Open Fields – formally known as the Voluntary Public Lands Access and Habitat Incentive – is run by the U.S. Farm Service Agency along with state and tribal governments. It offers competitive grants to states and tribal governments to expand private land access through easements. Outdoor recreation represents a $2.5 billion-per-year industry in Montana. Tester recently held a public hearing in Bozeman on the value of public lands where he heard from Montana’s sportsmen and women.

For purposes of the rule, roadless areas are defined as contiguous blocks of backcountry public land that are 5,000 acres or larger and do not have improved roads.

While access is important to sportsmen, densely roaded areas have been shown to negatively affect elk and deer behavior, reproduction and survival and consequently hunter opportunity. Excessive, poorly located roads contribute to increased sediment loads in waterways that are important to wild trout and salmon, thereby diminishing the number and size of fish. “We appreciate the dedication of the U.S. Department of Agriculture in upholding this popular land management policy,” said TRCP President and CEO Whit Fosburgh, “and we applaud the court’s decision as one made in the absolute best interest of our public-lands fish and wildlife populations and outdoor recreation. “As the 2011 fall hunting season continues, sportsmen have reason to celebrate backcountry conservation,” continued Fosburgh. “Whether they’re hunting the West Big Hole of Montana, the northern Blue Range of New Mexico or backcountry lands in Vermont’s White Mountains, publicland hunters across the nation will benefit from the court’s thoughtful decision for generations to come.”

Theodore Roosevelt Conservation Partnership WASHINGTON --(Ammoland.com)- The Theodore Roosevelt Conservation Partnership today commended a decision by the U.S. Tenth Circuit Court of Appeals that reinstated the 2001 Roadless Area Conservation Rule as the law governing 49 million acres of inventoried roadless areas located on the nation’s national forests and grasslands.

Learn more about the TRCP’s work in support of roadless area conservation. Inspired by the legacy of Theodore Roosevelt, the TRCP is a coalition of organizations and grassroots partners working together to preserve the traditions of hunting and fishing.

The ruling overturned a lower district court’s decision enjoining the 2001 rule in August 2008 and resolved uncertainty about federal management of roadless areas across America.

The so-called “roadless rule” is a multiple-use national forest management regulation that was designed to limit road building and timber harvest on undeveloped public lands managed by the U.S. Department of Agriculture. The rule determines the management of all national forest roadless areas outside of Idaho. “Today’s decision affirmed the value of backcountry areas in sustaining healthy and secure habitat for fish and wildlife – something hunters and anglers have known for years,” said Joel Webster, director of the TRCP Center for Western Lands. “Sound roadless conservation policies safeguard big-game habitat security, productive trout and salmon fisheries and

FAIRFAX, Va. --(Ammoland.com)- In a case supported by the NRA, David Lawson, who had previously been a plaintiff in McDonald v. Chicago, challenged the decision by the City of Chicago not to allow him to register two normal SKS rifles with fixed ten-round magazines.

FAIRFAX, Va. --(Ammoland.com)- NRA has filed friend of the court briefs in two separate cases involving the right to carry firearms outside the home for self-defense. In Shepard v. Madigan, currently pending in the U. S. District Court for the Southern District of Illinois, the lead plaintiff is church treasurer Mary Shepard, who, along with an elderly co-worker, was severely beaten at her workplace by an attacker with a criminal record. Mrs. Shepard has carry permits issued by two other states, but was left unarmed and defenseless by Illinois’ law. Her challenge – in which the Illinois State Rifle Association, NRA’s state affiliate, also joins as a plaintiff – contends that Illinois’ carry ban cannot stand in light of the Heller and McDonald decisions.

Although the rifles do not meet Chicago’s definition of an “assault weapon,” Chicago refused registration because they were “convertible” into “assault weapons.” The city denied the registration in spite of the fact Chicago has a separate provision for dealing with registered rifles that are converted into “assault rifles” after registration. Following an initial rejection and preliminary appeal before a hearing examiner, the case was appealed to the City Court. The judge ruled the hearing examiner had to take evidence as to whether the guns were actually capable of accepting a detachable magazine, which is one of the criteria to define a rifle as an “assault weapon,” and sent the case back to the hearing examiner.

In Richards v. Prieto, currently pending in the Ninth Circuit U.S. Court of Appeals in California, plaintiffs brought suit against Yolo County, Calif. Sheriff Ed Prieto for his refusal to issue carry permits to law-abiding applicants. The case was first heard in the U.S. District Court for the Eastern District of California, where the court ruled for the sheriff.

In both cases, the NRA, as the leading organization in the nation advocating for gun owners’ rights and specifically in advocating for the passage of right-to-carry laws in the states, has lent its expertise on the issue by filing briefs in strong support of the right to carry. The briefs stress that the right to carry is an important part of the fundamental right of self-defense. Additionally, the briefs counter the arguments that permit holders are a public safety threat. Specifically, the brief responds to Brady Campaign claims that passage of right-to-carry laws lead to increases in crime. In fact, the briefs show not only that crime does not increase in right-to-carry states, but that right-to-carry laws contribute to a reduction in crime. The previous Pan American record was 187 targets, needless to say Eller put up an amazing performance. In the final, he experienced difficulty with a spring in his trigger-he had two malfunctions but didn’t lose any targets as a result. “We were fortunate to have good conditions and the Jalisco Hunting Club is the nicest venue in the Americas,” commented Eller. Puerto Rico’s Jose Torres won the silver medal with 136 match targets and 49 targets in the final for 185 total targets. Luis Da Graca of Brazil won the bronze medal with a perfect final of 50 targets for 182 total targets. His father, Butch Eller (pictured at left with Glenn), made the journey down to Mexico to watch his son compete in his first Pan American Games.

