The ASCTE envisions a team with common goals and mutual accountability for student achievement that will become a national model in collaboration with governmental agencies,industry,andhighereducationspecializing incyber&engineering.

HISTORY

The AlabamaLegislatureestablishedASCTEasanindependent,residentialschoolforacademicallymotivatedand gifted students with educational opportunities and experiences in the rapidly growing fields of cyber & engineering. ASCTE will assist teachers, administrators, and superintendents across the state inreplicatingcyber &engineeringstudiesintheirownschools.

CORE VALUES

Establishing core values is essential to building a strong school culture, as values are the fundamentalbeliefsand principles that guide a school's behavior, decision-making, and interactions with the greater community. They represent the school's identity and provide a framework to create a positive learning environment. By clearly defining core values, a school can create a shared sense of purpose and direction while promoting respect and responsibility among its students, staff, and stakeholders. Moreover, core values can help a school navigate complex challenges and crises by providing a set of ethical principles to guide its response. Establishing core values is crucial for building a vibrant, resilient school community that encourages academic excellence, social-emotionallearning,andpersonalgrowth.

ASCTE aims for excellence in everything we do as students, teachers, administrators, and individuals. We recognize the values of Honor, Kindness, Tenacity,Integrity,andJoyasessentialqualitiesforaSentinelandstrive toupholdtheminourinteractions.

Honor: Honor exemplifies the principles of leadership and respect Sentinels set the highest standard by doing what is right and leading others to do the same

ASCTE’s philosophy emphasizes the notion that its graduates will go out into society and improve the state of Alabama, the United States, and the world at large. Students at ASCTE expand their worldviews through strong bonds with faculty, lifelong friendships, and unique experiences. Having a foundation built upon the core values the Honor Code at ASCTE rests as the cornerstone of the campus community. By pledging not to cheat, lie, or steal, members of the campus community hold each other to a higher standard, which allows people to build trustworthyandlong-lastingrelationships.

ASCTE’s core values and Honor Code provide clear understanding of the character commitment expected of all students. Thus, the honor code allows students to learn and grow from their mistakes with a framework of tiered disciplinary interventions. All students attending ASCTE shall uphold the Honor Code both on and off campus. Any student found in violation or assisting in the violation will be subjecttodisciplinaryactions. See the Code of Conduct section for the Honor Code expectations.

PUBLIC NOTICE STATEMENTS

NOTICE OF NON-DISCRIMINATION

ASCTE does not discriminate on the basis of race, color, national origin, sex, disability, age, sexual orientation, creed, religion, citizenship, non-English speaking ability, homeless or veteran status in employment, treatment, access to educational programs and activities, or admissions. Students with disabilities will be provided with the same needed support and services for extracurricular programs and activities that are provided during the school day, unless doing so would fundamentally alter the nature of the program and activity Anyclaimsshouldfollow the ASCTE Grievance Procedures. All inquiries and complaintsregardingcomplianceofthispolicyorregulation shouldbeaddressedtotheDeanofStudents.

GRIEVANCES

Ifastudentorparent/guardianbelievesheorshehasbeentreatedunfairlyregardingschoolmatters,federalorstate law, ASCTE policy, or ASCTE administrative regulations, he or she has the right to express a grievance. The student shall first attempt to resolve the matter at the classroom level and shallbeofferedanimpartialreviewand mediation by the student’scounselor.Iftheconcernisnotresolvedtothesatisfactionofthestudentorthestudent's parent/guardian, he or she may appeal to the Dean of Students who shall provideanimpartialhearingandmakea determinationinaccordancewithproceduresprescribedbyASCTE.

VISITORS

ASCTE welcomes visitors to the campus during regular school hours, under the proper conditions, and for the appropriate school-related reasons. Upon visiting the school, enter only through the main entrance, submitproper documentation to obtain a visitor’s pass from the receptionist in the main lobby before gaining access to anypart of the building. Visitors must be escorted at all times. The term “visitor’ includes, but is not limited to: parents, interested citizens, invited speakers, salespersons, news media, former students, students from other schools, all personsotherthanASCTEemployeesandstudents.

While visitors are welcome, some activities during the school day may not be open to the general public. Insuch cases, activitiesmayberestrictedtothosedirectlyinvolved,e.g.,parentsandfamilyofstudentsparticipatinginthe activity. No invited visitors will be denied attendance due to race, color, national origin, religious preference, disability, age, gender, sexual orientation, citizenship, non-English speaking ability, or homeless status unless otherwiseexcludedbylaworpolicy.

MANDATORY REPORTING

According toAlabamaLaw,allASCTEemployeesaremandatoryreporters. Asamandatoryreporter,anyASCTE employee who knows or has reasonable cause to believe or suspect that a child has been abused or neglected or who observes any child being subjected to conditions or circumstances that would reasonably result in abuse is required to report orally, eitherbytelephoneordirectcommunicationimmediately,followedbyawrittenreport,to DHR or law enforcement. This form is available at the Alabama Department of Human Resources, (256) 427-6200oralsoavailableforcompletionandwww.dhr.alabama.gov.

FAMILY EDUCATIONAL RIGHTS & PRIVACY ACT (FERPA)

In accordance with the Family Educational RightsandPrivacyAct(FERPA)(20U.S.C.§1232g;34CFRPart99) parents have the right to inspect their children's education records. These rights transfer to thestudentwhenheor shereachestheageof18.Studentstowhomtherightshavetransferredare"eligiblestudents."

