Ilove the construction industry. I love the people in our industry even more! Some of my fondest memories growing up were going to jobsites with my father and seeing field professionals working in the different trades. During these times, he impressed upon me that a hard day’s work builds strong moral character. I think our industry is one of the few remaining that still believes in giving a hard day’s work — every day.

It’s because of my love for the people in the construction industry that I am so honored to serve as president of AGC Georgia. I am the fourth person from Batson-Cook to serve an AGC chapter in this role, and I owe a tremendous amount of gratitude to personal and professional mentors for helping me reach this milestone. In particular, I want to share my sincere appreciation for Raymond Moody. During his service as president and chief executive officer of Batson-Cook, I had the pleasure of working closely with him. He is like a second father to me, and I benefit every day from knowing I have his support.

As Raymond ingrained in me, and you well know, our industry is all about people. However, in my opinion that simple statement has many interpretations. To me, it is the relationships you form with respected colleagues, clients and competitors. It also means taking care of employees — treating them fairly and sending them home safely each night to their families. I also believe the phrase our industry is all about people speaks to our need to be forward-thinking as we look to secure our industry’s successful future with a skilled and diverse workforce. We all owe a debt of gratitude to the generations that came before us. They built a strong legacy that we benefit from, and we must not lose sight of what it will take to sustain our industry for future generations.

In June at the Annual Convention, I shared my thoughts on stepping up member involvement with AGC Georgia’s workforce development initiatives and opening a dialogue on diversity and inclusion. I don’t think you can have one discussion without the other. The construction industry needs more people in all areas. We don’t have a trusted and steady pipeline of skilled labor to meet jobsite demands. We also don’t have enough people in construction management degree programs to fill the void in project leadership.

It’s my opinion that diversity in people creates diversity in thought, which leads to the best possible solution. Contractors are in the problem-solving

business, and I challenge anyone to tell me they don’t want their team to have the best opportunities to deliver the best solutions. I believe the secret to growing our skilled worker pipeline and our future project management teams is to be more inclusive in our recruiting practices and broaden our reach as we share our industry’s career opportunities. Too many people never even consider a career in construction because you and I don’t do enough to educate them. I’m ready to turn this tide, and I need your help to make a meaningful impact.

I encourage you to read the article on page 8 titled “The Business Case for Diversity and Inclusion” written by my good friend and mentor Brent Darnell. He perfectly summarizes my feelings on how we must mindfully create a culture in the construction industry that is more diverse and welcoming. I look forward to meeting with many of you as I tour the state in November to host seven regional meetings and discussing these important topics that will define the future of our industry. ■

The

Business Case for Diversity and Inclusion

With the turnaround in the economy and a workforce development crisis on every level, this longtime issue is reaching a tipping point. I’m talking about the lack of diversity and inclusion in the construction industry. And I’m not talking about coercing companies to hire more women and minorities. The lack of women and minorities is a symptom of a far deeper issue: This industry does not value diversity and is not very inclusive, and it is time to start a meaningful dialogue in order to create some traction toward a resolution.

The place to begin is with women and minorities. By exploring solutions

to this lack of diversity, perhaps we can solve the larger issue of inclusion. It is time for everyone to dig deeply and focus on this issue. It is time all sides commit to a proactive approach with compromise and cooperation in mind. It is time we meet in the middle and utilize a wonderfully diverse workforce to create better projects and better business results.

I have attended many industry events lately, and the demographics are a little frightening. As wonderful as our industry is, these events are filled with mostly middle-aged, white men. If I were a woman or a minority, I would take one look at the demographic and run away like my hair was on fire.

We all know women and minority participation is quite low, and the effort to be more inclusive to women and minorities is limited at best. There are several reasons for this situation: a lack of role models for women and minorities, wage disparity, the current culture of the industry, and lack of understanding and connection among all of these groups.

There is some good news, though. Several companies and industry organizations are reaching out to young people, women and minorities through a variety of workforce development initiatives. The ACE Mentoring Program targets young people, including women and minorities, and promotes

the construction industry as a viable career. Since that program is a more long-term solution, we must be more aggressive in our approach in order to realize some short-term results.

