This Student Code of Conduct provides information regarding expectations for student behavior and consequences for misconduct. Please read and review the information in the Student Code of Conduct with your student so that you have a clear understanding of its content. Once you and your student have reviewed the Student Code of Conduct, please sign the acknowledgment form listed below and return it to your child's campus. Please contact your student's teacher or campus administrator if you have any questions about the Code.

I understand that the Student Code of Conduct governs all behavior at school, at school-sponsored and school-related activities, during online or other remote instruction, during school-related travel, or while traveling in a vehicle owned or operated by the District. I also understand the Student Code of Conduct governs some designated behaviors occurring within 300 feet of school property, some designated behaviors occurring off-campus, including certain electronic communications and postings, conduct that threatens the safety of other students or staff members, and any school-related misconduct regardless of time or location. I understand that a referral for criminal prosecution is possible for certain violations of law.

General Overview

Purpose TheBoardofTrusteesadoptedthisStudentCodeofConduct(SCC)topromoteasafe,secure, andoptimallearningenvironmentforallstudents.Insideyouwillfindinformationregarding:

• TheDistrict-widedisciplinemanagementplan,

• Adescriptionofprohibitedconduct,

• Thedisciplinaryoptions,methods,andconsequencesforpreventingandaddressingstudent misconduct,and

• TheprocesstheDistrictwillfollowwhenadministeringdisciplinaryconsequences.

IfthereisaconflictbetweentheSCCandtheStudentHandbook,thetermsoftheSCCwill control.IfthereisaconflictbetweentheSCCandlocalDistrictpolicy,themorerecently adopteditemwillcontrol.

AdditionalRules

GeneralStandardsof StudentConduct

Studentsmaybesubjecttocampus,classroom,transportation,extracurricular,and/or organizationrulesinadditiontothosefoundintheSCC.Studentsmayfaceconsequencesunder theseadditionalrulesaswellaspossibledisciplinaryactionundertheSCC.Further,totheextent astudentengagesinmisconductthatisnotspecificallyaddressedintheSCC,thestudentmay stillbedisciplinedifthemisconductthreatensstudentsorstaffordisruptsorinterfereswiththe educationalprocess,learningenvironment,orschoolsafety.

Inordertopromoteapositiveeducationalexperienceforallstudents,theDistrictexpects studentstoadheretosevenbasicstandardsofconduct:(1)exerciseself-control,self-respect, andself-discipline,(2)demonstrateapositiveattitude,(3)respecttherightsandfeelingsof others,(4)respectschoolpropertyandthepropertyofothers,(5)supportthelearningprocess, (6)adheretorules,and(7)promoteasafeenvironmentthatdoesnotthreatenschoolsafety. Becauseofsignificantvariationsinstudentconduct,itisnotalwayspossiblefortheSCCto addresseachandeveryactofstudentmisbehavior.Tothatend,theDistrictretainsdiscretionto addressstudentmisconductthatisinconsistentwiththesesevenstandardseventhoughthe conductmaynotbespecificallyincludedintheSCC.

Noticeof DisciplinaryAction

Teachersandadministratorsstrivetonotifyparents/guardiansofstudentconductconcernsas theyoccur.Ifastudentisplacedinin-schoolorout-of-schoolsuspension,placedinadisciplinary alternativeeducationprogram,expelledfromschool,assignedtoajuvenilejusticealternative educationprogram,ortakenintocustodybyalawenforcementofficer,thecampusbehavior coordinatorwillpromptlycontacttheparent/guardianbyphoneorinpersonandwillalsomake agoodfaithefforttoprovidethestudentwithwrittennoticeofthedisciplinaryactiontobe deliveredtotheparent/guardianonthesamedaytheconsequenceisassignedor recommended.Iftheparent/guardianisnotreachedbyphoneorinpersonby5:00p.m.onthe firstbusinessdayafterthedisciplinaryconsequenceisassignedorrecommended,writtennotice willbesenttotheparent's/guardian'slastknownaddress.Anothercampusadministratormay providenoticeofdisciplinaryactionifthecampusbehaviorcoordinatorisnotableoravailableto providenotice.Failuretosendanynoticewithinthistimeperiodorasnotedelsewhereinthe SCCdoesnotprecludeimposingadisciplineconsequence.Aschooldistrictthatreceivesabomb threatorterroristicthreatrelatingtoacampusorotherdistrictfacilityatwhichstudentsare presentshallprovidenotificationofthethreatassoonaspossibletotheparent(s),guardian(s), orotherperson(s)standinginparentalrelationtoeachstudentwhoisassignedtothecampus orwhoregularlyusesthefacility.

Anti-Discrimination

TheDistrictdoesnotdiscriminateagainststudentsonthebasisofrace,sex,nationalorigin, disability,religion,age,color,orethnicitywhenenforcingtheprovisionsoftheSCC.

Disciplineof Studentswith SpecialNeeds

ThisCodeofConductappliestoallstudents.However,whenenforcingitsCodeofConduct,the Districtwillcomplywithfederalandstatelawspertainingtostudentswithdisabilities.Formore informationaboutthosespecificprocedures,pleasecontactJacobFischer,DirectorofSpecial Education

Appealsofdisciplinarymeasuresshouldbedirectedtothestudent'steacherorcampus administrator,asdescribedinlocalDistrictpoliciesFNG,FOC,orFODasappropriate.Depending onthedisciplinaryconsequenceassigned,differentcomplaintproceduresmayapply.Acopyof theappropriatepolicyisavailableatthecampusorcentraladministrationofficeoronlineat https://pol.tasb.org/PolicyOnline?key=306.Pleasenotethattheemailaddressanddedicated phonenumberofthecampusbehaviorcoordinatororcampusadministratorresponsiblefor studentdisciplineislistedonthecampushomepage.Timelinesforfilingappealsstatedinthe policywillbeenforced.Disciplinaryconsequenceswillnotbedelayedordeferredpendingthe outcomeofanappeal.

EffectofStudent Withdrawal

GeneralAuthority

WithdrawalfromschoolafterastudenthasbeenaccusedofaviolationoftheSCCwillnot preventtheDistrictfrominvestigatingtheallegedviolationand,ifitisdeterminedthata violationdidoccur,assessingtheappropriatedisciplinaryconsequenceandenforcingthat consequenceshouldthestudentre-enrollintheDistrict,and/orforwardinganyorderofa disciplinaryconsequencetoafutureschoolinwhichastudentenrolls.

Scope of the District's Disciplinary Authority

Inadditiontothedisciplinaryauthorityestablishedforcertaintypesofoffensesasdescribed withintheSCC,theDistricthasgeneraldisciplinaryauthorityoverastudentatthefollowing times:

• Atanytimeduringtheschoolday.

• WhiletravelingonDistrictownedoroperatedtransportationorduringschool-relatedtravel.

• Whileattendinganyschool-sponsoredorschool-relatedactivity,regardlessoftimeorlocation.

• Asprovidedinextracurricularororganizationhandbooks,by-laws,constitutions,orother guidelines.

• Duringlunchperiods,includingthoseinwhichastudentleavesthecampus.

• Whileonschoolproperty.

• Foranyschool-relatedmisconduct,regardlessoftimeorlocation.

• Duringonlineorothertypesofremoteinstruction.

• OtheroffcampusconductasauthorizedanddefinedbyChapter37oftheTexasEducation Code,includingcyberbullying.

• Forcertainoffensesagainstotherstudentsandschoolemployees,regardlessoftimeor location.

• Forcertainoffensescommittedwithin300feetofschoolpropertyasmeasuredfromany pointontheschool’srealpropertyboundaryline.

• Ifthestudentisaregisteredsexoffender.

• Conductthatthreatensthesafetyofotherstudentsorstaffmembers,regardlessofthe location

Astudent'sclothing,personalproperty,electronicequipment,ormethodoftransportationmay besearchedwhenthereisreasonablecausetobelievethesearchwillrevealarticlesormaterials prohibitedbytheDistrictorotherviolationsofschoolrules.Schoolpropertyusedbythe student,suchaslockers,desks,orschool-ownedelectronicequipment,maybesearchedwhen deemednecessarybythecampusadministration.Studentsareresponsibleforensuringthatany personalproperty,methodoftransportation,orschoolpropertyusedbythestudentdoesnot containprohibiteditems.Studentsmaybedisciplinedforpossessionofprohibiteditems discoveredduringasearch.Formoreinformationaboutsearches,pleasereviewtheDistrict's StudentHandbookandpolicyFNF(Local).

Schooladministratorswillreportcrimesasrequiredbylawandmaycontactlocallaw enforcementregardingsuspectedcriminalactivity.Certainactsofmisconductmayconstitute criminaloffensesinadditiontoviolationsoftheSCC.Becauseschooldisciplineisindependentof criminalproceedings,disciplinaryconsequenceswillnotbepostponedpendingtheoutcomeof anycriminalproceedingoraffectedbytheoutcomeofanycriminalproceeding.

