FRIENDS OF LAVERTON CREEK

On a very cold Winter morning on Wednesday 13th July twenty one member of the Karen community of Laverton in partnership with Hobson’s Bay City Council, Friends of Laverton Creek, Laverton Community Hub and Melbourne Water planted 250 trees and grasses along Laverton Creek. The trees and grasses were planted along the creek area adjacent to Bladin Street to beautify the area and provide a healthy recreational environment.

The group brought along their shovels and picks to assist in the enhancement of tis once neglected open space, worked tirelessly for three hours and then joined together for a BBQ lunch to celebrate their efforts.

On behalf of the Wyndham Community & Education Centre, I would like to thank Andrew Webster and Pat O’Brien from the Hobson’s Bay City Council for inviting our Women’s Group to be a part of the project.

with Roving Reporter Val It’s Spring, let’s hope it soon warms up. It is nice to see the Wattles in flower and the winter roses still blooming.

At the mini bike meeting held in August at Wyndham Council great ideas for the future of the track were voiced, but they still have to get many permits to make it happen. If the ideas by Motorcycling Victoria come into action they will then make a decision as to what capacity bike will be allowed to ride. They are saying it will not be used for competition.

The Laverton Community Association held it’s AGM in August and was a success but, more residents need to attend to give it strength and ideas. The members work to improve our area and for the cost of only $1.00 per year why not have your say. They meet at the Hub in Railway Ave on the 3rd Wednesday of every second month. The next one is in October.

The Western Suburbs National Services Group is also looking for members. Anyone who was conscripted into the Army, Air or Navy from 1951 to 1972 is welcome to join. Numbers are reducing as the first intake ages and their health deteriorates but the younger ones e.g. Those who served in Vietnam, would reinvigorate the group. If you need more details please contact Tom Crooks at the Altona RSL on 93982817. They meet once a month at the Altona RSL to keep members in touch with each other and to let them know what other groups in the State are doing.

Once again, as per usual, we have lost a couple of walkers. Some like my son have moved, others have had to give it away through ill health, so if you can help please leave your name, phone number and address on our answering machine as we are probable out walking the papers ourselves until a replacement is found. It usually only takes ½ hour once a month 10 time a year. (no paper Jan & Feb).

Consent & Rape

When a matter is before the courts regarding the criminal offence of rape, a central element in regards to the offence is that of consent. All legal matters before the courts are complex, however, cases involving sexual penetration without consent can be of particularly difficulty due to the nature of the offence, the effects on a complainant, as well as the evidence to be adduced. Both the common law and legislation deals with the offence of rape extensively and because the question surrounding consent can go to the heart of such matters, the law has had to define what constitutes consent.

The offence of rape From the common law, the High Court in Papadimitropoulos v The Queen defined rape as “… carnal knowledge of a woman without her consent: carnal knowledge is the physical fact of penetration; it is the consent to that which is in question; such a consent demands a perception as to what is about to take place; as to the identity of the man and the character of what he is doing.

But once the consent is comprehending and actual the inducing causes cannot destroy its reality and leave the man guilty of rape.”

In order for an offence of rape to have been committed there must be penetration, and before the laws were amended penetration was only viewed as penile penetration of the vagina. Now sexual penetration without consent can involve penetrating a vulva, vagina, anus or mouth.

All jurisdictions have laws regarding rape, and we can look towards s 38 of Victoria’s Crimes Act as a legislative example as to the elements which constitute the offence: “(1) A person must not commit rape.

Penalty: Level 2 imprisonment (25 years maximum).

(2) A person commits rape if(a) he or she intentionally sexually penetrates another person without that person’s consent(i) while being aware that the person is not consenting or might not be consenting; or (ii) while not giving any thought to whether the person is not consenting or might not be consenting; or (b) after sexual penetration he or she does not withdraw from a person who is not consenting on becoming aware that the person is not consenting or might not be consenting.

(3) A person (the offender) also commits rape if he or she compels a person(a) to sexually penetrate the offender or another person, irrespective of whether the person being sexually penetrated consents to the act; or (b) who has sexually penetrated the offender or another person, not to cease sexually penetrating the offender or that other person, irrespective of whether the person who has been sexually penetrated consents to the act.

(4) For the purposes of subsection (3), a person compels another person (the victim) to engage in a sexual act if the person compels the victim (by force or otherwise) to engage in that act(a) without the victim’s consent; and (b) while(i) being aware that the victim is not consenting or might not be consenting; or (ii) not giving any thought to whether the victim is not consenting or might not be consenting.”

Consent One of the central elements of the offence of rape is the question of whether the complainant consented to the penetration by an accused.

Additionally, it should also be noted that the complainant must also have the capability to consent as well.

Chief Justice King in Question of Law Reserved on Acquittal (No 1 of 1993) said: “The law on the topic of consent is not in doubt.

