ABC members have fought tooth and nail for so long to make this happen, and I want to personally thank each and every one of you for your commitment to free enterprise. You may not realize the impact you make here in Lansing, but the work you do every day to build this great state, your commitment to safety and training, and the evidence of free enterprise working in merit shops statewide do more than you know.

Finally, merit shop contractors will be given a level playing field and a fair shot at public construction.

FREEDOM PREVAILS IN THE STATE MICHIGAN’S “PREVAILING” WAGE LAW IS REPEALED

F

rom our association’s inception, the Associated Builders and Contractors of Michigan has maintained an uncompromising commitment to promote and defend the merit shop philosophy. Our foundational principles of freedom, fairness, and open competition have been our guiding light in the decades-long fight to combat special interests who seek to limit or eliminate those principles. Over the past few years, redundant, burdensome regulations and failed, big-government policies, like allowing unelected bureaucrats to pick “winners” and “losers,” have been replaced by the policies promoting fair and open competition. Whether it was the ban on discriminatory project labor agreements or achieving worker freedom through enacting “Right to Work,” the victories for the merit shop and free enterprise have changed our state’s economic landscape for the better. However, one policy had plagued Michigan’s construction market for decades, without an end in sight. That is, until this past spring. Michigan’s so-called “prevailing” wage law mandated that inflated, union-negotiated wages be paid on all state-funded construction projects, leaving Michigan taxpayers with millions of dollars in additional costs and strangling the competitive bidding process. That is why ABC, joined by a long list of pro-freedom groups including the Michigan Chamber of Commerce, the National Federation of Independent Businesses, and the Small Business Association of Michigan, came together to support legislation to repeal this archaic mandate. The proposal to repeal the law, submitted via a process provided in the Michigan Constitution called ‘citizen-initiated legislation,’ requires the signature of 253,000 Michigan voters. The Michigan Senate and House of Representatives receive the legislation, only after obtaining enough valid signatures and having the procedural aspects of the proposal approved by the Board of State Canvassers. The House and Senate then have 40 days to vote on the legislation.

required, submitting almost 400,000 to the Secretary of State’s (SOS) office. During the review and certification process, opponents of fair and open competition filed several challenges to the signatures, frantically trying to derail the effort in hopes they could protect this special-interest carve out that only benefitted a select few. Even after the staff at the SOS recommended certification of the petition with a “100% confidence level,” proponents of repeal had to request the intervention of the Court of Appeals, as the two Democrat members on the Board of Canvassers refused to vote to certify. The Court of Appeals responded with a unanimous decision, ordering the Board to certify the petition so it could move on to the Legislature. Opponents appealed that decision to the Michigan Supreme Court but received the same result. The courts spoke with one, clear voice: certify the proposal. After almost six months of review and legal challenges, the Board of State Canvassers certified the proposal and submitted it to the Legislature. Then, on Wednesday, June 6, after 53 years of having this special-interest government mandate in place, the Senate (23-14) and House of Representatives (5653) voted to repeal Michigan’s prevailing wage law. The law was given immediate effect and was certified by the Office of the Great Seal with the SOS the next day. The repeal of Michigan’s prevailing wage law now provides fair and open access to bid on government construction projects by implementing the practices realized in the private sector. That fair, open competition will drive down the inflated costs imposed by the old law, saving millions in taxpayers dollars every year, while allowing more public projects and creating more jobs. While this was a great victory for the merit shop, the fight will continue to promote and protect the free enterprise principles that make this country great. MM

HEARD FROM THE CAPITAL On the afternoon of June 6, Michigan Representatives and Senators voiced their strong support of the repeal of Michigan’s Prevailing Wage Act by rising before their peers and urging them to repeal this antiquated mandate. School, or a road, or a bridge project that is built in Michigan costs taxpayers anywhere from 1015 percent more than if it were built by the private sector. For decades, we have told our citizens they must pay more for projects, our citizens work hard each and every day to provide for their families and contribute to their communities. The time has come to eliminate this outdated law and save our taxpayers money.”

“Davis-Bacon, which is how the federal prevailing wage law is referred to, closes the door in such construction activity, in an industry most capable of employing the largest number of minorities. This legislation, that’s been law in Michigan for decades, also discriminates against the 80 percent of skilled trade workers in Michigan who choose to work for a contractor who is not union affiliated, or work for a small business without the personnel to process the amount of paperwork required to comply with this government price fixing scheme.” “If we repeal this antiquated price fixing law, it does not take these hundreds of millions of dollars out of our local economies. It simply will provide all contractors, the 80 percent that are non-union and the 20 percent that are union, equal access to government construction projects through the same merit based competitive bidding process by which we build all private sector construction projects; and it will no longer discriminate against the 80 percent of skilled tradesmen and workers who work for a non-union contractor.”

