Medicare Marketing Violations

Unlike Original Medicare, Medicare Advantage and Medicare Prescription Drug Plans are administered, marketed, and sold by private insurance companies. The Centers for Medicare & Medicaid Services (CMS) has guidelines for marketing these Part C and Part D plans to protect Medicare beneficiaries from manipulative and deceptive sales and enrollment tactics.

What are Examples of Medicare Marketing Violations?

• Receiving an unsolicited phone call from a plan you have no prior relationship with or have disenrolled from • An agent or broker representing themselves as being from Medicare • An unsolicited home visit • Receiving information such as flyers on your car or at your home from a company with whom you did not have an appointment • An agent initiating a discussion about other insurance products, such as life insurance, during a meeting about

Part C or Part D. • An agent returning uninvited to your home after missing an earlier appointment • Requiring you to provide contact information to attend a marketing event • Calling you after an event without your prior permission • Calling you to confirm you received information sent to you in the mail • An agent signing you up for a plan that you find out later does not cover the prescriptions or services they said it would

What Can Plans Agents Do?

Agents who sell Part C and D plans can call you, if you have told them they could, and they can make unsolicited contact with you through the mail and advertisements, including by email if it contains an opt-out function.

Report potential Medicare marketing violations and/or enrollment fraud, errors, or abuse if you encounter any of these examples.