If all industry organizations and companies would commit to some very simple initiatives, we could improve diversity and inclusion dramatically in a relatively short period of time:

Provide education and information. Reach out to the many women’s and minority organizations throughout the construction industry and court them; let them know they are welcome. Invite their members to the currently white-male-dominated events and give them the spotlight. Create an open dialogue. We need to learn more about each other, and the best way to do that is to get everyone in the same room. These types of gatherings will help to shift the industry image from one of exclusion to one of inclusion.

Provide meaningful training for all of the white guys. I don’t mean “diversity” training or “sensitivity” training. These tend to only provide the legal requirements to keep from being sued. I’m talking about training that creates true understanding and trust. We need to explode stereotypes and preconceptions from all sides of this equation and create an atmosphere of cooperation, trust, and comfort.

Provide meaningful training for women and minorities. Give them the tools they need to navigate this maze

of white males. Successful women and minorities in the industry know this navigation, and these skills are teachable and learnable. We must use this knowledge to create programs that teach these skills to maximize the success of women and minorities.

There is a very real business case for these inclusion initiatives:

1. Diverse people with diverse thinking lead to better ideas and better solutions to industry problems. We need the perspective of minorities and women to move forward.

2. If you look at sheer numbers, when more women and minorities enter the industry, it will greatly help our workforce crisis.

3. The industry is gravitating toward more collaborative ways of project delivery such as IPD and Lean, and women are generally better at collaboration than men, according to my research on the typical emotional profiles for men and women in the industry. Most women score relatively high in social responsibility (the ability to work in teams), empathy and interpersonal relationships. Most men score relatively high in self-regard, independence and assertiveness.

4. In an article from Engineering News Record (November 15, 2010), a research company found that “companies with more women board members significantly outperformed

those with fewer female directors in return on equity, return on sales, and return on invested capital.” This article was written nearly six years ago, and it seems we have made little progress with regard to promoting more female leaders. Many construction guys have the attitude that they “don’t mind” women and minorities in construction. This attitude must change. It’s simply not enough. We must take proactive steps, start this dialogue, create a more inclusive industry, and actively pursue women and minorities. We need them to move the industry forward and create a whole new industry that is inclusive and diverse. We need them to create an industry that is sustainable. We need them to create more successful projects and better profitability. If we don’t make this effort and women and minorities continue to stay away from construction, we may be in big trouble. ■

Highlights of AGC LEGISLATIVE GEORGIA’S

Initiatives and Victories

During each year’s session of the Georgia General Assembly, AGC Georgia is front and center regarding pending legislation, proposed policy changes, and other regulations that can negatively impact your firm and our industry. In addition to maintaining a strong defensive posture, AGC Georgia is also very proactive in identifying opportunities to better the business climate for your company.

For 20 years, it’s been my honor and privilege to represent AGC Georgia members before the General Assembly, statewide elected officials and the many professionals who represent industry-related governmental agencies. Over the past two decades, together with our members, we have accumulated quite a list of legislative accomplishments. Perhaps this summary will help newer members gain a better understanding of our

association’s legislative process and the history behind current industryrelated laws. Our veteran members will remember the legislative debates, lengthy committee meetings, close votes and wins and losses.

My job isn’t possible without the incredibly strong support from engaged members. Thank you for helping make these legislative accomplishments, and many others, a reality — all in the name of creating

the best business climate possible for our state’s construction industry.

Georgia’s Local Government Public Works Law (HB 1079)

AGC Georgia initiated the effort to develop this law. It established uniform rules for all local governments to follow in our state regarding public works contracting. This law requires public advertisement and competitive award for all local government construction contracts over $100,000 where the party providing services is at risk for construction. This landmark legislation also gave local governments the ability to use alternative construction delivery methods through solicitations under competitive sealed proposals such as CM @Risk, Design-Build, etc. Since its initial passage, AGC Georgia has gone back to work to amend the law with our partners in local government, the Georgia Municipal Association, Association County Commissioners of Georgia and the Department of Education, to address additional issues including:

• Advertising requirements and issuance of project addendums

• Use of project alternates and requirements for project award

• Prequalification criteria and limits of use

• Bid errors and grounds for bid withdrawal

• Early completion incentive opportunities

As our industry continues to evolve, our public works law will need to evolve with it. AGC Georgia will be at the forefront of these discussions.

