Civilians caught in Zambo crossfire ‘Humanitarian crisis’ worsens in battle-scarred ‘City of Flowers’ MANILA, September 26, 2013 (AFP) – Aid workers warned Thursday of a worsening humanitarian crisis in a major Philippine city racked by more than two weeks of deadly street battles between Muslim rebels and soldiers.

The overnight death of three soldiers brought the official death toll from the conflict in Zamboanga to 173, as the Moro National Liberation Front (MNLF) guerrillas remained defiant despite being heavily outnumbered.

“We are increasingly alarmed by the situation and the growing needs of people caught up with violence,” the UN Resident and Humanitarian Coordinator in the Philippines, Luiza Carvalho, said in a statement.

“We are particularly concerned for the most vulnerable, especially the well-being of women and children.”

MANILA, Sept 27 (Mabuhay) – Malacañang has declined to comment for now on the allegation of Senator Miriam Santiago that Senator Juan Ponce Enrile bankrolled the Moro National Liberation Front’s attack in Zamboanga.

36 Nur Misuari followers surrender, yield 23 firearms MANILA, Sept 25 (Mabuhay) – At least four followers of Moro National Liberation Front founding chairman Nur Misuari were killed while 36 others surrendered to authorities Wednesday, the Armed Forces of the Philippines said.

Philippine Army 7th Civil Relations Group commander Lt. Col. Harold Cabunoc said the four were killed in clashes with government troops.

The AFP also cited information from Cabunoc showing 36 MNLF members surrendered and yielded 23 high-powered firearms. “(Cabunoc confirmed) that 36 of remaining (Misuari followers) surrendered earlier today with 23 high-

powered firearms,” it said.

However, Cabunoc said Habier Malik, an aide of Misuari believed to be the leader of the MNLF men in Zamboanga City, refused to surrender, the AFP said in a separate tweet.

Cabunoc said Malik and at least two of his buddies “refused to surrender despite being abandoned by 35 of his own men today.”

The standoff between the government forces and the MNLF started Sept. 9, with the MNLF taking attacking several villages and holding over a hundred civilians hostage. Government forces have since retaken most of the MNLF-controlled areas in the city after 17 days of operation. (MNS)

BIR files P61-M tax evasion charges vs Napoles couple MANILA, Sept 26 (Mabuhay) – The Bureau of Internal Revenue on Thursday filed a P61-million tax evasion charges against pork barrel scam suspect Janet Lim-Napoles and her husband Jaime.

According to the BIR Chief Kim Henares, Mrs. Napoles has a tax liability of P44.68 million, while her husband owes the government P16.43 million in taxes.

Henares had earlier said that “common sense” dictates that fugitive Napoles would be on the BIR’s “Top 500 Taxpayers List” if, indeed, she owns the ghost foundations which received billions of pesos of public funds, and if she was paying taxes.

Pablo is among the respondents in the plunder and malversation complaint filed by the Department of Justice before the Ombudsman in his capacity as president of the Agri and Economic Program for Farmers Foundation, Inc. A special audit of the Commission on Audit said the NGO received P145 million from the combined Priority Development Assistance Fund (PDAF) of Senators Bong Revilla, Juan Ponce Enrile, and Gringo Honasan from 2007 to 2009.

The project purportedly provided farmers with training kits and seminars.

Whistleblower: Napoles used fake receipts, put several properties under others’ names MANILA, Sept 26 (Mabuhay) – Janet Lim-Napoles, alleged mastermind of the P10-billion pork barrel scam, used fake receipts and put several properties under other persons’ names, a whistleblower told a Senate probe Thursday.

Marina Sula, Napoles’s former employee, said the controversial businesswoman herself ordered the use of fake receipts for fund disbursements made by at least 20 bogus non-government organizations. “Minsan may mga resibo na peke rin na pinapagawa ni Mrs. napoles. Nagpapagawa po sya ng pekeng resibo,� Sula said.

She added that she was involved in the shredding of some important documents, including the fake receipts, before the alleged pork barrel scam broke out.

Sula likewise revealed that Napoles owned several properties in the Philippines and in the United States, but put them under the name of different persons. “Ipinangalan ni Madame sa anak niya at sa mga tao na hindi nila alam,� the whistleblower said.

Among the supposed Napoles properties identified by Sula were those located in Ortigas, Eastwood, Bulacan, Tandang Sora, Antipolo and Kidapawan City in Cotabato. Sula also confirmed that Napoles owns a unit at the Ritz-Carlton Residences in Los Angeles.

De Lima: No selective justice; next batch of ‘pork’ cases to be filed in 2 weeks MANILA, Sept 26 (Mabuhay) – Justice Secretary Leila de Lima on Thursday disagreed with Senator Jinggoy Estrada’s claim that the administration is only after “selective justice� in connection with alleged irregularities in the use of “pork� barrel funds. Appearing before a Senate probe on the alleged anomaly, De Lima said her department is still working on building up more cases against those involved in the supposed scam. “How can there be selective justice if we are proceeding on the basis of evidence that we are gathering?

We have emphasized that the cases filed so far are just the first batch. Investigation and case build-up so far is ongoing as we speak for the subsequent batches,� De Lima said during the Senate inquiry. “Maingat lang po kami. Fina-file namin

Santiago sees Enrile’s ex-COS as eligible state witness vs. senator MANILA, Sept. 26 (Mabuhay) – Lawyer Jessica ‘Gigi’ Reyes, the former chief of staff of Senate Minority Leader Juan Ponce Enrile, should turn state witness and tell all against her former boss, according to Sen. Miriam Defensor Santiago.

Santiago made the statement on Thursday at her keynote speech at the annual postgraduate course of the UP Dept. of Emergency Medicine at the Diamond Hotel, Manila.

Enrile’s lawyer reportedly said that Enrile did not authorize Reyes to sign any paper in connection with any transaction concerning the release of PDAF to the phony NGOs run by Janet Napoles.

Santiago said Reyes is eligible as a state witness because “there is absolute necessity for her testimony with respect to the senator.� �Without her testimony, no other direct evidence will be available for the prosecution to prove plunder against that particular senator,� Santiago said. Santiago said the testimony of Reyes “could be substantially corroborated in its material points.� �She does not appear to be the most guilty and there is no evidence that at any time, she has been convicted of any offense involving moral turpitude,� she said.