ABC MEMBERS STAND DOWN FOR SAFETY

O

n Thursday, May 11, The Michigan Occupational Safety and Health Administration (MIOSHA) along with contractors and employers throughout the state participated in the National Safety Stand-Down to Prevent Falls in Construction. Companies held stand-down events statewide to bring awareness to the risk of fall injuries in the trades. In particular, ABC Western Michigan Chapter and Pioneer Construction partnered alongside MIOSHA to host their own Stand Down event at the Diamond place jobsite in Grand Rapids. The event had record breaking turn out. Chris Beckering, Executive Vice President of Pioneer Construction, attributed their success to partnering with MIOSHA, ABC, Suppliers, Trade Contractor Partners, and even competitors to maximize turn-out. “The large number of people at the event

highlights the importance we place on ensuring every person returns home safely at the end of every work day. “Falls are the leading cause of death in construction in Michigan,” Beckering said. “Complacency is the enemy of safe work practices. A false sense of security resulting from going weeks, months, or years without incident can lead to tragic outcomes.” With the weather finally cooperating and construction projects ramping up, the risk of injury rises. Renewing their commitment to safety, Pioneer hopes to eliminate fall injuries and save lives throughout the state. MM

LEGISLATIVE UPDATE FROM

ABC OF MICHIGAN PARTNER: MIDWEST STRATEGY GROUP who are dedicated to helping guide students toward their career and associated academic goals. These navigators will be supported by additional tools such as a web-based career exploration platform that connects students to internships, job shadowing opportunities, and other such options in their local area.

It was a whirlwind of legislative activity at the state level before lawmakers left to in-district work this summer. Check out some highlights from the capitol:

Governor Snyder signed the following bills : • High school students can substitute a career-tech course or an extra arts class for one of the two required foreign language credits. Senate Bill (SB) 175, now Public Act 232 of 2018, extends that flexibility to meet the Michigan Merit Curriculum requirements until 2024. This was scheduled to sunset at the end of the year and has been a priority for ABC to ensure was extended. • SB 946, sponsored by Sen. Ken Horn, codifies the Skilled Trades Training Program, makes leadership training a reimbursable expense and extends the training window for up to a year. Importantly, ABC was able to work with lawmakers to have the bill amended in committee to specify that state propriety schools are qualified training providers. The bill is now PA 260 of 2018. • House Bill (HB) 5139, sponsored by State Rep. Daire Rendon, requires the Michigan Department of Education, in consultation with the Department of Talent and Economic Development, to develop and make available a model program of instruction in career development. The bill also requires, beginning in the 20192020 school year, schools incorporate grade-appropriate instruction on career development in each grade level from K – 12. The act is left intentionally broad to allow for flexibility and promote innovation. The bill is now PA 229 of 2018. • HB 5145, sponsored by state Rep. Julie Alexander, requires the Michigan Department of Education to develop rules that allow an individual to use time spent engaging with local employers or technical centers to count toward the renewal of a teaching certificate. The bill is now PA 234 of 2018.

Allow funding to be used for equipment, additional staff, new curriculum, professional development, industry mentors, testing fees, and other tools schools need to deliver 6 these experiences to students.

Create Marshall Plan Talent Consortiums - groups of educators and employers that partner to change the way students are prepared for careers. This will truly connect educators and employers to ensure that students experience a seamless transition from school to employment to lifelong learning.

Fund $20 million in scholarships and stipends for high school students and low-income residents to get high-demand credentials.

Establish the Innovative Educator Corps, a group of highlyskilled, proven, innovative educators that are nominated by their local schools to be honored for their excellence. These9 educators will receive stipends from the state and travel around Michigan to share their innovations with others. Creates an awareness campaign for attracting businesses and talent to Michigan.

The bills are now Public Acts 227 and 228 of 2018. MM

• HB 5141, sponsored by State Rep. Bronna Kahle, allows noncertificated individuals with professional experience to teach in an industrial technology or career and technical education program for up to 10 years. The bill is now PA 235 of 2018. • The Marshall Plan for Talent is now the “law of the land.” ABC supported the Marshall Plan and was invited to the bill signing by Governor Snyder. The Act includes equipment grants as well as the following other provisions: •

NATIONAL CRAFT CHAMPIONSHIPS

E

very spring, ABC members from around the nation gather for National Convention and this past March was no exception. Associated Builders & Contractors hosted hundreds of merit shop contractors in Long Beach California for a week of networking, education and competition. The National Craft Championship, hosted by the National Craft Championship Committee, which grants awards for Craft Professional of the Year and Craft Instructor of the Year is presented each year at ABC Convention. The National Craft Championship celebrates the training and education efforts of Associated Builders and Contractors and their member firms by allowing craft trainees from chapter and member training programs across the country to come together and compete to showcase their safe work practices along with their superior skills and training. This event is one of ABCs many efforts to continue to support the merit shop workforce by offering programs that promote life-long learning experience and national recognition based on achievement at every career level. Competitors compete in one of 15 competitions representing 12 crafts. The competition is made up of a written exam that accounts for 25 percent of the total score and a practical performance test, allowing competitors to showcase their skills, which accounts for 75 percent of the total score. First, second, and third place winners are entitled to their respective medals and cash prizes in addition to tools or gifts from National Craft Championship sponsors.