Finally,astheDistrictexpectsitsstudentstoadheretocertainstandardsofconduct,theDistrict alsoexpectsthatparentsofourstudentsandothervisitorswillcomplywithsimilarstandardsof conductandcivilityexpectedofourstudents.Accordingly,aschooladministrator,resource officer,orschooldistrictpeaceofficermayrefusetoallowapersontoenterormayejecta personfromanypropertyunderthecontroloftheschooldistrictifthepersonrefusestoleave peaceablyuponrequest,and1)thepersonposesasubstantialriskofharmtothemselvesor others,or2)isbehavinginawaythatisinappropriateforaschoolsetting.Apersonbehaving inappropriatelyforaschoolsettingmayberemovedif,priortothepersonbeingremovedfrom Districtproperty,1)theschoolemployeeissuedaverbalwarningthatthebehaviorwas inappropriateandcouldleadtotheperson'sremovaloftheindividualand2)theperson persistedinthebehavior.AnypersonremovedfromDistrictpropertymayappealsuchremoval underBoardpolicyFNG(Local)or(GF)(Local)andshallbepermittedtoaddresstheBoardin personwithin90daysoffilingtheinitialcomplaint,unlessthecomplaintisresolvedbeforethe Boardconsidersit.

Usingtheirprofessionaljudgment,campusbehaviorcoordinatorsorotherappropriate administratorswillconsideravarietyoffactorswhenadministeringdisciplinaryconsequences anddeterminingthedurationoftheconsequence,includingbutnotlimitedto:

• thedegreeofseverityandriskofdanger.

• theeffectofthemisconduct.

• theageandgradelevelofthestudent.

• legalrequirements.

• thefrequencyofthemisconduct.

• thestudent’sdemeanor.

• thepossibilityofdisruptionoftheschoolenvironment.

Whendecidingtoorderastudenttoout-of-schoolsuspension,DAEPplacement,expulsion,or placementinJJAEPtheDistrictwillconsider:(1)self-defense(seedefinitions),(2)thestudent's

intent (seedefinitions) orlackofintentatthetimeofthemisconduct,(3)thestudent's disciplinaryhistory,(4)adisabilitythatsubstantiallyimpairsthestudent'scapacitytoappreciate thewrongfulnessofthestudent'sconducttotheextentrequiredbystateandfederallaw,(5)a student'sstatusintheconservatorshipoftheDepartmentofFamilyandProtectiveServicesand (6)astudent'sstatusashomeless.Thesefactorswillbetakenintoconsiderationregardlessof whetheritisadiscretionaryormandatorydisciplinaryconsequence.

Astudentwho,uponinvestigation,isfoundtobesubjecttobullying(seedefinitions)willnot bedisciplinedonthebasisofusingreasonableself-defense(seedefinitions)inresponsetothe bullying,asdeterminedbythecampusadministration.

TheDistrictwillalsoestablisha"threatassessmentandsafeandsupportiveschoolteam"to serveateachcampusofthedistrictandwilladoptpoliciesandproceduresfortheteams.The teamisresponsiblefordevelopingandimplementingthesafeandsupportiveschoolprogram, aswellasconductingthreatassessments.Thesewillincludeassessingandreportingindividuals whomakethreatsofviolenceorexhibitharmful,threatening,orviolentbehavior,gatheringand analyzingdatatodeterminethelevelofriskandappropriateintervention(includingreferringa studentformentalhealthassessmentandimplementinganescalationprocedure,ifappropriate basedontheteam'sassessment),andprovidingguidancetostudentsandschoolemployeeson recognizingharmful,threatening,orviolentbehaviorthatmayposeathreattothecommunity, school,orindividual.

Beforeateammayconductathreatassessmentofastudent,theteammustnotifytheparent oforpersonstandinginparentalrelationtothestudentoftheassessment.Inconductingthe assessment,theteamshallprovideanopportunityfortheparentorpersonto:(1)participatein theassessment,eitherinpersonorremotely;and(2)submittotheteaminformationregarding thestudent.Aftercompletingathreatassessmentofastudent,theteamshallprovidetothe parentoforpersonstandinginparentalrelationtothestudenttheteam’sfindingsand conclusionsregardingthestudent.

Finally,securitypersonnelareimportantmembersoftheDistrictsafetyteam.Statelawrequires thatthejobdutiesofthepeaceofficers,schoolresourceofficersandsecuritypersonnelbe listedintheDistrictStudentCodeofConduct.Seejobdutieslistedbelow:

SchoolDistrictPoliceOfficers'primarydutiesareprotectingthesafetyandwelfareofany personsinthejurisdictionoftheAnnaIndependentSchoolDistrictandthepropertyofthe schooldistrict.Officerswillhandleallcallsinvolvingcriminalbehaviorandworkwiththeschool districtadministrationtoaddresssuchbehaviorthroughlawenforcementintervention.The AnnaIndependentSchoolDistrictwillnotassignorrequireasdutiesofaschooldistrictpeace officer,aschoolresourceofficer,orsecuritypersonnel:Routinestudentdisciplineorschool administrativetask;orContactwithastudentunrelatedtothelawenforcementdutiesofthe peaceofficer,resourceofficer,orsecuritypersonnel.Thisdoesnotprohibitaschooldistrict peaceofficer,aschoolresourceofficer,orsecuritypersonnelfrominformalcontactwitha studentunrelatedtoTheassigneddutiesoftheofficer,resourceofficer,orsecuritypersonnel; oranincidentinvolvingstudentbehaviororlawenforcement.Peaceofficers,resourceofficers, orsecuritypersonnelareonlytobetaskedwithdutiesrelatedtolawenforcementintervention andnottaskedwithdutieswithbehavioraloradministrativedutiesbetteraddressedbythatof otherdistrictemployees.

Disciplineisdesignedtocorrectstudentbehaviorandencouragestudentstocomplywithschool rules.TheDistrictmayuseanyoneoracombinationofthefollowingstrategiesortechniquesto managestudentbehavior,preventorinterveneindisciplineproblems,oraddressviolationsof theSCCorcampusorclassroomrules:

General Types of Prohibited Conduct

MisconductInvolving Others Misconductidentifiedinthelistofprohibitedbehaviorsbelowwillresultintheassignmentof oneormore“DisciplineManagementTechniques”ifthebehavioriscommittedatschool,a school-sponsoredorschool-relatedactivity,duringschool-relatedtravel,whiletravelingon Districtownedoroperatedtransportation,orwhentheDistricthas“DisciplinaryAuthority”as describedintheSCC.

• Horseplay,roughhousing,andotherplayfulbehaviorthat,thoughnotintendedtoharm, presentsareasonableriskofharm,threatensthesafetyofothers,oractuallycausesinjuryto others.

• Fighting(seedefinitions)orscufflingthatmayormaynotresultinphysicalpain,illness,or anyimpairmentofaphysicalcondition.

• Hitting,pushing,orattemptingtohurtanotherstudent.

• Engaginginconductthatcanordoescausebodilyinjury(seedefinitions).

• Forcinganunwillingpersontoactornotactorobtainingmoneyoranotherobjectofvalue fromanunwillingpersonthroughduress,threats,force,extortion,coercion,orblackmail.

• Addinganysubstance,whetherharmfulornot,withoutpermissiontoanyfoodorbeverages belongingto,inthepossessionof,ormeanttobeconsumedbyanotherstudentorDistrict employee,official,orvolunteer.

• Engaginginharassment (seedefinitions) towardanotherstudentoraDistrictemployee, official,orvolunteer,includingharassmentbasedonrace,color,religion,nationalorigin, disability,sex,gender,orage.

• Engaginginsexualharassment(seedefinitions)orsexualabuse.

• Releasingorthreateningtoreleaseintimatevisualmaterialofaminororastudentwhois18 yearsofageorolderwithoutthestudent'sconsent.

• Releasingorthreateningtoreleaseintimatevisualmaterialofaminororastudentwhois18 yearsofageoroldercreatedbyusingA.I.withoutthestudent'sconsent.

• Invasivevisualrecording(seedefinitions)

• Inappropriateverbal(oralorwritten),physical,orsexualcontacttowardanotherstudentora Districtemployee,official,orvolunteer,regardlessofwhetheritisconsensual.

• Touchingone'sownprivatebodypartsinasexualmanner.

• Consensualhugging,touching,orotherdisplaysofaffectionthatinterferewith,detractfrom, ordisrupttheschoolenvironment.

• Engaginginphysical,sexual,verbal,oremotionalabuseasameanstoharm,threaten, intimidate,orcontrolanotherpersoninacurrentorpastdatingrelationship.

• Engaginginoralorwrittenthreatstocauseharmorbodilyinjury(seedefinitions)toanother student,aDistrictemployee,official,orvolunteer,orschoolproperty,includingthreatsmade onoroffcampus,usingtheInternetorothertechnologyresources,includingmessagingapps, postings,oranykindofsocialmedia.

• Engaginginoralorwrittenthreatsofanykindofviolence,violentacts,orharmtoanother studentorstaffmember,whetherornotsuchthreatsaremeanttobetakenseriously.

• Preparingahitlist(seedefinitions)

• Wrongfullyobtainingandusinganotherperson’sidentifyinginformationorpersonaldata withoutpermission.

• Hazing(seedefinitions)

• Retaliatingagainstastudentfor(1)reportingeitheraviolationoftheSCCorbullying,or(2) participatinginaninvestigationofaviolationoftheSCCorbullying.

• Tobaccoproducts.