According to Santiago, whether or not the senator succeeds in transferring criminal liability to his COS, it appears that between the two of them there was a conspiracy.

Under the Penal Code, “a conspiracy exists when two or more persons come to an agreement concerning the commission of a felony, and decide to commit it.�

The basic effect of conspiracy in criminal law is that the act of one is the act of all. “Assuming for the sake of argument

that giving pork barrel funds to the phony Napoles NGOs was the criminal design of his COS, under our laws, he merged his will into the common felonious intent.

The senator can no longer repudiate the conspiracy, after it had already materialized,� Santiago said. “To free himself from criminal liability, the law requires an overt act on the part of the conspirator. To avail of his defense, the senator should show evidence that he tried to prevent commission of the other PDAF releases, or that he tried to abandon or dissociate himself from his COS during the initial release of funds,� she added.

Santiago explained that the presence of a conspiracy may be inferred from circumstantial evidence.“By its nature, conspiracy is planned in utmost secrecy; this is why it can rarely be proven by direct evidence.

There is no need to show that the senator received the money himself, because the action of the COS proved that there is sufficient circumstantial evidence. If the senator was absent during the pay-off, this does not constitute proof of innocence,� she said.

Santiago said the theory of conspiracy will serve to place the burden of criminal liability squarely on Enrile, even if only his COS acted directly in arranging for, and the collection of, the kickbacks. If the senator was a co-principal by reason of conspiracy, it is sufficient that the senator performed an overt act in pursuance or furtherance of conspiracy to plunder. Such an overt act may consist of one of two things: (1) either the senator actively participated in the actual commission of plunder, or (2) the senator provided moral assistance and asserted moral ascendancy over his COS by moving her to execute or implement the conspiracy.

In a decision promulgated on August 12, the Metropolitan Trial Court of Manila Branch 3 held Customs operations officer V Pier Angeli Senangote Sealtiel liable for 10 counts of violation of Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).

Sealtiel was found to not have reported

Heroes come in all shapes and sizes BAGRAM AIRFIELD, Afghanistan (Sept. 27, 2013) – What actions or characteristics describe a hero? Would you recognize a hero if he or she were standing next to you or speaking with you?

Many have witnessed accounts of heroism reported through a variety of media sources, but what drives a person to perform heroic acts? Is it in their bloodline?

Curious questions that may never provoke a similar response, however one fact will remain true: heroes come in all shapes and sizes.

Sgt. Zachary R. Berline stands just over six-feet-tall, squared shoulders and jaw. A college educated man who speaks moderately slow, his words are direct and their meaning rarely misunderstood. Older than most of his fellow infantry team leaders assigned to 2nd Battalion, 14th Infantry Regiment, 2/10 Security Forces Assistance Brigade, Forward Operating Base OrgunE, Berline enlisted after completing his bachelor’s degree.

“My recruiter was kind of surprised that I wanted to join the infantry,” said Berline.

“He said they saw it all the time though, guys who scored high on their entry exams, could pick any job in the Army, but insist on joining combat arms.”

Berline continued to say not joining the infantry might be a decision he would live to regret.

Standing beside Berline in front of the 9/11 memorial located in the main courtyard of the Regional Command-East Joint Operations Center on Bagram Airfield was Cpl. Jered R. Dominey.

Dominey is a soft spoken Soldier who is of average size and works as an intelligence collector assigned to Headquarters and Headquarters Company, 2/10 SFAB, at Forward Operating Base Sharana, and describes himself as just another intelligence nerd.

Physically, these men are very different but they share common traits. The values the Army has instilled in these two Soldiers allowed them to execute their mission flawlessly. Their actions saved the lives of those around them, distinguishing them from their peers.

On May 27, 2013, Berline’s infantry team came under heavy rocket fire, resulting in multiple Afghan National Army, or

ANA, soldiers being wounded and structures dangerously close to an ammo supply point being set ablaze.

“It wasn’t until the fifth day of our mission that things really hit home,” said Berline. “We saw the incoming rockets hit the ANA side of the base, and that’s when we saw the fire.”

With disregard for his own safety, Berline rushed to the aid of the ANA soldiers already attempting to put out the fire while his team followed closely behind.

“We gathered up our Soldiers and rushed to help,” said Berline. “We divided into teams, some set security, some tended to the injured, and others went to where the structures were burning.”

On that day, the bonds between U.S. Soldiers and Afghan National Security Forces grew stronger.

“It really didn’t matter if Americans or Afghans were in the bunkers, they needed help and we were going to provide that help,” said Berline. “The success of the day was in the training; everyone helped that day, everyone wanted to be a part of this.”

Berline received the Bronze Star Medal with “V” device for his valorous actions that day as an infantry team leader, directing his team through combat operations while simultaneously performing life saving measures.

Keeping with military tradition and following in his grandfather’s footsteps, Dominey also received the Bronze Star Medal with “V” device for saving the lives of multiple coalition force Soldiers during a direct and decisive engagement with an insider threat on Super Forward Operating Base.

On June 8, 2013, Dominey stepped outside the wire for the first time, attending a meeting on the ANA side of Super Forward Operating Base, when he noticed something was not quite right.

“I noticed an Afghan soldier who was acting odd but, this was my first time out and I didn’t really know what to do,” said Dominey.” It wasn’t until he fired at us that I truly understood the gravity of the situation.”

Engaging the enemy first was Dominey, who shot at the assailant multiple times, but the fight was not over.

Migrants not pawns on chessboard of humanity – Pope VATICAN CITY, September 24, 2013 (AFP) – Pope Francis on Tuesday called on countries to protect migrants, condemning the treatment of refugees as mere “pawns on the chessboard of humanity”.

Countries should cooperate on “the broad adoption of policies and rules aimed at protecting and promoting the human person”, he said in a message for the World Day of Migrants and Refugees.

“Migrants and refugees are not pawns on the chessboard of humanity,” he said in the message titled “Towards a Better World. They are children, women and men who leave or who are forced to leave their homes.”