● Parents or eligible students have the right to inspect and review the student's education recordsmaintainedby the school. ASCTE is not required to provide copies of records unless, for reasons suchasgreatdistance,itis impossibleforparentsoreligiblestudentstoreviewtherecords.ASCTEmaychargeafeeforcopies.

● Parents or eligible students have the right to request that ASCTE correct records which they believe to be inaccurate or misleading. If the school decides not to amend the record, the parent oreligiblestudentthenhas the right to a formal hearing. Afterthehearing,iftheschoolstilldecidesnottoamendtherecord,theparentor eligible student has the right to place a statement with the record setting forth his or her view about the contestedinformation.

● ASCTE must have written permission from the parent or eligible student in order to release any information from a student's education record. However,FERPAallowsASCTEtodisclosethoserecords,withoutconsent, tothefollowingpartiesorunderthefollowingconditions(34CFR§99.31):

○ Schoolofficialswithlegitimateeducationalinterest;

○ Otherschoolstowhichastudentistransferring;

○ Specifiedofficialsforauditorevaluationpurposes;

○ Appropriatepartiesinconnectionwithfinancialaidtoastudent;

○ Organizationsconductingcertainstudiesfororonbehalfoftheschool;

○ Accreditingorganizations;

○ Tocomplywithajudicialorderorlawfullyissuedsubpoena;

○ Appropriateofficialsincasesofhealthandsafetyemergencies;and

○ Stateandlocalauthorities,withinajuvenilejusticesystem,pursuanttospecificStatelaw

ASCTE may disclose, without consent, "directory" information such as a student's name, address, telephone number, date and place of birth,honorsandawards,anddatesofattendance.However,theschoolmusttellparents and eligible students about the directory information and allow parents and eligible students a reasonable amount of time to request that the school not disclose directory information about them. The school must notify parents and eligible students annually of their rights under FERPA. The actual means of notification (special letter, inclusioninaPTAbulletin,studenthandbook,ornewspaperarticle)islefttothediscretionofASCTE.

CLASS SCHEDULE

ATTENDANCE POLICY

ASCTE students must reside within the state of Alabama. Students who move out of state are no longer eligible for ASCTE enrollment and must withdraw. The only exception will be if a family is assigned for active military dutyoutsideofAlabama.

PHILOSOPHY: ASCTE believes that students enhance their learning and take advantage of the unique opportunities offered when they are in full attendance. If a student is absent, the parent/guardian must present a writtenvalidexcusewithinthree(3)days;otherwisetheabsencewillbecodedasunexcused.

Students must submit a leave request in REACH for any absence fromschool. Requestswillbeapprovedforany ofthereasonslistedunderexcusedabsencesbelow

EXCUSEDABSENCES

ASCTEacceptsthefollowingreasonsasgoodcauseforastudenttobeabsentfromschool:

● Doctor/Dental/MedicalAppointment-anyappointmentwherethestudentisseenorreceivesservices

● Illness-parent/guardianmaywriteanoteexplaininganyillnessofthestudent

● Death-Deathofafamilymember

● LegalObligation-anyrequiredappearanceofthestudentbysubpoenaorothercourtdocument

● Inclement/DangerousWeatherConditions-asdeemedbytheschool

● Quarantine/Isolation-asdeclaredbytheschool

● CollegeVisits-Documentationconfirmingvisitmustbesubmitted(photo,emailconfirmation,parkingpass,etc)

● Prior Permission - The parent/guardian request must be submitted on the appropriate form and approved by the Dean ofStudentsbeforeabsenceoccurs Noconsiderationwillbegiventorequeststhatoccurafteranabsence Five (5)daysisthemaximumnumberofdaysallowedinanyoneschoolyear

UNEXCUSEDABSENCES

Any absence without documentation or any absence that does not meet oneoftheexcusedcodeslistedabovewill be recordedasanunexcusedabsence. Anystudentwiththree(3)ormoreunexcusedabsenceswillbereferredto the Dean of Students for probationary review and may result in thestudentnotbeinginvitedtoattendASCTEfor thefollowingschoolyear.

EXCESSIVEABSENCES

Any student missing five (5) or more school days per term for any reason will be referred to the Dean of StudentsforreviewandmayresultinthestudentnotbeinginvitedtoattendASCTEforthefollowingschoolyear.

CHECKOUTS

All students must submit a REACH request and sign out when leaving campus during school hours. In the event that the parent cannot come to the school to sign the student out, or if the Main Office has not received a notice fromtheparent,thenthestudentmustobtainpermissionfromtheDeanofStudentsinordertobereleased. Nostudentmaysignoutunlesstheseconditionsaremet.

● Daytime Checkouts - ASCTE students will be allowed to check out from scheduled activities for sudden illness,afamilyemergency,adoctor’sappointment,orpre-approvedparent/guardianrequest,asfollows:

1. Sudden illness: If a student gets ill, he/she will visit the Nurses’ Office to be evaluated. If deemed appropriate, the parent/guardian will then be informed. Students should see orcontactthenursingstaff beforecallinghome.

2. Family emergency: The parent/guardian will contact the Dean of Students to request that the student bereleased.

3. Doctor’s appointment: Advanced notice to include student’sname,dateandtimeofappointment,and a phone number for the parent to confirm should be delivered to the Main Office the morning of the appointment. The parent/guardian (or approved designee) must sign out thestudentattheMainOffice. Parents areresponsiblefortransportingresidentialstudentstomedicalappointmentsandpickingupany medicationsthatareprescribed.