“This is the only international level event that Glenn has not won a gold medal in and I’m very proud of him,” said the senior Eller. National Shotgun Coach Bret Erickson was impressed with Eller’s “dedication and focus.” Erickson explained that “Eller voluntarily gave up his spot on the 2003 and 2007 Pan American Teams because in both instances, he already held a quota. I’m glad he had the opportunity to attend this year and delivered a world class performance.”

Recognizing the growing urbanization of America, NSSF first sought to build public awareness of the sportsman’s role in conservation and their contributions to wildlife management through landmark efforts such as the annual National Hunting and Fishing Day, established in 1973.

have been manufactured since 1986,” and that the banned magazines are even more prevalent. But the court also found — based largely on the testimony of a Brady Campaign lawyer to the District of Columbia Council — that “the District ha[d] carried its burden of showing a substantial relationship between the prohibition of both semi-automatic rifles and magazines holding more than ten rounds and the objectives of protecting police officers and controlling crime.” Fortunately, in a long and well reasoned dissenting opinion that may provide a road map for other courts, Judge Brett Kavanaugh rejected the majority’s reasoning. Rather than the “intermediate scrutiny” employed by the majority or any other “balancing test,” Judge Kavanaugh would have applied a standard based on “text, history, and tradition.” Under that standard, he argued that “it would strain logic and common sense to conclude that the Second Amendment protects semi-automatic handguns but does not protect semi-automatic rifles,” which “have not traditionally been banned and are in common use today.”

FAIRFAX, Va. --(Ammoland.com)- In a split ruling in an ongoing NRA-supported case challenging the restrictive gun laws established by the Washington D.C. government in defiance of the Supreme Court’s 2008 Heller decision, the U.S. Court of Appeals for the District of Columbia Circuit has upheld a number of highly restrictive gun laws.

“When it comes to self-defense, semi-automatic firearms of all types are an increasingly popular choice for most Americans, and the court itself admitted that semiautomatics are in common use, with millions of these guns sold in recent years,” said Chris W. Cox, Executive Director of the NRA Institute for Legislative Action. “Law abiding residents of the District should have the same access to these tools as residents of nearly all of the 50 states.”

Unfortunately, the court ruled that the District’s general handgun registration requirement is constitutional. However, the court reached that conclusion by misreading the Supreme Court’s Heller decision as presuming that any type of “longstanding” restriction is constitutional, so it only upheld the more traditional aspects of the registration system, such as the requirements that the registrant provide his or her name and address, a description of the firearm and certain other basic information.

By contrast, the court found that other D.C. requirements, such as fingerprints, a vision requirement, ballistics tests and mandatory training, were “novel” and therefore need to be reviewed again by a lower court under a tighter standard of scrutiny. Similarly, the court found that long gun registration is “novel” in the U.S. and returned that issue to the lower court as well. D.C. laws banning “assault weapons” and magazines that hold more than 10 rounds of ammunition were also wrongly found to be constitutional. The Supreme Court said in Heller that “arms” are protected under the Constitution if they are “in common use,” and the D.C. Circuit found it “clear enough in the record that semi-automatic rifles and magazines holding more than ten rounds are indeed in ‘common use,’” based on Bureau of Alcohol, Tobacco, Firearms and Explosives production statistics showing that “1.6 million AR-15s alone

Among other things, the suit sought to force BLM to ban the use of lead ammunition for hunting in the Arizona Strip, a rugged area in the northwest corner of the state renowned for great hunting. CBD contended California condors in Arizona and elsewhere were being poisoned from scavenging game that was shot by hunters using lead shot or bullets. But the record plainly shows that California condors were reintroduced to this area of Arizona based on express promises by FWS and other agencies that the reintroduction would not affect hunting. Among other things, the Court ruled that CBD had waived its claims concerning BLM’s failure to assess the alleged impact of lead ammunition on condors because “[i]t did not argue that BLM was required to include the potential effects of lead ammunition in [BLM’s] analysis of environmental impacts.” Even before the ruling, NRA’s intervention in the case on behalf of its members had already resulted in several legal victories. Arizona Game and Fish Department PHOENIX, AZ – -(Ammoland.com)- Mexican authorities released five Mexican wolves in the San Luis Mountains in Sonora, Mexico, on Oct. 12, 2011, approximately 80 miles south of Douglas, Ariz. Mexico’s desire to release wolves in Sonora as part of its recovery effort has been known for the past two years, although the exact timetable for release was unknown.

A similar case, in which many of the same plaintiffs challenge the state of Texas’ ban on issuance of Right-to-Carry permits to adults under 21, remains pending in the same court. That case is Jennings v. McCraw.

“Mexico is a sovereign nation with its own wildlife conservation and recovery goals. The vast majority of historic habitat for the Mexican wolf is actually in Mexico, and longterm full recovery of the sub-species is incumbent on successful recovery there, as well as our recovery efforts in the U.S.,” said Larry Voyles, director of the Arizona Game and Fish Department.

It will likely take years to finalize either plan because of federal environmental compliance processes that could easily be further drawn out by appeals and even litigation.”

The Maryland Natural Resources Police is the oldest state law enforcement agency with its beginnings as the State Oyster Police in 1868.