He slammed situations in which migration is propelled by human trafficking and enslavement, warning: “Nowadays, ‘slave labor’ is common coin.”

The Argentine pontiff has made defense of the poor and vulnerable a keystone of his papacy.

The threat was not neutralized and he continuously attempted to engage U.S. Soldiers.

“We ended up re-engaging the enemy two more times before he stopped fighting back,” said Dominey.

“I really think this will make my grandmother very proud,” said Dominey. “My

grandfather served in Word War II, the Korean War and Vietnam, and had received the Bronze Star Medal for his actions; I just don’t remember which war it was.”

Filipinos, Americans urged to help preserve rice terraces by patronizing Cordillera heirloom rice WASHINGTON, D.C. – The Philippine Embassy is urging both Filipinos and Americans to help preserve the Rice Terraces of the Cordilleras as a world heritage site by patronizing the organic heirloom rice that the region is exporting to the United States.

The Philippine Embassy made the call following the ceremonial sendoff earlier this week of the latest heirloom rice shipment to the US, which the Department of Agriculture in Manila described as “a milestone in the government’s effort to expand markets for premium varieties and promote the rich cultural heritage attached to it.”

“We call on our kababayans to help preserve the Philippine Rice Terraces by buying Cordillera heirloom rice that is available here in the US,” Ambassador Jose L. Cuisia, Jr. said.

“By supporting our own premium rice varieties, we are helping our own upland farmers derive viable income from knowledge and practices obtained from their ancestors while helping create a landscape of beauty,” Ambassador Cuisia added.

The Department of Agriculture said

that 15 metric tons of organic heirloom rice from the Cordilleras worth close to P870,000.00 left the Manila International Container Terminal for California on 20 September.

The shipment, which is made up of 10 tons of “mina-angan” variety from Banaue and “hungduan” from Ifugao and five tons of “ulikan” from Pasil and Lubuagan in Kalinga, was consolidated by Rice Terraces Farmers’ Cooperative (RTFC), in cooperation with Rice Inc. and Eighth Wonder Inc., a California-based non-government organization that helps market products from the Cordillera rice terraces.

According to Cordillera Regional Agriculture Director Marilyn Sta. Catalina, the grains represent the best in the Cordilleras, notably the industry and ingenuity of its people, as these are organically grown, and manually harvested and pounded to perfection.

“More than profit, we are promoting the rich Cordilleran cultural heritage through this export,” said Sta. Catalina, who represented Agriculture Secretary Proceso Alcala during the sendoff ceremony.

Are deductions on your wages legal?

Q: At work, we PROTECTING are required to wear EMPLOYEE & a uniform, which CONSUMER RIGHTS only the employer can provide. The cost of the uniform is deducted from our pay. Is this deduction legal?

A: No, this deduction for employer-mandated uniform is prohibited

Where uniforms are required by the employer as a condition of employment, the employer must provide and maintain these uniforms.

To protect employees, the law regulates deductions.

Employers must adhere to the following: 1) No deductions for uniforms or lost tools – A deduction for uniforms or loss of tools is allowed only if the employer can prove that the employee stole the tools or uniforms, or if there was “culpable negligence,”

or if the employee gave advance authorization for deducting the cost of the tools or uniforms if not returned at discharge.

2) No deduction for business losses caused by employee negligence – The law prohibits the employer from using an employee’s wages to shift the losses of the business to the employee. Unless the employee was dishonest or willfully or grossly negligent, losses due to simple negligence, such as cash shortages and breakage or loss of equipment should not be deducted.

Some workers, such as drivers in the transportation industry, are misclassified as independent contractors and deducted for fuel or insurance expenses. If these workers are employees, they should be reimbursed for these expenses.

3) No deduction for workers’ compensation costs – An employer is prohibited from directly or indirectly taking any deduction from an employee’s earnings to cover any part of the costs of worker’s compensation.

4) No right of offset for employee’s debts to employer – However, employee may authorize an employer in writing to withhold some amounts to pay a debt to the employer. If the employee is terminated

before the entire debt is paid, the employer may not “accelerate” the balance but instead withhold from the final paycheck only the periodic amount due.

5) No chargebacks for commissions fully earned – However, an employee who receives both wages and sales commissions may agree in writing to a chargeback against commissions advanced by the employer if the sale did not proceed (for example, the customer returns the merchandise).

Employees who have doubts about the legality of a payroll deduction would be wise to ask an experienced employment attorney for advice.

Question: I’m an IMMIGRATION Australian Citizen. Are TODAY there any special visas from Australia that I might be able to qualify for as an Australian Citizen?

Answer: Yes. The E-3 nonimmigrant classification is for Australian citizens who will

Dependent spouses and children of E-3 professionals hold E-3D status. E-3D spouses are eligible for employment authorization documents. An extension of E-3 status may be filed with USCIS, or the foreign national may apply for a new period of E-3 status at a U.S. consulate abroad. There is an ample annual numerical limitation of 10,500 E-3 visa numbers, and E-3 extensions and E-3D dependents are not counted towards the quota. There must be a professional assignment in the United States. You need a Bachelor’s degree. You need a profes-

Question: What documents basically are needed?

Answer: The U.S. job description. Copies of the foreign national’s educational degrees, including transcripts. Copies of the foreign national’s professional licenses, if applicable. Foreign national’s experience letters, if applicable. A Copy of foreign national’s résumé. Basic information about the company. A Copy of biographic page(s) of passport(s) of the foreign national and any dependent spouse and children.

Question: Is there a numerical limitation on E-3 Visas?

Answer: There is a numerical limitation of 10,500 E-3 visas that may be issued annually, but “[o]nly E-3 principals who are initially being issued E-3 visas, or who are otherwise initially obtaining E-3 status,” are counted towards this cap.

Neither Australian citizens who seek E-3 extensions with the same employer nor E-3D dependents are subject to the quota. Unused E-3 visa numbers “do not carry over to the next fiscal year.” The Department of State (DOS) tracks usage of the visa numbers used by the U.S. consulates and

by USCIS, so if it appears that the quota will be exhausted, DOS “will instruct posts to cease E-3 issuances for that fiscal year.” It seems unlikely, however, that the cap will be reached.