Georgia’s General Contractors License Law (HB 1003 & SB 124)

After more than 50 years of internal debate, AGC Georgia initiated efforts to develop and pass the Georgia General Contractor State Licensure Law. The state law supersedes all local municipal and county licensing requirements, allowing a state certified general contractor to work in any local jurisdiction of the

state without restriction. Since this law’s enactment in 2005, all contractor members on the General Contractor Division of the License Board have been AGC Georgia members.

Pitts Case – Workers’ Compensation Exclusive Remedy (HB 412)

AGC Georgia spearheaded an effort with the Georgia Workers’ Compensation Legislative Board to develop legislation to address a very negative Georgia Court of Appeals Decision in the Estate of Pitts v. City of Atlanta case. If this decision was left to stand, it would have circumvented the exclusive remedy provisions in Georgia Workers’ Compensation law for workplace injuries or deaths.

The exclusive remedy provisions in our state’s workers’ compensation laws are a tradeoff, or quid pro quo, between employer and employee. If the Pitts decision had not been addressed legislatively, every employer in Georgia (particularly contractors) would be left to question whether Georgia’s no fault workers’ compensation coverage would in fact be the exclusive remedy for work place injuries, or if the employer would be subject to additional actions for not providing a safe work place because of a workplace injury.

HB 412 makes it clear that the rights and remedies created by the Georgia workers’ compensation statute shall exclude “and be in place of” all other rights and remedies “and all other civil liabilities whatsoever.” The new law provides that an employer may, if it chooses, assume greater liability to employees but only “by expressly agreeing in writing to specific additional rights and remedies; provided, further, however, that the use of contractual provisions generally relating to workplace safety, generally relating to compliance with laws or regulations, or generally relating to liability insurance requirements shall not be construed to create rights and remedies beyond those provided in this chapter.”

Public Private Partnerships P3 (SB 59)

As a primary stakeholder, AGC Georgia was actively engaged in the development of Georgia’s P3 law for many years. SB 59 creates the Partnership for Public Facilities and Infrastructure Act, granting board authority to state and local governments to finance, design and build all types of infrastructure projects through public-private partnerships. This new law provides state and local government with additional tools to address our public works infrastructure needs.

Georgia Lien Law (Notice of Commencement & Notice to Contractor provisions)

AGC Georgia initiated Georgia Lien Law revisions, which created the provisions for Notice of Commencement and Notice to Contractor. These provisions offer general contractors tools needed to identify non-privy subcontractors and material suppliers in an effort to help ensure proper payment to downstream subs and suppliers, versus double paying for the same work. AGC Georgia’s staff and members on the topic’s task force later came together to work on the law to provide more clarity regarding Lien Law timelines and waivers.

Lien Law Rights for the Full Amount of the Contract (HB 434)

AGC Georgia initiated and passed legislation addressing a Manhattan Construction Company court case dealing with the Georgia Lien Law. The court ruled a contractor/subcontractor’s General Conditions Costs were not subject to lien. The court reasoned the only items subject to lien are those that are actually attached or affixed to the improved piece of real estate. The legislation AGC Georgia introduced that was ultimately passed by the General Assembly and signed into law clarifies that providers of construction services do have lien rights for the

full amount of the contract for work successfully completed.

Department of Revenue Tax Issues

• Our association initiated legislation clarifying the law

on Public Owner Tax Exempt Purchases

Installed by Private Contractors.

Prior to this law, contractors assumed the tax liability of the public owner, without knowledge of the tax owed and due. Public owners now have an obligation to notify the private contractor of any tax liability on publicowner-purchased items that will be installed by the contractors. A public owner’s failure to notify the contractor of the tax liability makes them liable for the tax, not the private contractor.

• AGC Georgia initiated a Department of Revenue Rule change eliminating notice and withholding requirements for general contractors on any subcontracts under $250,000. We subsequently pushed for and received a change in the law. The notice now only applies to non-resident subcontractors with subcontracts in excess of $250,000.