4. Parent/Guardian request: For reasons other than emergency, a written request must be submitted to the Dean Students for verification and approval. When possible, please make the request atleastaday inadvance,andincludeaphonenumberatwhichtheparent/guardiancanbereachedduringtheday

● Residential check out - ASCTE parents can signtheirstudentsoutorgivepermissionforstudentstogooff campus with friends or family. To give permission, parents must give writtenpermissionatleast48hours inadvance. Allpersonscheckingoutastudentmustpresentproperphotoidentification.

○ Weeknight check out - A student may requesttocheckoutonceduringtheweek. Requestsmaybe rejected by the Director of Residential Life for any reason to include, but not limited to, excessive requests,unclearinformation,unauthorizedhosts,etc.

○ Weekend check out - If a student is checked out for the weekend, the expectationisforthestudent to be offcampusforthefullweekend. Parentsmaynot“drop”thestudentbackoncampus. Oncea studentreturnstocampus,thestudentmustremainoncampusthroughthenewweek.

REACH SYSTEM

ASCTE has jurisdiction over students at all times except when theyarecheckedoutandintheirparent’scare.For this, ASCTE utilizes a program designed for boarding schools called Reachtoknowthewhereaboutsandprovide a way to contact students in case of emergency Students must sign out through this system everytimetheyleave campus, whether walking, driving, riding with other students,parents,orguests,leavingwithstaffonschooltrips, as well as going off-campus for weekends or breaks. For safety purposes, students must have at least onestudent with them at all times. Upon returning to campus, students must sign back in immediately. ASCTE reserves the righttorestrictstudentsign-outs,particularlyduringtimesofinclementweather.

During orientation, both students and parents will set up accounts with the Reach System.Logininformationwill be provided prior to move-in day and must be completed as part of the orientation checklist. Parents will be required to submit all overnight requests for their students through the Reach system. If someone other than the parent/guardian will be picking the student up, they must notate that in the request. Parents must give permission for any person signing out their student through the PowerSchool enrollment form. Please contact the Student Affairs Office to update this information throughout the year or if assistance is needed with submitting requests, resettingpasswordsetc.Seniorsmaybegrantedextraprivileges.

ARTICLES OF THE HONOR CODE

ARTICLE#1-HonestyandIntegrity

All students will demonstrate honesty and integrity in their work. Cheating, lying, and plagiarism will not be tolerated. Students are to understand and appreciate the privilege of attending ASCTE. As such, students are expectedtobeapositiverepresentationoftheschoolanditsmission.

Academic Honor Pledge for all graded work: “I pledge on my honor, I have neither given nor received any unauthorizedhelponthisassignment.”

Unacceptable Behavior: To lie or bedeliberatelydeceptiveoranyacttoobtain,attempttoobtain,oraidanotherto obtain credit for work by dishonest or deceptive means is prohibited.Cheating,lying,andplagiarismorproviding false information to a faculty or staff member is also a violation of this rule. Unacceptable Behavior: Any behavior that substantially disrupts the orderly conduct of a school function, substantially disrupts the orderly learning environment, or poses a threat to the health, safety, or welfare of students,staff,orotherstoincludeanycommunicationthroughelectronicorothermeans isprohibited.

● Bullying is any unwanted, aggressive, verbal, social, or physical behavior thatinvolvesarealorperceived powerimbalancethatisrepeatedovertime.

ARTICLE#3-RespectforPersonandProperty

All students will conduct themselves in a manner that is respectful of others to includetheirperson,property,and space. As such, ASCTE students willbeheldresponsibleforsecuringtheirbelongings.Studentswillrefrainfrom enteringanother’sroomwithoutpermission,uninvited,orwhentheoccupantisnotpresent.

Unacceptable Behavior: (Person) Defiance, Profanity - verbal, written or gesture, inappropriate physical contact, threats of violence, intimidation, inciting others, fighting, any harm or threat of harm is prohibited. (Property) Stealing/theftorvandalism-causingdamageordestructionof,ordefacementofanother’sproperty.

ARTICLE#4-RegardforAcceptableTechnologyUseandElectronicsPolicy

All students are expected to usetechnologyappropriately.Studentsareremindedthattheironlineactivityispublic and permanent. Students are asked to THINK before they post (Isittrue,helpful,inspiring,necessary,andkind?). Students and parents are expected to represent themselves positively and address others in a respectful manner onlinewhetherinchatrooms,throughemail,oronsocialmedia.

Unacceptable Behavior:Anyillegal,unkind,improper,unethical,orunauthorizeduseoftechnologytoinclude,but not limited to tablets/computers, mobile devices, or online venues such as social media and chat rooms is prohibited. Students must abide by the Acceptable Use Policy for technology and may be subject to dismissal basedontheironlinepresence.

ARTICLE#5-SafeandDrug-Free

In accordance with theSafeSchoolandDrug-FreeSchoolActoutlinedinALCode§16-1-24.1,ASCTEensuresa safeschoolenvironmentfreefromillegaldrugs,alcohol,andweapons.

UnacceptableBehavior:

● Drugs - The possession, transfer, sell, intoxication/under the influence, or use of any illegal narcotics, inhalants, alcohol, vaping products, tobacco products, associated equipment/devices or paraphernalia of saiditemsisstrictlyprohibitedonschoolproperty.

● Alcohol - The possession, sale, purchase, transportation, use, or intoxication/under the influence of alcoholic beverages or substances represented as alcohol at school, school-sponsored events, and on school-sponsoredtransportation.