Question: If I do not have a Bachelor’s Degree, can I still get the H-1B? Answer: Generally you cannot. However, you can try to get the equivalent of the Bachelor’s Degree. U.S. pending home sales slow for 3rd month running WASHINGTON, September 26, 2013 (AFP) – U.S. pending home sales slowed for a third straight month in August, amid rising mortgage interest rates and home prices, a key industry group said Thursday.

The National Association of Realtors (NAR) said its pending home sales index fell 1.6 percent to 107.7 in August from a downwardly revised 109.4 in July.

The decline was less than the 2.3 percent drop expected by analysts.

Pending sales of previously owned homes – a forward-looking indicator based on contract signings – had spiked higher in May to a 111.3 index reading.

Mortgage interest rates jumped in May after the Federal Reserve signaled it could begin easing its $85 billion a month bond purchases in the coming months if the economy continued to improve.

But pending home sales since have fallen for three months in a row under pressure from tight inventory on the housing market, rising home prices, restrictive lending and higher interest rates, NAR said.

“Sharply rising mortgage interest rates in the spring motivated buyers to make purchase decisions, culminating in a sixand-a-half-year peak for sales that were finalized last month,” said Lawrence Yun, NAR chief economist.

“Moving forward, we expect lower levels of existing-home sales, but tight inventory in many markets will continue to push up home prices in the months ahead.”

Of the four US regions covered in the August report, only the Northeast had an increase in pending home sales: 4.0 percent. The South was the worst-hit, down 3.5 percent.

The housing market has been recovering slowly from the 2006 collapse of the price bubble. Pending home sales year-over-year rose for the 28th month in August, with contracts up 5.8 percent from August 2012.

“The housing market is not rolling over, but it does seem to be losing steam,” said Ian Shepherdson of Pantheon Macroeconomics.

Comelec denies politics behind ER’s disqualification MANILA, Sept 27 (Mabuhay) – Commission on Elections (Comelec) spokesperson James Jimenez denies politics is behind the poll body’s decision to disqualify Laguna Governor ER Ejercito for overspending in the May polls.

Jimenez said the Comelec is merely enforcing a rule which punishes overspenders. He added the complaint against Ejercito was filed by his opponent even before the May elections.

The poll body has given Ejercito five days to file a motion for reconsideration.

Jimenez also said the Comelec is looking at the campaign spending of other elected officials, even those who belong to the administration party.

Meanwhile, the Parish Pastoral Council for Responsible Voting (PPCRV) is urging the Commission on Elections (Comelec) to investigate if candidates in the senatorial race last May also exceeded spending limits.

PPCRV chairperson Tita de Villa said this is to avoid perceptions the poll body is selective in scrutinizing the spending of candidates.

De Villa is concerned the Comelec’s disqualification of Laguna Governor ER Ejercito may create suspicions that government is moving against elected officials who are not allied with the present administration.

U.S. troops won’t get paid during shutdown: Pentagon WASHINGTON, September 27, 2013 (AFP) – The U.S. military’s nearly 1.4 million troops will stay on the job in the case of a government shutdown but not get paid, Pentagon officials said Friday.

The war effort in Afghanistan and other high-priority missions would not be affected but most training and a range of maintenance work would be cancelled if Congress fails to agree a new budget measure by the close of the fiscal year on Monday, September 30, top military officials said.

Details of how the Pentagon would operate under a shutdown came as a deeply divided Congress argued over rival spending bills, with the clock ticking on the Monday deadline.

“Military personnel will not be paid until such time as Congress makes appropriated

funds available to compensate them for this period of service,” Deputy Defense Secretary Ash Carter wrote in a memo describing contingency plans for a shutdown.

If government agencies close their doors, “roughly half” the Defense Department’s nearly 800,000 strong civilian work force would be deemed essential and ordered to continue to work, Pentagon comptroller Robert Hale told a news conference.

But those “essential” civilian employees would not be paid during the “lapse,” he said.

The Pentagon released a long list of services deemed essential that would continue during a shutdown, including medical care, mess halls, child care, legal offices, logistics, training, department schools and some accounting sections.

Ex-CJ Puno tells Senate: You risk destroying yourself

MANILA, Sept 26 (Mabuhay) – Former Chief Justice Reynato Puno said the Senate will wreck itself as an institution if it will surrender its right to investigate in aid of legislation.

“It is nothing less than act of decapitation by the Senate on itself.

For the Senate to self-destruct is the greatest tragedy of the [priority development assistance fund] scandal,” he said in a text message to reporters.

Senate President Franklin Drilon on Tuesday did not sign a subpoena for Janet Lim Napoles, but did so for the whistleblowers.

This “unreasonable treatment” drew the ire of Senator Teofisto “TG” Guingona III who said it raises the obvious question: “What is so confidential about Ms. Napoles’ possible testimony that it cannot be made under oath before the Senate Blue Ribbon Committee?”

During the Senate hearing on Thursday, Guingona said he will appeal to have the subpoena for Napoles signed.

Puno, who has been chief justice for almost five years until his retirement in 2010, said: “The Senate, thru its Blue Ribbon Committee, should uphold its right to investigate in aid of legislation. This right to investigate is a crucial component of the power to enact laws which the Constitution exclusively grants to Congress.”

He said the Supreme Court has consistently decided in the past a “liberal and latitudinarian interpretation.”

In all these decisions, the high court said “the cardinal principle of separation of powers demands from all branches and agencies of government the highest respect for the legislative power of Congress and its right to investigate in aid of legislation.”

He said destroying this exclusive power “is dangerous for it can destroy the check and balance mechanism of governmental powers so delicately crafted in our Constitution. Worse, any substantial erosion of the power of Congress to investigate in aid of legislation can lead to the impotence of Congress to enact laws.”

Confidentiality rule Puno said this right can only be limited by more superior constitutional rights such as the right against self-incrimination and certain executive privileges.

“Hence, this constitutional right to investigate in aid of legislation cannot be defeated nor diminished by any confidentiality rule which is only found in the Rules of Procedure of the Office of the Ombudsman. An administrative rule can never negate a constitutional grant of power,” he said.