• Lessthanauseableamountofstems,seeds,orotherpiecesofmarijuana.

• Paraphernalia(seedefinitions)relatedtoanyprohibitedsubstance,including,butnotlimited to,marijuana,acontrolledsubstance,adangerousdrug,oranalcoholicbeverage.

• Designerdrugs,syntheticmarijuana,syntheticcannabinoids(suchasK2orspice),stimulants (suchasbathsalts),oranalogsofanydruginanyform,regardlessofwhethercurrently scheduledorclassifiedasanillegaldrugunderstateorfederallawandregardlessofwhether thesubstanceislegallysoldormarketedas"herbalincense,""potpourri,""bathsalts,"or"not forhumanconsumption.".

• Razorblades,boxcutters,orchains.

• Kniveswithablade5½inchesorless.

• Handinstrumentdesignedtocutorstabanotherbybeingthrown;including,butnotlimited to,adirk,stiletto,dagger,poniard,bowieknife,sword,orspear.

• Fakeor“look-alike”weapons.

• Deadlyweapons(seedefinitions).

• Attemptingtoorsuccessfullyaltering,destroying,interrupting,intercepting,ordisabling Districttechnologyequipment,Districtdata,thedataofotherusersoftheDistrict’scomputer system,orothernetworksconnectedtotheDistrict’ssystem,includinguploadingorcreating computerviruses,worms,orotherharmfulmaterial.

• NOTE:Studentswillnotbedisciplinedfortechnologicalmisconductrelatedtopossessing itemsdescribedabovesolongasthestudent(1)didnotcontributetocreationoftheitemin anyway,(2)possesseditonlyafterreceivingtheitemunsolicitedfromanother,(3)either promptlydestroyedtheitemorreportedittoaschoolemployeeassoonaspossible,and(4) didnotshow,provideacopy,forward,orre-posttheitemtoanyoneotherthanlaw enforcement,aschoolemployee,orthestudent'sparent/guardian.

ReasonsforRemoval

• TakingoneormorestepstowardviolatingtheSCCevenifthestudentfailstocompletethe intendedmisconduct.

Removal from District Transportation

AppropriatestudentbehaviorisessentialtothesafeoperationofDistricttransportation. StudentsmustcomplywiththeexpectationsoftheSCCwhileusingDistricttransportation.In additiontocompliancewiththeSCC,studentsareexpectedtocomplywiththefollowing transportationrules:

• Enterandexittransportationinanorderlymanneratthedesignatedstop

• Remainseatedindesignatedseatsfacingforward

• Keepaislesclearofbooks,bags,instruments,feet,orotherobstructions

• Complywithlawfuldirectivesissuedbythedriver

• Followthedriver'srulesforfoodorbeverages

• Donotextendanybodypart,clothing,orotherarticleoutsideofthetransportation

Procedurefor Removal

AdriverofDistrictownedoroperatedtransportationmaysendastudenttotheadministrator's officetomaintaindisciplineduringtransporttoorfromschooloraschool-sponsoredorschoolrelatedactivity,toenforcethetransportationrules,orwhenthestudentengagesinbehavior thatviolatestheSCC.Theadministratormayuseoneormoredisciplinemanagement techniquestoaddressthebehavior,whichmayincludetemporarilysuspendingorpermanently revokingschooltransportationprivileges.

Thestudentwillbeinformedofthereasonforsuspensionorrevocationoftransportation privilegesandwillbegiventheopportunitytorespondbeforetheadministrator'sdecisionis final.Suspensionoftransportationprivilegesdoesnotexcuseastudentfromattendingschool. Itistheresponsibilityoftheparent/guardianand/orstudenttomakealternatetransportation arrangementstoandfromschool.

Removal from Classroom by Teacher

Ateachermaysendastudenttothecampusbehaviorcoordinator'sofficetomaintaindiscipline intheclassroomorwhenthestudentengagesinbehaviorthatviolatestheSCC.Forthese informalremovals,thebehaviorcoordinatorwilluseoneormoredisciplinemanagement techniquestoaddressandimprovethestudent'sbehaviorbeforereturningthestudenttothe classroom.Ifthestudent'sbehaviordoesnotimprove,thebehaviorcoordinatorwillemploy otherdisciplinetechniquesorprogressiveinterventionstoimprovethestudent'sconduct.

Ateachermayremoveastudentfromclasswhen:

• Thestudent’sbehaviorhasbeendocumentedbytheteacherasrepeatedlyinterferingwith theteacher’sabilitytoteachorwiththelearningofotherstudents;or

• Thebehaviorissounruly,disruptive,orabusivethatitseriouslyinterfereswiththeteacher’s abilitytoteachorwiththelearningofotherstudents.

AteachermaydocumentanyconductbyastudentthatdoesnotconformtotheStudentCode ofConductandmaysubmitthatdocumentationtotheprincipal.Ateachermustremovea studentfromclassifthestudentengagesinconductthatrequiresorpermitsDAEPplacement orexpulsionundertheTexasEducationCode,inwhichcasetheproceduresforDAEPplacement orexpulsionwillapply.

PlacementDuring Removal

Proceduresfor TeacherRemoval

Whenateacherutilizesaformalremovalofthestudentfromtheclassroom,theadministrator mayplacethestudentin:(1)anotherappropriateclassroom,(2)in-schoolsuspension,(3)out-ofschoolsuspension,or(4)DAEP.

Nolaterthanthreeschooldaysafterateacherhasformallyremovedastudentfromclass,an administratorwillscheduleaconferencewiththecampusbehaviorcoordinatororother administrator,thestudent’sparent/guardian,thestudent,andtheteacher.Attheconference, thestudentwillbeprovidedanexplanationofthebasisforremovalandbegivenanopportunity torespond.Aftertheconference,thecampusbehaviorcoordinatorordesigneewillrendera disciplinedecisionandinformthestudentandparent/guardianoftheconsequences.

Astudentwhoissenttothecampusbehaviorcoordinator'sorotheradministrator'soffice throughanordinaryoraformalteacherremovalfromclassisnotconsideredtohavebeen removedfromtheclassroomforthepurposesofreportingdatathroughthePublicEducation InformationManagementSystem(PEIMS)orothersimilarreportsrequiredbystateorfederal law.

Iftheteacherremovedthestudentfromclassbecausethestudentengagedinassaultresulting inbodilyinjury,aggravatedassault,sexualassault,oraggravatedsexualassaultagainstthe teacher,thestudentmaynotbereturnedtotheteacher’sclasswithouttheteacher’sconsent.In othercaseswheretheteacherinitiatesaformalremoval,thestudentmayonlybereturnedto theteacher’sclasswithouttheteacher’sconsentifthePlacementReviewCommittee determinesthattheteacher’sclassisthebestoronlyalternative.

ThestudentwillbeinformedofthereasonforplacementinISSandbegivenanopportunityto respond.WhileinISSthestudentwillcompleteassignmentsfromhisorherteacher,andthe campusadministratormayplacerestrictionsonthestudent'sparticipationinschool-sponsored orschool-relatedactivities.

Thestudentwillbeinformedofthereasonforout-of-schoolsuspensionandbegivenan opportunitytorespondbeforetheadministrator'sdecisionisfinal.Whilethestudentis suspended,theadministratormayplacerestrictionsonthestudent'sparticipationinschoolsponsoredorschool-relatedactivities.Studentsmaybesuspendedforamaximumofthree schooldaysatatime.

Astudentwhoisinsecondgradeoryoungercannotreceiveanout-of-schoolsuspensionunless, whileatschoolorataschool-sponsoredactivity,thestudentengagesinconductthatcontains theelementsofanoffenserelatedtoweaponsoraviolentoffense,orunlessthestudent engagesinselling,giving,ordeliveringtoanotherpersonorpossessing,using,orbeingunder theinfluenceofmarijuanaoracontrolledsubstance,adangerousdrug,oranalcoholic beverage.

Astudentwhoishomeless,asthattermisdefinedinfederallawforhomelesschildrenand youth,cannotreceiveanout-of-schoolsuspension,unlessthestudentengagesinconductthat containstheelementsofanoffenserelatedtoweaponsoraviolentoffense,orunlessthe studentengagesinselling,giving,ordeliveringtoanotherpersonorpossessing,using,orbeing undertheinfluenceofmarijuanaoracontrolledsubstance,adangerousdrug,oranalcoholic beverage.

Disciplinary Alternative Education Program (DAEP)

School-Related. SubjecttotherequirementsofTexasEducationCode,Section37.009(a),a studentmustbeplacedinDAEPforanyofthefollowingmisconductifcommittedwhileon schoolproperty,within300feetofschoolpropertyasmeasuredfromanypointontheschool's realpropertyboundaryline,orwhileattendingaschool-sponsoredorschool-relatedactivityon oroffschoolproperty:

• Engagesinconductpunishableasafelony.

• Commitsanassault (seedefinitions) resultinginbodilyinjury (seedefinitions) against another.

• Sells,gives,delivers,possesses,uses,orisundertheinfluenceofacontrolledsubstance(see definitions)oradangerousdrug(seedefinitions),inanyamountnotpunishableasafelony.

• Sells,gives,delivers,possesses,uses,orisundertheinfluenceofmarijuana(seedefinitions) ortetrahydrocannabinol(seedefinitions).

