1. I lotti sono posti in vendita dalle Aste Boetto in locali aperti al pubblico , essa agisce quale mandataria in esclusiva in nome proprio e per conto di ciascun Venditore il cui nome viene trascritto negli appositi registri di P.S. presso Aste Boetto. Gli effetti della vendita influiscono sul Venditore ed Aste Boetto non assume nei confronti dell’Aggiudicatario o di terzi in genere altra responsabilità oltre quella ad essa derivante dalla propria qualità di mandataria.
2. Gli oggetti sono aggiudicati al migliore offerente e per contanti; in caso di contestazione tra più Aggiudicatari, l’oggetto disputato potrà, a insindacabile giudizio del Banditore, essere rimesso in vendita nel corso dell’Asta stessa e nuovamente aggiudicato. Nel presentare la propria offerta, l’offerente si assume la responsabilità personale di corrispondere il prezzo di aggiudicazione, comprensivo della commissione dei diritti d’asta, di ogni imposta dovuta e di qualsiasi altro onere applicabile.
3. Aste Boetto si riserva la facoltà di ritirare dall’Asta qualsiasi lotto. Il banditore, durante l’Asta, ha la facoltà di abbinare o separare i lotti ed eventualmente variare l’ordine di vendita. Lo stesso potrà, a proprio insindacabile giudizio, ritirare i lotti qualora le offerte in Asta non raggiungano il prezzo di riserva concordato tra Aste Boetto ed il Venditore.
4. Alla cifra di aggiudicazione sono da aggiungere i diritti d’asta del 25%. Sui beni contrassegnati con “*” che provengono da imprenditori non soggetti al regime del margine, la vendita é soggetta ad Iva sull’intero valore di aggiudicazione.
5. Il Direttore della vendita può accettare commissioni d’acquisto delle opere a prezzi determinati su preciso mandato e può formulare offerte per conto del venditore.
6. Aste Boetto può accettare mandati per l’acquisto (offerte scritte e telefoniche), effettuando rilanci mediante il Banditore, in gara con il pubblico partecipante all’Asta. Le Aste Boetto non potranno essere ritenute in alcun modo responsabili per il mancato riscontro di offerte scritte, telefoniche, e via web, o per errori ed omissioni relative alle stesse. 6bis.
Con la richiesta telefonica, la Casa d’Aste Boetto prenderà contatto telefonico ai numeri indicati, al momento in cui verranno posti in vendita i lotti elencati.
Con la richiesta telefonica si intende garantita da parte del cliente un’offerta al banco pari alla cifra minima presente sul catalogo per ogni lotto di suo interesse.
Qualora per qualunque motivo, anche di natura tecnica, non riuscisse il contatto telefonico, la presente richiesta varrà come incarico per
effettuare per conto del cliente offerte per l’acquisto dei lotti elencati fino al prezzo minimo indicato sul catalogo per ciascun lotto.
7. Nel caso di due offerte scritte identiche per il medesimo lotto, lo stesso verrà aggiudicato all’Offerente la cui offerta sia stata ricevuta per prima. Aste Boetto si riserva il diritto di rifiutare le offerte di Acquirenti non conosciuti a meno che venga rilasciato un deposito ad intera copertura del valore dei lotti desiderati o, in ogni caso, fornita altra adeguata garanzia. All’atto dell’aggiudicazione, Aste Boetto potrà chiedere all’Aggiudicatario le proprie generalità, e in caso di pagamento non immediato e in contanti, l’Aggiudicatario dovrà fornire a Aste Boetto referenze bancarie congrue e comunque controllabili: in caso di evidente non rispondenza al vero o di incompletezza dei dati o delle circostanze di cui sopra, o comunque di inadeguatezza delle referenze bancarie, Aste Boetto si riserva di annullare il contratto di vendita del lotto aggiudicato.