Drilon justified his actions after receiving a letter from the Office of the Ombudsman.

In her letter, Ombudsman Conchita Carpio Morales only said “it would not be advisable, at this time, for Ms. Napoles to testify before the said Committee on ‘what she knows’ about the alleged scam.”

In signing the subpoena for the witnesses, however, Drilon said: “I am signing this subpoena in your presence now, for Secretary De Lima to produce the witnesses mentioned in this subpoena. This is now the subpoena for Secretary De Lima and the other witnesses that the Chairman of the Blue Ribbon Committee wishes Secretary De Lima to bring. I agree with Senator Guingona that nobody should undermine the mandate and power of the Blue Ribbon Committee, much less of the entire Senate.” (MNS)

Question: I heard that you prepare and file applications for naturalization for only $150 and I want to see if I can apply. I obtained my greencard through my husband who is a U.S. citizen in 2008. There are however, some strict rules regarding eligibility to naturalize. Ordinarily, you must prove that you have been a permanent resident for at least five years before filing for naturalization although you may file 90 days in advance of this date. If you are married and residing with an American for at least three years, you can file for naturalization as the spouse of a citizen with only three years of permanent residency. Again, you can file 90 days in advance. Since you are married to a citizen you should be able to file under the three year rule, that is if you are still residing

together with your spouse. If you are separated, you must wait the five year period before filing for naturalization.

Trips outside the U.S. are also an issue that can affect your eligibility to naturalize. The first rule is that you cannot have more than 50% of the last five years absent from the U.S. and no trip can last more than one year without breaking the continued residency period required for naturalization.

Since your trips never exceeded one year, you appear to qualify.

However, there can be exceptions to this rule.

The law also states that you cannot have abandoned your residence in the U.S. Trips of less than six months do not affect your eligibility for naturalization.

However, trips in excess of six months can call your continued residence into question. You should be prepared to present at your interview proof that during your absences of more than six months you did not intend to abandon your residence in the U.S. You should prepare to discuss why you traveled abroad and what ties did you have in the U.S. while you were away. ‘Eraser’ law will let California kids scrub online past LOS ANGELES, September 25, 2013 (AFP) – Teenagers’ nightmarish propensity to post underage party hijinks, flesh-flashing and nasty commentary online have found a dream come true in California, which will soon let them erase their tracks.

The first-of-its-kind “eraser button” law, signed Monday by Governor Jerry Brown, will force social media titans such as Facebook, Twitter and Google let minors scrub their personal online history in the hopes that it might help them avoid personal and work-related problems.

At risk for heart disease? Pop a few walnuts (Relaxnews) – Overweight adults can help protect themselves from diabetes and heart disease by adding walnuts to their diet.

That’s the conclusion of a new Yale University study published in the Journal of the American College of Nutrition which put a small group of adults on a walnut-enriched diet for two eight-week sessions.

For their research, scientists chose 46 adults between the ages of 30 and 75 who had a body mass index larger than 25 and a waist circumference exceeding 40 inches (102 cm) for men and 35 inches (89 cm) for women.

All exhibited risk factors for metabolic syndrome, a precursor of diabetes and cardiovascular disease, and none were smokers.

Participants were assigned to either a walnut-enriched ad libitum diet or an ad libitum diet without walnuts.

Those who followed the walnut diet were instructed to eat 56 g of shelled, unroasted walnuts a day as a snack or with a meal.

At the end of the experiments, scientists observed improved endothelial function in overweight adults who consumed walnuts. Endothelial cells make up the inner lining of blood vessels and help with blood clotting and the formation of new blood cells, regulate inflammation and control blood pressure.

No participants in the walnut-eating group gained weight.

“We know that improving diets tends to be hard, but adding a single food is easy,” explained lead author Dr. David Katz.

The Barretto siblings, as cited in Santiago’s account, supposedly believe that Claudine is mentally ill and that she is in need of professional help.

Claudine’s ‘condition’ Santiago’s sworn statement also includes photos and videos, which he said shows his wife’s alleged drug abuse. Furthermore, the actor said this can be proven by medical records showing Barretto testing positive in a drug test, as well as her admission to a drug rehabilitation center.

In late August, the actor already hinted of Barretto’s supposed condition, when he criticized her parents, Miguel and Inday, for allegedly not attending to her mental well-being.

“Kay mommy at daddy, alam niyo ang totoo. Tayo-tayo ang nag-uusap dati, ‘yung problema ni Claudine. Alam niyo and sana panindigan nila ‘yung sinabi nila dati sa akin,” Santiago said at the time.

At the height of the Barretto family’s publicized feud in April, Gretchen and JJ brought up the actress supposed “illness,” with the latter saying Claudine was put in a hospital at one point.

Responding to Inday’s move to disown Gretchen in favor of her youngest daughter, JJ in a statement mentioned “the truth about Claudine’s condition.”

“May I remind you that it was you and dad who had her put in a hospital because you wanted to save her from destroying herself. Yes, Claudine is going through

Ruffa’s daughters want her to find a partner The two daughters of host-actress Ruffa Gutierrez are still hoping their mother can find another man who will love and take care of her someday.

When Gutierrez was asked if she still misses having a special someone, the former beauty queen relayed the question to her daughters, seeking their opinion if they would like her to get into another relationship.

Without mincing words, Lorin quickly told her mom: “You have to get somebody soon before you get old.”

Lorin and Venice then added the qualifications Gutierrez’s future partner should possess.

“I don’t care as long as the new person for mommy’s heart is not a murderer. I don’t want mommy’s husband to be a murderer,” said Lorin.

“And someone who’s fit,” added Venice.

Erupting into laughter, Gutierrez explained Lorin’s “murderer” comment.

Sarah Geronimo opted to keep her silence on rumors romantically linking her to Matteo Guidicelli, saying she would rather remain “truthful” about her situation with the actor.

The 25-year-old singer was asked on the matter in a media huddle at the sidelines of a press conference held early this week for her latest endorsement.

Noting that Guidicelli is endorsing a competing brand, Geronimo said, “Hindi naman kami pwedeng mag-usap dahil sa competitor siya, ‘di ba?”

Geronimo was also brief with words when asked if she remains in good terms with the 24-year-old actor, only saying, “Okay naman.”

