VehicleConditionandReturn

Youacknowledgethevehicleisdeliveredto Youingoodconditionwiththe sealoftheodometerunbroken YouagreetoreturntheVehicleinthesame condition(exceptforordinarywearandtearNOTINCLUDINGWINDSCREEN ORTYREDAMAGE)togetherwithit'stools tyres accessoriesandequipment onthedatespeciedontheRentalAgreement(orsooner ifdemandedbythe Company) TheCarmustbereturnedto8BrownstCicconeAliceSpringsNT 0870 Cleaningfeemayapplyifexcessivelydirty TheCompanymaytake possessionoftheVehiclewithoutpriordemandedtoYouandatyour expensesiftherehasbeenanybreachofanytermsorconditionsofthis Agreementorifthevehicleisillegallyparked inviolationofthelaworis apparentlyabandoned Ifthesealoftheodometerisbroken,orotherwise tamperedwith,youwillberesponsiblefornotonlyanextrachargebasedon 500kilometresperdayat30cperkilometre,butalsoforanycostofrepairing orreplacingtheodometer NOTE:Ifthereistobeanyextensionoftheperiod ofhirebeyondthatstatedontheRentalAgreement thecompanymustbe notied anditmustagreetosuchextensioninwriting otherwisetheVehicle willbeimmediatelyreportedtothepoliceasstolen Vehiclesreturnedpriorto cessationofhiretermwillnotbeeligibleforrefund Achargeof$900applies incaseyourrentalcarkeysarelost

Circumstanceswherethevehiclemustnotbe used

IntheNorthernTerritoryandWesternAustralia,outsideanycitylimits betweenduskanddawn;or

(a)Throughstreams rivers,creeks,damsandoodwaters

(b)Anyunsealedroadsoroff-roadconditionsunlessauthorizedbythe CompanyontheRentalAgreementChargesmayapply

(c)Thecarriageofanypersonsforhireorthecartageofanyinammable explosiveorcorrosivematerials

(d)Pushingortowinganyvehicle,trailer boatorotherobjectunlessthe Companyhasauthorisedsuchuseinwriting

(e)Thecarriageofanygreaterloadand/orpersonsand/orforapurposefor whichtheVehiclewasdesignedandconstructed

(f)ThecarriageofanyanimalintheVehicleunlessauthorizedinwritingor notedontheRentalAgreementinSPECIALCONDITIONS

(g)TheuseoftheVehicleforracing pacemaking reliabilitytrials speed trials hillclimbingorbeingtestedinpreparationforthoseactivities

(h)TheuseoftheVehicleinadangerousmanner

(i)TheuseoftheVehicleincontraventionofanylegislationorregulation controllingvehiculartrac

DamageCover

ProvidedYouand/ortheAuthorisedDriveractwithinthetermsandcondition ofthisAgreement theCompanywillgrantdamagecoverintheeventofa multiplevehicleaccident(whichincludesyourlegalcostsincurredwithour writtenconsent)toYouand/ortheAuthorisedDriverinrespectofdamageto theVehicleand/ordamagetotheVehicletoanythirdpartypropertyother thandamagetoanypropertyownedbyYou(includinganyfriend/relative associateorpassenger)inyourphysicalorlegalcontrol Thiscoverisalso subjectto

PersonswhomustnotdrivetheVehicle

(a)ApersonwhoisnotidentiedontheRentalAgreementaseithertheHirer, JointHirerorAuthorisedDriver

(b)Apersonwhoisnotlicensedtodrivethehiredclassofvehicle

(c)Apersonwhosebloodalcoholconcentrationexceedsthelawful percentagewhilstdrivingtheVehicle

(d)ApersonwhoisdrivingtheVehiclewhilstundertheinuenceofadrug

(e)ApersonwhohasgivenorforwhomYouhavegivenafalsename,age, addressordriverslicensedetails

(f)Apersonwhosedriverslicensehasbeencancelled endorsedor suspendedwithinthelastthreeyears