8. Aste Boetto agisce in qualità di mandataria dei venditori e declina ogni responsabilità in ordine alla descrizione degli oggetti contenuta nei cataloghi, nella brochure ed in qualsiasi altro materiale illustrativo; le descrizioni di cui sopra, così come ogni altra indicazione o illustrazione, sono puramente indicative. Tutte le aste sono precedute da un’esposizione ai fini di permettere un esame approfondito circa l’autenticità, lo stato di conservazione, la provenienza, il tipo e la qualità degli oggetti. Dopo l’Aggiudicazione, né Aste Boetto né i Venditori potranno essere ritenuti responsabili per i vizi relativi allo stato di conservazione, per l’errata attribuzione, l’autenticità, la provenienza, il peso o la mancanza di qualità degli oggetti. Né Aste Boetto né il personale incaricato da Aste Boetto potrà rilasciare qualsiasi garanzia in tal senso, salvi i casi previsti dalla legge. 9. Le basi d’asta relative alla possibile partenza in asta di ciascun lotto sono stampate sotto la descrizione dei lotti riportata nel catalogo e non includono i diritti d’Asta dovuti dall’Aggiudicatario. Tali stime sono tuttavia effettuate con largo anticipo rispetto alla data dell’Asta e pertanto possono essere soggette a revisione. Anche le descrizioni dei lotti nel catalogo potranno essere soggette a revisione, mediante comunicazioni al pubblico durante l’Asta. 10. Il pagamento totale del prezzo di aggiudicazione e dei diritti d’Asta potrà essere immediatamente preteso da Aste Boetto, in ogni caso dovrà essere effettuato per intero, in Euro, entro sette giorni dall’aggiudicazione. L’aggiudicatario, saldato il prezzo e i corrispettivi per diritti d’asta, dovrà ritirare i lotti acquistati a propria cura, rischio,
spese e con l’impiego di personale e mezzi adeguati entro 14 giorni dalla vendita. Decorso tale termine, le Aste Boetto saranno esonerate da ogni responsabilità nei confronti dell’Aggiudicatario in relazione alla custodia, all’eventuale deterioramento o deperimento degli oggetti e avranno diritto ad applicare un corrispettivo, per singolo lotto, a titolo di custodia, pari a € 5,00 giornaliere per mobili e € 2,50 giornaliere per gli altri oggetti Per le vendite fuori sede, gli oggetti aggiudicati e non ritirati saranno trasportati e custoditi presso i nostri magazzini. Le spese di trasporto sostenute saranno a totale carico degli aggiudicatari. Su espressa richiesta dell’Aggiudicatario, le Aste Boetto potranno organizzare, a spese e rischio dell’Aggiudicatario, l’imballaggio, il trasporto e l’assicurazione dei lotti. 11. In caso di mancato pagamento, le Aste Boetto s.r.l. potranno: a)restituire il bene al mancato venditore ed esigere dal mancato acquirente il pagamento delle commissioni perdute; b)agire per ottenere l’esecuzione coattiva dell’obbligo di acquisto; c)vendere il lotto a trattativa privata, oin aste successive, comunque in danno del mancato compratore, trattenendo a titolo di penale gli eventuali acconti versati. 12. Nonostante ogni disposizione contraria qui contenuta, Aste Boetto si riserva il diritto di concordare con gli Aggiudicatari forme speciali di pagamento, per le quali viene espressamente convenuto il patto di riservato dominio a favore di Aste di Antiquariato Boetto s.r.l. fino all’integrale e completa estinzione del debito. Resta pertanto inteso che il mancato o ritardato pagamento, anche di una parte soltanto delle rate stabilite, darà facoltà al venditore Aste di Antiquariato Boetto s.r.l. di ritenere risolta la vendita, di richiedere l’immediata restituzione del bene nel caso esso fosse già stato consegnato e di trattenere quanto già pagato a titolo di caparra confirmatoria. 13. Gli Aggiudicatari sono tenuti all’osservanza di tutte le disposizioni legislative o regolamentari in vigore relativamente agli oggetti dichiarati di interesse particolarmente importante e per i quali il procedimento di dichiarazione é iniziato ai sensi dell’art. 6 es. del D.LGS. 29 Ottobre 1999, n. 490, con particolare riguardo agli artt. 54 e ss. del medesimo decreto. L’esportazione di oggetti da parte di Aggiudicatari residenti e non residenti in Italia é regolata dalla suddetta normativa nonché dalle leggi doganali, valutarie e tributarie in vigore. Il costo approssimativo di una licenza di esportazione é di € 200,00. La richiesta della licenza viene inoltrata
al Ministero previo pagamento del lotto e su esplicita autorizzazione scritta dell’Aggiudicatario. Aste Boetto non si assume nessuna responsabilità nei confronti dell’Aggiudicatario in ordine ad eventuali restrizioni all’esportazione dei lotti aggiudicati, né in ordine ad eventuali licenze o attestati che l’Aggiudicatario di un lotto dovrà ottenere in base alla legislazione italiana. L’Aggiudicatario in caso di diritto di prelazione da parte dello Stato, non potrà pretendere da Aste Boetto o dal Venditore nessun rimborso di eventuali interessi sul prezzo e sulle commissioni d’Asta già corrisposte. 14. In caso di contestazioni fondate e accettate da Aste Boetto per oggetti falsificati ad arte, purché la relativa comunicazione scritta pervenga ad Aste Boetto entro 21 giorni dalla data della vendita, Aste Boetto potrà, a sua discrezione, annullare la vendita e rivelare all’Aggiudicatario che lo richieda il nome del Venditore, dandone preventiva comunicazione a questo ultimo.
