A message from your President Lynne Barrie

It’s been a real pleasure to work with Tom Stenson our Training Team Leader over the last few months. We have been producing some short 10 minute micro workshops you can view on our new official ADINJC YouTube channel. We started the idea with taking 5 minutes to talk about a topic so that members could learn from and enjoy the clips but soon realised it needed to be 10 minutes. Just how much can you fit into 10 minutes? Well, in fact, it’s turned out to be quite a lot but in a short enough time for busy PDIs and ADIs to watch and enjoy. It’s been a learning curve, and an experience we have relished especially after the complimentary comments coming in from members. We hope you enjoy them as we continue to increase ones available for you.

You should find them succinct and punchy, and we aim to build up a range of topics for you to be able to watch. As an ORDIT trainer I’m often reminding PDIs and ADIs to keep instructions and explanations short and simple so hopefully we too have done just that. The takeaways are designed to give you information but more importantly to encourage the viewers to think and reflect on how they deliver their driver training. It’s a conversation between Tom and myself on what we consider to be a relevant and helpful topic where learning can take place for the viewer. Tom has plans for other committee members to join him and to use their vast expertise to explore a wide variety of topics.

Autonomous Vehicles Liam Greaney - Driving-Pro Limited

I used to think that all us driving instructors would soon be out of a job. Attending a conference a few years ago at the Portsmouth University Artificial Intelligence Transport Hub Conference tells me something different. There are going to be three basic problems that need to be solved for autonomy to work.

1. The Driver: Nobody is giving much thought to the driver. Autonomous vehicles will have 5 levels: 1.

Feet off

2.

Hands off

3.

Eyes off

4.

Brain off

5.

Complete autonomy

All the way up to level 4 will require the driver to be ready to take over in uncontrolled or hazardous conditions.

How will our nervous and anxious pupils, who if regularly using these types of vehicles, who will have had little driving experience, be able to cope when everything is going wrong. As instructors we are all aware of how unpredictable a learner or inexperienced driver can be. If you are nervous or anxious would you not be inclined to drive a car that did as much of the driving task as possible.

Skills will need to be practised to be of use. We are ourselves constantly reminded of the need to

keep training. Our skills are assessed to ensure we remain up to scratch. Will insurance companies insure people to drive who have very limited experience and will have to do so in difficult circumstances. Will there be substantial reductions for the driver who can prove their skills are up to date.

As professional instructors, we all know that other motorists treat our learner cars differently.

Nobody wants to get stuck behind a learner. Will not the selfish drivers be able to take advantage of autonomously driven ones. Think about how other drivers cut your learners up. Not so long ago there was a campaign about this sort of thing. While someone might think twice about taking advantage of a normal person, how about taking advantage of a machine.

How much thought has been given to how the transition to autonomy will work. How will drivers maintain the skill level to deal with uncontrolled or hazardous conditions. Remember that the driver is expected to be able to take control in uncontrolled or hazardous conditions. What will be the challenges.

2. The driving environment: An autonomous vehicle will need to know where it is and where it’s going. It will have a series of sensors to measure the road in different ways. These sensors are Camera, Radar and Lidar (laser detection). The new driving test has put us all on to rural roads. Edges of these roads are either grass, granite kerb stones, or granite kerb stones covered in grass. What about when the pot hole has a nice bit of ice covering it. Road signs and road markings can all be obscured in different ways.

Radar, Lidar or cameras will all have to cope with this routinely. Besides their normal limitations, what will be their capabilities in hazardous conditions. How will snow, ice or mud affect these sensors.

The Selby rail crash 2001 was caused by a Range Rover. The insurer sued the DoT for part of the £22 million pound settlement. This was on the basis of inadequate crash barriers. Will The Highways Agency and Local Authorities have to maintain roads and signs to better standards so the autonomous systems can cope. Think about how likely that is next time you go over a pothole.

Sat Nav will be an essential part of how these cars will function. It’s only as good as the last update and the info in that update. When out on test the examiner will quite often correct the sat nav or at least make it clearer. The manufacturers will no doubt say that it will be learning all the time and getting better and more accurate. But Sat Nav has been around for years and still gets things wrong. What about mini roundabouts, private roads and junctions that aren’t recognized by Sat Nav. Why isn’t that getting more accurate?