The film is based on the true scandal that rocked the Philippines wherein prison inmates were contracted by high-level politicians to temporarily leave jail and conduct a series of assassinations before returning to incarceration.

A prominent drug dealer is murdered by two hitmen – Tatang (Joel Torre) and Daniel (Gerald Anderson). Veteran police sergeant Acosta (Joey Marquez) is assigned to the case, but his investigation hits a blank wall because the killers vanish behind the security of the prison – the last place cops will look.

Young and rising federal agent Francis Coronel (Piolo Pascual) takes over the case, on the orders of his controlling fatherin-law Manrique (Michael De Mesa), a congressman. Unbeknownst to him, Manrique is himself acting on the orders of General Pacheco (Leo Martinez).

Acosta is skeptical as he turns the case over to the ambitious Coronel. Yet no sooner is he pulled back in when his friend (played by Lito Pimentel) is killed and turns out, is involved in the assassination business.

Now Acosta and Coronel follow their instincts on the trail of the hitmen – and on a collision course with powerful men who will do anything to silence them.

Hollywood fashion designer Oliver Tolentino had big success at the 65th Annual Primetime Emmy Awards last Sunday night in Los Angeles when he dressed 2 of the Emmy nominees. The first was MAYIM BIALIK, nominated for Outstanding Supporting Actress in a Comedy Series for her work on The Big Bang Theory, and the second was Allison Holder, nominated for Best Choreography for a segment she and co-nominee Derek Hough did for Dancing With The Stars. Both gowns were in shades of the hot color of the year: green.

Bialik, who co-stars as “Amy” in The Big Bang Theory, wore a dark emerald Sabrina neckline, ¾ sleeve silk brocade mermaid gown embellished with hand-beaded French lace at the waist, shoulder, and cuff.

Tolentino custom made the gown because Bialik is religious and prefers sleeves and a high neck in deference to modesty.

This is the second year Bialik has been nominated as Outstanding Supporting Actress in a Comedy Series and the third consecutive year that The Big Bang Theory has been nominated Outstanding Comedy Series.

Bialik decided early that Tolentino would be her designer and even went public with her choice in several blog entries in the weeks leading up to the awards. It is no coincidence Tolentino dressed Bialik after dressing co-star Melissa Rauch for

The 2013 Peñafrancia Festival is held to honor the feast day of Our Lady of Peñafrancia in the month of

September by the United Bicolandia of Los Angeles (UCBLA), the umbrella organization of Bicolanos from Southern California.

The whole-day celebration, which draws devotees and guests every year has always been one of the biggest festivals of Filipinos in Southern

California.

The first Filipino-American Bishop Most Rev. Oscar Solis celebrated the mass at Lincoln Park.

The highlight of the fiesta was a fluvial parade, which features yellowshirted “voyadores” carrying the image

of the Virgin Mary aboard a floral barge towed by boats around the lake.

The fluvial procession is accompanied by a foot procession along the perimeter of the lake.

Uniformed Knights of Columbus provide the guard of honor.

Consulate outreach in Walnut The Philippine Consulate General in Los Angeles, led by Consul General Ma. Hellen Barber De La Vega, conducted an outreach program for dual citizenship at St. Lorenzo Ruiz Catholic Church, Walnut, CA and its neighboring parishes on 14 September 2013.

The consular outreach program was undertaken in cooperation with the St. Lorenzo Ruiz Catholic Parish Community led by Parish Priest Fr. Tony Astudillo. It

New report shows Asian American community remains Los Angeles’ fastest growing LOS ANGELES – According to a new report released today by Asian Americans Advancing Justice - Los Angeles, Los Angeles County’s large Asian American and Native Hawaiian and Pacific Islander (NHPI) communities continued to grow dramatically over the past decade, fueling even greater diversity in a county whose overall population growth has slowed to a near standstill.

Already the largest in the country, L.A. County’s Asian American population remained its fastest growing, increasing at a rate (20 percent), nearly twice that of its Latino population (11 percent), between 2000 and 2010; its NHPI population, the largest in the continental United States, grew at a rate (9 percent) approaching that of Latinos over the same period. By comparison, the county’s total population grew only 3 percent over the decade. These trends have important implications for public policy.

“Our communities are growing and making real contributions to Los Angeles’ economy, but many also need help,” said Stewart Kwoh, president and executive director of Advancing Justice - Los Angeles.

“This growth deepens the urgency of our public policy concerns.”

According to data included in the report from the U.S. Census Bureau’s American Community Survey (ACS), there are nearly 930,000 Asian American and 7,700 NHPI immigrants in Los Angeles County; data from the U.S. Department of Homeland Security show more than 310,000 Asian American and 1,300 NHPI immigrants countywide obtained legal permanent resident status between 2000 and 2010.

The report estimates that roughly 130,000 Asian Americans in Los Angeles County are undocumented.

“Promoting access to services is critical, particularly among those who are limitedEnglish proficient or struggling in this tough economy,” said Betty Hung, policy director at Advancing Justice Los Angeles. “Many in our communities are undocumented, so these services need to be accessible to everyone

regardless of immigration status.”

The number of NHPI and Asian Americans in Los Angeles County who are unemployed and living below the poverty line also continues to grow. ACS data show that the number of unemployed NHPI and Asian Americans grew 111 percent and 89 percent, respectively, between 2007 and 2011; they also reveal corresponding increases in the number of NHPI and Asian Americans who are poor.

Among ethnic groups, over half of Tongan Americans and a quarter of Cambodian Americans countywide live below the poverty line.

“Contrary to this myth of Asian Americans and NHPI as the model minority, the data we compiled in this report show tremendous social and economic diversity in our communities here in Los Angeles,” said Kristin Sakaguchi, a research analyst at Advancing Justice - Los Angeles and the primary author of the report. “Some have achieved success, but others are facing considerable challenges.”

Makeup 101 by beauty expert Marlou Colina a runaway success It was dubbed “The Makeup Event of the Year” and it lived up to its billing.

Indeed, Makeup 101 was, by all accounts, a huge success and another feather on the cap of its chief architect, beauty expert Marlou Colina, founder and CEO of Colina Salons.