The National Craft Championships also grants awards for Craft Professional of the Year and Craft Instructor of the Year. “It’s quite an achievement to be named a finalist for ABC’s Craft Professional and Craft Instructor of the Year awards,” said 2018 ABC National Chair George R. Nash Jr., director of preconstruction at Branch & Associates in Herndon, Va. “These member firm employees embody the commitment to world-class craftsmanship, training and leadership that we celebrate in the merit shop construction industry. ABC members are fortunate to work with a group of talented leaders so dedicated to their craft and the development of our skilled workforce.” This year’s Convention was held from March 18-22. Two members of the Western Michigan Chapter of Associated Builders & Contractors were finalists for the 2017 Craft Professional of the Year award: Troy Clinger of Kent Companies Inc. in Grand Rapids and Jeff Dickman of Van Dyken Mechanical in Middleville. Previously, Dickman was awarded 2016 Craft Professional of the Year. This year, finalists were awarded one round trip coach airfare and three nights hotel accommodations (Tuesday-Friday), a Bosch tools prize pack, a video interview featured on the Craft Professional of the Year website, and press coverage in ABC National outlets. The winners were awarded a 2018 Ram Tradesman Truck, a Bosch Reaxx table saw, a trophy, a feature in Construction Executive Magazine, as well as press coverage in ABC National outlets. We are proud of ABC of Michigan members who were nominated for this prestigious award. MM

GET TO KNOW YOUR LAWMAKER SENATOR JIM STAMAS 36th Senate District Senator Jim Stamas represents the 36th State Senate district. The Senator was first elected to the Michigan Senate in November 2014. His district represents Alcona, Alpena, Arenac, Gladwin, Iosco, Midland, Montmorency, Oscoda, Otsego and Presque Isle counties. The senator was elected to be the Assistant Majority Floor Leader of the 98th legislature. Senator Stamas has been closely aligned with ABC over the course of his terms and we know will continue to fight for freedom and the merit shop.

Why did you run for office and what are you most passionate about in your position? I have grown up in a family that was taught the importance of community. And as such how important it is to give back to one’s community. Over the past 9 years Michigan has made taken some important steps to move forward. I am proud to have been a part of that. But Michigan has more challenges. I want to continue to serve the residents of Michigan in finding solutions that make Michigan the state that we expect and deserve. Another reason I love my job is being able to find solutions for constituents when they have problems with state government. I have found that to be one of the most rewarding jobs I have ever had.

Do you remember your first interaction with ABC? What impact has it had on your legislative effort? 18

The first time I interacted with ABC on a regular was when I was on the Midland County Commission. I could find ABC members of the Great Lakes Bay Region at nearly all of the events in the region. From Chamber events to fundraisers for the local high school band or anything to help the community, ABC members where there. Like myself, many ABC members are here to serve the community. ABC members have been integral in our communities and have a good pulse of what the community needs. They have always been willing to share what they know, what they hear and help me make better decisions.

Of which legislative effort are you most proud? During my 9 years in office the thing that I am most proud of is working with the residents of the 36th District to help them solve their issues they are having with state government.

What do you believe is the single biggest issue facing Michigan now and what do you think is the best solution to that issue? I do not believe there is a single issue that facing Michigan, there are many issues facing our beautiful state. Over the past 9 years we have done many things in Lansing that has allowed our small family business up to our large businesses find success. We still have a lot of work to do. I will continue to work towards better jobs, better educational opportunities and getting government out of the way.

How can ABC members continue keeping lawmakers up to date on key issues and priorities for their business and employees? I am a very hands on person. As such, I recommend ABC members to invite current legislators; township, city and county officials out to tour their facilities. In the Great Lakes Bay Region we have the Great Michigan Construction Academy. This is a great place to see not only the future of construction but also to meet the future employees, and therefore future owners, in the construction industry. Tours of places like this are eye opening to all of the positives Michigan has coming in the near future.

Why did you run for office and what are you most passionate about in the position? I worked as a banker in the private sector for 12 years, so I understand what businesses need to be successful. When Michigan businesses thrive, the whole state benefits. We need more business minded individuals from the private sector who are willing to step up and fight for policies that will continue to improve our economy. There are a wide variety of issue areas that I’m interest in but my true passion is addressing our unfunded liabilities and crumbling infrastructure.