RegardlessofLocation. AstudentmustbeplacedinDAEPifthestudentengagesinthe followingmisconduct,regardlessofwhethertheconductoccurredonoroffcampus:

• Issuesafalsealarmorreport (seedefinitions) oraterroristicthreat (seedefinitions) involvingapublicschool.

• Retaliates(seedefinitions)againstanyschoolemployee.

• Isaregisteredsexoffender(seedefinitions)undercourtsupervision,probation,community supervision,orparole.

Studentswhoare:(1)convictedofcontinuoussexualabuseofayoungchildorchildren;or(2) convicted,receivedeferredadjudicationordeferredprosecution,beenfoundtohaveengaged indelinquentconductorconductinneedofsupervision,orbeenplacedonprobationforeither sexualassaultoraggravatedsexualassaultagainstanotherstudentassignedtothesame campusatthetimetheoffenseoccurredwillbeplacedinDAEP(orJJAEPasappropriate)onthe requestofthevictim’sparentsifthevictimstudentdoesnotwishtotransfer,andthereisonly onecampusservingthatgradelevel.Placementinthiscircumstancemaybeforanylengthof timeconsiderednecessary.

School-Related. AstudentmaybeplacedinDAEPforanyofthefollowingmisconductif committedwhileonschoolproperty,orwhileattendingaschool-sponsoredorschool-related activityonoroffschoolproperty:

• Committinganyoffenseincludedinthelistof“GeneralTypesofProhibitedMisconduct”inthis SCC.

• Engaginginpersistent(seedefinitions)misbehaviorthatviolatesthisSCC.

• Engagesinamutualfight/combat

• Engagingincriminalmischiefifthedamageislessthan$2500.

Off-Campus. AstudentmaybeplacedinDAEPforengaginginthefollowingmisconductwhile off-campusandnotinattendanceataschool-sponsoredorschool-relatedactivity:

• Theadministratorhasareasonablebeliefthatthestudentengagedinconductpunishableasa felony(otherthanaggravatedrobberyoraTitle5felony),andthestudent’scontinued presenceintheregularclassroomisathreattothesafetyofothersorisdetrimentaltothe educationalprocess.

• Off-campusconductforwhichDAEPplacementisrequiredbystatelawwhenthe administratordoesnotlearnoftheconductuntilmorethanayearpassesaftertheconduct occurred.

RegardlessofLocation. AstudentmaybeplacedinDAEPifthestudentengagesinthefollowing misconduct,regardlessofwhethertheconductoccurredonoroffcampus:

• Aregisteredsexoffender(seedefinitions)whoisnotunderanyformofcourtsupervisionwill beplacedinregularclassesifthestudentisnotathreattothesafetyofothers,isnot detrimentaltotheeducationalprocess,andsuchplacementisnotcontrarytothebest interestsoftheDistrict'sstudents.

• Engagesinbullying (seedefinitions) thatencouragesastudenttocommitorattemptto commitsuicide.

EmergencyDAEP Placement

• Incitesviolenceagainstastudentthroughgroupbullying.

• Releasesorthreatenstoreleaseintimatevisualmaterialofaminororastudentwhois18 yearsofageorolderwithoutthestudent’sconsent.

• Isinvolvedwithapublicschoolfraternity,sorority,secretsociety,organg(seedefinitions), includingparticipatingasamemberorpledge,orsolicitinganotherpersontobecomea memberorpledge.

• Isinvolvedincriminalstreetgangactivity(seedefinition).

AnadministratormayorderanemergencyDAEPplacementifthestudenthasbeensounruly, disruptive,orabusivethatitseriouslyinterfereswiththeteacher’sabilitytoteachtheclass,the learningofotherstudents,ortheoperationofaschool-relatedoraschool-sponsoredactivity. ThereasonforemergencyplacementmustalsobeareasonforwhichDAEPplacementcouldbe orderedonanon-emergencybasis.Atthetimeoftheemergencyplacement,thestudentwillbe toldthereasonfortheaction.

NolaterthanthetenthdayafterthedateofemergencyDAEPplacement,thestudentwillbe givenaconferenceasrequiredforregularplacementinDAEP;seebelow.

ProcedureforDAEP Placement Conference.

Nolaterthanthreeschooldaysafterthestudentisremovedfromclass,acampus administratorwillscheduleaconferencewiththecampusbehaviorcoordinatororother appropriateadministrator,thestudent’sparent/guardian,andthestudent.Attheconference, theadministratorwillexplaintheallegationsagainstthestudent,informthestudentofthe basisfortheproposedDAEPplacement,andgivethestudentanopportunitytoexplainhisor herversionoftheincident.TheDistrictmayconducttheconferenceandmakeadiscipline decisionregardlessofwhetherthestudentorthestudent’sparent/guardianattendsifthe Districtmadereasonableattemptstohavethemattend.

Onplacementofastudentinadisciplinaryalternativeeducationprogram,theschooldistrict shallprovideinformationtothestudent’sparentorpersonstandinginparentalrelationtothe studentregardingtheprocessforrequestingafullindividualandinitialevaluationofthe studentundertheTexasEducationCode,Section29.004.

IfduringthetermofDAEPplacementthestudentengagesinadditionalmisconduct,additional conferencesmaybeconductedandadditionaldisciplinemaybeimposed.

InterimPlacement.

Untilaplacementconferencecanbeheld,thestudentmaybeplacedin anotherappropriateclassroom,in-schoolsuspension,orout-of-schoolsuspension.Thestudent maynotbereturnedtotheregularclassroompendingtheplacementconference.

DAEPPlacementOrder.

IftheoutcomeoftheconferenceistoplacethestudentinDAEP,the campusbehaviorcoordinatorordesigneewillissueaDAEPplacementorder.Ifthelengthof placementdiffersfromtheguidelinesincludedintheSCC,theDAEPplacementorderwillgive noticeoftheinconsistency.

AcopyoftheDAEPplacementorderwillbesenttothestudentandthestudent’s parent/guardian.ForthosestudentsplacedinDAEPforareasonidentifiedintheTexas EducationCode,theDistrictwillalsosendthejuvenilecourtacopyoftheDAEPplacement ordernolaterthanthesecondbusinessdayaftertheplacementconference.AcopyoftheDAEP placementorderwillbeincludedwithanyrecordssenttoaschoolwherethestudentseeksto enroll.TheenrollingschooldistricthasdiscretiontoenforcetheDAEPplacementorder.

Thelengthofastudent'splacementinDAEPwillbedeterminedonacase-by-casebasisusing thecriteriaidentifiedinthe"DisciplineConsiderations"sectionofthisSCC.Thelengthofa

ParticularRulesfor RegisteredSex Offenders

student'splacementinDAEPwillbedeterminedonacase-by-casebasisusingthecriteria identifiedinthe"DisciplineConsiderations"sectionofthisSCC.MandatoryDAEPplacements willresultinplacementforupto88schooldays.DiscretionaryDAEPplacementswillresultin placementforupto48schooldays.

IftheDAEPisatcapacityatthetimeaDAEPplacementdecisionismadeforastudentwho engagedinconductrelatedtomarijuana,avape,alcohol,oranabusablechemical,thestudent shallbe:

• (1)placedinin-schoolsuspension;and

• (2)ifapositionbecomesavailableintheDAEPprogrambeforetheexpirationofthe placementperiod,transferredbacktotheDAEPfortheremainderoftheplacementorder.

IftheDAEPisatcapacityatthetimeaDAEPdecisionismadeforastudentwhoengagedin conductdescribedunderSection37.007thatconstitutesviolentconduct,asdefinedby commissionerruleoradministratordiscretionintheabsenceofcommissionerrule,astudent whohasbeenplacedintheprogramforconductrelatedtomarijuana,avape,alcohol,oran abusablechemical:

• (1)mayberemovedfromtheDAEPandplacedinin-schoolsuspensiontomakespaceinthe DAEPavailableforthestudentwhoengagedinviolentconduct;and

• (2)ifremovedfromtheDAEPforthisreason,shallbereturnedtotheDAEPifspacebecomes availablepriortotheendoftheplacementperiod.

SuccessfulcompletionofschooldayswillbedeterminedatthediscretionoftheDistrict.The lengthofDAEPplacementmaynotexceedoneyearunless,afterreview,theDistrictdetermines thatthestudentisathreattothesafetyofotherstudentsorDistrictemployees.

StudentsplacedinDAEPattheendofoneschoolyearmayberequiredtocompletethe assignedtermatthebeginningofthenextschoolyear.ForDAEPplacementtoextendbeyond theendoftheschoolyear,theadministratormustdeterminethat:(1)thestudent’spresencein theregularclassroomorcampuspresentsadangerofphysicalharmtothestudentorothers;or (2)thestudentengagedinseriousorpersistentmisbehaviorthatviolatestheSCC.Forpurposes ofthisparagraphonly,“seriousorpersistentmisbehavior”meansanymisconductidentifiedas beingpunishablewithplacementinDAEPorexpulsionorthreeormoreviolationsoftheSCCor repeatedoccurrencesofthesameviolation.