● Weapons-Bringingorhavinginhis/herpossession,eitheronhis/herpersonorinhis/herpersonal belongingsaweaponisprohibited.Aweapon-definedasadevice,instrument,material,orsubstance, animateorinanimatethatisusedfor,isreadilycapableofcausingdeathorseriousbodilyinjury,designed toinflictharmonanotherpersonortointimidateanyperson.Aweaponisalsodefinedasaninstrumentnot usedforthepurposeforwhichitwasnormallyintendedthatiscapableofharminganindividual.

● Firearm - Bringing or having in his/her possession, either on his/her person or in his/her personal belongings,ahandgun,firearm,rifleorshotgun.

ARTICLE#6-PersonalSafety

Safety is a major concern for the ASCTE community.As young adults, students are responsible for their own safety. ASCTEstrivestoprovideasafeenvironmentforstudentsandstaff. Thefollowingsituationsposeariskto thestudentandarethereforeconsideredasviolations.

UnacceptableBehavior:

○ Fire - All students have a responsibility to keep campus buildings and dormitories safe from fire. Any items that cause a potential risk to fire safety, such as hot plates andcandles,arenotallowed.Nosmoking or open flame is allowed on campus. Also, tampering with or disabling fire safety equipment, or transmittingafalsefirealarmisprohibited.

○ Medication - Theunapprovedpossession,transfer,sell,overdose,neglect,abuseorunauthorizeduseofany prescribedorover-the-countermedication.

○ Curfew - From evening check-in until 6:00 am residential students are expected to beintheirdormitories. Earlymorningcommitmentsmustbeapprovedbytheresidentialadministrativestaff.

○ Sign out Compliance - Students during the schooldayandresidentstudentsleavingcampusmustfirstsign out with the Dean of Students or Academic Office. Failure to do so will result in a violation of this rule. Leavingwithanyoneotherthanthoseastudenthaspermissiontoleavewithisalsoaviolationofthisrule.

○ Campus Limits - Students will only be allowed to walk off campus with special permission and under specialcircumstances. Studentsareadvisedtowalkwithapartnerorhaveacellphoneasaprecaution

○ Sexual Behavior - Students should demonstrate self-control andrestraint. Anystudentengaginginsexual misconductmaybedisciplinedandsubjecttodismissal.

Any student found guilty of an Honor Code violation will have his/her parents notified of the incident and may receive other disciplinary actionsdependingonthedetailsandseverityofthecase.Also,thestudentwillbeplaced on probationary status for a specified period. A second honor violation within the probationary status period will result in automatic dismissal. ASCTE believes that one can learn from his mistakes, but must prove himselfonce givenasecondchance.

Any behavior not expressly written within this document is subject to review and disciplinary actions as determinedbytheDeanofStudents.

If the President acts uponthechargeoneofthetwoactionswilltakeplace:

a) The student’s discipline record will reflect the charge and consequences assigned by the Dean of Students and the studentmayadditionallybeplacedonprobation

b) Thestudent’sdisciplinerecordmaybechangedtoreflectanewchargeand/orconsequence

DISCIPLINARYHEARING/COMMITTEE

Purpose: In the event a student violates a major school rule or accrues ten (10) demerits, the President may refer the disciplinary review to the DisciplinaryCommittee.TheDisciplineCommittee’schargeistodeterminewhether ornotthestudentshouldremainatASCTEduetohis/herbehavior. Anycasemayresultinanexpulsion/dismissal.

Members: The Discipline Committee only convenes to hearthemostseriousoffenses;therefore,onlyfaculty/staff can serve on this committee. Members are appointed by the President. The Dean of Students serves as the ChairmanoftheDisciplineCommitteeandalsoservesasHearingOfficerfortheDisciplineCommittee.

Thestudent/parenthastherighttoappealthedecisionunderoneofthefollowingconditions:

ANTI-HARASSMENT/BULLYING POLICY

No student shall engage in nor should any be subjected to bullying, harassment violence, threats of violence or intimidation by any other student that is based on any of the specific characteristics set forth in this policy. Students who violate this policy will be subject to appropriate disciplinary sanctions as specified in the Student CodeofConduct,afteraninvestigationbyASCTEadministration.

DEFINITIONS

a. The term “harassment” as usedinthispolicymeansacontinuouspatternofintentionalbehaviorthattakes place on school property, on a school bus, or at a school-sponsored functionincluding,butnotlimitedto, written, electronic, verbal, or physical acts that are reasonably perceived as being motivated by any characteristic of a student, or by the association of a student with an individual who has a particular characteristic, if the characteristic falls intooneofthecategoriesofpersonalcharacteristics. Toconstitute harassment,apatternofbehaviormaydoanyofthefollowing:

● Placeastudentinreasonablefearofharmtohisorherpersonordamagetohisorherproperty

● Havetheeffectofsubstantiallyinterferingwiththeeducationalperformance,opportunities,or benefitsofastudent.

● Havetheeffectofsubstantiallydisruptingorinterferingwiththeorderlyoperationoftheschool.

b. The term “bullying” as used in this policy means any unwanted, aggressive verbal, written, electronic, social, physical behavior that involves a real or perceived power imbalance that is repeated or has the potentialtoberepeated,overtime.

● Have the effectofsubstantiallyinterferingwiththeeducationalperformance,opportunities,orbenefits ofastudent.

c. This includes “cyberbullying” any act of harassment, intimidation, discrimination or bullying committed through the use of digital technology, including but not limited to, email, blogs, cell phone, social media (Facebook, Twitter), chat rooms, instant messaging, or the use of data or computer software that is accessedthroughacomputer,computersystemorcomputernetwork.

d. The term “violence” as used in this policy means the infliction of physical force by a student with the intenttocauseinjurytoanotherstudentordamagetothepropertyofanotherstudent.

e. The term “threat of violence” as used in this policy means an expression of intention to inflict injury or damagethatismadebyastudentanddirectedtoanotherstudent.