(g)Apersonwhohasheldadriver'slicenseforanyclassofvehicleforless thentwoyears

(h)Apersonwhousesorintendstousethevehicleforanillegalpurpose

(i)Youandanyotherauthorizeddriverarenotunder21yearsofage

(j)Our4wheeldrivevehiclesarenotavailabletodriversunder25years

ObligationsoftheHirer/AuthorisedDriver

NOTEtheHirer/JointHirerandAuthorisedDriverarejointlyandseverally liableforcompliancewiththeTermsandConditionsofthisagreement

Itismandatorytoobtaininsurance Pleaseenquireaboutpackagesand optionsavailable

Byenteringintothisagreement youareresponsibleforandirrevocably authorisethecompanytodebitthecreditcardprovidedonTheRental Agreementoranyothercreditcardprovided(andYouwillpaythecompany ondemandanybalance)withthefollowingcharges:

(a)TherentalchargesspeciedontheRentalAgreement

(b)Allchargesclaimedbythecompanyinrespectofparkingand/orany othertracviolationsincurredduringtheperiodofhireoruntilsuchlatertime astheisreturnedtothecompany

(c)AlllossordamagetotheVehicle(includingthelossoruseofthat Vehicle) legalexpenses,collectioncostsorcommissioncharges, assessmentfees towingandrecovery,consequentialthird-partydamage, storageandcompanyservicechargeswhere

(i)AnytermorconditionoftheAgreementhasbeenbreached

(ii)TheVehicleisinvolvedinasinglevehicleaccidentunlessthecompany waivessuchalosstotheSingleVehicleIncidentLiabilityamountshownon theRentalAgreement(whichamountwillapplyinadditiontotheStandard LiabilityChargenotedtheRentalAgreement) Asinglevehicleincidentis denedasanyincidentwheretheVehiclesufferslossordamagebecause ofanimpactwithanyobjectwhetheranimateorinanimateexceptanother vehiclewhichcanbefullyidentiedanddetailsofwhichhaveprovidedby Youoronbehalftothecompany $5000excessmayapplyintheeventofa

SingleVehicleIncident

(iii)YouhaveleftthevehicleunlockedorleftthekeysintheVehicle

(iv)Youhaveoperatedthevehicleatnightunlessauthorisedtodosounder otherprovisionsoftheTermsandConditions

(v)Youhavefailedtokeepthekeysecureandunderyourpersonalcontrol

(vi)TheunderbodyoftheVehicleisdamagedregardlessofcauseexcept

(a)YouarepayingtheInsuranceExcessasagreedontheRentalAgreement

(b)Youand/ortheAuthorisedDrivernothavingbreachedanytermsand conditionsofthisAgreement

(c)Youand/ortheAuthorisedDrivernotbeingcoveredunderanypolicyof insurance;and

(d)Youareprovidingsuchinformationandassistanceasmayberequested bythecompanyoranyoneactingonbehalfofthecompany

Ifcoverisprovidedthatthecompany,oritsinsurer,maybring defendor settleanylegalproceedingsinits/theirsolediscretionandthecompanyshall havethesoleconductofanyproceeding Anysuchproceedingsshallbe broughtordefendedinyournameorthenameoftheAuthorisedDriver

GeneralProvisions

(a)IfthereisanyincidentlossordamagetotheVehicleorinvolvingthe VehiclewhilerentedunderthisAgreement Youand/ortheAuthorisedDriver shallpromptlyreportsuchincidenttothecompanyatthelocationwherethe Vehiclewashiredaswellasdeliveringtothecompanyimmediatelyupon receiptbyYouandortheAuthorisedDriver everysummons complaintor paperinrelationtosuchincidentinvolvingsuchlossordamage Youand/or theAuthorisedDrivermustalsoreportallincidentstothepoliceorother properauthority

(b)Youand/ortheAuthorisedDriverirrevocablyreleaseandholdharmless thecompany(anditsagentsandemployees)fromallclaimsforlossor damagetoyourpersonalproperty orthatofanyotherpersonspropertyleftin theVehicle orwhichisreceived handledorstoredbythecompanyatany timebefore duringoraftertherentalperiod whetherduetothecompany's negligenceorotherwise