IftheDAEPplacementextendsbeyond60daysortheendofthenextgradingperiod,whichever issooner,thestudentorthestudent’sparent/guardianmayparticipateinaproceedingbefore theBoardorBoard’sdesigneeasprovidedinpolicyFNG(LOCAL).AnydecisionoftheBoardis finalandmaynotbeappealed.

ThegeneralSCCrulesforDAEPplacementapplytoregisteredstudentsexoffenders (see definitions)exceptasmodifiedinthissection.

Placement. RegisteredsexoffenderswillbeplacedinaJuvenileJusticeAlternativeEducation Program(JJAEP)inlieuofDAEPif:(1)orderedtoattendJJAEPbyacourt,or(2)ifpermittedby agreementbetweentheDistrictandtheJJAEP.

LengthofPlacement. RegisteredsexoffendersundercourtsupervisionwillbeplacedinDAEP foraminimumofonesemesterschooldaysschooldays,whichistheequivalentofone semester.Registeredsexoffenderswhoarenotunderanyformofcourtsupervisionbutare assignedtoDAEPmustserveaminimumofonesemesterschooldaysschooldays,whichisthe

equivalentofonesemester.

Transfers. RegisteredsexoffendersundercourtsupervisionthattransferintotheDistrictwillbe requiredtocompletetheDAEPassignmentassessedbythepreviousschooldistrict,butwill receivecreditforanytimealreadyspentinDAEP.

RegisteredsexoffenderswhoarenotundercourtsupervisionthattransferintotheDistrictwill berequiredtocompletetheDAEPassignmentassessedbythepreviousschooldistrict,butwill receivecreditforanytimealreadyspentinDAEP.

PeriodicReviewforRegisteredSexOffenders.

After80schooldaysinDAEP,areviewcommittee willdeterminebymajorityvoteandrecommendtoJenniferKelley,AssistantSuperintendentof StudentServiceswhetherthestudentshouldremaininDAEPorbereturnedtotheregular classroom.JenniferKelley,AssistantSuperintendentofStudentServiceswillfollowthe committee’sdecisiontoreturnthestudenttotheregularclassroomunlessthestudent’s presenceintheregularclassroomisathreattothesafetyofothers,isdetrimentaltothe educationalprocess,orisnotinthebestinterestsoftheDistrict’sstudents.Conversely,Jennifer Kelley,AssistantSuperintendentofStudentServiceswillfollowthecommittee’sdecisionto continuethestudent’splacementinDAEPunlessthestudent’spresenceintheregular classroomisnotathreattothesafetyofothers,isnotdetrimentaltotheeducationalprocess, orisnotcontrarytothebestinterestsoftheDistrict’sstudents.

IfthestudentremainsinDAEP,thereviewcommitteewillre-considerthestudent’splacement beforethebeginningofthenextschoolyear.

AppealsforRegisteredSexOffenders.

DAEPplacementmaybeappealedasdescribedinDistrict policyFNGorFOC.However,theappealislimitedtothefactualquestionofwhetherthe studentisrequiredtoregisterasasexoffenderunderthelaw.AdecisionoftheDistrict’sBoard ofTrusteesisfinalandmaynotbeappealed.

OtherDAEPIssues

GradeLevels.

Elementarystudentsinkindergartenthroughgrade5willnotbeplacedinDAEP withsecondarystudentsingrade6throughgrade12.

NoParticipationinActivitiesWhileinDAEP. StudentsplacedinDAEPforanymandatoryor discretionaryreasonsarenotallowedtoattendorparticipateinschool-sponsoredorschoolrelatedextracurricularorco-curricularactivitiesduringtheperiodofDAEPplacement.This restrictionappliesuntilthestudentfulfillstheDAEPassignmentatthisoranotherschool district.

ImpactonGraduation.

ForgraduatingseniorswhoareinDAEPduringthelastweekofschool, theDAEPplacementwillcontinuethroughthelastinstructionalday.Thestudentwillbeallowed toparticipateincommencementexercisesandrelatedgraduationactivitiesunlessotherwise specifiedintheDAEPplacementorder.

Transportation. AstudentplacedinDAEPwillnotbeprovidedtransportationunlessthestudent hasanIEPthatrequiresspecialtransportationdesignatedasarelatedservice.

PeriodicReview. TheDistrictwillreviewastudent’sDAEPplacementandacademicstatusevery 120calendardays.Inthecaseofahighschoolstudent,thestudent’sprogresstoward graduationwillbereviewedandagraduationplanwillbeestablished.Atthereview,thestudent ortheparent/guardianwillhaveanopportunitytopresentreasonsforthestudent’sreturnto theregularclassroomorcampus.Thestudentmaynotbereturnedtotheclassroomofa teacherwhoremovedthestudentwithoutthatteacher’sconsent.

CourseworkOpportunity. StudentsplacedinDAEPwillhaveanopportunitytocomplete courseworkrequiredforgraduation,atnocosttothestudent,beforethebeginningofthenext schoolyear.

TransitionfromDAEP. AssoonaspracticableaftertheDAEPadministratordeterminesthedatea studentwillbereleasedfromtheprogram,theadministratorwillprovidewrittennoticeofthe datetothestudent’sparent/guardianandtotheadministratorofthecampustowhichthe studentwillreturn.TheDAEPwillalsoprovidethecampusadministratoranassessmentofthe student'sacademicgrowthwhileattendingthealternativeeducationprogramandtheresultsof anyassessmentinstrumentsadministeredtothestudent.Notlaterthanfiveinstructionaldays afterthedateofreleasefromtheDAEP,thecampusadministratorwillcoordinatethestudent's transitiontoaregularclassroom,whichmustincludeassistanceandrecommendationsfrom schoolcounselors,schooldistrictpeaceofficers,schoolresourceofficers,licensedclinicalsocial workers,campusbehaviorcoordinators,classroomteacherswhoareormayberesponsiblefor implementingthestudent'spersonalizedtransitionplan,andanyotherappropriateschool districtpersonnel.

TransitionPlan.

Eachstudentmustbeprovidedapersonalizedtransitionplandevelopedbythe campusadministrator.Thetransitionplanmustincluderecommendationsforthebest educationalplacementofthestudentandtheprovisionofinformationtothestudent'sparent orpersonstandinginparentalrelationshiptothestudentabouttheprocesstorequestafull individualandinitialevaluationofthestudentforpurposesofspecialeducationservicesunder TexasEducationCode,Section29.004.Thetransitionplanmayincluderecommendationsfor counseling,behavioralmanagement,oracademicassistanceforthestudentwitha concentrationonthestudent'sacademicorcareergoals;recommendationsforassistancefor obtainingaccesstomentalhealthservicesprovidedbythedistrictorschool,alocalmental healthauthority,oranotherprivateorpublicentity;andaregularreviewofthestudent's progresstowardthestudent'sacademicorcareergoals.Ifpracticable,thecampusadministrator ordesigneewillmeetwiththestudent'sparent/guardiantocoordinateplansforthestudent's transition.

EffectofStudentWithdrawal.

WhenastudentwithdrawsfromschoolbeforeaDAEPplacement orderiscompleted,theDistrictmaycompletetheproceedingsandissueaDAEPplacement order.Ifthestudentre-enrollsintheDistrictduringthesameorsubsequentschoolyear,the DistrictmayenforcetheDAEPplacementorderatthattime,minusanyportionofthe placementthatwasservedbythestudentduringenrollmentinanotherdistrict.

IftheadministratordoesnotissueaDAEPplacementorderafterthestudentwithdraws,the nextdistrictinwhichthestudentenrollsmaycompletetheproceedingsandissueaDAEP placementorder.

StudentTransfers. StudentsassignedtoDAEPinanotherTexasdistrict,aTexasopen-enrollment charterschool,oranout-of-stateschooldistrictatthetimeofenrollmentintotheDistrictwillbe placedintotheDistrict'sDAEPtocompletethetermoftheirDAEPplacement.Inorderto continueanout-of-stateDAEPplacement,thebasisfortheDAEPplacementmustalsobea reasonforDAEPplacementintheenrollingdistrict.Iftheout-of-stateDAEPplacementperiod exceedsoneyear,theDistrictwillreducetheperiodofplacementsothatthetotalplacement doesnotexceedoneyearunlesstheDistrictdeterminesthatthestudentisathreattothe safetyofothersorextendedplacementisinthebestinterestsofthestudent.

SummerSchool. StudentsinDAEPduringsummerprogramswillbeservedalongsideother studentsnotassignedtoDAEP.

SummerActivities. StudentswhoseDAEPplacementcontinuespasttheendoftheschoolyear andintothenextschoolyearwillnotbepermittedtoparticipateinschool-relatedactivities occurringduringsummermonths,includingteamcamps,clinics,practices,andworkouts.

CriminalProceedings. Thereviewandappealprocessdescribedbelowislimitedtoretaliationor off-campusmisconduct.ItdoesnotapplyifthestudentwasplacedinDAEPasrequiredbylaw forconductoccurringonorwithin300feetofschoolproperty,ataschool-sponsoredorschoolrelatedactivity,orforafalsealarmorreportorterroristicthreatinvolvingapublicschool.