RESIDENTIALEXPECTATION

f. The term “intimidation” as used in this policy means a threat orotheractionthatisintendedtocausefear or apprehension in a student, especially for the purpose of coercing or deterring the student from participating in or taking advantage of any school program,benefits,activityoropportunityforwhichthe studentisorwouldbeeligible.

g. Theterm“discrimination”asusedinthispolicymeansunjustorprejudicedtreatmentofstudentsbasedon personalcharacteristicssetforthbelow

h. The term “student” as used in this policy means a student who is enrolledintheMadisonCountySchool System.

DESCRIPTIONOFBEHAVIOREXPECTEDOFSTUDENTS

a. Students are expected to treat other students with courtesy, respect, and dignity and comply with the Student Code of Conduct. Students are expected and required(1)tocomplywiththerequirementsoflaw, policy,regulation,andrulesprohibitingbullying,harassment,violence,intimidation,ordiscrimination;(2) to refrain from inflicting or threatening to inflict violence, injury, or damage to the person or property of another student; (3) to refrain from placing a student in fear of being subjected to violence, injury, or damage when such actions or threats are reasonably perceived as being motivated by any personal characteristicsofthe studentthatisidentifiedinthispolicy.

b. Bullying, harassment, violence, threatofviolence,intimidation,anddiscriminationareprohibitedandwill be subject to disciplinary consequences and sanctions if the perpetrator of such action is found to have basedtheprohibitedactionononeormoreofthefollowingpersonalcharacteristicsof thevictim:

● Race,Color,Religiouspreference,Disability,Age,Gender,Nationalorigin,Citizenship,Non-English speakingability,and/orHomelessstatus.

REPORTING,INVESTIGATION,ANDCOMPLAINTRESOLUTIONPROCEDURES

a. Complaints alleging violations of this policy must be madeonBoardapprovedcomplaintformsavailable at the President’s Office or Student Affairs’ office. The complaint must be signed by thestudentalleging the violation or by the student’s parent or legal custodian and delivered to the President or President’s designee by either mail or personal delivery. At the request of the complaining student or the student’s parent or legal custodian, incidental or minor violations of the policy may be presented and resolved informally.

b. Upon receipt of the complaint, and evidence, if applicable, the President or the President’s designee will undertake an investigation of the complaint. The investigation will entail the gathering of relevant facts andevidenceandwillbeconductedinthefollowingmanner

i. The President or President’s designee shall investigate all complaints withinten(10)schooldaysof thedateofreceiptofthecomplaint.

ii. The President or President’s designee shall use the Complaint Action Form to document actions takenthroughouttheinvestigationwithintwenty(20)daysfollowingtheinvestigation.

iii. The President or President’s designee, within thirty (30) school days of the receipt of complaint, shallcompleteInvestigativeSummaryReportandmailtotheparentsofthecomplainant.

c. If the investigation establishes a violation, appropriate disciplinary sanctions will be imposed on the offending student(s). Other measures to prevent a recurrence of the violation(s) may also be imposed by thePresidentorASCTE.

d. Acts, reprisal, or retaliation against anystudentwhohasreportedaviolationofthispolicyorsoughtrelief provided by thispolicyareprohibited,andarethemselvesaviolationofthispolicy.Anyconfirmedactsof

reprisal or retaliation will be subject to disciplinary sanctions that may include sanction, penalty, or consequence that is available to school officials under the Code of Student Conduct. A student who deliberately, recklessly, and falsely accuses another student of a violation of this policy will besubjectto disciplinarysanctionsasoutlinedintheCodeofStudentConduct.

CONSEQUENCESOFVIOLATION

A series of graduated consequences is outlined in the Code of Student Conduct. The extent of the action taken will be determined by the degree and nature of the harassment. Such action may include disciplinary measures within Board policy guidelines. In certain cases, law enforcement orotherappropriategovernmentagenciesmay becontacted.

PROMULGATIONOFPOLICYANDRELATEDPROCEDURES,RULES,ANDFORMS

This policy and any procedures, rules, and forms developed and approved to implement the policy will be published, disseminated, and made available to students, parents and custodians, and employees by such means and methods as are customarilyusedforsuchpurposes,includingpublicationontheBoard’swebsite,theStudent CodeofConduct,StudentHandbooks,orfromASCTE’sDeanofStudents.

DRUGS/ALCOHOL/PROHIBITED ITEMS AND WEAPONS

ASCTE strives to maintain a positive learning environment for its students that is safe and drug free. As such, there are itemsthatareprohibitedforstudents. ThefollowinglistisnotanexhaustivelistandASCTEreservesthe righttochange,add,orre-classifyanysubstanceanddisciplinestudentsaccordingtotheCodeofConduct:

TOBACCO

Students shall not bring, possess, use, or sell tobacco/tobacco products in any form on school grounds or school activities. These items include, but are not limited to, electronic cigarettes; e-Cigarette, personal vaporizers, electronic nicotine delivery systems, or tobacco instruments/paraphernalia. Any student in violationofthispolicywillbesubjecttodisciplinaryconsequencesoutlinedintheCodeofConduct.