(c)YouandtheAuthorisedDriveracknowledgethatthecompanyrelieson thetruthofyour/theAuthorisedDriver'srepresentationsinthisAgreement

(d)YouandtheAuthorisedDriverwillnotrefuseoffailtotakeanyblood analysisorbreathtestrequestedbythepolice

(e)Exceptasprovidedbylaw,nodriverorpassengerintheVehicleshallbeor deemedtobetheagent,servantoremployeeofthecompanyinanymanner foranypurposewhatsoever

(f)Thecompanygivesnoexpresswarrantyinrelationtothemotorvehicle

Certainconditionsandwarrantiesareimpliedbystatute whether CommonwealthorState,whichcannotbeexcluded restrictedormodied, suchasthoseundertheTradePracticesAct1974 Wherethecompanyis permittedtolimititsliabilityunderthosestatutesforbreachofanimplied conditionorwarrantythecompanylimitsitsliabilitytoreplacement,repairor resupplyoftheVehicle Allotherwarranties conditionsandotherconditions andotherobligationswhichmaybeotherwiseimpliedareexpresslyexcluded intheirentirety ThecompanyisnotliabletoYouandortheAuthorisedDriver foranyincident,special incidentalorconsequentialdamagesrelatingtothis agreement

(g)NorightofthecompanyunderthisAgreementcanbewaivedexceptby writingofanauthorizedocerofthecompany

(h)WordsusedinthisAgreementtodenoteanygendershallincludeall genders,singularwordsincludingtheplural andnotedonTheRental Agreement

(i)NotwithstandinganyotherpersoninthisAgreement agoodsandservices tax(GST)oranysimilartax stampdutyoranyothertax duty,surcharge levy orfee(charges )imposedbyLocal,StateorFederalGovernmentthatis chargedandcollectedbythecompanyisimposedanywhereinAustraliaand hasapplicationtoanysupplyorusemadeunderorinconnectionwiththis Agreementorinrelationtotheuseoforthelikelyuseofanyroads facilities orotherinfrastructurebyYouand/ortheAuthorisedDriver orinrelationtothe provisionofrentalorotherservicetoYouandortheAuthorisedDriver The companymayinadditiontotherate,priceoranyotheramountor considerationquotedorexpressedaspayableelsewhereintheAgreement recoverfromYouand/ortheAuthorisedDriveranadditionalamounton accountofthecharge Anyadditionalamountonaccountofthechargeshall becalculatedwithoutanydeductionorsetoffofanyotheramountandis payabletothecompanyondemand

(j)Youand/ortheAuthorisedDriveracknowledgethatyourinterestinthe VehicleisasabaileeofthecompanyonlyandthatYouagreenottopartwith

wherethereisacollisionwithanothervehicle

(vii)TheVehicleistotallyorpartiallyimmersedinwaterregardlessofcause

(viii)TheinterioroftheVehicleisdamagedregardlessofthecauseexcept wherethereisacollisionwithanothervehicle

(ix)ThetyresoftheVehiclearedamagedotherthanbynormalwearandtear

(x)TheVehicleoranythird-partypropertyisdamagedbydrivingtheVehicle underorintoanobjectlowerthantheheightoftheVehicle

(xi)YouhavefailedtomaintainalluidandfuellevelsoftheVehicleorfailed toimmediatelyrectifyorreporttothecompanyanydefectintheVehicleof whichyouhavebecomeoroughttohavebecomeaware

(xii)TheVehicleisdamagedbyloadingorunloading exceptbynormalwear andtear

(xiii)Youhavefailedtosecureproperlyanyloadorequipmentwhichleadsto lossordamagecausedbyanypartoftheloadorequipment

(xiv)YouusetheVehicleasanarticulatedvehicleunlessagreedbythe companyinSPECIALCONDITIONSonTheRentalAgreement

