conduc�ng this Promo�on. All informa�on collected by BDSC will be used in accordance with BDSC’s Privacy Policy (see link below).

53. All entries will be entered into a database and BDSC may use the entrant’s names, addresses and telephone numbers for future Promo�onal, marke�ng and publicity purposes. By entering, entrants confirm that they allow their details to be used for this purpose. We collect and use that informa�on to provide you with our goods and services and to promote and improve our goods and services. We may share your informa�on with our related companies and any of us may be in contact for those purposes (including by email and SMS).

If you do not provide us with requested informa�on, we may not be able to provide you with the goods and services, you require.

54. Where you have entered a Promo�on, we may disclose your personal informa�on to authori�es if you are a prize winner or otherwise as required by law.

55. If entrants no longer consent to their details being used for future marke�ng purposes, the entrant should contact BDSC on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to BDSC. 56. BDSC’s privacy policy can be viewed at BankstownSports.com/privacy. To request access to, or to update, personal informa�on BDSC holds about them, entrants can contact the office of BDSC by telephone on 02 9722 9888.

57. This Promo�on is a game of chance and skill plays no part in determining the winner.

58. BDSC is authorised to operate the Promo�on under NSW Authority Number TP/00730.
