BUILDING OUR PLAYBOOK: LESSONS FROM FOOTBALL FOR CONSTRUCTION’S FALL SEASON

As the summer heat begins to fade and we welcome the crisp air of fall, many of us look forward to the return of football season. Across Pennsylvania, stadiums fill with fans eager to watch their teams take the field, each player relying on preparation, discipline, and trust in one another to succeed. In many ways, construction is no different. Our job sites, like football fields, demand careful planning, strong execution, and a commitment to teamwork if we want to achieve victory.
Just as coaches develop a playbook to anticipate challenges and seize opportunities, our industry thrives when we take time to prepare. Whether it’s conducting safety planning meetings, reviewing project schedules, or investing in workforce development, success doesn’t happen by chance. It comes from deliberate preparation. Just like athletes train throughout the offseason, our companies invest in training, leadership development, and safety programs that prepare our teams for the big plays ahead.
Teamwork is another shared lesson. On the field, no single player wins the game alone—it takes the combined effort of the offensive line, the quarterback,
the defense, and special teams. In construction, every role matters. From apprentices just beginning their careers to seasoned superintendents and executives, each of us contributes to the bigger picture. When communication breaks down, projects stall. When collaboration is strong, projects flourish, schedules are met, and quality shines.
This season also reminds us of the importance of momentum and resilience. A team that starts strong but loses focus can quickly fall behind. As we enter the final quarter of 2025, now is the time to push forward with focus and determination. Whether it’s advancing safety initiatives through STEP, strengthening mental health awareness with Total Human Health, or engaging in fall events like the Excellence in Construction Awards Gala, Leadership Development programs, and the upcoming networking mixers, momentum carries us toward success. And when challenges arise, whether supply chain issues, labor shortages, or shifting regulation, resilience becomes our edge. This summer, that resilience paid off as ABC Keystone secured a major victory against a mandated PLA on the Pennsylvania Joint Laboratory Facility Project, with the Commonwealth Court granting our injunction and affirming that open competition must be preserved. Wins like these underscore the importance of our advocacy efforts—not just for contractors, but for taxpayers across the Commonwealth.
As we embrace fall and all that it brings, let’s remember the lessons from the gridiron. Preparation, teamwork, momentum, and resilience aren’t just values for athletes—they are the foundation of success for our industry. Together, let’s keep building, keep striving, and keep moving down the field toward a stronger future for ABC Keystone and the construction industry across our region. I look forward to seeing many of you at our upcoming fall events and celebrating our shared successes together.

SEPTEMBER, A TIME TO CELEBRATE AND A TIME TO LOOK FORWARD!

Every year when September rolls around most people think of the end of summer and the end of family vacations for the year. I look at it as the start of something new and a time to celebrate those of you that chose to be a part of the construction industry.
Labor Day is not just a holiday to close out our summer activities. It is a day to celebrate every ABC member and all of their employees. Each and everyone of you are part of best labor force that makes up this country. I am reminded that very little in this world would exist if we didn’t have a construction industry.
The roads we drive on, the hospitals, schools, stores, religious buildings and all community infrastructure—they all require your talent and labor. For this we thank you for the contributions you make to the industry, but also to society.
Looking forward, this is the start of a new school year. ABC Keystone once again will kick off a new year with a record number of apprentices. In preparation we have added two new full time instructors, John Crum, joins our Electrical Team and Ira Berman is our new Craft Labor Instructor. The team that works with the apprenticeship program has spent the summer preparing the shop and working through their curriculum to ensure a high quality program.
We don’t stop with just the apprenticeship program. September is the ramp up to a very robust Career Development calendar offering education and training for all in the industry, from laborers to CEOs. Keep your eyes out for the 2025/2026 course catalog soon to be delivered to your office. Committee Update TOTAL HUMAN HEALTH
Suicide continues to be a growing concern in the construction industry—an industry that ranks among the highest in the nation for suicide rates. Long hours, physically demanding work, job insecurity, and stigma around mental health all contribute to the elevated risk.
Suicide Prevention in Construction Week, taking place September 8–12, 2025, is a national initiative to raise awareness, reduce stigma, and equip industry professionals with life-saving tools and resources. At ABC Keystone, this week is an important part of our year-round commitment to Total Human Health—a holistic approach that addresses the physical, mental, and emotional well-being of our members and their teams.
One of the key components of raising awareness of Suicide Prevention is a special opportunity to participate in VitalCog Suicide Prevention in the Workplace Seminars. These evidence-based training sessions are designed to teach participants how to recognize the warning signs of suicide, have conversations that save lives, and connect individuals with the help they need. The seminar is open to anyone in the construction community—from field workers to office staff—and we strongly encourage all members to sign up.