The boyish Marlou pioneered a clean, natural finish that looks fresh and stays that way for hours with minimal touch-up. Beauty queens Anjanette Abayari and Melissa Rodriguez gamely acted as live canvases for the make up class.

Participants were also treated to giveaways and raffle of Colina Salon products (Colina Cosmetics, MC Hair Care).

Singer Ella Mae Saison brought the house down with just a few choice numbers, winning new fans, all of them wanting to have their photo taken with the soul diva.

Holker selected to wear a dark olive green silk organza hand-draped bustier mermaid gown. “I’m very proud of that

gown,” commented Tolentino. “The draping detail from top to bottom is very complicated and it takes time to perfect,” he noted.

Most designers would have their hands full with dressing two nominees, but Tolentino also dressed several celebrities for the prestigious pre-Emmy parties.

Brooke Burke, co-host of Dancing With The Stars, chose the designer’s red floral hand-embroidered sleeveless mini cocktail dress to wear to the CAA talent agency party on Friday night in Beverly Hills.

Miss Mangatarem’s Alyssa Veloria Soto crowned as Miss Pangasinan-USA

Alyssa Lauren Veloria Soto, representing Assn. of Mangatarem Overseas Residents (AMOR) of Southern California was crowned as Miss Pangasinan-USA in a scintillating Beauty Pageant that coincided with Pangasinan Brotherhood-USA’s 35th Anniversary Foundation Gala Night at the Embassy Suites Anaheim-South near Disneyland.

Miss Soto, 20, a junior Pre-Med student at California State University-San Marcos also won the Miss Photogenic category and Evening Gown competition.

What most likely earned the judges’ nod was her straightforward and articulate response to a judge’s question: “With the standard of beauty being portrayed as fair or light skin in a Beauty Pageant like Miss Pangasinan-USA, what message would you convey to girls who don’t fit this standard.?”

Miss Soto’s instant reply was, “Throughout my childhood, I was constantly being bullied because I was either too short, my hair was too long and thick or too curly, my skin wasn’t clear, and yes I was either too dark or too light skinned. My mes-

The newly-proclaimed Miss Pangasinan-USA was crowned by PB-USA President Eddie C. Ferrer and outgoing Miss Pangasinan-USA Jazmyn Dela Cruz Bacani, The morning after the event, Miss Soto remarked, “I had an awesome time at the event and had a ton of fun participating in the pageant. All the girls were very friendly and we all got along backstage. I made new friendship. Looking forward to representing PB-USA as Ambassador of Goodwill.”

Miss Soto who performed an Indianthemed Bollywood dance routine in the Talent competition is a scion of two rich cultures. Her father Jerry Soto is of Puerto Rican ancestry while her mother is a Pangasinense. The family resides in Poway, San Diego County.

“President Aquino understands the scourge of corruption. The Aquino leadership made sure that a culture of integrity, accountability and transparency is being institutionalized. The government has taken a two-pronged approach: One is to establish a culture of accountability among those in public service and two is to soundly manage the nation’s coffers, which includes both ensuring prudent disbursement and that people’s money is used only for the benefit of the citizens. The results are obvious: revitalized institutions, confidence in what was once a struggling economy and greater opportunities opening up for the Filipino people. Our economy grew 6.6 percent in 2012 and 7.8 percent in the first quarter of 2013. Foreign Direct investment in April 2013 was recorded at $202 million, 61.6 higher than last year’s.”

She added, “the country is not hopeless.

In fact, the country has awakened. All we need is for our overseas Filipinos to have faith in our people and country and our resiliency. We are a maturing democracy, and we are getting there.”

Bong Soriano of Bayambang was credited for successfully hosting the event’s program and beauty pageant. Leo Arce, a well-acclaimed movie and T.V. director and producer with assistance from wife Adele and children directed the Filipino-themed production and music that drew sentimental longings for the motherland.

PB-USA President Eddie C. Ferrer said the well-choreographed production was “designed and produced for the emergence of PB-USA’s youths with the reality that they will take over the reins of the organization someday.”

The five judges to the Beauty Pageant were Alvin Rosales Garces, a former ramp model and radio announcer for KISS FM Manila and now owns a financial consulting firm; Jennifer Mary Anol, a Human Resources staff for the City of Fullerton; Jimmy Velasco, owner of Manila Peninsula Restaurant in the City of Orange; Darv Dayondon, a women’s wear buyer, designer and stylist for foreign exchange clothing and Edward Malilim, writer, filmmaker and High School Math teacher and musician.

Nissan will be first to offer its drivers in-car iTunes Radio (Relaxnews) – The Japanese car company has signed an exclusive deal with Apple to bring the much-hyped music streaming service to its new North American vehicles before anyone else.

The first cars to get the service, which allows users to curate their own radio stations based on favorite bands, musical eras, genres or moods, will be the Nissan Rogue SUV, Nissan Versa Note and the company’s best-selling electric car, the LEAF. The deal will see Nissan become Apple’s exclusive automotive partner at least until the end of 2013 and will enable the car maker to advertise on Apple TV. It will also be taking full advantage of the fact that iTunes Radio is a free service, supported by advertising, by using said ads to reach its customers. Nissan promises content relevant to consumers’ interests.

A new feature in the latest version of iTunes on the Mac and PC and an integrated service in iOS7, Apple’s latest mobile operating system, which is already installed on over 200 million iPhones and iPads, iTunes Radio went live for US consumers on Friday, September 20 and is expected to roll out to other international territories over the coming months. However, the timing and duration of the deal suggests that iTunes Radio could remain an exclusively American service until the end of 2013 and maybe even beyond.

An air of safety for motorcyclists (Relaxnews) – The closest thing to an airbag for motorcycles, the next-generation Dainese D-air is about to offer bikers even more protection, but there’s a catch: you have to dress like a Power Ranger.

Like the airbags in a car, the D-Air system inflates at the point of impact, thanks to a built-in air canister, but unlike the car-based system, the bags are designed to cushion the areas and keep them straight rather than bring a moving object to a halt. Finding the right balance is very challenging: inflate too much, too quickly and the airbags could actually crush the wearer, inflate too slowly or not enough and they’ll be useless at preventing injury.