(xv)TheexterioroftheVehicleisdamagedregardlessofcauseexcept wheretherehasbeenacollisionwithanothervehicle

WrongFuel:Minimum$500000penaltyappliesincaseofwrongfuelused byyou Dependingonthedamage thepenaltymayequalthecostofthe vehicle

LostKeys:Achargeof$900appliesincaseoflostvehiclekey

IfyouhavepaidforthehireoftheVehiclebyuseofacreditcardordirected thecompanytobillchargestosomeotherperson corporation rmor organizationwhoorwhichfailstomakepaymentwhencalleduponbythe company,youherebyirrevocablyacceptthatYouareliableandwill immediatelypaythefullamountduetothecompanyondemand The company,inaddition maychargeYouinterestattherateof18%perannum calculateddailyonalloutstandingaccountsorchargespayablein accordancewiththeAgreement suchinteresttobecompoundedfromthe endoftherentalperiod

FUEL&DAILYMILEAGE

Youareresponsibleforthecostoffuelusedduringthehire TheVehicle mustbereturnedwithafulltankfuel IftheVehicleisreturnedwithlessfuel thedifferencewillbechargedataratewhichmayincludeaservice componentunlesspriorarrangementshavebeenmadeandnotedonthe RentalAgreement Perdaymileagelimitis200kms,achargeof30cents appliesforeveryextrakilometer

Usingthecorrectfuelisyourresponsibility,wrongfuelcandamagethe vehicleengineresultinginhighrepaircostsnotcoveredbyinsurance

Smoking

Nosmokinginthevehiclesatanytime Chargeswillapply

Debit/CreditCardPolicies

AliceCarRentalacceptsanyDebit/CreditCardforthepaymentofavehicle rentalwhich:

•Isissuedbyabankorothernancialinstitution;and DisplaystheMastercardorVisaLogo;and Hasthecustomer'snameandcardnumberonthecard

Atthecommencementofrental,AliceCarRentaldonotacceptaprepaidor reloadablestoredvaluedcard atravelmoneycardorandEFTPOScard A CreditorDebitcardasoutlinedabovemustbepresentedatcommencement ofrental Uponcompletionofrental AliceCarRentalwillacceptexcess paymentswithaEFTPOScard Forbookingsmadeonlineorviatelephone thecreditordebitcardusedforthepurposeofthebookingmustbe presentedtotheCompanyatthestartofyourrental

Atthestartofyourrentalaholdwillbeplacedonyouraccountforthe insurancebetween$400-$1500bonds Paymentswillbetakenfromyour

possession,disposeof,encumberorassignanyrightorinterestinthe VehicleandnotcreateanyleinontheVehicleforrepairs

(k)Youand/ortheAuthorisedDriveragreetoindemnifythecompanyfrom andagainstanyorallclaims,demands,actions,liabilities,losses costsand expenses(including butnotlimitedtolegalcostsonanindemnitybasis) incurredbythecompanyasaconsequenceofthefailureforwhatever reasonofthedueandpunctualperformanceofyourobligationsunderthis Agreement

(I)Youacknowledgethatthecompanyhasnotinanywayrepresenteditself toYouasanentitycarryingonabusinessofinsurance

(m)Youand/ortheAuthorisedDrivermustnotatanytimeadmitliabilityfor anyclaim,lossordemandandagreethatifsuchanadmissionismadeby Youand/ortheAuthorisedDriverthenthatisabreachofthisAgreement

accountforthehireofthevehicle

Onreturnofvehiclewewillreleasetheholdofthebond butdependingon yourbank thismaytakeupto10businessdays AliceCarRentalwillnotbe heldresponsibleforanyoverdraftfeesbasedonthispolicy

Weareauthorisedtocancelabookinganytimeduetounavoidable circumstancessuchas

•Abrokenwindscreen(duetovandalisminAliceSprings)because windscreenreplacementcantakeuptoweeks; •Vehiclesgettingstolen PoorsparepartsavailabilityinAliceSprings