Please join us in welcoming Ira Berman to the ABC Keystone team! Ira brings with him eight years of hands-on experience in the construction industry, having started his career as a laborer with the very company that first introduced him to ABC Keystone through the Carpenter Apprenticeship Program. He graduated from the program with a Certificate of Excellence and steadily advanced through the ranks—from laborer to apprentice, then carpenter, lead carpenter, and most recently serving as a “new and still learning” superintendent. Ira now joins ABC Keystone as a Craft Labor Instructor, where his dedication, field experience, and passion for the trades will be a valuable asset to our program and the future workforce. Welcome aboard, Ira!
What part of your role are you most excited about?
I’m most excited about yet another opportunity to pass along many positive lessons I myself have learned during my own journey and experiences coming up
through the different stages of construction, along with the chance of learning new things and helping to develop what I hope to be a positive educational experience for my students and peers in construction.
What’s a skill or strength you bring to the team?
A skill or strength I bring is a unique ability to communicate with a diverse group of people from all walks of life and skills in a way that allows me to be genuine and humbly relate to and understand them, both on the work site and in the world.
What do you hope to contribute to ABC’s mission?
I hope to contribute a relatable approach to the learning development of my students while accurately communicating the curriculum and inspiring these people to keep moving forward and never giving up. If I can be where I am in my career today there is no doubt in my mind they can achieve anything they want to, because I am a living example of exactly that.

What drew you to work in the construction industry?
The opportunity to gain new skills, create with my hands, and thrive in a physically demanding industry is what inspired me to pursue construction.
What do you enjoy doing outside of work?
In my free time, I enjoy motorcycle riding, gardening, and attending live music events. I have a passion for all forms of art, including the performing arts, and I love to travel and discover new experiences. Meeting new people and connecting through conversation is something I value, as I try to embrace life to its fullest.

Are
Contractor’s Consent or Consent to Assignment Forms Required by the Customer’s Lender Anything to be Concerned About?
Our law firm represents a lot of general contractors and we’ve recently noticed an uptick in efforts by lenders and other providers of construction financing to obtain greater protection of their investment. These efforts often appear in documents called a Contractor’s Consent to Assignment, Contractor’s Consent or some other similar language which the contractor is asked to sign right before the work is about to begin and well after the contract with the owner was signed. The lender’s desire to protect its interests is understandable, but these documents present significant risk to contractors that they often do not recognize. The owners often present these agreements to the contractor requesting that they be quickly signed and returned as though they are bank forms. Typically, they are not voluminous and consist of 2-3 pages. As one commentator aptly observed, these forms are often presented to the contractor “as a matter of housekeeping,” suggesting they are nothing to be concerned about. But these forms can result in substantial changes to the contract signed weeks before and they should be carefully reviewed and revisions proposed to ensure they align with the contract.
These consent or assignment agreements often alter change order requirements. They often state that no contract modifications are valid unless the lender expressly agrees to them in advance. An ordinary change order is a modification to the contract so this provision would require lender approval of change orders to be valid. Some require the lender’s consent only to modifications (change orders) that exceed a certain monetary threshold. Contractors should attempt to eliminate this requirement or raise the threshold so that lender approval is not needed for most change orders.
From the lender’s perspective, one of the main reasons of these consent forms is to require the contractor to continue performing work for the lender if the borrower (the owner) defaults under the loan agreement. The lender wants to ensure the contractor will complete the project and protect the lender’s collateral – the completed building. While this serves a legitimate purpose of ensuring that the bank is not left with an incomplete project, it could leave the contractor holding
the bag on a substantial amount of money. The reason is these forms typically state that following a borrower default, the contractor must continue performing and that the lender will pay the contractor for all work completed from that point forward. The problem for the contractor is that by the time the owner defaults under the loan agreement, it’s undoubtedly in dire financial condition (and possibly even bankrupt) and has probably missed payments to the contractor. We always revise these agreements to state that as a condition of the contractor continuing to perform after the borrower defaults, the lender will pay all amounts the borrower owes to the contractor. Lenders often push back, advising that you can sue the owner, but that overlooks the fact that the borrower is insolvent and there’s little chance you’ll obtain payment from the owner. This problem is compounded by the fact that these agreements usually subordinate your lien rights to the lender’s mortgage, which means that any mechanics’ lien you file will be of little or no value.
These forms also prevent you from exercising important remedies if the owner is in default under the construction agreement. While the owner-contractor agreement may allow you to stop work for nonpayment (often within 7 days), these consent agreements often require you to continue work, to notify the lender of the payment default and wait another 30, 45 or even 60 days before you can stop work or terminate due to nonpayment.
Expect push back from the lenders on your revisions but stand your ground as the lender will often accept some revisions to the provisions discussed here. Your customer (the borrower) may also apply pressure on you by suggesting there’s is nothing to worry about and you’re being difficult. Resist this pressure and insist on changes to address the foregoing subjects.