15. Tutte le informazioni sui punzoni dei metalli, sulla caratura e il peso dell’oro, dei diamanti e delle pietre preziose colorate sono da considerarsi puramente indicative e approssimative e Aste Boetto non potrà essere ritenuta responsabile per eventuali errori contenuti nelle suddette informazioni e per le falsificazioni ad arte degli oggetti preziosi. Alcuni pesi in questo catalogo sono stati determinati tramite misurazioni. Questi dati devono considerarsi solo un’indicazione di massima e non dovrebbero essere acquisiti come esatti.
16. In aggiunta ad ogni altro obbligo o diritto previsto dalle presenti Condizioni di Vendita, Aste Boetto nel caso in cui sia stata informata o venga a conoscenza di un’eventuale pretesa odiritto di terzi inerente alla proprietà, possesso o detenzione del Lotto potrà, a sua discrezione, trattenere in custodia il Lotto nelle more della composizione della controversia o per tutto il periodo ritenuto ragionevolmente necessario a tale composizione.
17. Le presenti Condizioni di Vendita sono accettate automaticamente da quanti concorrono all’Asta e sono a disposizione di qualsiasi interessato che ne faccia richiesta. Per qualsiasi controversia é stabilita la competenza esclusiva del Foro di Genova.
18.Per ogni lotto contenente materiali appartenenti a specie protette come, ad esempio, corallo, avorio, tartaruga, coccodrillo, ossi di balena, corni di rinoceronte, palissandro,etc., è necessaria una licenza di esportazione CITES rilasciata dal Ministero dell’Ambiente e della Tutela del Territorio, cha avrà un costo di € 50.00.
Si invitano i potenziali acquirenti ad informarsi presso il Paese di destinazione sulle leggi che regolano tali importazioni.
1. Lots are put on sale by Aste Boetto at a public auction. Aste Boetto acts as exclusive agent in its own right and on behalf of each seller whose name is registered C/O Aste Boetto. The seller is responsible for the items on sale and Aste Boetto accepts no responsibility with regards to the buyer other than that which may derive from its position as agent.
2. The items are sold to the highest bidder for cash: in the case of disagreement between more than one high bidder, the disputed item may, at the sole discretion of the auctioneer, be relisted for new bidding during the same auction. When making a bid, the bidder accepts full personal responsibility to pay the price agreed inclusive of the Auction Commission and all other due fees and taxes.
3. Aste Boetto reserves the right to withdraw any lot from the auction. During the auction, the auctioneer has the right to separate or join lots and to change the order of their sale. The auctioneer may, furthermore, at his discretion, withdraw any lot which does not reach the reserve price agreed between Aste Boetto and the seller
4. An auction commission of 25% is to be added to the final selling price. Goods marked “*” which are offered by sellers not subject to “margin regulations” (VAT paid on only the difference between the original purchase price and sale price) are subject to the auction commission of 24% plus VAT on the entire value of the sale item plus expenses.
5. The auction director may accept a specific mandate to bid for lots at a determined price and make offers on behalf of the seller
6. Aste Boetto may accept mandates for buying (written and telephonic) and raise bids through the auctioneer at public auctions. Aste Boetto may not be held responsible in any way for not receiving written or telephonic or by web offers or for any errors or omissions in said offers. 6bis. IMPORTANT NOTICE FOR TELEPHONE BIDDERS: Aste Boetto Auction House will call the telephone bidder at the chosen number(s) when the lots come up for sale. By bidding on the telephone, prospective purchasers accept to automatically submit an order bid at the lowest price indicated on the catalogue, for each chosen lot. If by any reason, even of technical origin, the phonecall should fail, the telephone bid form will be considered as on order
bid at the lowest price indicated on the catalogue, for each chosen lot.
7. In the case of two identical offers for the same lot, the offer will be awarded to the offer which was received first. Aste Boetto reserves the right to refuse offers from unknown bidders unless a deposit is raised which covers the entire value of the desired lot or in any case an adequate guarantee is supplied. At the time of assignment of a lot, Aste Boetto may require identification details from the purchaser and in the case of referred and non cash payment, the purchaser must supply Aste Boetto with a congruous and checkable bank reference: in the case of references which do not correspond, are incomplete or inadequate, Aste Boetto reserves the right to cancell the sale contract of the assigned lot.