Reasonsfor MandatoryExpulsion

IftheDistrictreceivesnoticethatprosecutionofastudent'scasewasrefusedandnoformal proceedings,deferredadjudication,ordeferredprosecutionwillbeinitiatedoracourtorjury foundthestudentnotguiltyorthatthestudentdidnotengageindelinquentconductor conductindicatinganeedforsupervisionanddismissedthestudent'scasewithprejudice,the Districtwillreviewthestudent'sDAEPplacementandwillscheduleareviewwiththestudent's parent/guardiannolaterthanthethirddayafterreceivingnotice.Thestudentwillnotbe returnedtotheregularclassroombeforethereview.Afterreviewingthenoticeandreceiving informationfromthestudent'sparent/guardian,theadministratormayonlycontinuethe student'sDAEPplacementiftheadministrationhasreasontobelievethestudent'spresencein theregularclassroomthreatensthesafetyofothers.

Theadministrator’sdecisionmaybeappealedtotheBoard.Intheeventofanappeal,atthe nextscheduledmeetingtheBoardwill:(1)reviewthenotice,(2)hearstatementsfromthe student,thestudent’sparent/guardian,andtheadministrator,and(3)confirmorreversethe decisionoftheadministrator.

IftheBoardconfirmsthedecisionoftheadministrator,thestudentandthestudent’s parent/guardianhavetherighttoappealtotheCommissionerofEducation.Thestudentmay notbereturnedtotheregularclassroomwhiletheappealispending.

Expulsion

School-Related. Astudentmustbeexpelledforanyofthefollowingmisconductthatoccurson schoolpropertyorwhileattendingaschool-sponsoredorschool-relatedactivityonoroffschool property:

• Commitsastate-mandatedexpellableoffenseontheschoolpropertyofanotherTexasschool districtorwhileattendingaschool-sponsoredorschool-relatedactivityofanotherTexas schooldistrict.

• Issuesafalsealarmorreport (seedefinitions) oraterroristicthreat (seedefinitions) involvingapublicschool.

Inthiscircumstance,expulsiontoanalternativesettingmaybeorderedregardlessof:(1)the dateonwhichtheconductoccurred,(2)thelocationatwhichtheconductoccurred,(3)whether thestudentwasenrolledintheDistrictatthetimetheconductoccurred,or(4)whetherthe studentsuccessfullycompletedanycourtdispositionrequirementsregardingtheconduct.

Astudentmaybesubjecttoanexpulsionunderthiscircumstanceuntil:(1)thestudent graduatesfromhighschool,(2)thechargesaredismissedorreducedtoamisdemeanor,(3)the studentcompletesthetermoftheplacement,or(4)theDistrictassignsthestudenttoanother program.Thestudentwillbeentitledtothesameperiodicreviewaffordedtootherstudentsin alternatesettings.Anexpulsionorderedinthiscaseisfinalandmaynotbeappealedbeyondthe BoardofTrustees.

Anadministratormayordertheimmediateexpulsionofastudentiftheadministrator reasonablybelievestheemergencyexpulsionisnecessarytoprotectpersonsorpropertyfrom imminentharm.Thereasonfortheemergencyexpulsionmustalsobeareasonforwhich expulsioncouldbeorderedonanon-emergencybasis.Atthetimeoftheemergencyexpulsion, thestudentwillbetoldthereasonfortheaction.Nolaterthanthetenthdayafterthedateof emergencyexpulsion,thestudentwillbegivenahearingasrequiredforaregularexpulsion;see below.

Hearing. Studentsallegedtohavecommittedanexpellableoffensewillreceiveahearingbefore thePaulaMcMillion,ExecutiveDirectorofStudentServiceswithinareasonabletimefollowing theallegedmisconduct.Thestudent’sparent/guardianwillbeinformedofthebasisforthe proposedexpulsionandwillbeinvitedinwritingtoattendthehearing.Aftermakinganeffort toinformthestudentandparent/guardianofthehearing,theDistrictmayholdthehearing regardlessofwhetherthestudentorthestudent’sparent/guardianattends.Atthehearing,the studentisentitledto:

• Representationbyanadult,includingthestudent’sparent/guardian,whocanprovide guidancetothestudentandwhoisnotanemployeeoftheDistrict;and

• Anopportunitytotestifyandtoreviewandpresentevidenceandwitnessesinthestudent’s defense.

Additionalproceedingsmaybeconductedandadditionaldisciplinemaybeimposedifthe studentengagesinadditionalmisconductwhilethestudentisalreadyexpelled.

InterimPlacement. Untilanexpulsionhearingcanbeheld,thestudentmaybeplacedinanother appropriateclassroom,in-schoolsuspension,out-of-schoolsuspension,orDAEP.

ExpulsionOrder. Iftheoutcomeoftheexpulsionhearingisthatthestudentwillbeexpelled,the appropriateadministratorwillissueanexpulsionorderandprovideacopytothestudentand thestudent’sparent/guardian.Ifthedurationoftheexpulsiondiffersfromtheguidelinesinthe SCC,theexpulsionorderwillgivenoticeoftheinconsistency.

TheDistrictwillsendacopyoftheexpulsionordertothejuvenilecourtnolaterthanthesecond businessdayaftertheexpulsionhearing.Acopyoftheexpulsionorderwillbeincludedwithany recordssenttoaschoolwherethestudentseekstoenroll.Theenrollingschooldistricthas

LengthofExpulsion

discretiontoenforcetheexpulsionorder.

Thedurationoftheexpulsionwillbedeterminedonacase-by-casebasisusingthecriteria identifiedinthe"DisciplineConsiderations"sectionofthisSCC.Bothmandatoryand discretionaryexpulsionswillresultinexpulsionforuptooneyear.

Schooldayscountedtowardscompletionoftheexpulsiontermwillbedeterminedatthe discretionoftheDistrict.Studentswhobringafirearm(asdefinedbyfederallaw)toschoolwill beexpelledfromtheregularclassroomforatleastonecalendaryearexceptasmodifiedbythe administratoronacase-by-casebasis.

Anexpulsionwillnotexceedonecalendaryearunless,afterreview,theDistrictdeterminesthat: (1)thestudentisathreattothesafetyofotherstudentsortoDistrictemployees;or(2) extendedexpulsionisinthebestinterestofthestudent.

Studentsexpelledattheendofoneschoolyearmayberequiredtocompletethetermoftheir expulsionatthebeginningofthenextschoolyear.

OtherExpulsion Issues

AcademicImpact. Studentswillnotreceiveacademiccreditforworkmissedduringtheperiodof expulsionunlessthestudentisenrolledinaJuvenileJusticeAlternativeEducationProgram (JJAEP)orotherDistrict-approvedprogramorasnecessarytoprovideafreeappropriatepublic educationunderIDEA.

ParticipationinActivities. Expelledstudentsareprohibitedfrombeingonschoolgroundsor attendingorparticipatinginschool-sponsoredorschool-relatedactivitieswhileexpelled.

AgeRestrictions. Studentsundertheageoftenwhoengageinexpellablebehaviorwillnotbe expelled,butwillbeplacedinDAEP.

EffectofStudentWithdrawal. IfastudentwithdrawsfromtheDistrictbeforetheexpulsion hearingisconducted,theDistrictmayproceedwithconductingthehearingaftersending writtennoticetotheparent/guardianandstudent.Ifthestudentre-enrollsduringthesameor subsequentschoolyeartheDistrictmayenforcetheexpulsionorderatthattime;studentswill becreditedforanyexpulsionperiodthatwasservedbythestudentwhileenrolledinanother district.

Iftheadministratordoesnotissueanexpulsionorderafterthestudentwithdraws,thenext districtinwhichthestudentenrollsmaycompletetheproceedingsandissueanexpulsionorder.

StudentTransfers. TheDistrictwillcontinuetheexpulsionofstudentsexpelledfromeither anotherTexasschooldistrictorfromanout-of-stateschooldistrictforbehaviorthatisalsoa reasonforexpulsionintheenrollingdistrict,untilthetermofexpulsionhasbeenserved.Ifthe out-of-stateexpulsionexceedsoneyear,theDistrictwillreducetheperiodoftheexpulsionso thatthetotalexpulsiondoesnotexceedoneyearunlesstheDistrictdeterminesthatthe studentisathreattothesafetyofothersorextendedplacementisinthebestinterestofthe student.

ExpulsionAppeals

AnexpelledstudentmayappealtheexpulsiondecisiontotheBoardofTrusteesasprovidedby policy.Thestudentorstudent'sparent/guardianmustsubmitawrittenappealtothe Superintendentwithinthreedaysafterreceiptoftheexpulsionorderordecision.The Superintendentwillgivethestudentorthestudent'sparent/guardianwrittennoticeofthe date,time,andlocationofthemeetingatwhichtheBoardwillreviewthedecision. Consequenceswillnotbedelayedpendingtheoutcomeoftheappeal.

Definitions

ABUSABLEVOLATILECHEMICALS:ThosesubstancesasdefinedinTexasHealthandSafety Code§485.001.

ALCOHOLICBEVERAGE:ThosesubstancesasdefinedinTexasAlcoholicBeverageCode§1.04.

ARMOR-PIERCINGAMMUNITION:Handgunammunitionthatisdesignedprimarilyforthe purposeofpenetratingmetalorbodyarmorandtobeusedprimarilyinpistolsandrevolversor otherfirearms.