ABC Keystone offers numerous excellent opportunities for learning, and we have greatly appreciated the training offerings. I appreciate the wake-up calls that help keep me informed about current industry news and how it is translated into meaningful information for us as contractors. The mentality throughout ABC Keystone is very focused on growth opportunities and education, which I appreciate.
Tell us a bit about your company and your role there?
Founded in 2008, 11400 LLC is a commercial kitchen equipment contractor in Lancaster, PA. We have three distinct divisions: Projects, Direct Sales, and Federal Sales. I am the Director of Federal Sales, providing sales and customer service support to federal agencies nationwide. Preparing quotes, processing orders, and exploring new business opportunities are among my primary responsibilities.
What is the best part about the work you do?
I’m proud that 11400 LLC’s work goes beyond equipment and installations—our impact is felt in communities across the country. From school cafeterias to military bases and federal prisons, the kitchens we build help serve thousands of meals daily. Our projects support people of all ages during both joyful celebrations and challenging times, making it possible for quality food to be prepared and shared when it matters most.
Who has been the most significant influence on your career, and why?
I’m grateful to the mentors who shaped my career with honest feedback and support. The professors, bosses, and advisors who challenged me to improve—and encouraged creativity— helped me grow both professionally and emotionally.

It’s that time of year when everyone is talking about going back to school and posting pictures of their kids heading off for the first day. It’s also the time when our shop and classrooms welcome back our apprentices.
This is an exciting season for many because of the opportunities that lie ahead. Pennsylvania shouldn’t limit those opportunities—yet our elected policymakers are doing exactly that every day. Despite hearing great lines like the quote above, somewhere between campaign stump speeches and the reality of governing, something critical gets lost.

As we have for over 60 years, ABC continues to raise the alarm. Pennsylvania’s current apprenticeship ratio limits educational opportunities for apprentices. Under current law, only one apprentice can be enrolled in a registered program for every four journeymen (or nurses, attorneys, etc., in non-construction fields). This is an arbitrary and outdated calculation that no one has been able to justify.
We appreciate the true leaders in the legislature who are championing efforts to change this ratio—namely, Rep. Barb Gleim and Sen. Dawn Keefer, who have introduced bills to create a fair ratio for all apprentices across every trade. But they need support, and their colleagues need a serious push to join them. Governor Shapiro, unfortunately, has been missing in action when we’ve reached out to his office. While we are grateful that Labor & Industry Secretary, Nancy Walker, has met with us to discuss apprenticeship, she continues to defend the status quo.
It’s long past due to hold public officials accountable. If we want change, we must make sure legislators understand the real-world consequences workers and businesses face due to these outdated rules. Make it personal. Every time they shake hands on the campaign trail in 2026, remind them this problem isn’t going away. The next time you have to turn away a potential employee because an arbitrary ratio prevents them from joining your apprenticeship program, let your legislator know: their inaction just cost someone a job.
Let’s help Governor Shapiro “Get #@&! Done” on his goal of eliminating arbitrary limitations. Apprenticeship is a great place to start—because we already agree on its value.