DRUGSandALCOHOL

Students are not to bring, possess,haveintheirpersonalbelongings,oruseonschoolgroundsorschoolactivities any drugs or alcohol. This includes any illegal drugs, oils, derivatives, synthetic drugs, prescriptionmedication, over the counter medication, drug paraphernalia, electronic cigarettes, e-Cigarettes, personal vaporizers, or electronic nicotine delivery systems; drug seeds and/or residue, simulated drug substances, alcohol or products containing alcohol, medication not prescribed for use by the student, andoverthecountermedication(outsideof the Medication policy). Any student found to be under the influence of or having consumed any of the outlined itemsissubjectfordisciplinaryactionsoutlinedintheCodeofConduct.

DRUGSCREENING

Beginning 30 days after enrollment, students may periodically and randomly be selected for drug screening. ASCTE reserves the righttoscreenurine,hair,blood,breath,orsaliva. Sincescreeningisrandom,somestudents may be tested multiple times and others not tested at all. A negative test result does not exempt a student from future testing. ASCTEreservestherighttotestanystudenttowhichthereisreasonablesuspicionthatthestudent has used drugs or alcohol. The President will confidentially communicate the results positive or negative to the student’s parents. Iftheresultsarepositive,thenthestudentwillbesubjecttodisciplinaryreviewandbereferred to an outside agency for counseling/rehabilitation at the parent’s expense. Refusal to undergo screening is groundsfordismissal.

WEAPONS

In accordance with the Code of Alabama §16-1-24.1, weapons are not permittedonschoolpropertyinAlabama. Students who violate this policy are automatically subject to dismissal/expulsion. ASCTE strictly prohibits the possession,use,and/orthreatofuseofweaponsoncampuses. Weaponsinclude,butarenotlimitedto:

● Knives (butterfly, switchblade, box cutter, utility knife, pocket knife, Bowie knife, hunting knife, single bladefoldingknife,multi-bladefoldingknife,kitchenknifewithsharporserratededges);

● Firearms/Guns (including paintball, pellet, BB, or a toy that could be mistaken for a firearm) and ammunition(includingjewelryorarticlesofclothingmadefromormadetolooklikeammunition);

● Throwingstars;

● Hatchetsandaxes;

● Swordsandothermartialartsequipment;

● Explosives(fireworks,firecrackers,dynamite;gunpowder);and

● Tasers.

ACCEPTABLE USE POLICY/ELECTRONICS POLICY (AUP)

ASCTE providesitsfaculty,staff,andstudentswithaccesstoinformationandcomputingresources. Eachmember oftheASCTEcommunityhasbasicrightsandresponsibilitiesthatare unethicaltoviolateorignore. Allmembers of the ASCTE community are accountable for their use/misuse of these resources. Appropriate use of these resources are legal, ethical, respectful of intellectual property, data, resource consumption, security systems, individual rights to privacy, individual rights to freedom from intimidation and harassment,andappropriateinthe areasofexpressionandcommunication.

Access to these resources is a privilege and not a right and may be revoked by the school administration at any time for misconduct. ASCTE reserves therighttolimitthecontentofmaterialthatstudentsreadduetolegitimate pedagogical concerns and the right to monitor, track, and, when necessary, examine all computer use at ASCTE. Thisincludesbutisnotlimitedto:

● Protectingstudents’exposuretoinappropriatesites/contentbyinstallingfilters

● Trackingofstudents’usebymaintaininghistoricalsystemlogs.

● Searchingpersonalcomputerswhenthereisevidenceorsuspicionofmisuseorinfraction

● Viewingorinspectinganyfile,transmissionorprogramsonpersonalcomputers.

Prohibited activity/behaviors are subject to disciplinaryactionuptoandincludingtermination,prosecution(where applicable),and/orrestitutionfordamages/loss. ThefollowingactionsareprohibitedbyanyASCTEstudent:

MINORVIOLATIONS

a. Accessing another individual's materials, information, files folders, or work without the permissionofthat person

b. Violating copyright or otherwise using the intellectual property of another individual or organization withoutpermission

c. Usingpasswordsotherthanone’sown

d. Givingoutpersonalinformationonlinesuchasfullname,homeaddress,phonenumber,etc.

e. Usingsoftwarethathasnotbeenassignedorapprovedbystaff

f. Failing to follow a district policy while using computers or failing to follow any other policies or guidelinesestablishedbythedistrictadministration,teachers,orotherappropriatedistrictstaff

g. Seeking to gainorgainingunauthorizedaccesstoinformationresourcesorothercomputingdevices(level 1hacking)

h. Accessingchatrooms,andsitessellingtermpapers,bookreportsandotherformsofstudentcoursework

i. Intentionallywastinglimitedresources

j. Negligent care of or accidents to computers resulting in repeated repairs to a singular computer or multiplecomputers.

INTERMEDIATEVIOLATIONS

a. Accessing, uploading, downloading, posting or distributing pornographic, obscene, or sexually explicit material

b. Transmittingobscene,abusive,sexuallyexplicit,orthreateninglanguage

c. Broadcastingunsolicitedmessages(“spamming”)

d. Usingthenetworkforcommercialpurposes

e. Harassing,insulting,orattackingothers

PERSONAL DEVICES/TECHNOLOGY ETIQUETTE

ASCTE permits the use of personal technology on campus. This technology includes, but is not limited to, laptops, desktops, cell phones, tablets, Blackberries, PDAs, language translators, video players, and audio players. Students are expected to use these devices properly and within the guidelines set forth by ASCTE. Personal technology is permitted in the classroom provided permission has been granted by the course instructor. Devices may be confiscated or searched in the event that ASCTE believes:(a)thatausermaybein violation of the law, the AUP, or any other school rules of conduct; (b) that apersonorpropertyisinjeopardy; or (c) that the device has become a distraction to the learning environment. Students are expected to demonstratethefollowingpersonaldevicemanners:

Residential Life

RESIDENTIAL HALLS

The dormitoryisthestudents’homeawayfromhome. Dormstaffwillensurethatthedormenvironmentreflectsa fun and positive community where students feel safe and secure. Students are encouraged to participate in residential life activities. All residential students are expected to be in the residence hall beginning at 7:30pmon SundayuntilclassesendonFridayafternoon.