Do you remember your first interaction with ABC? What impact has it had on your legislative efforts? When I first met with representatives from ABC, I asked immediately about repealing prevailing wage. Throughout the process of gathering signature all the way to the final vote, ABC gave me the tools and information I needed to explain the vote to my colleagues and constituents.

What do you believe is the single biggest issue facing Michigan right now and what do you think is the best solution? We’ve done a lot to recover from the lost decade, but one area that still needs some focus is our roads and infrastructure. There is a lot more that can be done to prioritize existing revenues and look for public private partnerships to address long term maintenance.

How can ABC of Michigan continue keeping lawmakers up to date on key issues and priorities for their business and employees? Work through Jeff Wiggins. He has great relationships with legislators and can help educate the right people on your issues. MM

ABC, INDUSTRY GROUPS URGE PRESIDENT TRUMP TO REVERSE

TUESDAY, JULY 24, Associated Builders and Contractors joined a coalition of construction and business associations urging President Trump to eliminate government-mandated project labor agreements and allow all qualified contractors to compete for federal and federally assisted taxpayer-funded construction projects. In a letter sent to President Trump this week, the coalition stressed that such regulatory reform would create a level playing field in the procurement of government construction contracts, increase competition, curb construction costs and help small businesses grow. The coalition also said it is “imperative to cut regulations that stand in the way of creating career pathways into the construction industry,” which has an estimated 500,000 open positions. “With the current construction boom contributing to a severe shortage of skilled labor, a new fair and inclusive policy encouraging all Americans to compete to rebuild their community’s schools and infrastructure would be a win-win for taxpayers and the U.S. economy,” said ABC Vice President of Regulatory, Labor and State Affairs Ben Brubeck. “And with a projected 10-year, $2 trillion infrastructure investment gap in the United States, a policy ensuring taxpayers get the best

The coalition highlighted that studies of hundreds of taxpayerfunded school construction projects found that PLA mandates increased the cost of construction 12 percent to 18 percent compared to similar non-PLA projects. In addition, PLAs unfairly discourage competition from quality contractors and their nonunion workers, who comprise of 86 percent of the U.S. private construction industry, according to recent U.S. Bureau of Labor Statistics data. ABC and industry groups have repeatedly petitioned President Trump to rescind President Obama’s Executive Order 13502, which allows state and local recipients of federal dollars to mandate PLAs and encourages federal agencies to require PLAs on federal contracts to build projects of $25 million or more on a case-by-case basis. ABC and the coalition have advocated to replace the Obama-era policy with Executive Orders 13202 and 13208, which would prohibit PLAs from being required on federal and federally assisted construction projects, respectively. Two dozen states have enacted fair and open competition legislation that welcomes all contractors to bid on construction projects.

ABC COMMITS TO EDUCATION GOALS AT WHITE HOUSE ‘PLEDGE TO AMERICA’S WORKERS’ EVENT

n July 19, Associated Builders and Contractors signed on to President Trump’s “Pledge to America’s Workers” today, committing to educating and developing at least 500,000 construction workers over the next five years.

The pledge, which was signed by more than a dozen leading companies and industry trade associations, stressed the need to expand apprenticeship programs to educate current and future generations of America’s workforce. “ABC is proud to join the White House in pledging to develop and support generations of skilled craftsmen and women who are building America,” said Greg Sizemore, ABC’s vice president of environment, health, safety and workforce development. “There are currently 500,000 open positions in the construction industry alone, a number which will continue to grow if we don’t join forces to expand registered and industryrecognized apprenticeship programs in the United States to fill skills gaps.” The pledge calls for organizations to advance work-based learning, continuing education and re-skilling programs to enhance career opportunities and economic security for America’s workforce. In total, the signers pledged to train more than 3.8 million people for new positions. Brianna DeAngelo, a second-year electrical apprentice with ABC member company Gaylor Electric Inc. who attended the White House signing, emphasized how much she values the education and career opportunities her apprenticeship program provides.

“Being an electrician is more than a job, it’s a career path,” said DeAngelo. “Through my apprenticeship program, I have learned a skilled trade that will afford me a fulfilling and well-paid lifelong career. And as older generations continue to retire, there will be a huge void in experienced construction workers if companies don’t continue to recruit and train young people like me to join the construction sector.” ABC members invest $1.1 billion on workforce development to educate more than 475,000 industry employees annually, and ABC chapters have set up more than 800 apprenticeship, craft training and safety programs across the United States. Yet more than 80 percent of ABC members report they have trouble finding skilled labor, which impacts construction firms of all sizes. And as the Construction Labor Market Analyzer projects a deficit of 1.1 million workers over the next decade, prioritizing apprenticeship and workforce development programs is a key priority for ABC members.