Knowing where you are and recognising the hazards around you are key components in the move to autonomous cars. The car will need multiple sensors and systems of different kinds to properly read what’s happening around it. These need to be maintained and calibrated. When sensors degrade, malfunction or fail at what point will the system stop controlling the car. In computing there is a term ‘the blue screen of death’. What will be the autonomous vehicle equivalent. At what point will your car refuse to move unless you take manual control.

3. Legal: As far as I am aware autonomous cars must be law abiding and comply with the advice in The Highway Code.

Try driving around a busy urban environment without breaking some aspect of the code or the law. Minor transgressions to maintain traffic flow are not normally enforced by the police. A police officer’s sensible discretion will compliment a driver’s careful and considerate driving.

For instance, what if hypothetically my nearside wheels went into a bus lane to get around the car in front which was turning right. Only for a second and only just the nearside wheels. All the cars in front had already done so.

The law is quite clear. You must not cross a solid white line. The guide lines from The CPS say that for this to result in my prosecution two things must be in place: •

A public interest in having me prosecuted

See https://www.cps.gov.uk/publication/code-crown-prosecutors From an evidence point of view for me to get caught, either something must have had to have happened which would require a police presence. Or I had been observed doing this by the police.

Or maybe my retractable confession.

Would it have been in the public interest for me to wait and hold up the traffic behind me. Not to have moved would have meant the junction behind me becoming blocked. Would it have been in the public interest to prosecute me. It was perfectly safe.

But will your autonomous vehicle be making that decision. If you want to safely maintain traffic flow you now have a car manufacturer deciding how to break the law and to what extent. Or will rigorously enforced laws lead to gridlock.

What about a busy zebra crossing, will you wait until the pedestrians are safely clear of the crossing and on the pavement. Or will you safely clear the pedestrian? What happens when the law conflicts with the advice.

Hears what the police say about zebra crossings: Generally, if a pedestrian is on a pedestrian crossing then a driver must give precedence to them and allow them to cross. However, in the case of Kayser v London Passenger Transport Board [1950] 1 All ER 231, the court ruled that where a driver is satisfied that persons who are lawfully entitled to cross the road - whether they are on a pedestrian crossing or not - are well out of any danger from him if he goes on in the normal course, he is perfectly entitled to go on, but, of course, only at such a pace as will enable him to stop almost immediately in the unlikely happening of those persons doing something dangerous and negligent themselves.

Nonetheless, we would suggest that it is best for a driver to wait until the pedestrian has left the crossing before proceeding, so as to avoid any potential issues.

The law says one thing, police advice says another!

Go out on a test and your learner will likely fail if they move on when a pedestrian is still on a crossing. At a busy zebra crossing and you could be waiting a long time if you only go following the advice given above. Who would want to get stuck behind an autonomous car.

Next time you are reading your Highway Code have a think about how some of the rules and advice might be applied by an autonomous vehicle. What might the problems be. How will that advice be interpreted.

Think about how autonomous vehicles will deal with bicycles. Rule 163 says give bicycles as much room as you would give a car when overtaking. The Safe Pass advice for going round a bicycle is 1.5 metres.

We now have advice from The Highway Code and the police which could be said to be saying when you overtake another vehicle you should give a gap of 1.5 metres. In congested or narrow roads will an autonomous vehicle be able to overtake anything.

So with solid white lines we have seen how the law can affect autonomous vehicles. With zebra crossings how police advice could be different from the law. And with overtaking how the advice from two different sources (police and The DVSA) could create some interesting problems.

Courts will make decisions about laws and advice. Those decisions will decide how autonomy will work. But they will lag behind the technology.

The big problems are how will: •

The autonomous vehicle cope with badly maintained and poorly mapped environments

•

Law and advice affect the routine operation of autonomous vehicles

My own conclusions are that everything will become safer and journey times will initially increase because everyone is following the rules. Bicycles and scooters will become more dominant on the road as the autonomous vehicles will treat them properly. This will then lead to decreasing journey times.

There will be some very interesting court cases involving the vehicle manufacturers. Drivers will have to prove they are maintaining a skill level to obtain affordable insurance for the situations that will require them to drive.

One of the big reasons for autonomy is safety with 95% of incidents involving driver error. So what about putting some extra effort into improving the skill level of the driver. At the end of the day that’s what we are all about.

The Standards Check/Part 3 Exam David Allen - Chair of the Birmingham Group

This is my seventh instalment on the 17 sub competencies of the Standards Check.

Today I am going to give you my interpretation of, ”Was the trainer aware of the surroundings and pupil’s actions”?