The dormitory is staffed with the Director of Residential Life, the Assistant Director of Residential Life, and residential assistants, all of which reside on campus. All ASCTE staff members share evening and weekend responsibilities, although the Director of Residential Life is responsible for coordinating dormitory duties and activities. Parents are encouraged to reach out to the residential staff member on duty (256-697-3871) to share informationorconcerns.

DORM ROOM

The dormitory sits perpendicular to theacademicbuilding. Thedormitoryconsistsoffourfloorswiththebottom floor consisting of the cafeteria, locker rooms, and work out room while the top three floors are dedicated to residential living spaces for staff/students. Each room is double occupancy and is equipped with two beds, two desks, two chairs,andseparatedrawerspacesforeachstudent.Bathroomsaresharedamongtworooms,andeach bathroomhastwosinks,ashower,andatoilet.

Dorm life enhances a student’s life development skills and independence while building community among the students. Dorm room and roommate assignments will be given during orientation. DRIVING/RIDING/PARKING PRIVILEGES

Any student who is sixteen years of age or older properly enrolled as a sophomore or higher at ASCTE and with proper documentation from the Department of Public Safety may apply for driving privileges. Students must present a valid driver’s license, current vehicle registration, and current insurance documentation. Students will only be allowed to operate the vehicle that they register. Studentsandparentsareresponsibleforthemaintenance and upkeep of the vehicle. Insurance documentation must be updated at the beginning ofeachsemester. Driving privileges may be revoked based on the student’s good standing status. Any student with ten (10) or more absenceswillautomaticallylosedrivingprivileges.

ABSENCESDUETOILLNESS

Students should not attend class if experiencing fever, vomiting, diarrhea, or other symptoms of communicable diseases. If the illness begins while the student is on campus, it is the student’s responsibility to see the nurse before missing class. (Pleasenote:Thenursecannotexcuseastudentfromaclassthathasalreadybeenmissed.)If a class is missed, thestudentshouldnotifytheteacheroftheabsencebyvoicemailoremail. Thenursecanexcuse a student from class due to illness, require the student to stay in their dorm room, and/or require the parent/guardian to pick up the student. The nurse also has the discretion assigning residential students to quarantine spaces if illness indicates. Students excused from the academic day due to illness must remain off campus, in their dorm room, or in thequarantineroomuntilre-assessedbythenurse. Studentswhoseresidenceis more than 2 hours away from ASCTE may be transported at the discretion of the nurse to seek medical attention for acute illness. NOTE:Ifthestudentsubsequentlyattendsanyotheractivities,curricularorextracurricular,while he/sheisexcusedbythenurseforillness,allclasseswillbecomeunexcused.

COMMUNICABLEDISEASES

Students with any known communicable disease or parasite that is spread by any form of casual contact may be excluded fromclass/schoolinordertomaintainasafeandhealthylearningenvironment.ASCTEreservestheright to exclude any student, and such exclusion shall be for a period of time as may be prescribed by the local health department, school nurse, or physician. Before the student mayre-enter school, a statement of clearance from the DepartmentofHealth,schoolnurse,oraphysicianisrequired.

MEDICATION

ASCTE strives to maintain the physical andemotionalhealthofitsstudents. Therefore,theparentmustnotifythe school of any prescribed or over-the-counter medication the student uses and update this information regularly. Failure to notify the school of a change to the approved medications a student may possess could result in disciplinary action. No expired medications will be administered. Changes in medications (prescription or over-the-counter) require updated paperwork in a timely manner Medications maintained in the clinic must be pickedupattheendoftheacademicyearortheywillbedisposedofwithin24hoursafterthelastdayofschool.

In addition to physical illness, ASCTE understands that students may also have mental health concerns. These concerns are temporary stemming from normal, transitional issues related to the academic pressure and/or adaptation to a residential environment. Other concerns may be more severe issues and long-term in nature. Regardless of the concerns, ASCTEwilltakereasonableandappropriatemeasurestoaccommodatestudentsonan individual basis. Parents/guardians need to notify ASCTEofanyhealthconcerns,includingmentalhealth,thatthe student may have exhibited. ASCTE reserves the right to require a letter from the student’s therapist/psychiatrist/psychologist, stating the student can handle the academic and residential pressures at ASCTE.Atanytimeasaprecautionarymeasure,ASCTEreservestherighttorequireamentalhealthevaluationat the parent’s expense. If it is discovered that the school was not informed of the student’s history, continued enrollmentwillbereviewedbytheschooladministration.

1. The student will contact their parent or guardian to inform them of the situation and talk through the reasonsforrequestingamentalhealthday.

2. The parent or guardian will send an email request for a mental health day to the DeanofStudentServices andccthementalhealthcounselor

3. The counselor will contactthestudentrequestingamentalhealthdaytoassessthestudent(days-byphone andresidentialstudentseitherattheresidencehallorattheschoolbuilding).

4. Upon meeting with the student, a plan will be outlined for the day and this will be agreed upon by the counselorandstudentandwillthenbecommunicatedtotheparentorguardian.