• At our recommendation, the Department of Revenue changed their rules to only require general contractors to submit one notice per year if they do business with the same subcontractor multiple times during the year and that subcontractor has a sales and use tax bond.

Reverse Auction Bidding

AGC Georgia initiated legislation that was ultimately signed into law that prohibited reverse auction bidding in state public works contracts. We also prevailed in a major court action on this issue against a municipal government.

Private A/E Plan Review & Inspections

As a result of AGC Georgia’s initiating legislation, owners and contractors are now allowed to seek the services of private architects and engineers to provide plan review and inspections when a local government either can’t or won’t provide timely service.

Georgia State Construction Manual

The State Construction Manual was jointly developed by representatives of industry, including AGC Georgia members, and industryrelated state agency leadership. AGC Georgia participated in all aspects of the development of the Manual including serving on the editorial advisory board. We also supported legislation that became law requiring all state agencies to adhere to the policies and procedures included in the Manual .

Reciprocal Preference

To help level the playing field for Georgia businesses when looking to work in other states, AGC Georgia initiated the effort to pass reciprocal preference legislation

for state construction. If an out-ofstate contractor enjoys a preference in their respective home state, they will be penalized by the same provisions when they attempt to secure state construction contracts in Georgia.

Fire Marshal Code Violations

AGC Georgia worked with Senator Lindsey Tippins and State Fire Marshal Dwayne Garriss to develop legislation that was passed into law. This legislation requires Georgia fire officials to substantiate in writing where codes have been violated before they can require a change in design or construction on previously approved plans that have been constructed per the code requirements..

AGC Georgia has Participated in Many Successful Lawsuits and Amicus Briefs on Behalf of Members and the Entire Construction Industry:

• Challenged the city of Statesboro and the Georgia Municipal Association in court when they began using reverse auction bidding to secure local government construction contracts. AGC Georgia prevailed and the practice is now prohibited.

• Challenged Georgia EPD over onerous Georgia NPDES permit requirements; resulting in reasonable monitoring requirements versus the original requirements, which would have required monitoring after every half-inch rain event.

• Challenged Gwinnett County in court and won over a local ordinance on immigration that would have required contractors to violate federal employment law to comply with their local ordinance.

State and National Political Action Committee

AGC Georgia consistently participates in more than 150 state legislative races each election cycle while maintaining a greater than 90% batting average.

AGC of America PAC is nationally recognized for its clout, and AGC Georgia Board of Director members have achieved 100% participation in the federal PAC for nearly a decade. In recent years, AGC Georgia has been recognized for its members submitting the largest total contributions to the federal PAC compared to the other 92 chapters across the country. ■

Winners of an “AGC in the Community” Award

AGC Georgia’s YLP was recognized at the 2016 AGC of America annual convention for their work at the Georgia Center for Child Advocacy office. Their national recognition was a fitting conclusion to this very rewarding charitable project. The group completed a renovation project at the center that included increasing the size of an interview room, adding walls to the deck with acoustical sealant for soundproofing, re-wrapping fabric panels, painting, placing new floor and baseboards and providing new furniture and light fixtures. These improvements directly impacted the quality of video recordings the center must capture when interviewing victims seeking support and security from the organization. Firms integral to the project’s successful completion were Specialty Finishes; Reliance Interiors; Penco Electrical Contractors, Inc.; Century Fire Protection; Allstate Waste, Inc.; Premier Contract Carpet; and Levino Jones.

Cox House Update

Last year, YLP learned about the Cox family in Forsyth losing their home to a fire. The family’s daughter, Haleigh, suffers from many medical issues, and the family welcomed YLP’s construction assistance. Since November 2015, the build has come a long way thanks to the incredibly generous contributions by industry firms. The family hopes to move in their new home in fall 2016. Fundraising Success

Net proceeds from the YLP Golf Classic have always been very impressive, but the group outpaced all fundraising expectations for the 2016 event. This May, industry firms supporting the tournament helped YLP net $81,500. All of these funds were placed in the AGC Georgia Foundation, Inc. to support YLP’s community service endeavors. While their history of giving back to the community runs for two decades, in just the past five years, this tournament has raised over $270,000, and all funds are used to support worthy families and organizations.