Consent must be a free and voluntary consent.

It is not necessary for the victim to struggle or scream. Mere submission in consequence of force or threats is not consent. The relevant time for consent is the time when sexual intercourse occurs. Consent, previously given, may be withdrawn, thereby rendering the act nonconsensual. A previous refusal may be reversed thereby rendering the act consensual. That may occur as a consequence of persuasion, but, if it does, the consequent consent must, of course, be free and voluntary and not mere submission to improper persuasion by means of force or threats.”

Some jurisdictions have defined the elements that constitute consent in a sexual case and an example can be found in s 348 of Queensland’s Criminal Code which states: “(1) In this chapter, consent means consent freely and voluntarily given by a person with the cognitive capacity to give the consent.

(2) Without limiting subsection (1), a person’s consent to an act is not freely and voluntarily given if it is obtained (a) by force; or

(b) by threat or intimidation; or (c) by fear of bodily harm; or (d) by exercise of authority; or (e) by false and fraudulent representations about the nature or purpose of the act; or (f) by a mistaken belief induced by the accused person that the accused person was the person’s sexual partner.”

Can consent be communicated via the conduct of a person?

The common law has noted that consent may be communicated by conduct, with McPherson JA in R v Millar stating: “It is the nature of things rare for consensual conduct involving intimacy of this kind to be preceded by formal offer and acceptance. In some instances, consent is capable of being inferred from acquiescence in the continuation of the activity.”

Can consent be given then withdrawn?

We should re-emphasise the judgment of King CJ in the matter of Question of Law Reserved on Acquittal (No 1 of 1993) with his Honour stating: “Consent, previously given, may be withdrawn, thereby rendering the act non-consensual.”

News from CR Carl Marsich Spring in Hobsons Bay marks the beginning of the annual Spring into Life event to encourage everyone in the community to get out and about after the lull of winter. The Laverton Bowling Club is holding free beginner sessions on Sunday, 20 and 27 September from 10.30am. Perhaps Zumba is more your thing? If Tai Chi seems a more gentle start to your morning, come to the Laverton Community Hub on Friday 18 September at 9.30am and experience this ancient tradition for free. Speaking of infrastructure projects, building works on the pavilion at Bruce Comben Reserve are progressing well and are expected to finish by October. Works have also begun on the Laverton Creek Trail shared path along Watts Street and Williams Road.

I was extremely pleased in being given the opportunity to formally open AB Shaw Reserve’s redeveloped playground last month, which features Hobsons Bay first flying fox and also an extremely impressive bird nest swing. There was significant community input into the planning and development of the playground and more than 300 local residents attended the opening, making it a great success for our community.

Lastly, if you like owls, puppets and entertainment, come to the Old Laverton School on 25 September for The Owl’s Apprentice. The shadow puppet performance, ideal for young children and families, is part of the Arts at Your Doorstep program and tickets are available from www.hobsonsbaytickets.com.au. Congratulations to a number of local organisations who have recently received extra funding to help them continue their fantastic work serving our local community.

Altona Life Saving Club will share in $12.5 million to purchase much-needed equipment through the 2015-16 Volunteer Emergency Services Equipment Program. These grants go towards operational equipment such as trucks, tankers, watercraft, trailers and minor facility improvements for volunteer groups.

How quickly the term goes when you are having fun and learning. As planning educators we step into the position of the educators that are leaving room for their planning and we continue with the day’s program. We are often in many different rooms throughout the day, where children are at different stages of development, As planning educators we cooperate with different educational programs and individual children’s routines. We interpret children’s interests and needs and provide time and space for children to engage in both individual and collaborative play. We are aware of the stages of social play which is very important in helping children to interact with others. These stages include: Exploratory play: where a child seemingly has random interactions with things and people around them. Often as if there was no purpose to their play, but we know better.

Onlooker Play: where a child seems to be playing alone while actually watching others play activities.

Solitary Play: where a child plays alone or near another child with no interaction between them.

Parallel Play: where children play near each other using similar materi als but with little or no social interaction.

Cooperative play: this play is very social and may include common goals, negotiating decision making and rule setting.

Children pass through these stages as they grow but it is important to keep in mind, as educators that at any age a child’s play may reflect an earlier stage often when children are exposed to a new situation. The girls went to the Bowling Club where Entertainer, Ron Sutton, made it a memorable and fun occasion.

On the 11th August the Committee had their Annual Lunch at the Harbour Inn Altona. It was an enjoyable event.

LAVERTON POLICE S T A T I O N Hi all.

I’m Inspector Michelle Young and I’m currently the Local Area Commander for Hobsons Bay, the local Police Service Area (PSA) that Laverton sits within.

