Who are bailiffs?

● Abailiff is someone who enforces a money debt, fine, or repossessed goods under hire purchase or conditional sale agreement

● They may also carry out evictions on behalf of a landlord

● Bailiffs have the power to repossess property and sell possessions to pay off debts owed to a creditor

● They are sent by the court if payments towards a County Court Judgement are not maintained. When are bailiffs used?

If you don't pay your creditors and your debt is taken to court, bailiffs can be directed to take possessions from your home, particularly if a County Court Judgment (CCJ) has been issued. Bailiffs can also be employed to repossess your home or carry out specific arrest warrants.

Before any action is taken, bailiffs receive instruction by a warrant which specifies how much is owed.

They can seize goods for:

Bailiff force entry?

● Abailiff can't enter your locked property without your permission.

● You can refuse entry by taking various measures.

● Bailiffs can legally enter through an unlocked back door, garage, or shed if they suspect assets to be seized are there.

● In some cases, bailiffs can force entry with a court order by cutting padlocks, chains, and opening doors.

● Generally, bailiffs cannot enter business premises unless they have visited there previously.

● HMRC, High Court Enforcement Officers, and Bailiffs from the County Court are exceptions and may enter business premises with a court order.

Check for when a bailiff arrives?

It is important to remember that if a bailiff presents themselves at your property, you should ensure that:

● Check the accuracy of the debt being chased.

● Ensure the correct process has been followed.

● Verify that the notice has been given properly.

● Confirm that the correct time frames have been allowed.

Always take the time to ascertain whether they are certified by checking the Ministry of Justice Bailiff Register and checking the identity of the bailiff by asking to see:

● Ask to see identity proof, including an enforcement agent certificate, ID card, or badge.

● Ask for the identity of the firm they work for.

● Ask for contact details, such as an office number and email address.

● Ask for a comprehensive breakdown of the outstanding debt and the claimant.

What documentation must they have with them?

Bailiffs can only seize belongings when they have written authorization, such as a court warrant or creditor authorization. Written proof of the court order may not be presented, but bailiffs will typically have it with them.