This sub competency in my humble opinion is the most important of all of them. The ADI 1 states that the ADI/ PDI: •

Should be able to take in the outside world

•

Observe the actions, including comments and body language judging whether those actions are suitable in any given situation

•

And respond

It also states,”Any serious lapses in this area are likely to lead to a 0 marking”.

Ok, let’s explain this sub competency in detail. You need to be observant and aware of what is happening in short, medium, long distance, to the sides and behind your vehicle at all times.

This skill is critical in keeping the vehicle safe as if you don’t see or anticipate what is going to happen then how can you instruct or prompt your pupil to do next.

It’s more important to see hazards or dangers earlier as an untrained or inexperienced driver takes longer to respond to your instruction and prompts.

The ADI part 2 is useful to develop these key awareness skills, but if they need to be developed further by using scanning techniques and using a planned system of driving you might consider completion of an advanced driving qualification that uses the Road-craft system of driving.

The second important element of this sub competency is observing your pupil. This would have to be shared with your observation of your surroundings, the key is when you should be watching your pupil.

On approach to a junction, to turn right, when you give to instruction to your pupil to “turn right” you should be watching: •

Your pupils’ eyes first (mirrors)

•

Then their hands (signals)

•

Outside the vehicle (to check position)

•

Their feet/hands (to see how they are slowing down and their gear change)

•

Their eyes (look)

•

And finally their hands to see how they are steering.

With experience you can tell how your pupil is slowing down as you feel the vehicle. The best practice is to expect the pupil to follow the actions that you would make and to observe them taking these actions. The amount of time you observe your pupil also depends on the level of risk of a developing hazard ahead. You do not want to be watching your pupil and miss the danger ahead of you.

Also, you should be observant of your pupil’s body language and facial expressions. They could be expressing anxiety or frustration with any aspect of the lesson and you will have to help your pupil to overcome these barriers. Or find out why they are anxious or frustrated, so learning can be more effective.

Road Safety Information Graham Feest ADINJC Road Safety Advisor

Graham Feest is the Road Safety Advisor to the ADI National Joint Council, celebrating this year 50 years in Traffic and Road Safety. It is also twenty years since he started his own consultancy and ten years since he has worked with his Executive Assistant, Victoria. Graham is available to speak at any association meetings/conferences throughout the UK. for which he makes no charge to those associations who are part of the National Joint Council but reasonable travelling and subsistence expenses need to be met. “Well, technically…” – The Importance of Delivering Correct Technical Information A major part of any profession that educates people is giving out information, so it is important that the information delivered is correct and up to date. It’s even one of the competencies we are marked against on a part 3 and standards check – ‘was the technical information given comprehensive, appropriate and accurate?’.

Sometimes, the information we give out as instructors can be simplified to help our learners grasp concepts, but this can sometimes mean the information we give ends up not being entirely accurate, or comprehensive. This can then lead to misunderstandings arising.

For example, a regulation I often hear explained incorrectly is rule 129: double white lines where the line nearer to you is solid. This means you MUST NOT cross or straddle it unless it is safe and you need to enter adjoining premises or a side road. You may cross the line if necessary, provided the road is clear, to pass a stationary vehicle, or overtake a pedal cycle, horse or road maintenance vehicle, if they are travelling at 10 mph (16 km/h) or less.

The issue that arises is when the information being given out is either incorrect, or not complete.

When I ask people what a solid white line in the centre of the road means. The answer I usually get back is ‘no overtaking’. This would not be the correct technical information as one could overtake without crossing or straddling the white lines. If overtaking was prohibited, there should be a ‘No Overtaking’ sign.

Another area for confusion are yellow lines. I often hear people mention (including instructors) that you can’t stop on double yellow lines. This is incorrect. Double yellow lines at the side of the carriageway means ‘no waiting at any time’. However, drivers may stop to pick up or set down passengers and, where not prohibited, to load and unload. So, to say that you cannot stop on yellow lines is incorrect.

These may seem like minor distinctions or technical details. So, why should we persist in correcting our students understanding? Partly because as instructors this can help us tailor the lesson to the needs of the pupil by identifying where their technical knowledge can be expanded. It also forms part of fault identification, where we are not just thinking about faults in their physical operation of the car, but also in their decision making process if it is based on faulty information e.g. whether or not they are allowed to overtake a road sweeper if solid white lines are present.