ASSAULT:Forstudentdisciplinepurposes,intentionally,knowingly,orrecklesslycausingbodily injurytoanother.

BODILYINJURY:Physicalpain,illness,orimpairmentofaphysicalcondition.

BULLYING:Asinglesignificantactorapatternofactsbyoneormorestudentsdirectedat anotherstudentthatexploitsanimbalanceofpowerandinvolveswrittenorverbalexpression, includingelectroniccommunication,orphysicalconductthatoccursonorisdeliveredtoschool propertyortothesiteofaschool-sponsoredorschool-relatedactivityonoroffschoolproperty oronapubliclyorprivatelyownedschoolbusorvehiclebeingusedfortransportationof studentstoorfromschooloraschool-sponsoredorschool-relatedactivity,andthat:(1)hasthe effectorwillhavetheeffectofphysicallyharmingastudent,damagingastudent’sproperty,or placingastudentinreasonablefearofharmtothestudent’spersonorofdamagetothe student’sproperty;(2)issufficientlysevere,persistent,orpervasiveenoughthattheactionor threatcreatesanintimidating,threatening,orabusiveeducationalenvironmentforastudent; (3)materiallyandsubstantiallydisruptstheeducationalprocessortheorderlyoperationofa classroomorschool;or(4)infringesontherightsofthevictimatschool,includingcyberbullying (seedefinitionbelow).SeeDistrictpolicyFFIforadditionalinformationregardingbullying.

CHEMICALDISPENSINGDEVICE

:Adeviceotherthanasmallchemicaldispensersold commerciallyforpersonalprotection,thatisdesigned,made,oradaptedforthepurposeof dispensingasubstancecapableofcausinganadversepsychologicalorphysiologicaleffectonan individual.

CLUB:Aninstrumentspeciallydesigned,made,oradaptedforthepurposeofinflictingserious bodilyinjuryordeathbystrikingapersonwiththeinstrument,includingablackjack,nightstick, mace,andtomahawk.

CONTROLLEDSUBSTANCE

:Asubstance,includingadrug,anadulterant,andadilutant,listed inSchedulesIthroughVorPenaltyGroup1,1-A,2,2-A,3,or4oftheTexasControlled SubstancesAct.Thetermincludestheaggregateweightofanymixture,solution,orother substancecontainingacontrolledsubstance.Thetermdoesnotincludehemp,asdefinedby AgricultureCode121.001,orthetetrahydrocannabinols(THC)inhemp.

CRIMINALSTREETGANG

:Threeormorepersonshavingacommonidentifyingsignorsymbol oranidentifiableleadershipwhichcontinuouslyorregularlyassociateinthecommissionof criminalactivities.

CYBERBULLYING

:Bullyingthatisdonethroughtheuseofanyelectroniccommunication device,includingthroughtheuseofacellularorothertypeoftelephone,acomputer,acamera, electronicmail,instantmessaging,textmessaging,asocialmediaapplication,anInternet website,oranyotherInternetbasedorelectroniccommunicationtoolandthatoccursoff schoolpropertyoroutsideofaschool-sponsoredorschool-relatedactivity,ifthecyberbullying interfereswithastudent’seducationalopportunitiesorsubstantiallydisruptstheorderly operationofaclassroom,school,orschool-sponsoredorschool-relatedactivity.

DANGEROUSDRUG:SubstancesasdefinedinChapter483oftheTexasHealthandSafetyCode, specificallyadeviceoradrugthatisunsafeforself-medicationandthatisnotincludedin SchedulesIthroughVorPenaltyGroups1through4oftheTexasControlledSubstancesAct.

DEADLYCONDUCT

:Recklesslyengaginginconductthatplacesanotherinimminentdangerof seriousbodilyinjuryorbyknowinglydischargingafirearminthedirectionofanindividual, habitation,building,orvehicle.

DEADLYWEAPON

:Afirearmoranythingmanifestlydesigned,made,oradaptedforthe purposeofinflictingdeathorseriousbodilyinjuryoranythingthatinthemannerofitsuseor intendeduseiscapableofcausingdeathorseriousbodilyinjury.

E-CIGARETTE

:“E-cigarette”meansanelectroniccigaretteoranyotherdevicethatsimulates smokingbyusingamechanicalheatingelement,battery,orelectroniccircuittodelivernicotine orothersubstancestotheindividualinhalingfromthedevice.Thetermdoesnotincludea prescriptionmedicaldeviceunrelatedtothecessationofsmoking.Thetermincludes1)adevice describedbythestatuteregardlessofwhetherthedeviceismanufactured,distributed,orsold asane-cigarette,e-cigar,ore-pipeorunderanotherproductnameordescription,and2)any component,part,oraccessoryforthedevice,regardlessofwhetherthecomponent,part,or accessoryissoldseparatelyfromthedevice.

EXPLOSIVEWEAPON

:Anyexplosiveorincendiarybomb,grenade,rocket,orminethatis designed,made,oradaptedforthepurposeofinflictingseriousbodilyinjury,death,or substantialpropertydamage,orfortheprincipalpurposeofcausingsuchaloudreportasto causeunduepublicalarmorterror.Itincludesadevicedesigned,madeoradaptedfordelivery orshootinganexplosiveweapon.

FALSEALARMORREPORT

:Knowinglyinitiating,communicating,orcirculatingareportofa present,past,orfuturebombing,fire,offense,orotheremergencythatisknowntobefalseor baselessandthatwouldordinarily:(1)causeactionbyanofficialorvolunteeragencyorganized todealwithemergencies;(2)placeapersoninfearofimminentseriousbodilyinjury;or(3) preventorinterrupttheoccupationofabuilding,room,placeofassembly,publiclyaccessible place,ormodeofconveyancesuchasanautomobile.

FIGHTING:Twoormorepersonsengagedinanymutualviolentorphysicallyaggressivecontact towardeachothersuchasscuffling,pushing,shoving,orhitting.

FIREARMSILENCER:Anydevicedesigned,made,oradaptedtomufflethereportofafirearm.

GANG:Anorganization,combination,orassociationofpersonscomposedwhollyorinpartof studentsthat:(1)seekstoperpetuateitselfbytakinginadditionalmembersonthebasisofthe decisionofthemembershipratherthanonthefreechoiceoftheindividual,or(2)thatengages inillegaland/orviolentactivities.Inidentifyinggangsandassociatedgangattire,signs,or symbols,theDistrictwillconsultwithlawenforcementauthorities.

GRAFFITI:Makingmarksofanykindonthetangiblepropertyofanotherwithouttheeffective consentoftheowner.

HANDGUN:Anyfirearmdesigned,made,oradaptedtobefiredwithonehand.

HARASSMENT(asdefinedbyBoardPolicyandfederallaw):Threateningtocauseharmor bodilyinjurytoanother,engaginginintimidatingconduct,causingphysicaldamagetothe propertyofanother,subjectinganothertophysicalconfinementorrestraint,maliciouslytaking anyactionthatsubstantiallyharmsanother'sphysicaloremotionalhealthorsafety,orother conductprohibitedbyDistrictpolicyFFHorDIAthatissosevere,persistent,orpervasivethatit hasthepurposeoreffectofsubstantiallyorunreasonablyinterferingwithastudent's performance;createsanintimidating,threatening,hostile,oroffensiveeducational environment;affectsastudent'sabilitytoparticipateinorbenefitfromaneducationalprogram oractivity;orotherwiseadverselyaffectsthestudent'seducationalopportunities.(Seealso definitionofSexualHarassment,below.)

HARASSMENT(asdefinedbythePenalCode):Actionsagainstaschoolemployeewithintent toharass,annoy,alarm,abuse,torment,orembarrass,wherebythestudentinitiatesthe communicationandmakesamakesacomment,request,suggestion,orproposalthatis obscene;threatens,inamannerreasonablylikelytoalarmtheemployeereceivingthethreat,to inflictbodilyinjuryontheemployeeortocommitafelonyagainsttheemployee,amemberof theemployee'sfamilyorhousehold,ortheemployee'sproperty;conveys,inamanner reasonablylikelytoalarmtheemployeereceivingthereport,afalsereport,whichisknownby thestudenttobefalse,thatanotherpersonhassuffereddeathorseriousbodilyinjury;sends repeatedelectroniccommunicationsinamannerreasonablylikelytoharass,annoy,alarm, abuse,torment,embarrass,oroffendanemployeeoftheDistrict;orpublishesonanInternet website,includingasocialmediaplatform,repeatedelectroniccommunicationsinamanner reasonablylikelytocauseemotionaldistress,abuse,ortormenttoanotherperson,unlessthe communicationsaremadeinconnectionwithamatterofpublicconcern.