JASON FLATT ACT

SECTION1-PreventionofSuicide

The Jason Flatt Act was passed in ordertoequipAlabamaschooldistrictsandtheirpersonneltorecognizeandact on signs of suicide risk in order to provide prevention, intervention, and postvention with students at risk, their families, and their communities who may be affected. This act, which amends 16-28B-8oftheCodeofAlabama 1975,includespreventionofharassmentandviolence. ASCTEwillfollowtheALSDEmodelpolicy.

SECTION2

TheJasonFlattActincludesseveralelementswhichshouldbeinterpretedasPolicy. ASCTEwill:

(1) Fosterindividual,family,andgroupcounselingservicesrelatedtosuicideprevention.

(2) Make referral, crisis intervention, and other related information available for students, parents, and schoolpersonnel.

(3) Fostertrainingforschoolpersonnelwhoareresponsibleforcounselingandsupervisingstudents.

(4) Increasestudentawarenessoftherelationshipbetweendrugandalcoholuseandsuicide.

(5) Educatestudentsinrecognizingsignsofsuicidaltendencies,otherfactsandwarningsignsofsuicide.

(6) Informstudentsofavailablecommunitysuicidepreventionservices.

(7) Promote cooperative efforts between school personnel and community suicide prevention program personnel.

(8) Fosterschool-basedorcommunity-based,orboth,alternativeprogramsoutsideoftheclassroom.

(9) Developastrategytoassistsurvivorsofattemptedsuicide,students,andschoolpersonnelincopingwith theissuesrelatingtoattemptedsuicide,suicide,thedeathofastudent,andhealing.

(10) Engage in any other program or activity which the Board determines is appropriate and prudent in the effortsoftheschoolsystemtopreventstudentsuicide.

(11) Provide training for school employees and volunteers who have significant contact withstudentsonthe Boardpoliciestopreventharassment,intimidation,andthreatsofviolence.

(12) Develop a process for discussing local board policiesrelatingtothepreventionofstudentsuicideandto thepreventionofharassment,intimidation,violence,andthreatsofviolencewithstudents.

(13) Provide annual training for all certificated. School employees insuicideawarenessandprevention.This training may be provided within the framework of existing in-service training programs or as a part of requiredprofessionaldevelopmentofferedbytheschoolsystem.

SECTION3-DescriptionofBehaviorExpectedofStudents

Students are expected to treat other students with courtesy, respect, and dignity and comply with the Code of Student Conduct. Students are expected and required to (1) comply with the requirements of the law, policy, regulation, and rules prohibiting harassment, violence, or intimidation, and (2) comply with ASCTE prevention strategiesrelatedtosuicideprevention,intervention,andpostventionsupport.

SECTION4-ResponsibilityofReporting

Any person involved in a cause of action or omissionresultingfromtheimplementationofthissuicideprevention policy or resulting from any training, or lack thereof, required by this section, shall be subject to state immunity law

STUDENT SAFETY PLAN SUICIDE PROTOCOL

1. REQUEST FOR ASSISTANCE - Once a student has expressed ideation to harm oneself and/or others, the counselor will be notified immediately. If the counselor is not available, the nurse will be contacted to complete the Student Safety Plan Protocol. The counselor/nurse notifies the President IMMEDIATELY. If the President isnotavailable,itisthePresident’sdesignee’sresponsibilitytonotifythePresident. Inthecaseofan emergency,911assistancewillbecalled.

2. PARENTAL NOTIFICATION - Note: The counselor/nurse/president/president’s designeewillremainwiththe student until the parent/guardian arrives. The counselor/nurse/president/president’s designee will contact and meetwiththeparent/guardianimmediately.Thepurposeoftheemergencyconferenceistodiscussthestudent's immediatepsychologicalandsafetyneeds,includingsupervision.Topicstobediscussedinclude:

Ifthestudentistakentothehospital,thecounselor/nurse/principal/principal’sdesigneewillaccompanythe child.Oncetheparent/guardianarrives,thecounselor/nurse/principal/principal’sdesigneemaychooseto remainbutisnolongerrequired.

Theparent/guardianwillbeaskedtosigntheStudentSafetyNoticeandNoticeofEmergencyConference Form.Theparent/guardianwillalsobeaskedtoindicatewhethertheywillseekmedical/mentalhealth assistancefortheirchild.Thisformacknowledgesthattheparent/guardianhasbeennotifiedofhis/herchild's behaviorsandtherecommendationsfortreatmentoptions.Theformwillbekeptinaconfidentialfileseparate fromthestudent’scumulativefolder.

Whenthestudentreturnstoschool,thecounselor/nurse/president/president’sdesigneewillconducta mandatoryreadmitconferencewiththestudentandparent/guardian.Atthattime,appropriateclearance documentation(i.e.,dischargeform,doctor’snote,mentalhealthclearanceform,etc.)willbecollectedfrom theparent/guardian.Acopyofthisdocumentationshouldbeattachedtotheschool’scopyoftheStudent SafetyPlanProtocolandbesenttotheStudentAffairsOffice,GuidanceDepartment,inanenvelopemarked “CONFIDENTIAL.”

3. FOLLOW-UP

During the mandatory readmit conference with the parent/guardian, the counselor/nurse/president/president’s designee needs to obtain a copy of the release/discharge paperwork/medical clearance document showingthat the student has been assessed by a medical/mental health provider. The counselor will conduct a follow-up conference with thestudentassoonasthecounselorreturnstocampusandwillcontinuetomonitorthestudent onceaweekforfourweeksandasneededthroughcontactwithstudent/teacherand/orobservation.