8. Aste Boetto acts as agent for the seller and declines responsibility deriving from descriptions of the items in the catalogues, brochures or any other such descriptive material: the descriptions as stated above as with all other illustrations are purely indicative. Al auctions are preceded by an exhibition in order to allow a thorough examination of the authenticity, condition, origin, type and quality of the items. After the assignment of a lot, neither Aste Boetto nor the seller can be held responsible for flaws with regards to the condition, for mistaken attribution, origin, authenticity, weight or quality of the items. Neither Aste Boetto nor anyone charged by Aste Boetto can release any guarantee in this sense other than in cases foreseen by law.
9. The starting price relative to the possible auctioning of each lot is printed under the description of said lot and do not include the Auction commission to be paid by the purchaser. These estimates are nevertheless made well before the date of the auction and may therefore be subject to modification. The descriptions of the lots in the catalogue may also be subject to revision via communication to the public during the auction.
10. Aste Boetto may require payment in full of the final price and Auction Commission, in any case, full payment in Euros must be made within seven days of the assignment. Having paid the final price and Auction Commission, the purchaser must collect the bought lots at his own risk, responsibility and expense within seven days of the purchase. At the end of said period, Aste Boetto will
be exonerated of all responsibility with regards to the purchaser concerning storage and possible deterioration of the items and may exercise the right to apply a charge for the storage of each single lot at the rate of € 5.00 per day for furniture and € 2.50 per day for other items. Items sold off site and not collected will be transported and stored in our warehouses. Any transport costs will be responsibility of the purchaser If specifically r equested by the purchaser, and at their risk and expense, Aste Boetto may arrange packaging, transport and insurance of the lots.
11. In case on non-payment, Aste Boetto may:
a) return the goods to the seller and demand from the buyer payment of the lost commission
b) act in order to obtain enforcement of compulsory payment
c) sell the lot at a private sale or subsequent auction, and in any case detain as penalty any deposits paid.
12. Notwithstanding any disposition contrary to this content, Aste Boetto reserves the right to agree with the purchaser special forms of payment, public or private warehouse storage, to sell assigned lots which have not been collected privately, to insure assigned lots, to resolve disputes and claims by or against the purchaser and to generally undertake actions considered appropriate in order to collect payment owed by the purchaser or even according to the circumstances, cancel the sale according to articles 13 and 14 of Italian civil law and to return the goods to the purchaser.
13. Purchasers are required to uphold all laws and regulations in force with regards to the items declared to be of particular importance and for which the procedure of declaration was began in accordance with article 6 es. of the legislative decree 29 October 1999, n°490, with particular regards to article 54 of the same decree. The export of goods by the purchaser, resident and not in Italy, is regulated by the aforementioned decree and furthermore by customs, currency and tax regulations in force. The approximate cost of an export license is € 200.00.
The application for an export license is to be sent to the Ministry on payment of the lot and with explicit written authorization of the purchaser. Aste Boetto is not held responsible in any way to the purchaser with regards to any eventual export restrictions concerning the lot assigned, nor for any license or permit which the purchaser of a lot
must acquire in accordance with Italian law. In the case of the State exercising the right of withdrawal, the purchaser cannot expect any reimbursement from Aste Boetto or from the seller, of interest on the price or Auction Commission already paid.
14. In the case of a reasonable contestation, accepted by Aste Boetto, with regards to faked works of art, and given that a written communication is received by Aste Boetto within 21 days from the sales, Aste Boetto may, at its discretion cancel the sale and should the purchaser so require, reveal the name of the seller informing said seller of this action.
15. All information regarding hall-marks of metals, carats and weight of gold, diamonds and precious coloured gems are to be considered purely indicative and approximate and Aste Boetto cannot be held responsible for eventual errors contained in said information nor for the falsification of precious items. Some weights in this catalogue have been ascertained by way of measurement. This data is to be considered approximate and must not be considered as exact.
16. In addition to all other obligations and rights as contained in these Conditions of Sale, Aste Boetto may at its discretion, in the case that is informed or becomes aware of claims by third parties concerning the ownership, possession or holding of a lot, hold the lot in custody for the duration of the claim or for the time deemed necessary for the claim to be made.
17. These Conditions of Sale are automatically accepted by all those participating in the auction and are available upon request to any interested party.
Any dispute is to be under the jurisdiction of the court of Genoa.
18. For all object including materials belonging to protected species as, for example, coral, ivory, turtle, crocodile, whale bones, rhinoceros horns, rosewood and so on, it is necessary to obtain a CITES export license released by the Ministry for the Environment and the Safeguard of the Territory, it will cost € 50.00.
Possible buyers are asked to get all the necessary information concerning the laws on these exports in the Countries of destination.