HAZING:Anyact,occurringonoroffthecampus,byonepersonaloneoractingwithothers, directedagainstastudent,forthepurposesofpledging,initiationinto,affiliationwith,holding officein,ormaintainingmembershipinanorganization,iftheactconstitutesanytypeof physicalbrutality,involvessleepdeprivation,exposuretotheelements,confinementinasmall space,calisthenics,orothersimilaractivitythatsubjectsthestudenttoanunreasonableriskof harmorthatadverselyaffectsthementalorphysicalhealthorsafetyofthestudent,orinvolves theconsumptionofafood,liquid,alcoholicbeverage,liquor,drug,orothersubstance,including inamountsthatwouldleadareasonablepersontobelievethestudentisintoxicated.Hazing includessoliciting,encouraging,directing,aiding,orattemptingtoaidanotherstudentin engaginginhazing,aswellashavingfirsthandknowledgeoftheplanningoroccurrenceofa specificstudenthazingincidentwithoutreportingtheincidenttoaschooladministrator,a peaceofficer,oralawenforcementagency.Consenttooracquiescenceinthehazingactivity doesnotexcusethestudentofresponsibilityforthemisconduct.

HITLIST:Listofpeopletargetedtobeharmedusingafirearm,knife,oranyotherobjecttobe usedwithintenttocausebodilyharm.

IMPROVISEDEXPLOSIVEDEVICE

:Acompletedandoperationalbombdesignedtocause seriousbodilyinjury,death,orsubstantialpropertydamagethatisfabricatedinanimprovised mannerusingnonmilitarycomponents.Thetermdoesnotincludeunassembledcomponents thatcanbelegallypurchasedandpossessedwithoutalicense,permit,orothergovernmental approval;oranexplodingtargetthatisusedforfirearmspractice,soldinkitform,andcontains thecomponentsofabinaryexplosive.

INDECENTEXPOSURE

:ThoseactsdefinedinTexasPenalCode§21.08asanoffensethat occurswhenapersonexposeshisorheranusoranypartofhisorhergenitalswithintentto arouseorgratifythesexualdesireofanypersonandisrecklessaboutwhetheranotheris presentwhowillbeoffendedoralarmedbytheact.

INTENT:Thedesign,resolve,determination,orstateofmindwithwhichapersonacts,ordinarily

proventhroughinferencesdrawnfromtheactand/orcircumstancessurroundingtheact.Intent includestheconsciousobjectiveordesiretoengageintheconductorcausetheresult,an awarenessthattheconductisreasonablycertaintocausetheresult,ordisregardofa substantialandjustifiableriskwhenthereisanawarenessthatthecircumstancesexist,orthe resultwilloccur.Thefactthatastudentmaynothavebeenmotivatedbyadesiretoviolatethe SCCdoesnotprecludeimposingadisciplinaryconsequencesolongasthestudentintendedto engageintheunderlyingconductthatviolatedtheSCC.

INTIMATEVISUALMATERIAL

:Visualmaterialthatdepictsapersonwiththeperson’sintimate partsexposedorengagedinsexualconduct.“Visualmaterial”meansanyfilm,photograph, videotape,negative,orslideofanyphotographicreproductionoranyotherphysicalmedium thatallowsanimagetobedisplayedonacomputerorothervideoscreenandanyimage transmittedtoacomputerorothervideoscreen.

INVASIVEVISUALRECORDING

:Apersoncommitsanoffenseif,withouttheotherperson's consentandwithintenttoinvadetheprivacyoftheotherperson,theperson:(1)photographs orbyvideotapeorotherelectronicmeansrecords,broadcasts,ortransmitsavisualimageofan intimateareaofanotherpersoniftheotherpersonhasareasonableexpectationthatthe intimateareaisnotsubjecttopublicview;(2)photographsorbyvideotapeorotherelectronic meansrecords,broadcasts,ortransmitsavisualimageofanotherinabathroomorchanging room;or(3)knowingthecharacterandcontentofthephotograph,recording,broadcast,or transmission,promotesaphotograph,recording,broadcast,ortransmissiondescribedabove.

KNIFE:Abladedhandinstrumentthatiscapableofinflictingseriousbodilyinjuryordeathby cuttingorstabbing,includingaswitchblade.

KNUCKLES:Anyinstrumentconsistingoffingerringsorguardsmadeofahardsubstancethatis designed,made,oradaptedforthepurposeofinflictingseriousbodilyinjuryordeathbystriking apersonwithafistenclosedintheknuckles.

LOCATION-RESTRICTEDKNIFE:Aknifewithabladeover5½inches.

MACHINEGUN:Anyfirearmcapableofshootingmorethantwoshotsautomatically,without manualreloading,byasinglefunctionofthetrigger.

MARIJUANA:TheplantCannabissativaL.,whethergrowingornot,theseedsofthatplant,and everycompound,manufacture,salt,derivative,mixture,orpreparationofthatplantoritsseeds.

ONORABOUTHISORHERPERSON:Withinthestudent’scontrolandwithinarm’sreach.

PARAPHERNALIA:Anyarticleordeviceusedorintendedforusetoinject,ingest,inhale,or otherwiseintroducemarijuana,acontrolledsubstance,adangerousdrug,oranalcoholic beverageintothehumanbody,includingbutnotlimitedtoroachclips,rollingpapers,needles, baggieswithresidue,razorblades,orpipes.

PERSISTENT:ThreeormoreviolationsoftheSCCorrepeatedoccurrencesofthesame violation.

POSSESSION :Tohaveinoron:(1)astudent'spersonorinthestudent'spersonalproperty, suchasthestudent'sclothing,purse,orbackpack;(2)inanyconveyanceusedbythestudentfor transportationtoorfromschoolorschool-relatedactivities,suchasanautomobile,truck, motorcycle,orbicycle;or(3)anyotherschoolpropertyusedbythestudent,suchasalockeror desk.

POSSESSIONORPROMOTIONOFLEWDVISUALMATERIALDEPICTINGACHILD:Possessing, accessing,orpromoting,lewdvisualmaterialdepictingachild,asfurtherdefinedbyTexasPenal

Code§43.25andpunishableasafelony.

PROHIBITEDWEAPONS:Aprohibitedweaponincludesthefollowingitems:armor-piercing ammunition,chemicaldispensingdevice,explosiveweapon,machinegun,short-barrelfirearm, zipgun,improvisedexplosivedeviceortiredeflationdeviceasfurtherdefinedinTexasPenal Code§46.05.

PUBLICLEWDNESS:ThoseactsdefinedinTexasPenalCode§21.07asanoffensethatoccurs whenapersonknowinglyengagesinanactofsexualintercourse,deviatesexualintercourse,or sexualcontactinapublicplaceor,ifnotinapublicplace,isrecklessaboutwhetheranotheris presentwhowillbeoffendedoralarmedbytheact.

REASONABLEBELIEF

:Adeterminationthatmisconductoccurredmadebytheadministrator usingallavailablefactualandlegalinformation,includinginformationfurnishedunderArticle 15.27oftheCodeofCriminalProcedure.

RETALIATE:Harmingorthreateningtoharmanother:(1)onaccountoftheirserviceasaDistrict employeeorvolunteer,(2)topreventordelayanother'sservicetotheDistrict,or(3)because thepersonintendstoreportacrime,includingpostingtheresidenceaddressortelephone numberoftheemployeeonapubliclyaccessiblewebsitewithintenttothreatenharmorcause harmtotheemployeeortheemployee’sfamilyorhousehold.

SELF-DEFENSE

:Toclaimself-defense,thestudentmust(1)bewithoutfaultinprovokingthe encounterandnotactastheaggressor,and(2)usetheminimumforcerequiredtoremove himselforherselffromimmediatedangerofharm.Actionsthatescalateorcontinuethe encounterwillnotbeconsideredself-defense.Interactionspriortotheencounterwillalsobe considered.

SERIOUSMISBEHAVIOR

SEXOFFENDER:AstudentrequiredtoregisterasasexoffenderunderChapter62oftheCode ofCriminalProcedureforanoffensecommittedonorafterSeptember1,2007.Thetermdoes notincludeastudentwho:(1)isnolongerrequiredtoregisterasasexoffenderunderChapter 62,(2)isexemptfromregisteringasasexoffenderunderChapter62,or(3)receivesanearly terminationoftheobligationtoregisterasasexoffenderunderChapter62.

SEXUALHARASSMENT

:Unwelcomesexualadvances,requestsforsexualfavors,andother verbal,nonverbal,orphysicalconductofasexualnature,orconductonthebasisofsex prohibitedbyDistrictpolicyFFHorFNC,whenitissosevere,persistent,pervasive,and objectivelyoffensivethatithasthepurposeoreffectofeffectivelydenyingapersonequal accesstoaneducationalprogramoractivity.Conductthatmeetsthedefinitionsofsexual assault,datingviolence,domesticviolenceorstalkingunderfederallaw.

SHORT-BARRELFIREARM

:Ariflewithabarrellengthoflessthan16inchesorashotgunwitha barrellengthoflessthan18inches,oranyweaponmadefromarifleorshotgunif,asaltered, hasanoveralllengthoflessthan26inches.

SWITCHBLADEKNIFE:Anyknifewithabladethatfolds,closes,orretractsintothehandleor sheathandthatopensautomaticallybypressingabuttonorotherdevicelocatedonthehandle oropensorreleasesabladefromthehandleorsheathbytheforceofgravityorcentrifugal

force.Itdoesnotincludeaknifethathasaspring,detent,orothermechanismdesignedto createabiastowardclosureandthatrequiresexertionappliedtothebladebyhand,wrist,or armtoovercomethebiastowardclosureandopentheknife(alsoknownasone-handed openersorassistedopeners).

TELECOMMUNICATIONSDEVICE
