Legislation

Thereareseveralmisconceptionsaboutinteriordesignlegislationandhowitwillaffect differentdesigndemographicsinArizona.From mypointofviewasacommercialdesigner,the effectoflegislationwillonlybeapositiveone.

Theterm“InteriorDesign”encompassesawide arrayofspecialtiesandspecifics:interiordesigner,interior decorator,residentialdesigner,commercialdesigner,kitchen designer,bathroomdesigner,setdesigner,stager,furnituredesigner, textiledesigner,flooringdesigner,manufacturer’srep.,furniture salesperson,draftsperson…Currentattemptsatlegislationare seekingtoincreasecommercialdesigners’abilities,andwillnot infringeupontheopportunitiesalreadyenjoyedbythemyriad otherdesignersworkinginthestate.

ThebillsubmittedtothelastsessionoftheArizonaCongresssought toincreasetheabilitiesofcommercialinteriordesignersbyallowing themtosigntheirowndrawingsforpermit.Currentlythiscan onlybedonebylicensedarchitects.

“Interiordesigndocumentsfiledwithanystateorlocal buildingdepartmentforthepurposeofobtainingabuilding permitshallbearthesealoftheengineer,architectorregisteredinteriordesignerwhopreparedorapprovedthedocumentsandthedateonwhichthedocumentsweresealed.”

Designersmustworkunderalicensedarchitect.Itisnotlawful foradesignertohireanarchitecttosimplysigndrawingsforthem. Thedesignermustbehiredbythearchitecttododesignwork. Withthesufferingeconomy,manyarchitectsarebranchingout andofferinginteriorservices–effectivelytakingworkaway fromqualifieddesigners.Ifdesignerswereabletostampandsign theirownnon-structuraldrawings,thiswouldopenthefieldback uptotheprofessionalsthathavetrainedtodothework.Thisability wouldalsoputinteriordesignersonthesamefootingasgeologists, homeinspectors,landsurveyorsandlandscapearchitects,whoare alreadyregulatedbythestate–therightandabilitytoeffectively dotheworkassociatedwiththeirprofession.

“RegisteredInteriorDesignermeansapersonwhoisregisteredpursuanttothischapterandwhoisqualifiedbythe boardbasedoneducationandexaminationtoprovideinteriordesignservicespursuanttothischapter.”

Legislationwouldnotbearequirementtopractice“InteriorDesign” inthestateofArizona.Itwouldbeanoptionforthosewishingto signnon-structuralinteriordrawings.Itissimilartotheoption manyhavenowtotaketheNCIDQortheCQRIDexamsandbecome “professional”membersofcertaininteriordesignorganizations. Ifadesignerchoosesnottotaketheexam,theydonotenjoyfull membershipbenefits;howevertheyarestillabletobeamember oftheorganizationandtoworkasadesigner.Similarly,ifadesigner wishesnottoberegistered,theywillnotbeeligibletostamptheir owndrawingsforpermit,butwillstillbeallowedtopractice interiordesigninallitsotheraspects.

Thechoiceofexaminationrequiredforregistrationwillbechosen byaboardofprofessionals,madeupfromtheregulatedprofessionsassociatedwiththebill:(2)architects,(3)engineers,(1)public member,(1)landscapearchitect,(1)geologist,(1)landsurveyor, and(1)interiordesigner.TheNCIDQisnotmentionedinthebill; norhasitbeenpre-determinedastheexamofchoice.

“Anapplicantforregistrationasinteriordesignershall complywithallofthefollowing:

•Possessatleastthreethousandfivehundredtwenty hoursofdiversifiedpracticalinteriordesignexperience.

•Nothavehadaregistrationdeniedorrevokedpursuant tothischapterwithinoneyearimmediatelypreceding theapplication.”

Thebilldoeshavea“grandfather”clauseforcurrentlypracticing designersthatwishtoberegistered,butdonotnecessarilyhave theeducationrequiredintherequirementslistedabove.

“Foranapplicantforregistrationasaninteriordesigner whoappliestotheboardwithineighteenmonthsafterthe effectivedateoftheamendmenttothissection, theboard maywaivetheexamination, educationorexperience requirementsfortheapplicantifbothofthefollowing apply:

•Theapplicantisactivelyengagedasaninteriordesigner ontheeffectivedateoftheamendmenttothissection.

•Theboarddeterminesthattheapplicanthassufficient competency.”

Thelegislationcurrentlyproposedspecificallystatesthatitwill notallowanyrestrictionsontherighttopracticeinteriordesign. Thelegislationislookingforanopportunitytoexpandtherights andprivilegesassociatedwiththeprofession.Itisunderstood, thatanyattempttorestrictworkbypracticingdesignerswould ultimatelyharmtheprofessionasawhole.

“32-144:ExemptionsandLimitations

ASIDsupportslegislationthatworkstowardsmorerecognition forinteriordesignersandtherighttopracticetothefullestextent possible,withouttherequirementtoworkunderanotherlicensed profession.Ibelievethisisapositivestepforwardforallinterior designers.