The impact of leaving learners with information that is incorrect or incomplete can mean that they have misconceptions about driving for the rest of the time they drive a vehicle. It can mean that learners continue to propagate common misconceptions around driving. If we are thinking about preparing students for lifelong driving, we need to impart our technical knowledge, so even if it does not come up “on the test”, our learners are well informed for the future.

When considering technical information, make sure you are referring to the correct guidance from sources such as The Highway Code and “Driving: The Essential Skills”. Sometimes in any profession, we take certain information for granted, when really, investing to ensure our own technical knowledge is correct can go a long way in making us stronger instructors.

Dead Slow statistics campaign

The British Horse Society (BHS) have recently announced that 66 horses and three equestrians were killed on our roads in 2023. In total, 3,383 road incidents involving horses were recorded via the equine charity’s “Horse i” app last year.

What does this mean for equine safety?

Despite the introduction of new Highway Code guidance for equestrians in 2022, road incidents involving equestrians continue to persist across the UK. Critically, people and horses are still being killed.

As part of our Dead Slow road safety campaign, the BHS are encouraging road users to evaluate how they pass horses as well as how impactful passing them too closely and too quickly can be.

To do this, BHS will be offering guidance to motorists and equestrians throughout February.

We hope that you might be able to support us with sharing our core safety messages, as well as driving greater awareness amongst all road users as to how to pass equestrians safely.

We have shared a detailed pack where you can find some helpful assets, top tips copy and social media suggestions. We also have spokespeople and further imagery available.

Public Liability Driving Tuition Why is Public Liability cover so important?

Because we all make mistakes in life, including in our business operations as a driving instructor.

Quite simply, if a member of the public (or any other third party) is injured or suffers damage to their property, arising out of the conduct of your business as a driving instructor, you could be held responsible.

The ADINJC Public Liability insurance, is designed to provide protection from claims against you by third parties who may have suffered personal injury or damage to their property, during contact with your driving school. Most motor policies provide you with a compulsory £20 Million Public Liability cover for accidents and injuries that occur as a consequence of having an accident. The ADINJC believes it’s important to ensure you also have sufficient cover away from the vehicle, and have therefore arranged for its paid up members to benefit from £10 Million Public Liability cover away from the vehicle. The policy also has a low policy excess of just £500 for each and every claim. The ADINJC policy provides £10 Million cover for each and every claim during the life of the policy.

A range of claims can arise. These can extend from accidents at your own business premises, to incidents that occur whilst providing advice or tuition whilst working away from your vehicle.

Increasingly, it is a requirement of many customers, principals, and clients (particularly local authorities and government agencies), that you be asked to present proof of Public Liability insurance before they will work with you, or allow you to work on their property or premises.

Compensation arising from Public Liability claims can be substantial, and may include loss of earnings, future loss of earnings and damages awarded to the claimant. In addition, considerable legal costs in defending the claim can be incurred, and the claimants’ legal costs may also be awarded against you if you are found to be at fault.

All would be covered under a comprehensive Public Liability policy Claims for trips, slips and falls are the most common, but there are other events that can lead to a claim against you. The following are examples of potential claims that can give rise to public liability claims against your driving school: •

you open your door for a pupil who you inadvertently trip over, causing an injury;

•

you spill a hot drink in a classroom and a pupil slips over on this, causing an injury;

•

a pupil falls over some cones you have positioned to practice parking, causing an injury;

•

you knock over a valuable antique whilst waiting for a pupil at their home;

Latest news from DVSA Pass Plus We heard from a member that he’d ordered a stock of Pass Plus forms back in November and was still waiting delivery. A colleague of his had also put in an order in early December.

On contacting the Pass Plus team at DVSA he was told they were out of stock, awaiting a reprint following the DVSA’s change of address.

We wrote to the Registrar to query this, and received the following: The forms have only just been updated as we were using the remaining stock after the move to Unity Square, it would have had significant cost implications if we were to destroy a large amount of existing stock.

We ran out of stock around the middle of December. We did make the print request in early November but due to issues out of our control with the supplier we are still waiting the first delivery.

Once it arrives, we will issue all outstanding orders as soon as possible. David (the pass plus team) has offered anyone a refund if they do not want to wait for their order.

How driving test waiting times looked at the end of January 2024 To help us to reduce national average car driving test waiting times we committed to create an additional 150,000 driving test bookings.

We are doing this by getting more eligible people in DVSA with a driving test warrant card to test full time up to 31 March 2024.
