Animal neglect earns fine An Ashburton farmer who failed to provide adequate food and water for 122 dairy cows was sentenced and fined in the Ashburton District Court yesterday. Paul Samuel Bailey, 51, appeared before Judge Noel Walsh for sentencing on three charges, including recklessly ill-treating a dairy cow, ill-treating a dairy cow by failing to give it adequate feed while pregnant and failing to ensure the physical health of 122 dairy cows.
At a hearing on January 19, Ministry of Primary Industries (MPI) prosecutor Grant Fletcher told the court that an MPI animal welfare inspector visited Bailey’s farm in Hinds on August 4, 2014, following a complaint from a member of the public. An inspection of a herd of cows on the property found that 122 mixed age cows belonging to Bailey were in “relatively poor condition”.

There was little grass cover on the farm, and there was no sign of supplement feed being fed to the cows. Bailey told the inspector that he would remove the 50 lightest cows from the herd and take them to another property where they would be fed kale and straw, however, when an inspector revisited the property on August 20, none of the cows had been removed. He said the cow subsequently calved and both the cow and calf died due to being in such a poor condition. However, at yesterday’s sentencing, defence counsel Greg Martin told the court that the
animals had not died, which was accepted by MPI. Mr Martin said his client accepted he should have taken steps to give the animal special treatment and adequate feed. During the inspection, it was also noted that most of the cows were suffering from a severe lice infestation.