But the technology doesn’t stop there; just like inside a smartphone, the system uses an accelerometer, gyroscopes and GPS to calculate the optimum airbag deployment time and can record up to 2 GB of telemetry data which it can overlay onto Google Earth.

D-air has had to pass 800 stringent tests in order to be certified and the development process will continue as more professional riders start wearing D-air next season.

The improvements to the existing system were a joint effort between Dainese, British Superbikes championship and MotoSport Vision.

“The current D-air system proved extremely effective in preventing collarbone and neck injuries, but below that are critical areas of the body, including major organs and that is what we wanted to concentrate on through our safety partnership with Dainese. [We] visited Dainese and between us all looked at what would be possible to achieve. This could be the biggest evolution of rider safety,” said Stuart Higgs, British Superbikes director.

But the new system won’t be confined to the racetrack. Dainese’s retail dealers will also be able to sell the race specification and a road version – D-air Street – of the system to any motorcyclist looking for extra protection and though the company is yet to confirm pricing, the full Race suit, complete with a rider’s choice of logos and graphics, is expected to retail for $5000.

Meanwhile a jacket supporting the Street version of the airbag system could cost as little as $1500.

CHICAGO, September 26, 2013 (AFP) – Toyota will recall nearly 700,000 Sienna minivans in North America to fix a gear shift defect, the Japanese automaker said Thursday.

The faulty shift lever has been found to occasionally slip out of the park position, which “could result in a vehicle roll-away,” Toyota said. “There were 21 minor accidents and two included minor injuries,” Toyota spokeswoman Cindy Knight told AFP. “The minor accidents involved some minor property damage. The injuries are on the order of bruises.”

A lock on the shift level generally prevents the vehicle from moving out of the park position unless the brake is depressed.

But Toyota found this lock could become damaged and is contacting customers to inspect and replace it.

The bulk of the recalled vehicles – 615,000 – are in the United States. Another 56,000 will be recalled in Canada and 23,000 will be recalled in Mexico.

There are also 300 affected Siennas in Germany and 100 in Guatemala, Knight said. The recall affects model years 2004, 2005, 2007, 2008 and 2009.

Meanwhile, Japanese auto giant Nissan also on Thursday said it would recall about 910,000 cars worldwide over an accelerator glitch that can stall vehicle engines.

The global recall cover five models, including the Serena minivan and X-Trail SUV, produced between October 2004 and June this year, it said.

About 765,000 cars will be recalled in Japan, with about 100,000 units of its luxury Infiniti M sedan being called back in North America.

U.S. fines 9 Japanese auto-parts firms for price-fixing WASHINGTON, September 26, 2013 (AFP) – The United States government said Thursday that nine Japanese auto-parts companies and two executives have pleaded guilty to price-fixing and will pay more than $740 million in fines.

The parties, in separate conspiracies, fixed the prices of more than 30 different products sold to US car manufacturers and installed in cars sold in the United States and elsewhere, the Department of Justice said in a statement.

The products include seatbelts, radiators, windshield wipers, air conditioning systems, power window motors and power steering parts.

The Justice Department said that Hitachi Automotive Systems Ltd. had agreed to pay a $195 million fine, the largest among the penalties announced. The plea agreements require court approval.

SPORTS Woman rower lands in Alaska after solo Pacific crossing LOS ANGELES, September 25, 2013 (AFP) – A 28-year old female adventurer has arrived in Alaska after rowing 4,315 miles across the northern Pacific, her support team said, the first person to make the solo crossing by rowboat.

Briton Sarah Outen arrived Monday at the sparsely populated Alaskan outpost of Adak in the Aleutian islands, after 150 days of rowing, often having to battle in rough ocean swells.

“Happy tears and tired muscles remembering this morning’s row... to Alaska!” Outen wrote in a Twitter post dated September 24, shortly after her arrival.

In another message later that day, @sarahouten wrote: “Cried & grinned as I rowed final strokes to shore in Adak Port, welcomed by lovely locals to beautiful island.”

Outen started her voyage in April in Chosi, Japan in her rowboat dubbed “Happy Socks.”

The Japan-to-Canada voyage is just one leg of a journey during which Outen said she hopes to cycle, row and kayak around the world.

She says she will travel some 20,00 miles in all to raise money for various charities.

In addition to her Twitter feed, Outen has chronicled her exploits at the website sarahouten. com.

In June of last year, she was forced to abandon a first attempt to row to Canada when she ran into a severe storm after about one month in the Pacific and had to be rescued by the Japanese coastguard.

The explorer said that after taking some time to rest and recover, she plans to bike 3,000 miles from western Canada to Nova Scotia before rowing back to Britain via the North Atlantic.

The researchers were an international group of private individuals, law enforcement officers, and military people generally operating independently of each other, challenging the then accepted standards of technique, training practices, and equipment. The work was, for the most part, conducted for their own purposes without official sanction. Even so, what they learned changed the face of police and military training forever.

Competition had begun with the “leather slap” quick draw events of the 1950’s.

It evolved to test what had been learned, and just for the pure fun presented by what quickly became a sport requiring competitors to deal with constantly changing scenarios while shooting rapidly and accurately with full power handguns.

For 20 years USPSA competition has provided a test bed for equipment and techniques, many of which are now the standard for police and military training.

Some of USPSA’s top competitors are FACTORY REBATES ON APPROVED CREDIT regularly employed as trainers for elite ON SELECT MODELS police and military units. Today, USPSA matches are conducted every week by the nearly 400 affiliated clubs all over the United States.

ROME, September 25, 2013 (AFP) – Italian athlete Devis Licciardi risks a two year ban after using a fake penis during a doping control.

The 27-year-old was caught with the artificial organ at the Italian championships at Molfetta last Saturday.

After competing in the 10km road race Licciardi was discovered with the device by a controller during a urine test.

Licciardi informed the official that he wanted to be alone to carry out the test only to be told: “No, I have to stay close to you as the rules stipulate,” the Gazzetta dello sport reported.

After suspicions were raised and the discovery of the false penis filled with clean urine, the offending object was confiscated for investigation.

The device was hidden in the athletes’ underwear.