Recently, with Supt Bateson and Sergeant Steve Bosnar, I was a guest at Hobsons Bay Citizenship Ceremony at Laverton Community Hub. May I honestly say how humbled I was and how proud I was to see so many smiling happy faces making themselves ‘family’ within our communities.

Although som etimes we see a lot of ‘stuff’ we’d like to change or do away with, it’s moments like welcoming new citizens that ensure that we continue to focus on the good within our communities. I’d encourage each of you to be active around your communities, whether that is taking part in committees to influence the good, right down to ensuring that you know your neighbours. It may surprise you how many of our elderly in particular don’t have anyone checking up on them and in some instances; police are the ones knocking on their doors checking on them. Next time, yell out ‘Hi’ and you may be surprised at how grateful someone may be for a simple word and a ‘smile’.

We have noticed that recently there are a large number of vehicles broken into throughout our PSA. The unfortunate contribution is that we are still leaving valuables within sight when we’re leaving our vehicles and this occurs during the day when the vehicles are at railway stations or in our drives whilst we work, and at night when we’re sleeping. The inconvenience of having to contact banks/Vic Roads/Shops, etc., can be reduced by ensuring that your vehicle is locked and taking the valuables with you, including the small change we leave in our consoles. For our tradies, your utes filled with tools, are like taking kids to candy shops, and I ask you again, be mindful and ask the question ‘AM I CONTRIBUTING TO ME BEING A TARGET?’.

I’d also ask you to consider investing in ‘one way screws’ for your rego plates (available at Bunnings) as plates too are attractive to those wanting some ‘free petrol’, joy rides through tolls and worst result, being on stolen vehicles involved in committing crimes.

The same principle applies to your homes and your businesses. Make sure your windows and doors are secure and even consider investing in a security system or buying ‘dummy’ cameras and alarms from Dick Smith or similar. You may be surprised how easy it is to make sure we are not setting ourselves up to have our premises broken into.

Working together, we can all do something towards making our communities feel safe.

I encourage you that if you see something that doesn’t sit right with you, like a suspicious vehicle – get the rego, or someone in your neighbours’ yards when they’re not home, don’t hesitate to contact 000 or call Crime Stoppers (1300 333 000). tennis club The team of coaches and committee once again warmly welcome all readers to this issue. Winter season WRTA competition has been completed with nine of our teams, both Junior and Senior, progressing to finals action. Good luck to all our teams during finals and trust you can bring home some pennants of success. A BIG THANK YOU also goes out to the teams that competed for the club but fell short of finals appearances. Another season is just around the corner.

With this in mind, SUMMER competition teams have been finalised and it is pleasing to say that numbers of teams competing has increased once again and look forward to competition starting late October. TUESDAY NIGHT MENS has started as well with three teams competing. If you are still interested to join and have a go don’t worry we are always looking for new members and players even to be named as ‘emergencies’ with emphasis on expanding our mixed team players and also appealing to our female readers (all ages) to set up mixed and ladies teams for various competitions but also to our Juniors base both boys and girls. Don’t forget our motto is: “Tennis is fun for everyone”.

ANZ HOT SHOTS FOR JUNIORS: Term 4 registrations and placements filling fast so please register asap with this programme being a great introduction for 5-12 year olds commencing after term holidays, and promoted by Tennis Australia to come and have a go in this non-contact and enjoyable sport with the interest and enthusiasm currently being enjoyed in tennis in this country it certainly is a great time for tennis in Australia.

GENTLE REMINDERS: Courts at our club are available for general hire at very generous rates and subject to conditions in respect of registration, attire, and respect of facilities as well as Wednesday night social tennis being a great way to come and enjoy a hit and meet new people from 7:30pm to 9:30pm. Behind This Smile Behind this smile I see my people trying to change themselves to fit in.

When I came to Australia 16 years ago, it was different, there wasn’t any help, and there is help now. Being new in this country we all want to learn.

We want to come here and get a new life, we want to bring our own culture as well, and we want to enjoy a life where the two cultures come together.

We have to mix it up to learn and grow. The young ones come here now and they go straight to school, but the elderly come like I did, with no language, no English, and it is very hard in our community. We try to change ourselves to fit in and the biggest part of that change is the need to learn. The young ones can learn fast because they are in school, but the older ones find it difficult. It is hard to change.

You have to think of racism as the need to learn, to know the right way. When we are close to each

other, living in the same country, the same state, same suburb, same street, same village, we have to get to know each other. We are the new tribe here, you are in your tribe and we have to come together.

I try to help our people learn the right way. I tell them we have to follow the ruling country; we have to learn to know them. If we learn, then later we will improve. There are a lot of things we don’t know, but we can learn. I have to look at you and I have to know which way you are showing me; if you are showing me the right way then I can follow and learn. We have to learn the right way. If we follow the right way, we will get the benefit; we will all get the benefit. I love to follow people that do the right thing, that know the right way. Akon
