A guide on how to get SCOMET License for Export item list

In India, exports and imports of goods are subject to the Foreign Trade (Development & Regulation) Act, 1992 (as amended from time to time) and the rules and regulations made thereunder, including the Export and Import Policy (“Exim Policy”). The Exim Policy is issued by the Government of India every year and sets out the terms and conditions for exports and imports. The Exim Policy provides for the licensing of exports and imports of goods. The Directorate General of Foreign Trade (DGFT) is the licensing authority for exports and imports of goods.

What is SCOMET?

The Special Chemicals, Organisms, Materials, Equipment and Technologies (SCOMET) List is a list of items, materials, equipments, etc. which are subject to export control under the Foreign Trade (Development & Regulation) Act, 1992 and the Export (Control) Order, 2002.

What is a SCOMET License?

A SCOMET license is an authorization granted by the Directorate General of Foreign Trade (DGFT) to allow the export of goods or providing of services included in the SCOMET List. The license is granted under the provisions of the Foreign Trade (Development & Regulation) Act, 1992 and the Export (Control) Order, 2002.

Purpose of SCOMET Item list

The purpose of the SCOMET list is to regulate the export of items that could be used for both civilian and military purposes. The list includes items that are controlled for nuclear non-proliferation, antiterrorism, chemical and biological warfare, and missile technology.

Seven categories of items on the SCOMET list

There are seven categories of items on the SCOMET list:

• Nuclear Non-Proliferation

• Chemical and Biological Warfare

• Missile Technology

• Lasers and Sensors

• Navigation and Avionics

• Computing Equipment

• Information Security

Each category of items on the SCOMET list has its own set of benefits.

1. Nuclear Non-Proliferation: The export of items on the SCOMET list helps to ensure that nuclear weapons and materials are not proliferated to other countries or non-state actors.

2. Chemical and Biological Warfare: The export of items on the SCOMET list helps to ensure that chemical and biological weapons are not proliferated to other countries or non-state actors.

3. Missile Technology: The export of items on the SCOMET list helps to ensure that missile technology is not proliferated to other countries or non-state actors.

4. Lasers and Sensors: The export of items on the SCOMET list helps to ensure that lasers and sensors are not proliferated

What are the benefits of having a SCOMET License?

There are several benefits of having a SCOMET license:

1. It helps promote the export of items on the SCOMET List.

1. A SCOMET licence is required for the import of any goods that appear in the SCOMET list, which is released by the Directorate General of Foreign Trade (DGFT)

2. The SCOMET list includes goods that are controlled for strategic, security or other reasons.

3. Depending on the goods, a SCOMET licence may be required for the import of goods falling under any of the four SCOMET categories – ‘A’, ‘B’, ‘C’ or ‘D’.

4. A SCOMET licence is also required for the import of any SCOMET export item, regardless of its value.

5. The SCOMET licence is valid for a period of one year from the date of its issuance, and can be renewed annually.

6. A SCOMET licence is obtained from the DGFT, which is a part of the Ministry of Commerce and Industry.

7. The licence is required to be furnished at the time of import of the specified SCOMET goods. What is the Procedure to get a SCOMET License?

The procedure to obtain a SCOMET license is as follows:

1. The applicant should first get the SCOMET List from the DGFT website.

2. The applicant should then identify the item he/she wants to export on the SCOMET List.

3. The applicant should then file an application for a SCOMET license on the DGFT website.

4. The DGFT will process the application and grant the license if everything is in order.

In Nutshell: To export any item from the SCOMET List, an exporter needs to obtain a license from the DGFT. The license is called the SCOMET License.
